While the Su ns h i ne L aw has lon g required mee tings of boards or commissions to be open to the public, the law has no t hereto fore gu aranteed a r igh t to pa r ticipa te. Except for a fe w lim ited exce pti o ns, the law expands the Su ns h ine L aw in a man ner tha t guarantees the ri gh t of the public to be heard at m eet i ng s of governmental bodies. Th e law takes effect October 1, 20 13. Section 2 86 . 0 114 a pplies t o an y “board or comm ission.” Th e term is def in ed br oa d ly in a manner that encompasses most government entities, including public pe n s ion boards. It specific ally pro v ide s: M em b ers of the public shall be g ive n a reasonable opportunity to be heard on a proposition bef ore a board or com mi ssion. Th e opportunity to be he ard n eed not occur at the sa me meeting at which the bo a rd or commission tak e so fficial action on the proposition if the opportunity occurs at a meeting t ha t is du r ing the decisionmaking process and is within a re aso n abl e proximity in tim e be f ore the meeting at which the bo ard or commission ta kes the off icial ac tio n. RE: SB 50 -- Public Participation in Open Meetings

SB 50 passed the legislature and was signed into law earlier this yea r by Governor Scot t. Thisbill creates a new section 286.0114, F lo rida Statutes , which is intended to provide the genera lpublic with a reasonable opportunity to be heard in meetings subjec t to the Sunshine Law. Whilethe Sunshine Law has long required meetings of boards or commissions to be op en to the public ,the law has no t heretofore guaranteed a right to pa rticipate . Except for a few limited exceptions ,the law expands the Sunshine Law in a manner that guara ntees the righ t of the public to be heardat meeting s of governmental bodies. The law takes effe ct October 1, 2013.

Section 286 .0114 applies to any “board or comm ission.” The term is defined broadly in amanner that encompasses most government entities, including public pension board s. Itspecifica lly provides:

Members of the public shall be given a reasonable opportunity to be heard on aproposition before a board or commission. Th e opportunity to be heard need notoccur at the same meeting at which the board or commission takes offic ial ac tion

on the proposition if the opportunity occurs at a meeting tha t is du ring thedecisionmaking process and is within a reasonable proximity in tim e be fore themeeting at which the board or commission takes t he official ac tion. This sectiondoes no t prohibit a board or commission from maintaining orderly conduct orprope r decorum in a public mee ting. The opportunity to be heard is subjec t torules or policies adopted by the board or commission...

The requirements under section 286.0114 do not apply to:

• Emergency situations;

• ministerial acts (i.e. approval of minutes);

• exempt meetings under 286.011 (executive session re: litigation); or

• quasi-judicial proceedings (i.e. disability hearings, forfeitures).

A board or commission may adopt rules or policies to implement the new law. If the board orcommission does so and complies with those rules or policies, it will be deemed to be acting incompliance with the law. Rules adopted by a board or commission can regulate the following:

• The amount of time an individual has to address the board or commission;• Procedures for allowing representatives to address the board or commission ratherthan all members of a group, in meetings in which a large number of people wishto be heard;

• Procedures or forms fo r an individual to use to inform the board or commission ofa desire to be heard, to indicate support, opposition or neutrality and to indicateh is o r her designation of a representative to speak on his or her behalf; and

• Designation of a specific period of time for public comment.

The law is enforceable by injunction in circuit court and if a court determines that a board or

commission took any action in violation of section 286.0114, the court will assess attorney’s feesagainst the board or commission. Conversely, if the court determines that an individual filed anaction under section 286.0114 that was frivolous or in bad fai th , the court may assess reasonableattorney’s fees against that individual. Any action taken by a board or commission in violationof section 286.0114 is no t void as a result of such violation.
