What needs Legislation to protect it? • Access to sites needs to be protected. • Hunting, fishing and bush medicine • Burials along the river. • More control over commercial tour operators. • Rivers and waterways – have stories. • All water sources including underground water. • All burials known and unknown. • All site types currently protected should remain protected. • Bernier and Dunnie Islands need to be protected. No access should happen. • Coastline. • Mt Augustus and Kennedy Ranges/Jiddarrabundee (Barley Ranges). • Not using pest control affect native fauna. • Historical Aboriginal prisoner trails. • Old missions. • Lakes – Lake McLeod.

Who needs to be consulted and how? • The traditional owners from the country needs to be consulted. • Needs to speak with traditional owners direct, not through rep body. • Through Yinngarrda Corporation. • Formal agreement on way corporation is consulted. With all parties at local level. • Need to go back to skin group to determine who needs to be consulted. • Act need to be very clear that traditional owners relate to skin group. • It’s ok for people to be part of two groups, one on mother’s side, and one on father’s side. • Need resourcing and funding for groups to manacle their Heritage. • Need a tenure regime to assist protect heritage. • Rangers should be engaged to undertake heritage management work. • Training and education:

o Particle and administrative skills. • Scholarships for Aboriginal Heritage jobs. • Act to have register of who the right people are to consult for each region. • Any Government Department and Shire needs to consult with Yinngarrda people prior to

doing any works.

What actions require approval? • Changes tot rivers- water flow, bed and banks. • Changes to water sources. • Draining water. • All mining including sand. • Also need determination for damaged sites. • Increase to water allocation. • Roads that impact sites. • Land clearing. • Accreditation for tour operators.

• Access to coastline for traditional owners need to be maintained. • Cultural awareness training for land users. • Coastlines need to be managed. • Hunting of native fauna should require approval. • Aboriginal people also need approval for same activities. • Removing material from sites requires approval. • Diversification permits. • Compensation for mining and quarrying activities. • Ground disturbance works require consultation. • River banks should be protected with a half kilometer buffer.

What roles and responsibilities are needed? • Decisions about whether a place is a site needs to be made by traditional owners not

Aboriginal Cultural Material Committee (ACMC). • Minister needs to be acknowledge and meet with traditional owners on country. • Decisions about impacting sites should be made under a partnership agreement

between with traditional owners and the developer. • Need to register sites. • What the resources to register and record sites. • Templates to assist traditional owners work in partnerships. • Resourcing for traditional owners. • Roles for rangers in managing sites. • Traineeships for Aboriginal people to manage rangers. • Resources to Traditional Owners. • Do not want role for ACMC. • Prospectors also need approval from traditional owners. • All need to recognise men’s and women’s business to educate courts about culture and

authority when things are sensitive. Nominate people the courts to work with.

Enforcement • Traditional owners and rangers authorised to fine offender.s • Provisions to give cautions. • Increase penalties. • Native plants and fauna need to be protected. • Repeat offenders banned or permits revoked. • Register of offender company (ongoing). • Educate the public – brochures. • Cultural awareness training - this needs to be mandatory for land users. • Heritage awareness training – this needs to be mandatory for land users. • Remediation/Education courses for offenders. • Fines should come back to traditional owners. • Community services as a fine. • Punishments to be administrated through courts. • Mediation. • Courts to consult with traditional owners regarding penalties.
