THE SOCIETYThe Medico-Legal Society of Queensland Inc. (MLSQ) has approximately 400 members spanning three professions: doctors, solicitors and barristers. Associate members represent professions working in the medico-legal industry including allied health practitioners, nurses, medical administrators, medical defence organisations, medico-legal reporting agencies and tertiary students of medicine and law. This mix of members provides a unique opportunity for practitioners of these disciplines to meet, share knowledge and exchange views on medico-legal issues and to develop an understanding of how those issues affect each profession.

MLSQ was formed in 1952 to further medico-legal knowledge and to promote understanding and rapport between the medical and legal professions. The then Chief Justice of Queensland, The Honourable Justice Macrossan delivered the inaugural address, Medical and Legal Aspects of Drunkenness in relation to drivers of motor vehicles. After a hiatus during the 1970s, MLSQ was re-formed in the 1980’s and has being going from strength to strength since then. During its 60th Anniversary year, the Society agreed to incorporate, adopting a new constitution and introduced Associate Membership.

Past presidents have included a who’s who of Queensland’s legal and medical fraternities. The MLSQ executive rotates biennially through a doctor, barrister, solicitor sequence.

MLSQ is a very active organisation regularly hosting dinner meetings featuring speakers from a variety of professions. Topics covered at dinners address issues and events of current interest and benefit to all practitioners. MLSQ also hosts an annual conference as well as regular educational workshops.

The MLSQ Expert Witness Directory is another valuable membership benefit. Doctors may register to be included in the directory and lawyers may request access to details of experts in particular areas of specialty, via the Secretariat. View the website for further information.

This year’s Annual Conference will be held at the Surfers Paradise Marriott Resort, Gold Coast, from 12- 13 August 2016.

The executive committee has very carefully crafted a scenario that we feel sure will resonate for doctors and lawyers alike and I encourage you all to attend.

Addressing the consequences for medical practitioners (of varying seniority) in the aftermath of an unwanted procedural outcome, we follow the processes within public and private hospitals. Sorting through the aftermath, our highly respected and experienced presenters will explore the professional, legal and ethical dilemmas and delays practitioners face when caught up in an investigation process.

The issues addressed are significant to all medical practitioners, whatever their specialty and whatever their stage in the profession. We provide an opportunity for legal practitioners to reflect on the role they perform and in particular reflect on the medical, legal and ethical challenges they have to face as the scenario evolves.

Both our esteemed MLSQ Patrons are participating in the business program.

The conference coincides with the 2016 Summer Olympic Games so our evening social activities will have an international flavour, as well as being relaxed and entertaining. The Hon. Justice Daubney, Supreme Court of Queensland, is guest speaker at Saturday’s Conference Dinner.

After graduating from The University of Queensland and completing his internship in Townsville Dr Rob Barnett trained in both Anaesthesia and Intensive Care on the Queensland rotation scheme. He then travelled to Canada where he was the Program Director for Critical Care at the University of Alberta for five years. Rob returned to Australia and became Director of the ICU’s in Townsville, Princess Alexandra and currently at Holy Spirit Northside. He has also held many administrative positions including Director of Medical Services for 10 years at Holy Spirit Northside, and a Board Member of St Vincent’s Health and Aged Care. Rob’s particular interests are in the processes that lead to successful multidisciplinary teams.

Justine Beirne is the Head of Medical Defence and Services, Queensland for Avant Mutual Group. She has extensive experience in medico-legal litigation and disciplinary issues acting for medical mutuals and insurers of allied health practitioners. Justine has successfully combined her litigation experience, risk management skills and Master of Laws, specialising in the area of ethics in medicine, to provide a holistic service to clients in the medical area.

Dr Sara Bird has worked in the medico-legal area since 1998. A University of Sydney Graduate and Fellow of RACGP, Sara is currently the Manager, Medico-legal and Advisory Services with MDA National. She assists doctors in dealing with a variety of medico-legal issues including complaints, investigations, coronial inquiries as well as medical negligence claims, both litigated and unlitigated. Sara has previously worked as a GP and also as a medical officer in sexual assault services, performing forensic medical assessments.

