In November, Miami Valley NARI launched its new membership campaign. Though we want new members to keep our industry and association strong, drawings based on recruiting new members are getting all the buzz. Steve Jobs may be gone, but you could own part of his legacy if you’re able to recruit new members. What’s the story? For each new member you recruit, you’ll be entered to win an iPad; the more you recruit, the more you’re entered to win. The iPads will keep coming throughout the campaign, and a drawing will be conducted at the Membership Meeting immediately following the sign up of the tenth new member. So, if you recruit two of the ten new members, you‘ll be entered twice – and so on. Recruit your industry friends; tell them the advantages we enjoy as members, and you don’t have to tell them that you could win an iPad - keep that one to yourself until they are an eligible member and begin recruiting! New Remodeling Report: Key Drivers of Market Upturn Include Green Retrofits The Improving America’s Housing report, The U.S. Housing Stock: Ready for Renewal, found that after languishing for several years, the nation’s housing revitalization is underway. Recent Census Bureau estimates show homeowner improvements spending increased 11 percent in 2012, and double-digit growth is projected through 2013’s third quarter. One trend gaining popularity is sustainable home improvements; energy-efficiency spending expanded throughout the remodeling downturn. The share of homeowner spending on energy-related projects—roofing, siding, windows, doors, insulation and HVAC systems—rose from 2007’s 23 percent, to 33 percent in 2011. 25% of homeowners remodeling in 2010-2011 did one or more projects for energy efficiency purposes, spending over $6,300 on average each year. Homeowners doing non-energy efficient projects spent only $3,400; the difference being whether the homeowner received a home energy tax credit for their green remodeling project. Nearly 44 percent of homeowners undertaking energy efficiency improvements received home energy tax credits for one or more projects. Homeowners receiving tax credits on average spent $8,300 annually for improvements, compared to $4,800 for homeowners pursuing energy efficiency without tax credits. Homeowners receiving tax credits averaged 4.2 projects in 2010-2011, compared to 3.5 for those not receiving tax credits, and 2.4 projects for homeowners remodeling for reasons other than energy savings. Green homeowners receiving tax credits spent almost 65 percent more, even when controlled for the number of projects undertaken. While some of this difference for homeowners pursuing green projects suggests premiums for energy-efficient and sustainable building products, tax credits were a major incentive to undertake projects otherwise put off during the downturn. New Remodeling Report: Key Drivers of Market Upturn Include Green Retrofits

Ohio’s Workers’ Comp Group Rating Plans

Recently, various Ohio newspapers addressed the court decision striking down the use of group rating programs to lower workers’ compensation premiums for employers and the claim that the refund of previously paid premiums could be devastating to the program.

As you may recall, a case decided in a Cuyahoga County Common Pleas Court found that the Ohio Bureau of Workers’ Compensation (BWC) had acted improperly several years ago in the methods it employed to assess premiums against State Fund insured employers for Workers’ Compensation insurance. These employers had been excluded from participating in savings groups and generally paid premiums higher than their fellow employers enrolled in groups. Millions of dollars in overpayments are now alleged and the State may be on the hook to reimburse these employers.

This decision could affect over 270,000 businesses in the state resulting in refunds in excess of $860,000,000. Please bear in mind, however, that this decision was rendered by a judge in the Court of Common Pleas. The BWC has already indicated that it will appeal and there are two levels of appeal where the decision will be challenged. The Court of Appeals for Cuyahoga County will hear the first appeal, while the case will ultimately end up in the Ohio Supreme Court for the final decision. Many experienced employment law attorneys believe that the decision will be upheld and the group rating program will be dismantled.

Even if the decision is upheld, it has been projected that 50% of all companies affected will receive less than $200, while 75% will receive less than $1,000 in refunds. This decision will be challenged over the next several years. Only when the Supreme Court has reached its decision will we know the amount and

scope of the restitution, if at all. In summary, please be patient because the battle has only begun.

But, you should take action now to get your current workers’ compensation claims under control because it is anticipated that employers will no longer enjoy substantially reduced premiums as the group rating program is modified or extinguished by the State and premiums increase substantially.
