    The pW'pOse of this Jntcrgovemmental Service Agreement ( IGA ) is to establish a fonnaJ bindingre lationship between the United States Marshals Service (USMS) and other federal use r agen ci es (theFederal Goverrunenl) and Mecklenburg County. Nonh Carolina (the Local Government) for the detentionof perso ns charged with or convicted of violations of federal law or he ld as material witnesse s (federalpri sone rs) at the M ecklenburg County Jail (the facility) .

    The Local Governm ent a grees \0 accept and provide for the secure custody, care and safekeepin g offedern.lpri so ners in accordance with state and local law, standards, policie s , procedures. or court orders applicableto the operations of the facility . The USMS con s iders a ll federal prisoners medium/m ax imum security -typepri s one rs that are housed within the confines of the facility, at a level appropriate for prisoners considered ari sk of night, 8 danger to the community, o r wanted by othe r juri sdictions .

    ART ICLE II ASSIGNMENT AND CONTRACTING OF CATEGOR ICAL PROJECTED -SUPPORIED

    3. When a fed eral prisoner i s being transferred. via the USMS airlift, helshe will be provided with three(3) to seven (7) days of pre sc ription medication which will be dispensed from the detention facility, Whenpossible, ge neric medicati ons s hould be prescribed.

    4. Medical records must travel with the federal prisoner. If the record s are maintained at R medicalrontrac to r' s facility, it is the detention fac ility's re spons ibili ty 10 obtain them befor e a federal prisoner ismoved .

    5. Federal prisoners will not be charged and are not re quired to pay their own medical expenses. Thesee x p en ~ s will be paid by th e Federal Government.

    6. The Local Governmen t agrees 10 notify the USM as soon as possible when a federn.1 prisoner isinvo lved in an escape, attempted escape , o c conspiracy to e scape from the facility .

    ARTICLE IV - RECEIVING AND DISCI;!ARGE

    1. The Loca l Government agrees to acce pt as federal prisoners those persons committ ed by fed.eral lawenfo rcement officers for violations of fede ral l aws only up on present ali on by the officer of proper lawenforcement credentials.

    2 . The Local Government agrees to rele ase federal prisoners o nly to law enforcement officers ofogencies initially committi ng the pri soner (i.e., DEA, INS, etc .) o r to a Deputy U SM. Th ose pri so ners whoarc remanded to custody by a US M may only be released to il USM o r an a.genl specifi ed by the USM of thJud ic ia l District.

    ) . 111e Federal Government agrees to maintain federal prisoner population levels alar below the levelestab lished by the facility administrator.

    4. Federa l prisoners may not be rtleased from the fucility or placed in the custody of state or localofficials for any reaso n except for medical emergen cy situ ll tions. Federal pri soners so ught for a state orlocal court proceeding must be acquired through a Writ of H abeas Corpus or the Interstate Agreemen t ofDetaincrs nod then on ly with th c concurrence of the Distric t U SM.

    ARTICLE YI . PE R DIEM RATE AND ECONOMIC PRICE ADJUSTMENT

    I . Per diem rates shaH be established on the basis of Ilct1.181and allowable costs ass ocia ted with Lhcoperatioll of the facility during a recent annual 3ccowuing period.

    2 . TIlc Fedenll Government shall rclmburse the Local Government at the pe r diem rate identified onpa ge onc (1) of this agreement . Tho r31e may be renegotiated not mOre than once per year, after th eagreement has been in effect for twel ve (12) months.

    3. The rate covers one ( I) person pe r " pris oner cUy," TIle Federal Goverrunent may not be billed f o r two(2) da ys w hen a prisoner is ad m ilted one evening an d rl.iTloved the following moming . Th e Loca lGovernment may bill for the day of arriva l, but not for the da y o f departure .

    4. The dollar val ue of property provided each yellr will not exceed the annual dollar payment made bythe USMS for prisoner support unless a specific exemption is granted by th e Chief, Prisoner ServicesDivision, USMS Headquarters .

    5. It is understood an d agreed that the Local Government shall fully defend, indemnify, and holdhannless the United States of America, its officers , employees, agents, and servants, individually andofficially, for any and all liability caused by any acl of any member of the Local Government or anyone c:Isarising ou t of the use, operation, Or handlin g of any property (to include any vehicle, equipment, andsupplies) furnished to the Local Government in which legal ownerShip is retained by the United States o fAmerica., and to pa y all claims, damages,judgments , le ga l costs, adjuster fees, nnd attomt:y fees relatedthereto . The Local Go ..ernrnent will be so lely responsible for all maintenance, storage, and other expensesrelated t o the care and responsibility for all property furnished to the local Government .

    ARTICLE XII - MODIFICAIIONSIDISPU I ES

    I . Either party m3.Y initiate a requl! sl for modification to Ihi s agreement in writing. All modificationsnegotiated will be wTitten and approved by a USMS Contracting Officer and submitted to the LocalGoverruncnt on fonn USM 24 1 for approval.

    2. Disputes, questions, Of concerns pertaining 10 this ag reement will be resolved between the USM andthe appropria lC: Local Government official. Space guarantee question s alon g with any other WlIesolvedissues are to be directed to the Chief. Prisoncr Services Division .

    ARIWI.E XIIl - INSPECTION

    The Loca l Government agrees to allow periodic inspecti ons of the faCility by USMS Inspectors. Findingsof the in spec tion will bc shared with the facility administrator in o rder to promote improvemt:nts t o facilityoperations, conditi on s of confinement , and level s of services. Th e mandatory minimum conditions ofconfinement which are to be met during the entire period of the lGA agreement are:

    I. Adequate, tra.ined jail slo.ffwill be provided 24 ho u r a day to supervise prisoners . Prisoners will becounted at least o nce on every shifl, but at least lwi ce in every 24-hour period. One of the counts must bevisu al 10 validate prisoner occupancy . .

    2. 10il s taffing will provide full co vera ge o f a ll securiry pos ls and full survei llance of irunatcs.

    3. Jail wi ll provide for three meal s per day for pri soner s . Th e me als must meet' th e nat ional\ yrecomm ended dietary allowances publish ed by the Nationa l Academy of Sc iences.

    4 . Jail wi ll pro vide 24-hour emergency medical care for prisone rs.
