SUBJECT: TRACTION POWER SUBSTATIONS FOR EXPOSITION LINE PHASE 2AND GOLD LINE FOOTHILL EXTENSION
ACTION: AWARD CONTRACT FOR TRACTION POWER SUBSTATIONS
RECOMMENDATION
Authorize the Chief Executive Officer to award a firm fixed price contract under Bid No.OP39602869 with Balfour Beatty Rail Inc, the lowest responsive and responsible bidderfor 18 Traction Power Substations (TPSS) for an amount not-to-exceed $19,176,024.01inclusive of sales tax and storage fees.
ISSUE
Traction Power Substations are a vital part of the rail system. The stations are placedone mile apart along the alignment. They convert high voltage electricity (alternatecurrent) for the Light Rail Vehicle (LRV) catenary cable power into the necessaryvoltage (direct current) required to run the LRV cars.
As agreed to in the Memorandums of Understanding with the Construction Authorities,Traction Power Substations for the Foothill Extension and Phase 2 of the Expo line willbe purchased by Metro. Funds were identified and reserved to procure and supplysubstations to the construction authorities' contractors. Procurement of substationsunder a combined contract provides economies of scale and uniformity of equipmentbetween rail lines. Standard sub station design and construction will benefit Metro withreduced life-cycle costs for training, maintenance and replacement parts.
DISCUSSION
On January 1, 2012, the Board approved a Master Cooperative Agreement andFunding Agreement with the Foothill Construction Authority that includes TractionPower Substations as items Metro will supply. There are similar requirements in theFunding Agreement Term Sheet for Phase 2 of the Exposition Line. Procurement ofsubstations under a unified contract provides economies of scale and uniformity ofequipment between rail lines.
Traction Power Substations
This contract is for the designing, manufacturing, testing and delivery of 18 TractionPower Substations, including spare parts and special tools. The Contract also includesa schedule of storage fees in the event that one or both projects are not ready toreceive substations when they have been manufactured.
DETERMINATION OF SAFETY IMPACT
Approval of this item will ensure uniformity of equipment manufacture, design andconfiguration across projects, thereby improving the safety of maintenance throughconsistency of operation.
FINANCIAL IMPACT
The funding of $1,134,162 for this project is included in the FY12 budget in cost center3920, Wayside Systems, under project 860301, EXPO Blvd. LRT Construction PhaseII, account 53102 Acquisition of Equipment and in cost center 8510, ConstructionContracts/Procurement, under project 860200, Gold Line Foothill Extension, account50316 Services, Prof and Tech Service.
Since this is a multi-year contract, the project manager and Executive Officer, WaysideSystems will be accountable for budgeting the cost in future years.
Impact to Budget
The funding for this acquisition will come fromMeasure R funds eligible for rail operating and capital.
ALTERNATIVES CONSIDERED
This procurement could be rejected and the funds for substation procurementtransferred back to the two Construction Authorities. However, the time lost insolicitation, bid and selection would be lost and may impact the opening date for theseprojects, or result in higher cost due to accelerated manufacture to make up for losttime.
NEXT STEPS
Following execution of this contract, the vendor will commence manufacturing, withdeliveries scheduled to commence in June 2013.

A. Procurement Background
This Board action is for aTwo-Step Invitation for Bid (IFB), technically acceptable
and lowest-responsive bid procurement issued in support of Wayside Systems to
acquire up to eighteen standardized Traction Power Sub-Stations (TPSS) for Expo II
and Foothill.
The IFB was issued in accordance with Metro's Acquisition Policy and the contract
type is firm fixed price.
Three amendments were issued during the solicitation phase of this IFB;
• Amendment No. 1 issued on February 17, 2012 clarified revisions to the
performance specification and provided responses to questions;
• Amendment No. 2 issued on February 22, 2012 clarified critical due dates,
revised the performance specification and provided responses to questions;
and,• Amendment No. 3 issued February 24, 2012 clarified revisions to the
performance specification and provided responses to questions.
Traction Power Substations
A pre-bid conference was held on February 16, 2012. A total of three firms attendedthe pre-bid conference, and eight questions were asked.
A total of four technical bids were received under Step One on March 12, 2012. AllStep One technical bids were evaluated, and only firms found to be technicalacceptable were invited to submit Step Two —Price Bids. On March 28, 2012, a totalof three price bids were received under Step Two.
B. Evaluation of Proposals/Bids
A total of four bidders responded to this solicitation. A Source Selection Committeeconsisting of two staff members from Wayside Systems and one from SystemsEngineering was convened and conducted a comprehensive technical and priceevaluation of the bids received.
The bids were evaluated on a pass/fail evaluation criteria based on the minimumqualification requirements defined in the IFB.The evaluation criteria is appropriateand consistent with criteria developed for other, similar equipment procurements.
Of the four technical bids received, three were determined to be technicallyacceptable. The three firms that were deemed technically acceptable are listedbelow in alphabetical order:
1. Balfour Beatty Rail, Inc.2. Powell Electrical Systems, Inc.3. Siemens Industry, Inc.
On March 16, 2012, firms found to be technically qualified were formally invited tosubmit Step Two pricing on March 28, 2012.

