3 Functional description

3.1 PurposeThe first step for import in ICS Phase 1 is the pre-notification ( Entry Summary Declaration). This is the first transmission of information regarding a goods import in the EU. The pre-notification ENS is sent by CUSCAR( D04A) for Maritime transport. The ENS is very similar to the summary declaration ( “summiere aangifte”) in such a way that the full summary declaration an extension is of the ENS: the full SD contains more information than the ENS.

A pre-notification is sent to the first port of entry in the EU, providing all information required by Annex 30A (R1875/2006) and will contain all waybills & containers (stored on the ship) for the part of the cargo for whichthe lodger is responsible. The arrival notification or summary declaration ( “summiere aangifte”) will only specify the goods that are to be discharged in the port of first entry.

ICS executes a safety risk analysis on the ENS information to check whether goods are blocked from entry inthe EU ( the so called no-load notification).

Depending on the mode of transport, the ENS must be sent 24 hours before departure of the transport vessel in the overseas port, leaving the shipping agent ample time to be alerted of a no-load.

It is possible that the message does not reach the shipping agent in time and that the goods are already loaded to be shipped to Belgium. Therefore, also the goods handler is alerted of the customs decisions to block the goods.

The purpose of this system function is to handle the registration and amendment of the Entry Summary Declaration (Advanced Intervention Notification is described in the IE351 MIG)

This system function describes the future PLDA support for the following ICS DG Taxud process steps:

• CO1B0501(SUM) - Validate and register ENS

• CO1B0520(SUM) – Perform common safety and security risk analysis

• CO1B0600(SUM) – Validate and register amendment request

• CO1B0650(SUM) – Validate and register amendment request

3.2 Process descriptions

3.2.1 ENS RegistrationFollowing figure displays the core flow process in which the Entry Summary Declaration is submitted to the Office of first Entry (port of airport in Belgium), safety and security risk analysis is performed and risk is identified.




1. The process starts with the Person lodging the ENS, submitting the ENS to the Belgian PLDA via an IE315 message (ENS) corresponding with the message guide in this document. The Person lodging the ENS can be the following:

a. The shipping agents submitting partial ENS’s consisting of the goods in their responsibility. Vessel registration number, IMO and/or LLoydsnumber is mandatory to allow ICS to identify the shipment and to consolidate the ENS declarations.

2. The trader must make sure that the ENS message is structured according to the agreed upon rules in this MIG or the referred to MIG’s ( eg. CUSCAR MIG)

a. If the validation rules are violated, ICS (PLDA) will responds with an IE316 ENS rejection message indicating which of the rules are violated.

b. The trader has to correct the ENS and resubmit the original ENS with corrections applied. Note: amendment cannot be used here because no MRN has been generated nor provided.

3. After successful validation of the ENS, the declaration is registered and a MRN is automatically generated.

4. The allocated MRN is communicated back to the relevant actors via an IE328 message. Those actors are:

a. To the shipping agents that have submitted partial ENS’s

b. to the declared Trader at Entry (Carrier) if he is different from the Person lodging the ENS

5. The shipping agent receiving the MRN sets the status of the import operation to ENS Registered.

3.2.2 ENS AmendmentFollowing figure indicates the case where an amendment request is submitted at the Office of first Entry.

1. Only the trader who has submitted the original ENS can send an amendment request to Belgian PLDA. This is done using the IE313 ENS amendment message.

2. The incoming message has to follow the validation rules and structure described in this MIG and related other MIG’s ( e.g. CUSCAR). If the message fails to meet the imposed conditions, the amendment is rejected using an IE305 rejection message which will indicate the rejection reason(s). The trader has to take this into account when submitting a 2nd (or 3rd) try for the amendment request

3. The Office of first Entry checks if the amendment request is made on an already registered declaration and if the trader making the request is allowed to do so. If this is not the case, an IE305 rejection is sent with the corresponding rejection reason. In both cases, a new amendment request isnot possible unless the situation ( e.g submit original ENS) is resolved

4. In some cases, the amendment itself is completely rejected (IE305 is sent with corresponding rejection reason) because of the status of the import operation. In some cases, the status of the import operation does not allow an amendment. For example:

a. The Trader has been informed that the Office of first Entry intends to examine the goods;

b. The (declared) Office of First Entry has accepted a diversion request.

c. The (actual) Office of first Entry has accepted the corresponding presented arrival notification

d. The (actual) Office of first Entry has allowed the removal of goods.

5. If the amendment is valid, the Office of first Entry communicates to the Person lodging the ENS or his Representative and to the Trader at Entry (Carrier) (If he is declared in the ENS, he is different from the sender of the amendment request and he is connected to ICS of the Member State that the Office of first Entry is located) that the amendment request was accepted via an IE304 message.

3.3 Timing constraintsNote: article 184a, 1, R1875/2006 is the source of the following time limits:

For ENS Registration:

1. In the case of maritime traffic the entry summary declaration shall be lodged at the customs office of entry by the following deadlines:

a. (containerised traffice) the entry summary declaration has to be sent 24 hours before departure of the vessel in the overseas port.

b. (bulk/break bulk cargo) at least 4 hours before arrival at the first port in the customs territory of the Community

c. for movement between Greenland, the Faeroe Islands, Ceuta, Melilla, Norway, Iceland or ports on the Baltic Sea, the North Sea, the Black Sea or the Mediterranean, all ports of Morocco, and the customs territory of the Community with the exception of the French overseas departments, the Azores, Madeira and the Canary Islands, at least two hours before arrival at the first port in the customs territory of the Community

d. for movement, other than where point (c) applies, between a territory outside the customs territory of the Community and the French overseas departments, the Azores, Madeira or the Canary Islands, where the duration of the voyage is less than 24 hours, at least two hours beforearrival at the first port in the customs territory of the Community.

2. In the case of air traffic the entry summary declaration shall be lodged at the customs office of entry by the following deadlines:

a. for short haul flights, at least by the time of the actual take off of the aircraft 2;

b. for long haul flights, at least four hours prior to arrival at the first airport in the customs territory ofthe Community;

For the purposes of this paragraph, “short haul flight” means a flight the duration of which is less than four hours from the last airport of departure in a third country till the arrival to the first Community airport. All other flights are considered to be long haul flights.

3. In the case of rail and inland waters traffic, the entry summary declaration shall be lodged at the customs office of entry at least two hours prior to arrival at the customs office of entry in the customs territory of the Community.

4. In the case of road traffic, the entry summary declaration shall be lodged at the customs office of

entry at least one hour prior to arrival at the customs office of entry in the customs territory of the Community.

ENS data can be amended:

• before notification of goods control

• before goods arrival/goods release

• before a diversion request

3.3.1 1875 annex 30 bis requirementsThe following table describes the requirements for data attributes from a legal point of view, namely from reference [A14]. The table below is valid for the following mode of transport:

1 = Sea transport

2 = Rail transport

3 = Road transport

4 = Air transport

5 = Postal consignment

7 = Fixed transport installations

8 = Inland waterway transport

9 = Own propulsion

As a matter of fact, the Specific Circumstance Indicator, with following possible values, can be used by the trader lodging the ENS to indicate specific transport like B:

• A Postal and express consignments

• B Ship and aircraft supplies

• C Road mode of transport

• D Rail mode of transport

• E Authorised economic operators

The indication of the specific circumstance has impact on the set of attributes that are required or not ( refer to [A14]. Considering the mapping between transport mode and the circumstance indicator, it is clear that only values B & E of the circumstance indicator cannot be derived from transport mode. When AEO is in place, we also don’t need the value E of the circumstance indicator.
