ELECTRICITY DISTRIBUTION COMPANY BY PERUSAHAAN PERSEROAN

(LIABILITY COMPANY) PT PERUSAHAAN LISTRIK NEGARA

BY THE GRACE OF GOD ALMIGHTY

MINISTER OF ENERGY AND MINERAL RESOURCES OF

REPUBLIC OF INDONESIA,

Considering : a. that in order to improve services the supply

of electricity to consumers and the ease

of doing business as well as in the framework

of the certification of the installation

of the use of electric power low voltage,

necessary to improve the provision of the

quality of services and costs associated

with the distribution of electricity as

stipulated in the Regulation of the Minister

of Energy and Mineral Resources Number 33

of 2014 on level of Service Quality and

Cost Associated With Electricity Distribution

By Perusahaan Perseroan (Liability Company) PT.

Perusahaan Listrik Negara;

b. Based on the considerations as referred to

in paragraph a, it is necessary to stipulate

Regulation of the Minister of Energy and

Mineral Resources of the Amendment to the

Regulation of the Minister of Energy and

Mineral Resources Number 33 of 2014 on the

level of service quality and Cost Associated

With Distribution of Electric Power By

Perusahaan Perseroan (Liability Company) PT

Perusahaan Listrik Negara;

In view of : 1. Law Number 8 of 1999 on Consumer Protection

DECIDED:

Stipulated : REGULATION OF THE MINISTER OF ENERGY AND MINERAL

RESOURCES ON AMENDMENT TO THE REGULATION OF MINISTER

OF ENERGY AND MINERAL RESOURCES NUMBER 33 OF

2014 ON THE LEVEL OF QUALITY OF SERVICE AND COSTS

ASSOCIATED WITH ELECTRICITY DISTRIBUTION OF

PERUSAHAAN PERSEROAN (LIABILITY COMPANY) PT

PERUSAHAAN LISTRIK NEGARA.

Article I

Several provisions in Regulation of the Minister

of Energy and Mineral Resources Number33 of

2014 on the level of service quality and Cost

Associated With Distribution of Electric Power

By Perusahaan Perseroan (Liability Company) PT

Perusahaan Listrik Negara (Official Gazette of

the Republic of Indonesia of 2014 Number 1790),

is amended as following:

1. The provisions of item 9 of Article 1

changed and between number 7 and number 8

is inserted 1 (one) number which is a number

7a, therefore Article 1 shall be read as

follows:

Article 1

1. Consumer is any person or entity who

purchase electricity from Perusahaan


Listrik Negara.

2. Electricity Regular rates is electricity

rates provided by Perusahaan Perseroan

(Liability Company) PT Perusahaan Listrik

Negara which is paid after the use of

electricity by consumers.

3. Prepaid electricity tariffs is prepaid

electricity tariffs provided by Perusahaan


Listrik Negara paid prior to use of

electricity by consumers.

4. The connection fee is a fee paid by

consumers to obtain the connection

power or additional power.

5. Subscriptions Security Electricity is

a Security in the form of cash or

bank Security issued by national banks

on the power consumption and energy

into electricity for consumers.

6. Exposure power is power that is calculated

proportionately and professionally by

limiting instrument or Ability Conductivity

Flow (KHA) a conductor that is used

by power users who are caught at the

time of Controlling Power Consumption

implemented.

7. Connected power is power that is

agreed between Perusahaan Perseroan

Negara with Consumers who poured in a

power purchase agreement.

7a. Certification costs Eligible Operation

hereinafter referred to as SLO costs

are costs incurred by the consumer in

the implementation of the certification

of the installation of low-voltage

electric power utilization.

8. Minister is the minister who held

government affairs in the field of

electricity.

9. The Director General is the director

general who has the task of organizing

the formulation and implementation of

policies in the field of development,

exploitation, engineering, working safety,

and the environment in the electricity

sector.

2. Between Article 3 and Article 4, 1 (one)

article, namely Article 3A, which reads as

follows:

Article 3A

(1) The amount of the level of service

quality of power for the new connection

service speed indicator of low voltage

as defined in Article 2 letter h,

implemented within a maximum period

of:

a. 5 (five) working days without

network expansion;

b. 15 (fifteen) working days with

network expansion; and

c. 25 (twenty five) working days

with the addition of a transformer.

(2) Conditions period referred to in

paragraph (1), including the implementation

of the certification of the installation

of low-voltage electrical energy utilization

up to the issuance of Certificate of

Eligible Operations.

(3) Under certain conditions, the provision

period referred to in paragraph (1)

may be excluded.

(4) Certain conditions referred to in paragraph

(3), among others:

a. geographical conditions; and

b. the condition of the existing network.

3. The provisions of paragraph (1) of Article

5 are amended and in between paragraphs

(1) and (2) inserted 3 (three) paragraph

namely paragraph (la), paragraph (lb) and

(lc) as well as paragraph (2) plus 1 (a)

paragraph, namely paragraph (3), so that

Article 5 reads as follows:

Article 5

(1) Perusahaan Persero (Liability Company) PT

Perusahaan Listrik Negara obliged to

provide a reduction in electricity

bills to consumers if the realization

of electric power service quality

levels exceed 10% (ten percent) on the

amount of the quality of services regulated

electricity, for the indicators:

a. long interruption;

b. the amount of interference;

c. speed of service low-voltage power

changes;

d. kWh meter reading error;

e. time error correction account; and/or

f. speed connection service new low

voltage.

