MINUTES OF A REGULAR MEETING OF THE RUTHERFORD BOARD OF EDUCATION NOVEMBER 12, 2007 A regular meeting of the Board of Education was held on Monday evening, November 12, 2007 in the High School Cafeteria. Meeting was called to order by President Casadonte at 7:35 P.M. with the Pledge of Allegiance to the Flag. On roll call the following members were present: Mrs. Ahmed, Mr. Casadonte, Mrs. Cevasco, Mr. Jasko, Mrs. Jones, Mr. McLean, Mr. Novosielski, and Mrs. Williams. Dr. Fiume was absent for the entire meeting. Also present were Ms. O’Keefe and Mr. Brown. N.J. OPEN PUBLIC MEETINGS LAW The New Jersey Open Public Meetings Law was enacted to ensure the right of the public to have advance notice of and to attend the meeting of public bodies at which any business affecting their interests is discussed or acted upon. In accordance with the provisions of this Act, the Rutherford Board of Education has caused notice of this meeting to be published by having the date, time and place thereof posted on the bulletin board outside the Borough Clerk's Office, mailed to the News Leader, Herald, South Bergenite, and the Record newspapers, and filed with the Borough Clerk. TAPING AND BROADCASTING OF MEETINGS As approved by the Rutherford Board of Education, we are taping and broadcasting our worksessions and regular meetings. These meetings will be broadcast without editing during a two-hour time segment on Tuesday evenings at 8:00 PM on the Comcast public access channel. At the conclusion of the two-hour segment, the broadcast will end regardless of what part of the meeting is currently being viewed due to the Comcast time constraint. Any member of the public who wishes to view the two-hour tape should make a written request to the Board Secretary who will have a copy of the tape made available within two weeks of the request. There will be a nominal fee charged for this tape reproduction. We welcome comments from residents viewing the broadcast. MINUTES APPROVAL 1. Resolution by Mr. Novosielski, seconded by Mrs. Cevasco. RUTHERFORD BOARD OF EDUCATION NOVEMBER 12, 2007

A regular meeting of the Board of Education was held on Monday evening, November 12, 2007 in the High School Cafeteria. the following school goals and objectives for the 2007-2008 school year: Rutherford High School Objective #1 - By June 2008, 94% of Rutherford High School students will demonstrate an increased proficiency in mathematics and language arts by achieving a level of proficient or advanced proficient on the High School Proficiency Assessment (HSPA). Objective #2 - By June 2008, graduating seniors will demonstrate an increased understanding and demonstration of citizenship within the school and community as measured by:

Objective #2 - By June 2008, 90% of general education students in grades four through eight will demonstrate proficiency in mathematics by achieving a level of proficient or advanced proficient on the NJASK. Objective #3 - By June 2008, 50% of special education students will demonstrate individualized improvement by achieving a level of proficiency or an increased scale score in the NJASK in language arts literacy and math. Union School Objective #1 - By June 2008, on the NJASK 8 Mathematics, 20% of the students will achieve Advanced Proficient level. Objective #2 - By June 2008, on the NJASK 8 Language Arts Test, 12% of the students will achieve at the Advanced Proficient level. Objective #3 - By June 2008, the 6-8 Special Education Subgroup scores on the Mathematics and Language Arts NJASK, will improve 10% to keep us at safe harbor status. Lincoln School Objective #1 - Over the last three years, the grade 3 results for the “Geometry & Measurement” section of the NJASK has decreased for “All Students”. For the 2007-2008 school year, our goal will be to improve our score in the “Geometry & Measurement” section of NJASK. We want to attain a score, which is one point higher (5.5) than the 4.5 points earned this past school year. In case the number of questions changes from the current 8, we are looking to score at least a 69. Objective #2 - By June 2008, the percentage of points earned for “Writing: Content, Development and Language Conventions” on the 2nd grade NJ Pass will increase by 5 percentage points. Objective #3 - Develop a school wide writing program with specific benchmarks for each grade level. A portfolio would be created and maintained for each child. The individual student portfolio would be passed on with the student from grade level to grade level and eventually on with him/her to Union School. This writing program will be designed to serve as a growth model for students within their grade level as well as over their range of grades at Washington School. It will be developed by a committee in the fall of 2007 for implementation over the 2007-2008 and 2008-2009 school years.

BE IT FURTHER RESOLVED that the Board of Education acknowledges the audit recommendation (1) that all funds received by the district should be deposited on a timely basis.

BE IT STILL FURTHER RESOLVED THAT THE BOARD OF EDUCATION approves the attached Corrective Action Plan for the aforementioned recommendation.

SECY/TREAS. REPORT 4. BE IT RESOLVED BY THE RUTHERFORD BOARD OF EDUCATION that it has received and accepts the financial reports of the Secretary and Treasurer of School

Monies for the month ending August 2007, and September 2007, and certifies that the reports indicate that no major account or fund is overexpended in violation of NJAC 6:20-2.13 and that sufficient funds are available to meet the district's financial obligations for the remainder of the school year.

