Multicolour adsIn the case that black is omitted in processing a multicolour ad, this will notalter the charge. If, in the case of formats with a gutter bleed, differentadditional colours are used on each side of a double page, each page will becharged separately according to the rates for partial formats.Special colours or tones which cannot be achieved by combining colours in thescale used are possible but require prior agreement. Details can be providedon request. Minor variations in tone in offset printing are permitted within thetolerance area. Corrections will be made against a proof.
Advertisement placementsA confirmed placement is no longer valid if the printing material has not arrivedat Musik-Media before the deadline.

Usually you get this checklist together with the confirmationof your order. Claims for compensationWe only accept responsibility for the perfect processing and publication of digi-tally transferred advertising copy when the guidelines listed above have beencomplied with.The publishing house may reject data that does not match the guidelines. No claim for a price reduction will be accepted for unsatisfactory printed resultsthat are due to the customer deviating from the guidelines.Transferred data will be deleted three months after the publication of the ad-vertisement. Transferred data that deviates from the above technical instructi-ons and that requires additional work will be invoiced for at an hourly rate ofEuro 100. All claims by the orderer, with the exception of obvious deficiencies,must be asserted by letter within four weeks of receipt of invoice and vouchercopy.

015 General Terms and Conditions.
1. “Advertisment order” within the meaningof the following general conditions of acceptance is the contract for the publica-tion of one or more advertisments by an advertiser or other space buyer in a publication for the purpose of dissemination.2. Where doubt exists advertisments are tobe released for publication within one yearof conclusion of a contract. If a contract allows for the release of individual advertisements, the order must be processed within one year of the advertis-ment appearing for the first time, providedthe first advertisment is released and published within the period specified in sentence 1.3. In the event of a contract being concludedthe orderer is entitled to release further advert isements exceeding the advertise-ment volume specified in the contract withinthe period agreed or the period specified insection 2, whichever is applicable.4. In the event of a contract not being performed for reasons for which the publishing company is not responsible, theorderer, notwithstanding any other legal obligations, must reimburse the publishingcompany the difference between the discount granted and the relevant discountfor the number of advertisments actually published. Reimbursement need not be effected if the failure to perform is attributa-ble to force majeure within the scope of thepublishing company´s risk.5. When calculating the amount of text to bepublished the text millimetre lines are convert ed into advertisement millimetres inaccordance with the price.6. Advertisments and inserts shall only be included in specified issues, specified editions or in specified positions in the publication if the orderer has stated that theadvertisment or in sert must appear in specified issues, specified editions or in specific positions in the publication and the
publishing company has provided writtenconfirmation to this effect. Classified advertisments will appear in the appropriatespecial section without express agreementbeing required.7. Textual advertisements are advertisements which border on text on atleast three sides and do not border on otheradvertisements. Advertisements which fromtheir copy or layout are not recognisable asadvertisements shall be rendered recognisable as such by the publi shing company by the addition of the word “advertisement”.8. The publishing company reserves theright to reject both advertisement orders, nclud ing individual releases within the framework of a contract, as well as insert orders, on account of their content, their origin or their technical form in accordancewith uniform, objectively justified principles,if, in the due judgement of the publishingcompany, their contents contra vene laws orofficial directives or are likely to cause offence, or their publication cannot be expected of the publishing company. Thisalso applies to orders placed at registeredor branch offices or agencies. Insert ordersare only binding for the publishing companyonce a specimen copy of the insert has beensubmitted and approved. Inserts shall not beaccepted which, by nature of their size orappearance, give the reader the impressionof being a part of the newspaper or maga zine, or which contain advertisementsof a third party.The orderer will be notifiedwithout delay of the rejection of an order.9. Prompt submission of the advertising textand fautless copy or of the inserts, glued-ininserts etc. is the responsibility of the orderer. The publishing company shall demand im mediate replace ments for recognisably unsuitable or damaged copy.The publishing company warrants usualprinting quality within the scope of possibilities of the copy
