AMENDMENT NO. 1

Amend Section 1 of the Ordinance beginning on line 155 as follows:

(6) From the earlier of the legal effective date of 2011 Wisconsin Act 10, or

the legal effective date of a substantially similar state law that grants Milwaukee County the authority, in the same manner as 2011 Wisconsin Act 10, to take the following action, until one year and one day thereafter, notwithstanding any other provisions of this code, incumbents of a position represented by the American Federation of State, County and Municipal Employees District Council 48 who would have received an advance in the pay range upon the meritorious completion of two thousand eighty (2,080) hours, shall be advanced to the next highest rate of pay in the pay range provided for the classification only upon meritorious completion of an additional two thousand and eighty (2080) straight-time hours for full-time positions, and a prorated fraction thereof for employees whose scheduled work week is less than forty (40) hours or who began employment after the earlier of the legal effective date of 2011 Wisconsin Act 10, or the legal effective date of a substantially similar state law that grants Milwaukee County the authority, in the same manner as 2011 Wisconsin Act 10, to take the preceding action. The intent of this section is to temporarily suspend incremental salary advancements for employees represented by District Council 48 for one year consistent with the terms of the 2011 Adopted Budget.

Amend Section 2 of the Ordinance beginning on line 173 as follows:

(8) Milwaukee County Group Health Benefit Program for actively employed

members represented by AFSCME District Council 48. Changes to Section 17.14(8) shall become effective as soon as administratively possible following the earlier of the legal effective date adoption of 2011 Wisconsin Act 10, or upon the legal effective date of a substantially

similar state law that grants Milwaukee County the authority, in the same manner as 2011 Wisconsin Act 10, to take the following action.

Amend Section 3 of the Ordinance beginning on line 429 as follows:

(5) Upon the earlier of the legal effective date of 2011 Wisconsin Act 10, or the legal effective date of a substantially similar state law that grants Milwaukee County the authority, in the same manner as 2011 Wisconsin Act 10, to take the following action, the provisions of sections 17.16(1)–(4) shall also apply to employees represented by American Federation of State, County and Municipal Employees District Council 48 in the same manner that those sections apply to nonrepresented employees, notwithstanding any bargaining unit representation by, or any collective bargaining agreement with, American Federation of State, County and Municipal Employees District Council 48, or any language to the contrary in sections (1)-(4) above.

(6) Upon the earlier of the legal effective date of 2011 Wisconsin Act 10, or the legal effective date of a substantially similar state law that grants Milwaukee County the authority, in the same manner as 2011 Wisconsin Act 10, to take the following action, or January 1, 2012, whichever is later, the provisions of sections 17.16(1)–(4) shall also apply to employees represented by District No. 10 of the International Association of Machinists and Aerospace Workers; the Technicians, Engineers and Architects of Milwaukee County; the Federation of Nurses and Health Professionals; the Building Trades of Milwaukee County and the Association of Milwaukee County Attorneys, in the same manner that those sections apply to nonrepresented employees, notwithstanding any bargaining unit representation by, or any collective bargaining agreement with, those bargaining units, or any language to the contrary in sections (1)-(4) above.

1. AMEND the RESOLVED clause beginning on line 69 as follows:

BE IT FURTHER RESOLVED, that if the Legislature passes legislation legalizing

concealed carry, it is imperative that the State grant Milwaukee County, as a local

government, the unfettered authority to regulate its own facilities (including

buildings, land, vehicles, and parking lots) for security purposes and preserves the

same criminal penalties as in previous statutes if the law is violated; and

2. ADD the following RESOLVED clause beginning on line 74 as follows:

BE IT FURTHER RESOLVED, that it is essential that the proposed legislation

contain felony penalties for carrying a concealed weapon without a permit and for

illegally obtaining a weapon through an intermediary or obtaining a weapon for a

person prohibiting from possessing such a weapon (“straw buyers”); and

3. AMEND any and all references to Milwaukee Public Zoo to read Milwaukee County

Zoo.

