    The following Mine Rescue & Recovery plan is hereby submitted inaccordance with The Act section 103 (K) & West Virginia Mine Lawsection 22-A-1-35.(Mine Rescue Teams)

    This mine rescue plan is by design in accordance with standardindustry accepted practices as referred in the M.S.H.A. InstructorsGuide # 3028 (Formerly IG7) Mine Rescue Team Training for CoalMines as required by 30cfr part 49.The mine rescue teams are certified, properly trained and fullyequipped.

    The mine rescue plan will be executed in the following manner:1. The first Priority will be the safety of the mine rescue teams.2. The second priority of the mine rescue will be the rescue of

    survivors.3. Initial Constituent Readings will be taken from all mine openings.4. Exploration will begin in the contaminant entry.5. Bare faced exploration will be in all areas with 19.5 % Oxygen or

    greater & less than 50 PPM CO.6. A 100% safety factor will be maintained concerning explosive

    gases.a. CO will be less than 6.25% by volume.

    b. CH4 will be less than 2.5% with no CO.c. CH4 will be less than 1. % with CO present below 6.25%.

    Note: The team and or teams will withdraw from the mine upondetermining that the safety factor is < 100% of the stated constituentvalues as stated above.

    7. A fresh Air Base will be established prior to the point of less than19.5 % O2.

    8. For each mine rescue team underground there will be one teamon surface as a back up. For each mine rescue team inby the fresh airbase there will be one mine rescue team on standby at the fresh airbase.

    9. Communications will be maintained at all times between theteams and the command center.

    10. Exploration in smoke will only be done while on a life line that isconnected to a fix point in visually clear air i.e.; the fresh air base.

    11. No changes will be made to the ventilating circuit in the mine.

    12. No ventilation circuit will be made to course through an unexploredarea of the mine.

    13. The command center may at its discretion authorize changes inthe ventilation circuit without endangering the team and orunaccounted for miners.

    14. The mine rescue exploration will look for survivors & will continueexploring as long as it can be done safely in accordance withaccepted industry practices and principles as referenced in theM.S.H.A. Instructors Guide # 3028 (Formerly IG7) Mine Rescue TeamTraining for Coal Mines as required by 30cfr part 49.

    This mine rescue is the sole responsibility of the mine operator andtime is of the essence .Due to that fact the approving agencies are toexpedite the approval of this plan to ensure the rescue of thesurvivors.