(1a) Reduction of electricity bills to

consumers as referred to in paragraph

(1) is provided by:

a. 35% (thirty five percent) of the

Account Fees or Minimum Charges

for consumers on group rates charged

by electric power tariff adjustment

[tariff adjustment); or

b. 20% (twenty percent) of the Account

Fees or Minimum Charges for consumers

on group rates are not subject

to adjustment of electricity tariff

(tariff adjustment).

(1b) For electricity consumers on prepaid

electricity tariffs, reduction in the

bill referred to in paragraph (la)

synchronized with the bill reduction

electricity consumers in the electricity

tariff Connected regular with the same

power.

(1c) Reduction of the bill referred to in

paragraph (la) and (lb) calculated on

electricity bills or purchase prepaid

electricity tokens in the next month.

Perusahaan Listrik Negara shall periodically

report on the realization of the

quality of services and the implementation

of the reduction of electric power

electricity bill every quarter in

writing to the Director-General no

later than thirty (30) calendar days

after the end of the quarter.

(3) The data source reporting the realization

of the quality of services of electricity

referred to in paragraph (2) using

the measurement and reporting application

Article 7


Perusahaan Listrik Negara exempted from

the obligation to provide a reduction

in electricity bills to consumers as

referred to in Article 5 paragraph

(la) in case of force majeure reasons.

(2) Because force majeure as referred to

in paragraph (1) an ability causes

beyond the control of Perusahaan Perseroan


Negara include general chaos, riots,

sabotage, riots, violent demonstrations,

strikes, fires, floods, landslides,

earthquakes, due to accidents, natural

disasters, or command authorities.


11 is amended so that Article 11 shall be

read as follows:

Article 11

(1) Consumers with Electricity Rates Regular

imposed Power Security Subscription.

(2) Subscriptions Security electric power

as referred to in paragraph (1) is

set at or worth the expense accounts

of the national average of 1 (one)

month according group rate paid /

delivered no later than 1 (one) month

after the new grafting or change of

power.

(3) Subscriptions Security electric power

as referred to in paragraph (2), may

take the form of bank Securities for:

a. low voltage consumers, namely:

1. group rates for the purposes

of midsize businesses with

the power of 6,600 VA to

200 kVA; and

2. group rates for industrial

purposes is being supplied

with power above 14 kVA up

to 200 kVA.

b. medium voltage consumers; and

c. high voltage consumers.

(4) Electricity Power Security Subscriptions

Management as referred to in paragraph

(1) shall be improved continuously in

the interest of consumers and Limited

Liability Company (Liability Company)

PT Perusahaan Listrik Negara.

(5) Directors of the Company (Liability

Company) PT Perusahaan Listrik Negara

can assign lower Electricity Power Security

Subscription than the provisions as

referred to in paragraph (2) by reason

that could accounted for.

(6) Consumers who terminate the Electricity

Power Purchase Agreement, or switch to

Power Prepaid Rates, Electricity Power

Subscription Security returned to the

consumer after deduction of electricity

bills and all debts to Perusahaan


Listrik Negara which has not been

repaid.

(7) Further provisions on the implementation

of Electricity Power Subscription Security

set by the Board of Directors of

Perusahaan Perseroan (Liability Company)

PT Perusahaan Listrik Negara.

6. Between Chapter IV and Chapter V, 1 (one)

chapter namely Chapter IVA, which shall be

read as follows:

CHAPTER IVA

USAGE INSTALLATION CERTIFICATION COST OF

LOW-VOLTAGE POWER CONSUMER

Article 16A

(1) Installation of low-voltage electric

power utilization required to have a

Certificate of Eligible Operations

prior to the connection of electricity

by Perusahaan Perseroan (Liability

Company) PT Perusahaan Listrik Negara.

(2) To obtain the Certificate of Eligible

operations referred to in paragraph

(1), subject to SLO fee with the amount

as stated in Attachment II which is

an integral part hereto.

Article 16B

(1) SLO fees paid to the following provisions:

a. perform jointly with payment

of the new connection fees;

b. performed jointly with payment

with the electric power addition

cost, as long as there are changes

in power installations; or

c. performed after receiving notification

from Perusahaan Perseroan (Liability

Company) PT Perusahaan Listrik

Negara for recertification of the

Certificate of Eligible Operations

that have expired.

(2) SLO costs referred to in paragraph (1)

may be paid to Perusahaan Perseroan

(Liability Company) PT Perusahaan

Listrik Negara through one (1) door

service.

(3) In addition to through one (1) doors

services payment as referred to in

paragraph (2), SLO fee can be paid

directly to the Low Voltage Technical

Inspection Agency.

Article 16C

Board of Directors of Perusahaan Persero


Negara further regulate service provision

of 1 (one) door and ordinances SLO fee

forwarding paid to the Technical Inspection

Agency of Low Voltage.

7. The provisions of Annex I is converted into

as listed in Annex I which is an integral

part hereto.

Article II

(1) The provisions referred to in Article 5

come into effect on January 1, 2017.

(2) This Regulation comes into force on the

date of promulgation.

For public cognizance, this Ministerial Regulation

shall be promulgated in the State Gazette of

the Republic of Indonesia.
