HELD ON TUESDAY, NOVEMBER 1, 2016, IN THE BOARD ROOM OF THE
HISTORIC COURTHOUSE, SALUDA, VIRGINIA:

CALL TO ORDER
Mr. Miller called the meeting to order at 3:00 p.m. and led the group in prayer. Mr. Walker led in the Pledge of Allegiance.
CONSENT AGENDA
Mr. Miller noted that with the consent of the Board, the Agenda would be amended to add an additional closed session item to discuss land disposition and comments by Mr. LeBoeuf after action on the Capital Improvement Plan. The motion to approve the Consent Agenda as amended was made by Mr. LeBoeuf seconded by Mr. Jessie and carried unanimously. The Consent Agenda included approval of minutes from the October 4th Board meeting; disbursements dated October 17, numbers 84569-84661 for $285,056.96, dated October 19, number 84662 for $41.29, and dated November 1, numbers 84663-84732 for $320,430.86, and payroll dated October 15, numbers 84526-84556 for $357,465.50.
PUBLIC COMMENT
Monica Sanders expressed her opposition to voting for Hillary Clinton in the presidential election.
Hal Muller expressed his dissatisfaction with representation by Mr. Mansfield, noting that Mr. Mansfield has left several meetings early and was not in attendance at today's meeting.
Mr. Miller announced that Mr. Mansfield was recovering from surgery and hoped to be back with the board soon.

CONSTITUTIONAL OFFICERS
Sheriff Bushey informed the Board that his department had purchased two drones and Middlesex was one of only two counties in the State to currently participate in the State's drone program (York County is the other). The drones can be used for law enforcement and emergency services for damage assessment. The program requires adoption of local policies and piloting by a licensed pilot. The drones will be insured under the county's property insurance, however, an additional liability policy is required. The motion to purchase of the additional liability policy for the drones was made by Mr. LeBoeuf, seconded by Mr. Jessie and carried unanimously.
AGENCY AND STAFF REPORTS
VDOT:
Ron Peaks, Assistant Resident Administrator, updated the Board on current VDOT projects. Mr. Peaks commented that he would work with the Cedar Pointe Subdivision Homeowner Association on their request for reduced speed limits in their area. A speed study would be required.
Mr. Miller thanked VDOT for fixing the ditch issue at NoHead Bottom.
Schools:
Dr. Gretz was present to represent the School system.
The motion to approve adjustments to the 2016 IDEA 611 Part B Special Education Award and approve appropriation of funds for a 2016/17 School Security Equipment Grant for the High School and Middlesex was made by Mr. LeBoeuf, seconded by Mr. Jessie and carried unanimously:

Adjustments to 2016 IDEA 611 Part B Special Education Award
Planning District Commission
Trudy Feigum, citizen representative on the Planning District Commission (PDC), presented her report from the October 26 meeting of the PDC, which featured the Director for the Central Regional Office of the Virginia Department of Social Services (DSS), who oversees activities for Middlesex County and other Middle Peninsula counties. DSS is encouraging on-line filing for services; walk-in filing

requires 45-60 minutes of staff assistance and there is currently a need for one or more "lobby navigators" to assist with processing. According to 2014 data, 26% of the county is living in proverty. DSS needs in the Middle Peninsula include affordable housing, economic development/jobs, transportation, adult care and assisted living facilities.
The Middle Peninsula Public Access Master Plan is posted and available for public comment. According to the Virginia Department of Environmental Quality Stormwater Fee Advisory group, the revenues from Stormwater fees are "extremely short" compared to what was anticipated - in the range of $2 billion short.

Appointments:
The motion to appoint the following as representatives of the Board of Equalization was made by Mr. Jessie, seconded by Mr. LeBoeuf and carried unanimously: Ray Kostesky, Saluda District, May Lou Ebinger, Jamaica District, and Frank Johnson, Pinetop District.
Compensation Study:
Mrs. Jones reported that 10 companies submitted proposals to perform a compensation and job classification study that would include employees from county government, school board, social services and the sheriff's department. The selection committee narrowed the choices to three companies which were interviewed by Marcia Jones, Peter Gretz, Rebecca Morgan and Garth Wheeler. The firm of Springstead Incorporated has been recommended to perform the work, for a contract price of $33,250.00. The motion to contract with Springstead was made by Mr. LeBoeuf, seconded by Mr. Holt and carried unanimously.

