    Chairman Porcari called the meeting of the Maryland TransportationAuthority to order at 9:03 a.m.At 9:04 a.m., motion was made by Mr. Basso and seconded byMr. Whitson, with unanimous approval of the members, to move into ClosedSession pursuant to Section 10-508 (a) of the State Government Article of theAnnotated Code of Maryland to: (8) to consult with staff, consultants, or otherindividuals about pending or potential litigation (URS Inspections) and (10) todiscuss public security, because the Authority determined that public discussionwould constitute a risk to the public or to public security, including: (i) the

    deployment of fire and police services and staff (security and police update).(At 9:07 a.m., Mr. Marks joined the meeting).(At 9:10 a.m., Ms. Hoblitzell joined the meeting by telephone).

    ACTIONS TAKEN DURING CLOSED SESSIONNo actions were taken in Closed Session.At 9:17 a.m., the meeting of the Maryland Transportation Authority wasadjourned, by general consensus, without objection, upon motion by Mr. Whitsonand seconded by Mr. Marks.Chairman Porcari recalled the meeting of the Maryland TransportationAuthority to order at 10:05 a.m. Rev. Dr. Calhoun arrived prior to the recalling ofthe meeting.

    APPROVAL OF OPEN AND CLOSED SESSION MINUTESUpon motion by Mr. Basso and seconded by Rev. Dr. Calhoun, membersunanimously approved the Open and Closed Session minutes of the April 23,2008 meeting.

    MAJOR PROJECT CAPITAL COST ESTIMATE UPDATEMr. Freeland provided an update on current construction cost increases tothe Authority's three mega projects, those being - Section 100 Express TollLanes, Hatem Bridge Preservation Program and the Bay Bridge Preservation

    and performance durIng the life of the contracts. Each of the projects has actualor potential significant cost increases. Members will continue to be updated.This item was presented as information only.

    FINANCIAL AFFORDABILITY OF PRELIMINARY DRAFT FY 09 CTP STATUSREPORT

    Mr. Simpson presented the Preliminary FY 2009-2014 Draft CTP, itsaffordability, and development of a financial forecast to be presented to thelegislature in July for member review. During May and June, the Authority willdevelop the Draft FY 2009 - 2014 CTP and adopt the Final 2009 OperatingBudget. Mr. Chapin reported that revenue forecasts are currently belngevaluated, taking into consideration the potential impact of a recession onAuthority revenues. The assumptions related to operating costs, capital costsand schedule, revenues, and the timing and extent of toll increases will affect theaffordability of the capital program. The financial forecast needs to be approvedin June, prior to submission to the General Assembly in July. The CapitalCommittee was also provided this material.

    This item was presented for information only.APPROVAL - CONTRACT NO. MA-971-000-002 - CLEANING ANDPAINTING, BEARING REPAIRS, JOINT MODIFICATIONS, AND OTHERMISCELLANEOUS REPAIRS (FRANCIS SCOTT KEY BRIDGE ANDBALTIMORE HARBOR TUNNEL

    Mr. Kolberg presented this contract for member approval. The work to beperformed includes typical miscellaneous structural repairs to bridges located onthe Francis Scott Key Bridge and the Baltimore Harbor Tunnel. The CapitalCommittee recommended approval of the award of the contract.Upon motion by Mr. Basso and seconded by Mr. Woodford, membersunanimously approved the award of Contract No. MA-971-000-002- Cleaningand Painting, Bearing Repairs, Joint Modifications, and Other MiscellaneousRepairs to the Francis Scott Key Bridge and the Baltimore Harbor Tunnel to theJoseph B. Fay Company in Baltimore, Maryland in the amount of $1,456,170.At 11 :25 a.m., motion was made by Mr. Marks and seconded by Rev. Dr.Calhoun, and unanimously approved, to return to Closed Session pursuant toSection 10-508(a) of the State Government Article of the Annotated Code of M

    OPEN SESSIONMAY 28,2008PAGE 4Maryland (14): before a contact is awarded or bids are opened, discuss a matterdirectly related to a negotiating strategy or the contents of a bid or proposal, ifpublic discussion or disclosure would adversely impact the ability of the publicbody to participate in the competitive bidding or proposal process (Contract No.AE 2213-000-002/6/7, Contract No. AE 2214-000-002/6/7, Contract No. AE2215-000-002/6/7, Contract No. AE 2216-000-002/6/7, Contract No. AE 2217-000-002/6/7).

    At 11:26 a.m., motion was made by Mr. Whitson, seconded by Mr. Lewinand unanimously approved to return to Open Session.No actions were taken during Closed Session.

    APPROVAL - CONTRACT NOS. AE 2213 THROUGH 2217-000-002/6/7 -COMPREHENSIVE TRAFFIC ENGINEERING SERVICESMr. Kolberg presented these contracts for member approval which willestablish agreements with five consultants totaling $20 million. The agreementswill provide comprehensive traffic engineering and miscellaneous consultingservices for the Authority over a four-year period. The consultants will perform avariety of traffic engineering and miscellaneous consulting services necessary forthe continued development and operation of the Authority's facilities; and performthese services for review, development or improvement of other transportationprojects or research activities in which the Authority may have a current or futureinterest.Upon motion by Mr. Woodford and seconded by Rev. Dr. Calhoun,members unanimously approved and awarded Contract No. AE 2213-000-002/6/7 to the joint consulting firm of Whitman, Requardt and Associates/CenturyEngineering, Inc. in the amount of $6 million, and Contract No. AE 2214-000-002/6/7 to the joint consulting firm of McCormick Taylor/Jacobs in the amount of$4 million.

    APPROVAL - VEHICLE DONATIONMr. McMullen presented this agenda item for member approval. TheTown of North East has requested a Crown Victoria and the Department ofNatural Resources, Wildlife and Heritage Service, has requested dump trucksand one stake body truck.

    unanimously declared the Crown Victoria and the dump trucks and stake body tobe excess to the Authority's operational needs and recommended the donation ofthe Ford Crown Victoria to the Town of North East and the dump trucks and onestake body truck to the Department of Natural Resources.laTTA UPDATE

    Ms Sparks provided an update for the members on the 2008 AnnualMeeting of the International Bridge, Tunnel and Turnpike Association's (IBTTA)being held September 20 through September 24, 2008 in Baltimore. Staff is inthe process of developing the final program schedule. Members will continue tobe updated.FY 2007 ANNUAL REPORT

    Ms Sparks distributed the FY2007 Annual Report to members for theirinformation.REPORT OF COUNSEL

    Ms. Donohue presented the Report of Counsel to the members for theirinformation.There being no further business, the meeting of the MarylandTransportation Authority was adjourned, by general consensus, withoutobjection, at 11:50 a.rn. upon motion by Rev. Dr. Calhoun and seconded by Mr.Basso.The next meeting of the Maryland Transpo tion Authority will be held onWednesday, June 25, 2008 at 9:00 a.m. in the me ber conference room of thePoint Breeze Complex.