Dr Donna Callaghan is a barrister at the private Bar in Brisbane, practising mainly in the areas of health law and personal injuries. Her previous experience includes 11 years as a medical practitioner, State Claims Manager at a national medical professional indemnity organisation and Senior Associate in a large national law firm in the litigation and dispute resolution group. Donna has a passionate interest and broad experience in the medico-legal field. She had been on the editorial board of the Australian Health Law Bulletin and enjoys publishing and presenting to practitioners of both professions.

Associate Professor Tina Cockburn works within the Faculty of Law, Queensland University of Technology, and is a researcher within the Australian Centre for Health Law Research (ACHLR). Her health law research focuses on patient safety law and medico-legal issues arising out of adverse medical outcomes and the

communication of information, including patient consent and post treatment open disclosure. She has published several books, book chapters and numerous scholarly articles and other publications, nationally and internationally. She is a member of the Queensland Law Society Health and Disability Law Committee.

Hon. Justice Martin Daubney was appointed to the Supreme Court of Queensland in July 2007. At the time of his appointment, he was a silk with an extensive practice in civil litigation and as a mediator, and was President of the Bar Association of Queensland. Justice Daubney holds numerous appointments in professional, charitable and community organisations, including as Chair of the Judges’ Forum of the International Bar Association and as a member of the Senate of The University of Queensland. Justice Daubney will deliver the Conference Dinner address.

Dr Amanda Dines is the Executive Director, Royal Brisbane and Women’s Hospital. A Monash medical graduate and a Masters in Public Health from Harvard School of Public Health, Amanda holds fellowships of the Royal Australasian Colleges of Medical Administrators and General Practice. She has worked at the RBWH since 2007; firstly as Deputy Executive Director Medical Services, and more recently as the Executive Director Cancer Care at RBWH and Metro North Hospital and Health Service. Amanda served in the Royal Australian Air Force as a Medical Officer for 24 years, during which time she was deployed on operational service to Iraq and East Timor, and commanded the RAAF Health Services Wing based at Amberley QLD, and the Canberra Area Medical Unit. She transferred to the RAAF Specialist Reserve in 2007 and is currently an Honorary Aide de Camp to the Governor General. Her professional interests include leadership development in healthcare, disaster management, and research ethics and governance.

Dr Jennifer King has more than 32 years experience as a medical practitioner and is a respected and well-credentialed medical administrator. Over the past 20 years Dr King has held significant executive leadership roles including Executive Director Mater Public Hospitals Brisbane, General Manager Wesley Hospital, Executive Director Logan-Beaudesert Hospitals and Executive Director Princess Alexandra and QEII Hospitals. Recently as an independent consultant she has performed senior medical administrator roles in Western Australia, Gladstone Hospital, Coffs Harbour Hospital and Cairns hospitals.

Dr Lawrence Malisano completed his primary medical degree at The University of Queensland. After post graduate training in Queensland, he was awarded his Fellowship of the Royal Australasian College of Surgeons. Subsequent Fellowship experience included appointments in hip and knee arthroplasty at the Royal National Orthopaedic Hospital, London, a trauma fellowship at The University Hospital in Bochum (Germany) and a Reconstruction and Trauma Fellowship at the Sunnybrook Health Sciences Centre, Toronto. Lawrence is a Senior Specialist at the Princess Alexandra Hospital and has an education role with The University of Queensland Medical School. He is a Fellow of the Australian Orthopaedic Association (AOA) and currently serves as the AOA’s second vice-president; is a Council Member of the Royal Australasian College of Surgeons in which capacity he chairs the RACS professional standards committee.

Annette McMullan was appointed as Chief Legal Counsel for Queensland Health in 2011, providing legal advice to the Minister for Health and Minister for Ambulance Services, Director-General and Senior Executive of Queensland Health on legal issues associated with the Departments key programs, policies and portfolio legislation. In addition to her legal qualifications, Annette holds a Bachelor of Nursing from QUT and post graduate midwifery qualifications, practising as a registered nurse and midwife for over 20 years, prior to her admission to the Supreme Courts of the ACT and Queensland.

