Development in a matching amount of $20,000.

6. Change Order #2, Contract 2016-07 College Avenue North Frontage Road Reconstruction, increasing the contract amount by $22,556.80 and changing the final completion date to November 9, 2016.

G. RESOLUTIONS 1. Preliminary Resolution TBR-04-2017 declaring intent to exercise special assessment powers

under Chapter 66, Police Powers, Wis. Stats., 2015-16 as amended for Broadway Drive (Meade Street to Ballard Road) street reconstruction.

2. Resolution TBR-05-2017 supporting efforts to close commercial property assessment loopholes.

H. CLOSED SESSION 1. Motion to convene in Closed Session via ROLL CALL VOTE pursuant to WI. Stats 19.85 (1)(g)

Conferring with legal counsel for the Town, legal counsel rendering oral or written advice concerning strategy to be adopted by the Town Board with respect to litigation in which the Town is now or is likely to become involved (property valuations) and WI. Stats 19.85(1)(e) - Deliberations or negotiations on the purchase of public properties, investing of public funds or conducting other specific public business when competitive or bargaining reasons require a closed session (Wisconsin Avenue property) (tabled from February 23 meeting).

2. Motion to adjourn Closed Session and reconvene Regular Meeting.

Motion carried. PUBLIC INPUT Roger A. Spiegel, 2639 W. Sunnyview Circle, was concerned with the panhandling and soliciting in Grand Chute. He stated City of Appleton has an ordinance forbidding panhandling/soliciting. He would like an ordinance in the Town of Grand Chute. Bob Grode, 4009 Town Lakes Circle #9316, stated the recommendation for the handbook policy was to include vacation, holiday and floating holidays to count towards actively worked hours. He asked that comp time also be added to this category. These are hours that have been worked and banked. Motion carried. UNFINISHED BUSINESS Approval of the Grand Chute Policy Handbook revisions (deferred from January 17, 2017). Motion (Sherman/Schowalter) to approve the handbook according to the Town Administrator’s recommendations. Supv. Sherman asked if comp time was banked at straight time or at an overtime rate.

Admin. March responded that comp time was banked at an overtime rate. They are concerned that adding comp time would create a compounding effect. The recommendation was based on the surrounding municipalities’ policies. Supv. Thyssen stated that they originally thought they were going to find savings. This has not been the case. The employees have had many things taken away and this is one more thing that is being taken away. With the savings estimated at $1,500, he would like it to stay the same and then maybe it could be revisited in the future. Motion carried. Thyssen opposed. NEW BUSINESS Approval of strip right-of-way acquisition from Thomas Thurber along Lynndale Drive for the installation of a sidewalk at a cost of $6,500. Motion (Thyssen/Sherman) to approve. TOWN OF GRAND CHUTE RESOLUTION, SERIES OF TBR-05-2017

A RESOLUTION OF THE TOWN OF GRAND CHUTE, OUTAGAMIE COUNTY, WISCONSIN, SUPPORTING EFFORTS TO CLOSE COMMERCIAL PROPERTY ASSESSMENT LOOPHOLES WHEREAS, homeowners in Wisconsin already pay 70% of the total statewide property tax levy; and WHEREAS, the disproportionate burden is about to get much worse unless the Legislature addresses tax avoidance strategies that national chains like Walgreens, and big box establishments like Target and Lowe’s are using across the country to gain dramatic reductions in their property tax bills at the expense of homeowners and other taxpayers; and WHEREAS, a carefully-orchestrated wave of hundreds of lawsuits in Wisconsin is forcing assessors to slash the market value of thriving national retail stores, shifting their tax burden to local mom and pop shops and homeowners; and WHEREAS, Walgreens and CVS stores in Wisconsin have argued in communities across the state that the assessed value of their property for property tax purposes should be less than half of their actual sale prices on the open market; and WHEREAS, in many cases the courts have sided with Walgreens and CVS, requiring communities to refund tax revenue back to the stores; and WHEREAS, there are over 200 Walgreens stores located in Wisconsin; and

WHEREAS, Target, Lowes, Meijer, Menards and other big box chains are using what is known as the “Dark Store Theory” to argue that the assessed value of a new store in a thriving location should be based on comparing their buildings to sales of vacant stores in abandoned locations for a different market segment; and

WHEREAS, the Indiana Legislature has on two occasions in the last two years overwhelmingly passed

legislation prohibiting assessors from valuing new big box stores the same as nearby abandoned stores from a different market segment; and

WHEREAS, the Michigan State House overwhelmingly passed similar legislation in May of 2016.

NOW, THEREFORE, BE IT RESOLVED by the Town Board of Supervisors for the Town of Grand

Chute, Outagamie County, Wisconsin, that Grand Chute does hereby urge the Governor and State Legislature to protect homeowners and main street businesses from having even more of the property tax burden shifted to them by passing legislation clarifying that:

1. Leases are appropriately factored into the valuation of leased properties; and

2. When using the comparable sale method of valuation, assessors shall consider as comparable only

those sales within the same market segment exhibiting a similar highest and best use rather than similarly sized but vacant properties in abandoned locations.