County Administrator Update:
Oyster Grounds:
Mr. Walker reported that with oyster grounds open, watermen were now off-loading their catches at the State-owned dock at the end of Lovers Lane and also at the County dock at the end of Timberneck Road.
Cooks Corner Water Project:
Plans for a 30,000 gallon storage tank for fire protection on the Cooks Corner properties is being held until the feasibility study is completed, as the location for the tank may change. Plans for Phase II of the Cooks Corner Water System are in the draft stage.
Whitings Creek
Mr. Miller noted that VDOT needed to improve the ramp at the Whitings Creek Dock for watermen using this facility. The entrance to the creek is also filling in and is in need of dredging. Mr. Walker suggested doing a Joint Permit Application for work on a parking lot project and dredging.
OLD/NEW BUSINESS
Board members were reminded of the Veterans Day Celebration and dedication of the new flag pole scheduled for November 11, 2016, at 11:00 a.m., on the grounds of the Historic Courthouse.
SUPERVISORS COMMENTS AND REPORTS
Board members reported on meetings attended since the last meeting.
CLOSED MEETING
The motion to convene in a Closed Meeting pursuant to the following - §2.2-3711.A1, personnel involving the county attorney; §2.2-3711.A3, discussion or consideration of the disposition of publicly held property, was made by Mr. LeBoeuf, seconded by Mr. Jessie and carried unanimously.
The meeting returned to open session. The motion to certify the following statement was made by Mr. Jessie, seconded by Mr. Holt and carried unanimously:
To the best of the members' knowledge, only public business matters lawfully exempted in the motion by which the closed session was called were considered or discussed in the closed session.

The motion to have staff engage for a property survey of the properties at Cooks Corner was made by Mr. LeBoeuf, seconded by Mr. Jessie and carried unanimously.
The motion to employ Heather Wilson Lewis as the County Attorney effective December 1, 2016, and consistent with a contract between her and the County that the chairman will sign, was made by Mr. Holt, seconded by Mr. Jessie and carried unanimously.
RECESS AND RECONVENE
The meeting recessed and then reconvened at 7:00 p.m. for the evening.
PUBLIC HEARINGS
Special Exception 2016-03
Dave Kretz, Interim Planning Director, presented this application for approval to construct a utility barn on an adjoining lot immediately across a right-of-way from the lot containing a principal building in the Residential Zoning District. The principal building is located at Tax Map 45-7-H-8, 37 Birch Tree Trace in Deltaville, with the vacant lot at 45-7-H-9. Approval requires compliance with zoning ordinance requirements found in Section 15-24.1-6, which includes recording a deed covenant that the lots be sold or transferred together, or recording of a memorandum of understanding stipulating that the accessory structure shall be removed from the adjoining lot if only one of the lots is sold. Mr. Kretz explained that this was the only condition that is currently not fulfilled. Conditional approval was recommended by the Planning Commission.
Mr. Miller opened the hearing for comments from the public. There being no comments, the public portion of the hearing was closed. The motion to approve the application as recommended and with the following conditions was made by Mr. Holt, seconded by Mr. Jessie and carried unanimously:
1. The use shall meet the criteria of Section 15-24 and any other zoning or building code requirements, and
2. The submitted memorandum of understanding shall be legally recorded prior to the issuance of any Zoning or Building Permit for the proposed utility barn.
Capital Improvement Plan
Mr. Kretz presented the proposed Capital Improvement Plan for FY 2017-2021 that has been prepared by the Planning Commission. The Board and public were reminded that this was only a plan, and should not be a taken as approval for any projects.
Mr. Miller opened the hearing for comments from the public. Robert Jackson questioned why the wastewater collection system is only being proposed for the Deltaville area and asked that the Route 17 corridor be considered. Mr. Jackson also

voiced his opposition to lighting at the Syd Thrift Complex, and questioned if funded, is the Board putting sports ahead of education.
There being no further comments, the public portion of the hearing was closed. Mr. Walker noted that a public water system was not on the plan because there are no dollar figures available yet. He did however add that this will probably be part of budget discussions for the FY 18 budget. Mr. LeBoeuf noted that the Capital Facilities Inventory was not included as Appendix B.
The motion to approve the Capital Improvement Plan for 2017-2021 was made by Mr. LeBoeuf, seconded by Mr. Jessie and carried unanimously.
Mr. LeBoeuf's Comments:
Mr. LeBoeuf explained a proposed tool developed to correlate capital improvement projects to the budget. This tool will plot principal and debt service and allow the Board to estimate how much money will be needed per year to fund capital projects and to see what the tax rate will need to be to pay for them. With interest rates at their lowest, Mr. LeBoeuf noted that the time may never be better to start a lot of these projects.
PUBLIC COMMENT
Ed Robins questioned what the driving factor for the Board to bring water to Deltaville is, if the citizens of Deltaville do not seem to want it, as evidenced by the low turnout of subscribers. Who does the Board hope to attract to build the tax base and if water and sewer is installed, how long do you expect it to take to break even on the expense? Mr. Robins also expressed his support in keeping the boat tax.