4. AMEND any and all references to the performing arts center to read The Marcus

Center for the Performing Arts.

A RESOLUTION 3

Authorizing and directing the Interim Director, Department of Labor Relations, to 5

negotiate a voluntary settlement with AFSCME District Council 48 for 2009 – 2010 6

and a potential extension or successor agreement for 2011-2012. 7

WHEREAS, the last executed Memorandum of Agreement with AFSCME 9

District Council 48 (DC 48) expired December 31, 2008, approximately 29 months 10

ago; and 11

WHEREAS, the successor to that agreement, which would cover 2009 and 12

2010, has been mired in the mediation/arbitration process since November of 2009 13

with no resolution anticipated in the near future, resulting in fiscal distress for the 14

County and furloughs, potential layoffs and outsourcing of jobs for DC 48; and 15

WHEREAS, DC 48 has indicated in a written communication dated May 4, 16

2011 an interest in working with the Interim Director of Labor Relations to reach a 17

voluntary settlement with Milwaukee County; and 18

WHEREAS, DC 48 has further indicated a “public commitment to voluntarily 19

accept premium sharing for health insurance and the voluntary contribution to the 20

pension plan, [and] other wage and benefit modifications” in the interest of 21

strengthening Milwaukee County’s fiscal health, preserving services for the 22

community and achieving a measure of labor peace; and 23

WHEREAS, because DC 48 currently represents approximately 60% of the 24

overall County workforce, it is in the County’s best interests to work with DC 48 to 25

reach an agreement covering 2009-2010 as well as a potential extension or 26

successor agreement for 2011-2012, provided such agreement is consistent with 27

adopted Milwaukee County policy and any tentative agreement is subsequently 28

presented, as required, for review by the Committees on Personnel and Finance and 29

Audit; now, therefore, 30

BE IT RESOLVED, that the Interim Director, Department of Labor Relations, 31

is authorized and directed to negotiate a voluntary settlement with AFSCME District 32

Council 48 for 2009 – 2010 and a potential extension or successor agreement for 33

2011-2012; and 34

BE IT FURTHER RESOLVED, that such negotiations shall be consistent with 36

adopted Milwaukee County policy, and that any resultant tentative agreement shall 37

subsequently be presented for review, as required, by the Committees on Personnel 38

and Finance and Audit. 39

DESCRIPTION OF FISCAL EFFECT In the space below, you must provide the following information. Attach additional pages if necessary. A. Briefly describe the nature of the action that is being requested or proposed, and the new or

changed conditions that would occur if the request or proposal were adopted. B. State the direct costs, savings or anticipated revenues associated with the requested or

proposed action in the current budget year and how those were calculated. 1 If annualized or

subsequent year fiscal impacts are substantially different from current year impacts, then those shall be stated as well. In addition, cite any one-time costs associated with the action, the source of any new or additional revenues (e.g. State, Federal, user fee or private donation), the use of contingent funds, and/or the use of budgeted appropriations due to surpluses or change in purpose required to fund the requested action.

C. Discuss the budgetary impacts associated with the proposed action in the current year. A statement that sufficient funds are budgeted should be justified with information regarding the amount of budgeted appropriations in the relevant account and whether that amount is sufficient to offset the cost of the requested action. If relevant, discussion of budgetary impacts in subsequent years also shall be discussed. Subsequent year fiscal impacts shall be noted for the entire period in which the requested or proposed action would be implemented when it is reasonable to do so (i.e. a five-year lease agreement shall specify the costs/savings for each of the five years in question). Otherwise, impacts associated with the existing and subsequent budget years should be cited.

D. Describe any assumptions or interpretations that were utilized to provide the information on this form.

Adoption of this resolution will not result in an increase in tax levy. Any tentative contract agreement will be presented with a comprehensive fiscal note under a separate resolution for consideration by the Committees on Personnel and Finance and Audit.