Balfour Beatty Rail, Inc (BBRI) is a rail infrastructure contractor specializing inconstruction and maintenance services for the public and private railroad markets.BBRI's clients are Class 1 and regional/short line railroads, industrial railroads, portsand rail transit authorities. BBRI is part of Balfour Beatty, a global engineering,construction, services and investment organization headquartered in London,England specializing in large infrastructure and building programs. Balfour Beattywas founded in 1909 and is publicly traded on the London Stock Exchange (BBY.L).BBRI is headquartered in Atlanta, Georgia and has several locations in the USincluding a division office in Los Angeles, California.
Traction Power Substations
BBRI has previously contracted with Metro, and has provided satisfactoryperformances. In addition to Metro, BBRI has had contracts with Denver TransitContractors, Elcon Corporation, City of Tucson, and City of Seattle.
Powell Electrical Systems, Inc:
Founded in 1947, Powell Industries, Inc. designs, manufactures and packagesequipment and systems for the distribution, control, generation and management ofelectrical energy and other dynamic processes. Headquartered in Houston, Texas,Powell serves large industrial customers such as oil and gas producers, refineries,petrochemical plants, pulp and paper mills, transportation facilities, and public andprivate utilities.
Powell has previously contracted with Metro, and has provided satisfactoryperformances. In addition to Metro, Powell has had contracts with Long IslandRailroad, Washington Metropolitan Area Transit Authority, and Dallas Area RapidTransit.
Siemens Industry, Inc:
Siemens Corporation is a U.S. subsidiary of Siemens AG, a global leader inelectronics and electrical engineering, operating in the industry, energy, healthcare,and infrastructure and cities sectors. Siemens has been in business for over 160years.
Siemens has previously contracted with Metro, and has provided satisfactoryperformances. In addition to Metro, Siemens has had contracts with BART, Amtrak,Tri County Metropolitan Transportation District, Denver Regional TransportationDistrict, and Dallas Area Rapid Transit.
C. CostlPrice Analysis
The recommended price has been determined to be fair and reasonable basedupon adequate competition and comparison to Metro's Independent Cost Estimate("ICE"). The proposed total NTE for the recommended awardee is $19,176,024.01for the baseline quantities, training, warranty, and optional quantities, whichcompares favorably to Metro's ICE of $36,143,076.13.

The recommended firm, Balfour Beatty Rail, Inc located in Atlanta, Georgia hasbeen in business for over 100 years, is a leader in the rail infrastructure contractorspecializing in construction and maintenance services for the public and privaterailroad markets. BBRI's clients are Class 1 and regional/short line railroads,industrial railroads, ports and rail transit authorities. BBRI has completed similarprojects with the cities of Seattle, and Tucson.
The Project Manager assigned to this project has 25 years of experience in thetraction power industry. Other key personnel assigned to the project, have over 60years of combined experience in the Traction Power Systems Industry.
E. Small Business Participation
The Diversity and Economic Opportunity Department (DEOD) established a 7%Disadvantaged Business Enterprise (DBE) Anticipated Level of Participation (DALP)for this solicitation. Balfour Beatty Rail Inc. made an 8.76% DBE commitment. TheContractor's, commitment exceeds the goal.