There being no further business, the meeting was adjourned until the regular meeting scheduled for December 6, 2016, at 3:00 p.m. This motion was made by Mr. LeBoeuf, seconded by Mr. Jessie and carried unanimously.

SUBJECT: Oyster Festival Ordinance
The Town of Urbanna has asked that the County consider
renewing its Oyster Festival Ordinance, which authorizes the Town of
Urbanna to apply its Master Plan to certain portions of Middlesex County
during Oyster Festival weekend. The previous ordinance was in effect for the
2011 - 2016 Festivals.
A public hearing would be required to consider adoption of the
attached ordinance.

ORDINANCE OF THE COUNTY OF MIDDLESEX AUTHORIZING THE TOWN OF
URBANNA TO APPLY ITS MASTER PLAN TO CERTAIN PORTIONS OF MIDDLESEX
COUNTY DURING OYSTER FESTIVAL WEEKEND
BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF MIDDLESEX COUNTY,
VIRGINIA THAT THE FOLLOWING ORDINANCE IS HEREBY ADOPTED:
Section 1 Intent
It is the intent of the Board of Supervisors of Middlesex County to provide a healthy and
safe environment for patrons and visitors at the Urbanna Oyster Festival.
Section 2 Area
It is hereby determined and ordained that the Urbanna Oyster Festival Master Plan
(Town’s Master Plan) shall apply to the following areas of Middlesex County:
From the boundary of the Town of Urbanna west along State Route 602 to State Route 684;
From the boundary of the Town of Urbanna south along State Route 227 to its intersection with Ivy Shore Road;
Town Bridge Road to headwaters of Urbanna Creek; and Those areas behind Middlesex Volunteer Fire Department (which involve
State Routes 1010, 1023, 1024 and Laurel Hill Drive)
Section 3 Application
Middlesex County landowners in the stated “Area” are governed by the “Policies” of the
Town’s Master Plan as follows:
1. Landowners selling their own goods:
Non-food – must comply with the Town’s Master Plan policies and procedures,
including making application and Service Mark compliance. All Town and
Foundation fees are waived for landowners.
Food – same as above, including compliance with Health Department temporary
restaurant permitting procedures. Landowners must pay related Health Department
fee(s).

2. Landowners leasing space to non-owner vendors, with or without compensation – vendors must comply with Town’s Master Plan policies and procedures, including
payment of all Town, Foundation and Health Department fees.
Section 4 Duration
This ordinance shall be in affect during the 2017 through 2021 Urbanna Oyster Festivals
from 8:30 a.m. on Friday until 6:00 p.m. on Saturday.
Section 5 Exclusions
Provisions of this ordinance do not apply to parking.
Section 6 Enforcement
This ordinance may be enforced by the Town or County Sheriff or deputies, State Police
or any authorized official of the Oyster Festival.
Section 7 Violation
A violation of this ordinance shall be a class III misdemeanor and shall be punishable by
a fine of up to Five Hundred Dollars ($500.00). Each day’s violation shall constitute a separate
offense.
Section 8 Severability
Should any provision or portion of this ordinance be determined by a court of competent
jurisdiction to be unenforceable or held invalid, such portion or provision shall be deemed a
separate, distinct and independent provision and such holding shall not affect the validity of the
remaining portions hereof.
This ordinance shall be in effect upon adoption.

I testified at the public meeting three or four months ago and offered what is called
Barnhardt Option 2. After the public meeting the two SCC hearing officers called for
Dominion Power to study these two options and required the SCC to delay the hearing by
about 6 months while this study was made.
Dominion Power has historically stated that they were against other methods of crossing
due to the costs, but it would appear that Option 2 should be the less expensive option
(since the power company would not be required to build 8 towers), Option 2 would
simply lay the cable along the river bottom (it would be trenched in). Note: this Option
was used to run power along the bottom of a commercial waterway for about 200 miles
so it must have some economic benefits.
Dominion Power has estimated the cost of this option at 92.3 million, but did not itemize
the costs, and Option 2 included a redundant set of cables which I do not believe was
included in the tower version which is Dominion's pick. Also I believe this is Dominion's
estimation, not the cost for a turnkey estimate by a company that contracts this type work.
I would like to respond to the SCC at the next Board Meeting (December 6th.)

into consideration the two new alternatives.