provided for the issue in which the order isto appear.10. In the event of the printed advertisementbeing partially or entirely illegible, incorrector incompletely reproduced, the orderermay claim price abatement or a faultless replacement advertisement, but only to theextent to which the advertisement was impaired in its purpose. In the event of thepublishing company allowing a reasonableextension period granted to it to elapse, orof a replacement advertisement again failingto be acceptable, the orderer has the rightof candellation.Claims for compensation forcollateral negligence, culpa in contrahendoor wrongful act are excluded even for ordersplaced by telephone; claims for compensation resulting form im possibility of performance and default are limited to compensation for forseeable damage andthe compensation payable for the advertisement or insert in question. Thisdoes not apply to intent and gross negligence on the part of the publishingcompany, its legal representative or its vicarious agent. The liability of the publishing company for damage caused bylack of warranted qualifica tions remains unaffected. Nor is thepublishing company liable in commercialbusiness deal ings for gross negligence onthe part of vacarious agents; in all othercases the liability to merchants for grossnegligence is limited to the forseeable damage to the value of the compensation tobe paid for the advertisement in question.All claims by the orderer, with the exceptionof obvious deficiencies, must be assertedwith in four weeks of receipt of invoice andvoucher copy.11. Proofs will be supplied at the orderer´sexpress wish. The orderer is responsible for the correctness of the returned proofs. Thepublishing company will act on all corrections to which attention is drawn wit-hin the period set at the time of despatch ofthe proof.
12. Provided no particular size has been specified the order will be charged on thebasis of the print height actually used usualfor the type of advertisement.13. Unless the orderer effects prepaymentthe invoice will be sent immediately, at allevents however, fourteen days following publication of the advertisement.The invoice is to be paid within the periodspecified in the price list an commencingfrom the receipt of the invoice, unless another period or prepayment has beenagreed for the case in question. Any discounts for early payment will begranted in accordance with the price list.14. In the event of default or delay in payment interest charges in accordancewith those list ed in the pricelist together with collection expenseswill be levied. However, the orderer retainsthe right to furnish proof that the loss incurred is substantially less serious. In the event ofdefault the publishing company may delayfurther performance of the current orderuntil payment has been effected, as well asdemand prepayment of the remaining advertisements. In the case of justifieddoubt in the ability of the orderer to effectpayment the publishing company has theright, even during the duration of an advertisement contract, to make the appearance of further advertisements dependent upon the prepayment of the sum in question and ofsettlement of outstanding invoices withoutregard to the terms of pay ment originallyagreed upon.15. Upon request the publishing companywill supply a voucher copy of the advertisement together with the invoice. Depending on the nature and size of the advertisement order clippings, tear sheets,or complete voucher copies will be supplied. Ifit is no longer possible to obtain a voucher

copy, a legally binding certification confir-ming that the advertisement was publishedand disseminated will be provided by thepublishing company in its stead.16. The orderer shall bear the expense ofthe preparation of copy and drawings orde-red, or of alterations requested by the orde-rer, or of reasonable alterations which differsub -stan tially from the version originallyagreed upon.17. Where a contract has been signed for thepublication of a series of advertisements aclaim can be deduced in the event of a re-duction in the number of copies printed, if,on overall average for the insertion year commencing with the appea-rance of the first advertisement, the circula-tion falls below the average circulationquoted in the price list or otherwise speci-fied, or, in cases where no circulation is spe-cified, the average number of copies sold inthe previous calendar year (in the case ofspecialist publications this may be the ave-rage number of copies actually dissemina-ted). A reduction in the print run is only adeficiency justifying a reduction in price ifthe reduction amounts to 20 % in the case of a circulation of up to50,000 copies15 % in the case of a circulation of up to 100,000 copies10 % in the case of a circulation of up to 500,000 copies5 % in the case of a circulation exceeding 500,000 copiesFurthermore, reductions in contract priceare excluded in cases where the publishingcompany informed the orderer of the re-duction in circulation sufficiently early so asto allow the latter enough time to terminatethe contract before the advertisement ap-peared.18. In the case of box number advertisementthe publishing company entrusts the cus-tody and prompt forwarding of the offers tothe care of a serious businessman. Registe-
