In their ubmiion, !uno and Mendoa aid the Supreme Court ha already de$ided on the $ontitutionality of the Minin* &$t in the landmar /a u*al#laan . %amo $ae in 200, a de$iion penned by former Chief Juti$e &rtemio !an*aniban. C"M! oined it member repondent in ain* that the petition filed by former %ep. %ia ontiero and other in Mar$h 2004 a*aint Se$tion 40 and 41 of %epubli$ &$t 592, or the Minin* &$t, be dimied. It further ar*ued that in$e the /a u*al rulin* ## the lon*et in Supreme Court hitory whi$h too i6 year for the hi*h tribunal to deliberate on ## there ha been no material $han*e in the $ir$umtan$e of the !hilippine minin* indutry. 78here i no $ompellin* reaon for the hi*h tribunal to abandon it preiou rulin*. 8o hae the Supreme Court reiit it rulin* o oon after it de$iion be$ame final in 200-, will definitely hae inetor $onfiden$e and detabilie a $riti$ally needed indutry.
