In May 2012, the Board of Supervisors voted to form a Committee to review aspects of the County’s land use and environmental review processes and make recommendations to the Board of Supervisors regarding improvements to the implementation of existing and planned future regulations and policies.In August Klif Knoles, Executive Director of the MBA was appointed to the committee. The Committee is comprised of individuals who represent key interests and possess relevant experience in the following areas: community advisory organization, social equity, building industry, Planning Commission, environmental organization, sustainability, business, affordable housing, and architect/engineer.The Advisory Committee will focus their review and recommendations on the following areas:

• California Environmental Quality Act (CEQA) The County’s Environmental Impact Review Guidelines for potential improvements to the effectiveness and efficiency of implementing CEQA within unincorporated Marin.

• Permit Review Efficiencies The County’s Development Code (zoning regulations) and Building Permit process for improvements in the permit review process and customer service.

• General Plan Policy Implementation The Marin

Countywide Plan (CWP) and the implementation of certain policies and programs to facilitate the permit review process for projects that clearly implement important CWP goals and policy objectives.

The Committee will meet for six to eight months with a definitive end date to ensure the timely completion of the Committee’s work.

Kalb's Q&A for Contractors By David Kalb & Shauna Krause, Capitol Services, Inc.

We polished a couple of seats at the latest Contractors State License Board Committee meeting on behalf of contractors out there getting the real work done. At the latest get together of decision-makers it was recommended that ‘retroactive’ finger-printing be rubbed out; an hour added to the exam clock and the notion of ‘continuing education’ flunked! These and other important issues and a reminder that your chance to speak directly to the Board is coming up. We begin with a ‘good news/bad news’ statistic…

The number of license applications filed by contractors continues to decrease on a year-to-year basis. There has roughly been a 40% decline in the number of applications received by the CSLB over the past 6 years. The decrease for total applications received for FY 2011-12 alone, as compared with 2010-11, is down 14%.

These and other topics were discussed at the Contractor Board’s Licensing Committee meeting in Sacramento on August 28th. One benefit however, of the application decrease, is processing times. On average, most applications are currently processed in 2 to 3 weeks from the day they’re received at CSLB headquarters.

One thing that hasn’t changed much over the past 30 years is the number of applications rejected due to errors in completing the forms. It was reported that, on average, 45% of all applications (Original License, adding a class or replacing the Qualifier) are re-turned for corrections. Just as trained professionals often complete state tax forms, successfully preparing contractor license applica-tions may require input from an expert to reduce the chance of it being rejected. This is especially true when time is of the essence in obtaining your number.

Those who are required to sit for a test may be happy to learn that starting immediately, you’ll be given an extra hour to complete the exam process. Applicants will now have 3 ½ hours to finish. The Testing Division update also specified that the wait time for an exam is three weeks statewide and that “on any given day, walk-in applicants have an excellent chance of finding an available seat” in one of the 8 CSLB testing centers.

The Licensing Committee discussed several policy recommenda-tions. One involved “retroactive” fingerprinting while a second dealt with continuing education requirements for all existing contractors. In both cases, after careful study and consideration, the Committee adopted the recommended staff position to NOT require either.

Legislation to require all contractors to be fingerprinted was introduced in 2009 but failed to pass. Since fingerprints were first required in 2005, approximately 40% of current licensees have been required to submit prints when applying for a new license or modifying an existing license (such as a change in qualifying individual or additional class). This proposal would have required ALL existing licensees (even some who have been licensed for more than 50 years) to submit a set of fingerprints to the CSLB. It was determined that for a host of reasons, it was very impractical to adopt this requirement.

Continuing Education (CE) requirements have been discussed off and on for decades. It was determined that since there is “no identi-fied problem with the construction industry that CE would address, and due to the significant cost impact of such a requirement on licensees and the Board, (the) CSLB cannot support a CE require-ment”.

All the above items will be discussed and voted on by the FULL CSLB at their 1:30pm meeting in Sacramento on September 11th. The meeting is open to the public and contractors are urged to at-tend. Many other topics including potential legislation, and updates on various enforcement actions will also be discussed. At the be-ginning of each CSLB meeting, members of the public may address the Board on any topic.

Workplace Accidents Can be Costly We all know that safety is essential in construction, but do you realize just how costly a job site injury can be? According to the Occupational Safety and Health Administration (OSHA), the average eye injury costs $1,463. It may not seem like much money, but the extra expense to pay for injuries has a powerfully negative effect to a company’s bottom line. Why is profitability also an important issue to you? The only way that can stay in business is to operate at a profit, and that ability can be threatened by a serious workplace injury. The Real Cost of Workplace Injuries It may be surprising to hear that most companies do not have a high profit margin – 3 percent is about average. Expenses take a large chunk of the income, and competition limits how much we can charge for the services we provide. Each time an accident occurs, the cost of the injury must be subtracted from profits. Consider the following two examples: • At a 5 percent profit margin, an

extra $20,000 in income is needed to compensate for a $1,000 injury.

• If the profit margin is nearer to 1 percent, an additional $100,000 worth of new income is necessary to maintain that profit level for the same injury.

As you can see, that adds up to a lot of extra contracts just to compensate for a

single injury. Plus, every time a worker gets hurt on the job, other employees are affected too. You may need to work extra hours to make up for the injured worker, the cost of insurance can go up, or the company may be forced to make difficult budget decisions such as cutting hours or having temporary layoffs. Also, recovering from an injury can mean time away from work, reduced compensation, painful rehabilitation and frustrating adjustments to daily life. Practice Prevention Though operating at a profit is essential to our success, our top priority is to keep our employees safe and healthy. That’s why we are counting on you to help practice good safety principles on the job site, including wearing personal protective gear, following all safety procedures and noticing unsafe situations. Safe work behavior will contribute directly to our bottom line as well as to everyone’s job security. By observing safety precautions, we can limit on-the-job accidents. It is always wiser to spend a bit more time doing the job safely than to risk getting a serious injury. Be sure to always follow our safety guidelines and stay alert for unsafe conditions. Think of practicing good safety as both pain-free and profitable – a win-win situation for everyone!