red letters and express letters in reply to boxnumber advertisements will be forwardedby standard post. Letters received in reply tobox number advertisements will be kept forfour weeks. Letters not collected within thisperiod will be destroyed. The publishingcompany returns valuable documents, alt-hough no such obligation exists. In the inte-rest and for the protection of the orderer thepublishing company reserves the right toopen offers receiv ed for examination to en-sure that the box number service is not mi-sused. The publishing company is notobliged to forward commercial recommen-dations or offers of mediation.19. Text and layout will only be returned tothe orderer in response to a specific requestso to do. The obligation to keep text and lay-out in safe custody elapses three monthsafter expiry of the contract.20. Place of performance is the registeredoffice of the publishing company. In busi-ness trans actions with merchants, juristicpersons under public law or separate esta-tes under public law the place of jurisdictionfor legal action is the registered office of thepublish ing company. If the domicile or placeof habitual residence of the orderer, even inthe case of non-merchants, is unknown atthe time of the commencement of an action,or if the orderer alters his/her domicile ofplace of habitual residence to a place out-side the jurisdiction of the law following con-clusion of the contract, the place ofjurisdiction is agreed upon as being the re-gistered office of the publishing company.Additional conditions of acceptance of thepublishing companya) While exercising all due diligence whenaccepting and examining the advertisementcopy, no liability attaches to the publishingcompany if misled or deceived by the orde-rer. By placing an advertise ment order theadvertiser undertakes to bear the expenseof the publication of an counter -representation referringt to actual claims
made in the published advertisement in ac-cordance with the advertisement rates validat the time.b) The orderer bears the responsibility forthe content and the legal permissibility ofthe text and illustrations provided for the in-sertion. It is incumbent upon the orderer toindemnify the publishing company with re-spect to the claims of third parties arisingagainst the publishing company from theexecution of an order, even if it was not suspended in time. The publishing companyis not obliged to check orders and advertise-ments with a view to their infringing therights of third parties. In the event of adverti-sements appear ing which were notsuspend ed in time, no claims of the adverti-ser can be made against the publishingcompany. The orderer also releases the pu-blishing company from all claims resultingfrom infringement of copyright.c) Notification of cancellations must be givenin writing. In the event of an advertisementbeing cancelled the publishing company candemand payment of the composition costsincurred.d) Cases of force majeure and industrial ac-tion for which the publishing company bearsno respon sibility release the publishing com-pany from the obligation to fulfil contractsand to pay compensation.e) The publishing company accepts no liabi-lity for errors in the transmission by tele-phone of adver tisements, changes of theappointed date of appearance or of theissue in which the advertisement is to ap-pear, of corrections to the text, or of cancel-lations.f) Claims arising from incorrect printing ofrepeat advertisements are excluded if theadvertiser had the opportunity of drawingattention to the error prior to the printing ofthe advertisement immediate ly following. The claim to payment of the publi-shing company remains un affected.g) The advertiser may lay retrospective claimto the corresponding discount for the actual
number of advertisements printed within theone-year period if, at the beginning of theperiod, he concluded a contract which, in accordance with price list,would have entitled him to a rebate from thevery beginn ing. The claim to retrospective rebatelapses if not pressed within one month ofthe expiry of the one year period.h) A trade discount of ten percent on thestandard price shall only be granted for di-rect advertis ing orders.i) The publishing company reserves the rightto fix special rates for advertisements in pu-blish ers in serts, special publications andspecials/special editions. The publishingcompany further reserves the right to cor-rect (credit notes, additional charges) incor-rect invoices within six months of themaking out of the invoice.j) Space brokers and advertising agenciesare obliged to adhere to the prices listed bythe publishing company when making theiroffers to, as well as concluding contractsand settling accounts with advertisers. Theagency commission granted by the publi-shing company may not be passed on to theadvertiser either in full or in part.k) Personal liability of the representative ofan orderer: If the orderer is a juristic person,or other wise limited liability (eg. GmbH), theperson signing on behalf of the orderer ispersonally liable to the publishing companyas a guarantor who has waived his plea ofprimary recourse against the principal debtor.l) Data protection: Pursuant to §26 of the(German) Federal Data Protection Act wedraw attention to the fact that within the framework of the business relations the required customer and supplier data are stored with the aid of electronic data processing equipment.