Dr Kerri Mellifont QC was admitted to the Queensland Bar in 1994, and took silk in 2010. She practises predominantly in the areas of mediation, criminal and regulatory law and administrative law. A large part of her admin practice is representing registrants in medical disciplinary matters. She was a member of the Psychologist’s Board of Queensland 2005 until 2010. Kerri holds a doctorate having researched illegally and improperly obtained evidence, and is the author of a book on that topic entitled, Fruit of the Poisonous Tree. She was the senior legal officer in the Forde Commission into Child Abuse, one of the silks acting as Counsel Assisting the Flood Commission of Inquiry, and sits on the QUT Law Founders Scholarship Committee and the board of Barristers Chambers Ltd.

In 2012 Dr Susan O’Dwyer was appointed Executive Director, Medical Services, Metro South Hospital and Health Service. Susan is a member of the Queensland Board of the Medical Board of Australia, as well as Queensland’s Practitioner member on the national Medical Board of Australia. She chairs the Queensland Registration Committee of the Medical Board of Australia, and was previously a member of the Australian Medical Council prevocational accreditation standards committee. She has worked in medical administration roles at various facilities across

Queensland since 2001, including a seven year term at Queensland Health with responsibilities for medical workforce, education and training. Susan is a Censor with the Royal Australasian College of Medical Administrators.

Dr Luis Prado joined The Wesley Hospital in 2004 as Director of Medical Services where he is responsible for Clinical Governance. Luis is also the Chief Medical Officer for UnitingCare Health. His previous positions include Manager of Junior Medical Staff at Princess Alexandra Hospital, Deputy Director of Medical Services at Greenslopes Private Hospital and Director of Clinical Training at both The Prince Charles Hospital and Greenslopes Private Hospital. He has also served as a medical officer with the Australian Regular Army, including deployments to the Western Sahara and Solomon Islands and commanded the 11th Medical Company at Gallipoli Barracks, Brisbane. Luis is actively involved in medical education and clinical teaching and regularly teaches medical students via UnitingCare Health Clinical School and is an Associate Professor for Bond University. He is a Fellow of the Royal Australian College of General Practitioners, the Australian College of Health Services Management, the Royal Australasian College of Medical Administrators, The Australasian Association for Quality in Health Care and the International Society for Quality in Health Care and holds a Graduate Diploma in Sports Medicine.

Dr Nigel Prior is a graduate of The University of Queensland, a Fellow of the Royal Australian and New Zealand College of Psychiatrists (RANZCP) and a Fellow of the Australasian Chapter of Addiction of Medicine of the Royal Australasian College of Physicians (FAChAM). He trained both in the United Kingdom and Australia and has had extensive experience in both clinical and forensic psychiatry. He is a member of the Forensic Faculty of the RANZCP, the Medico-Legal Society of Queensland and the American Association of Psychiatry and the Law. He is a Senior Lecturer in Psychiatry at The University of Queensland. His special interests relate to general psychiatry involving anxiety and depressive disorders, addiction medicine and civil medico-legal practice. He has previously been a member of General Council and a Chair of the Board of Practice Standards of the RANZCP.

Dr Stephen Walker is Associate Medical Director of the Cognitive Institute. Prior to joining the Cognitive Institute Stephen held positions as Director of Clinical Training, Deputy Director of Medical Management and Emergency Physician at Mater Health Services Brisbane. He has completed postgraduate studies in both clinical education and medical management. Stephen has been a Senior Lecturer in the Department of Anaesthesia and Critical Care, The University of Queensland. In 2013 he was named Queensland Clinical Educator of the Year.

MANDATORY REPORTING: DO I OR DON’T I?

On a Sunday afternoon in the intensive care ward of a regional base hospital, a Trainee is faced with an ethical dilemma which will shape his career. The Trainee finds himself teamed with a consultant who, fairly or not, has a reputation as a “cowboy”. The conference scenario explores the professional and personal ramifications experienced by the Trainee in the context of his decision to report, or not to report, to the Board and the Coroner. Our conference speakers will follow the Trainee from the time of the event, through the various investigations by the facility and the Coroner, and the sequelae of his decision to report or not to report to the Board.