County Administrator’s Update
1) Middlesex Water Authority
The VDH Planning and Design Grant was awarded to us by the Virginia Department of
Health Office of Drinking Water. This aid will offset the cost of the feasibility study and the
preliminary engineering. These funds are highly competitive due to the significant number
of applicants and therefore staff are very pleased to have this welcomed news. Staff have also
completed submission for an additional planning grant through the USDA Rural
Development program and we have been preliminarily notified that it is likely to be awarded
pending the federal FY17 funding allocation. It appears very likely that the County and
MWA will be able to partner with the USDA on design and construction funding for the
potential project. Again the USDA Rural Development program currently has 40 year loan
interest rates as low as 1.375%. If obtained, this could be a great opportunity for the
Authority and the County to deploy much needed infrastructure at an amazing rate not likely
to be equaled in the years to come.
2) Board of Equalization/ Regional Reassessment
The selection of a Board of Equalization (BOE) has been completed and those recommended
will be forwarded to Judge Shaw for appointment. Wampler-Eanes has completed property
owner meetings for appeals of the reassessment and has completed conferences with
individual property owners. The firm has met with approximately 150 property owners and
thus far 18 property owners have requested a hearing with the Board of Equalization which
will be empanelled in January. We have preliminarily scheduled Virginia Tax Department
training for our equalization board for January 5th
or 6th
and are awaiting finalization from the
state on the specifics. We have also offered this training to the surrounding counties for those
interested in attending.

On a related matter Steve Wampler has identified 92 parcels which indicate new construction
that has not been completely assessed and will require site revisit. I have instructed him to
complete this additional work @ $20/parcel ($1,840) in order to have as up to date and
accurate reassessment practicable.
3) Jackson Creek Dredging
The VMRC have approved our modification permit for dredging -9 feet and staff have
finalized the agreement with Docks of the Bay. We have issued a notice to proceed Docks on
the Bay to mobilized and begin work on December 15th
and to be completed within 45 days.
Staff will continue to update the Board as the project moved forward.
4) Broadband Authority
The Broadband Authority did not meet in November and our next meeting is on January 18th
2017. Staff continue to work with the Commonwealth of Virginia’s Center for Innovative
Technology (CIT) to develop a citizen broadband survey and identify local assets and current
coverage in order to identify and prioritize the county’s needs and goals, develop a strategic
broadband plan and define requirements for establishing partnerships with the private sector.
It is staff’s desire to have this work completed in January.
5) Middle Peninsula Chesapeake Bay Public Access Authority, (MPCBPAA) - David
Kretz
Public Access Authority: There was no meeting scheduled for November. The next meeting
is tentatively scheduled for December 9.
Public Access Meetings: The seven (7) site specific neighborhood meetings along with the
general public meeting that were facilitated by Doug Diedrichsen have concluded.
Attendance for the most part has been good with the majority of the attendees being either
directly adjoining or within close proximity along the waterway of the site being discussed.
Attendance from the general public that would travel to these sites for use could be
categorized as fair.
Many of the concerns relayed by property owners adjoining the sites were common to several
of the sites. Concerns voiced include, but are not limited to, tresspass on to adjoining
property and confrontation with adjoining property owners; unacceptable or criminal
behavior (especially during off or night time hours); parking issues; lack of law enforcement
intervention and general lack of management; trash and overcrowding at certain times; to
name a few. Many of the residents attending the meeting for Paradise Lane mimicked these
concerns as fears in the event that the site is developed for public use. Additionally, residents
seemed to be generally opposed to the addition of boat traffic on Jackson Creek.
Attendees that participated in several meetings, who support public access, agreed with
adjoining property owners in that the access sites lacked proper management but still felt
strongly that public access sites should not be closed.

6) Cooks Corner Water Project
Bill Rosenbaum and I have requested a meeting with the VDH ODW for submission of the
final piping plan for phase two of the project. We are waiting to receive confirmation on a
meeting date. Staff would like to hold this meeting with the Office of Drinking Water staff
to discuss the project and insure understanding of our project.
7) Rappahannock Community College, Board of Directors
The Board met in November at the Warsaw Campus, but I was unable to attend due other
commitments.