This scenario is purely fictional and was developed by doctors and lawyers with many years’ experience in medico-legal matters.

For children up to 12 years: Please meet your activities leader at the terrace by the pool for fish feeding in the lagoon. After this, go back to the Kids Club for a morning of arts, crafts and games. Children who are not toilet-trained must be accompanied by an adult. Please register your child’s attendance on the registration form. Places are limited!

For older children, unsupervised activities at the resort include the world class pool, slides and lagoon complete with tropical fish, a reef and a beach. Fish feeding is scheduled every morning at 9.30am at the Lagoon. The hotel has a water sports kiosk where you can hire snorkel gear, li-los and water play items, or bring your own gear and avoid hire fees! Or play a game of tennis on the resort courts. Bring your own tennis gear or equipment is available for hire at the activities desk.

Directions from Brisbane

Drive along the Pacific Motorway (M1), take the Smith Street Connection Exit to Southport.

1. Smith Street turns slightly left and becomes North Street. At the end of North Street, turn right onto the Gold Coast Highway, following the signs to Surfers Paradise.

2. Travel on the Gold Coast Highway for approximately 4 kms. As you enter Surfers Paradise you will see the Marriott Hotel on your right. Note: for southbound traffic there is no right turn into the hotel from the highway.

3. To access the hotel, turn left into Pandanus Ave and then right into Surfers Paradise Boulevard.

4. Turn right into Cypress Ave (third street along).5. Turn right into Gold Coast Highway, heading north back towards

Southport. Surfers Paradise Marriott Resort & Spa entry is approximately 600 m on the left.

Interstate delegates are recommended to fly directly into the Coolangatta Airport. Transfers to Surfers Paradise on Friday afternoon/evening take approximately 35-45 minutes. • Single, double or twin rooms are available.

• If you wish to reserve a suite, please contact the secretariat to ascertain the conference rates.

• Interconnecting rooms – a king bed room and a twin bed room - are recommended for family accommodation. These are subject to availability so please book as soon as possible.

• The maximum occupancy in a standard room is three adults, or two adults and two children (up to 14 years).

• Please advise children’s ages on the registration form

• Extra bedding (rollaway bed or cot) is complimentary for children up to 14 years, and $40 per night for an adult.

• Room rates are per room per night and include GST. The rate includes full buffet breakfast in Citrique Restaurant for one adult (single occupancy) or two adults (double occupancy).

• Credit card details or a deposit of at least one night’s tariff must accompany your registration form before your reservation can be processed. Deposits will be deducted by the venue when you settle your account on check-out. A tax invoice/receipt will be issued at that time.

• Alternatively, your credit card authority will be passed to the hotel to secure room reservations. The secretariat will not debit your credit card for your accommodation deposit. The total amount owing will be debited at check-out and a tax invoice/receipt issued.

• Check-in time is 1500 hrs. Check-out time is 1100 hours. Late check-out may be requested but cannot be guaranteed.

• Please indicate your expected arrival and departure times on the registration form.

• If you are a Marriott Rewards Member, please include your membership number and your details will be included with your reservation.

CANCELLATION POLICY

• Accommodation cancellations must be made in writing to the secretariat.

• Accommodation deposits will be refunded if a cancellation is notified prior to 29 July 2016 and the room is reallocated to another delegate.

• Between 29 July and 5 August 2016, a cancellation of one night’s deposit applies, unless the room is reallocated to another delegate.

• Rooms cancelled after 5 August 2016 will incur a cancellation fee equal to the tariff for the total number of room nights booked, unless the room is reallocated.

DRESS

Smart casual attire is appropriate for conference sessions. A jacket may be required for air-conditioned session rooms and evening activities. Jacket but no tie is the dress for gentlemen attending the conference dinner. A wrap or jacket is recommended for ladies for cooler evenings.