RELATIONS WITH VENDORS The board of education wishes to maintain good working relations with vendors who supply materials and services to the school system. Constructive efforts by the administration to seek the advice and counsel of vendors about how to improve such relationships are encouraged. In the schools, vendors shall be seen by appointment only. Vendors who call upon a school shall be governed by policy #1250. Teachers or supervisors of instruction who have invited vendors to call should notify the principal's office in advance so that proper courtesies may be extended. No agents, canvassers, or vendors shall have access to teachers during their classes. Mentoring Novice Teachers In order to enhance student achievement of the Core Curriculum Content Standards by Enhancing the skills of inexperienced teachers, identifying exemplary teaching skills and practices necessary for excellent teaching and assist novice teachers in adjusting to the challenges of teaching, the board shall ensure the development of a mentoring plan for all novice teachers employed in the district, and an individual professional improvement plan (PIP) within 60 days of the board’s approval of the teacher’s employment contract. The plan shall provide each novice teacher with in-person contact with a mentor teacher (who may be a retired teacher or administrator) who shall provide confidential support and guidance to the novice teacher. The plan shall be developed by the local Professional Development Committee, approved by the board, and aligned with the professional standards for teachers as set forth in administrative code. Included in the plan shall be criteria for selection and training of mentor teachers. Implementation of the district mentor plan shall be in compliance with the administrative code and included in the Quality Assurance Annual Report. The board shall annually submit a report with required data to the State Department of Education on the effectiveness of the local mentoring plan. In order to protect the pupils and staff in the district schools, all regulations of the state department of education, the state department of health and the local board of health shall be scrupulously observed, particularly those dealing with contagious/infectious diseases. Staff who have been identified as having a communicable disease shall not be permitted continued employment unless they qualify under the above agencies' rules pertaining to periods of incubation, communicability, quarantine and reporting. Teachers who are absent for more than ten consecutive days are required to provide medical documentation stating the reason for the absence and the anticipated date of return. Such teachers will be required to request a leave of absence until the designated return date. Teachers who are absent due to illness on the day prior to or immediately after a school holiday may be required to provide medical documentation stating the reason for the absence. When required examinations are performed by a physician designated by the board, the board shall bear the expense. Occupational Containment of Bloodborne Pathogens The board is committed to provide a safe and healthful work environment for staff. EMPLOYEE SUBSTANCE ABUSE

General - All Employees The use of alcoholic beverages in school worksites is prohibited. Violations of this prohibition may subject an employee to disciplinary action which may include but is not limited to nonrenewal, suspension, or termination at the discretion of the board. The unlawful manufacture, distribution, dispensing, possession of, use of or sale of any narcotic drug, hallucinogenic drug, amphetamine, barbiturate, marijuana or any other controlled substance on or in school worksites is prohibited. Any violation may subject an employee to participation in a drug rehabilitation program and disciplinary action including but not limited to nonrenewal, suspension, or termination at the discretion of the board of education. For the purposes of this policy "worksite" shall include any school building, or any school premises and any school-owned vehicles or any other school-approved vehicle used to transport students to and from school or school activities. Worksite also includes off-school property during any school-sponsored or school-approved activity, event or function such as a field trip or athletic event, where students are under the jurisdiction of the school district. The board of education, as a result of criminal convictions of any criminal drug statute violation by an employee occurring outside of the worksite, may discipline said employee. Disciplinary action may include, but is not limited to nonrenewal, suspension, or termination at the discretion of the board. Illegal gambling is not permitted in or on the school worksite.

Smoking by employees in school buildings, in school vehicles or on school grounds is prohibited. The chief school administrator shall establish a drug-free awareness program which includes notice of the dangers of drug abuse in the workplace and available drug counseling programs and shall distribute this policy to all employees annually. New employees shall be provided with a copy of this policy prior to beginning work assignments. Work Performance in Connection with a Federal Grant In order for the school district to qualify for any direct federal grant, the district must certify that it will provide a drug-free workplace and maintain a good faith effort to continue to maintain a drug-free workplace. To this end, employees engaged in school worksites as a result of federal grant moneys shall in addition to complying with requirements of the programs shall also be in strict compliance with this policy. school district. The board of education, as a result of criminal convictions of any criminal drug statute violation by an employee occurring outside of the worksite, may discipline said employee. Disciplinary action may include, but is not limited to nonrenewal, suspension, or termination at the discretion of the board. Illegal gambling is not permitted in or on the school worksite. Smoking by employees in school buildings, in school vehicles or on school grounds is prohibited. The chief school administrator shall establish a drug-free awareness program which includes notice of the dangers of drug abuse in the workplace and available drug counseling programs and shall distribute this policy to all employees annually. New employees shall be provided with a copy of this policy prior to beginning work assignments. Work Performance in Connection with a Federal Grant In order for the school district to qualify for any direct federal grant, the district must certify that it will provide a drug-free workplace and maintain a good faith effort to continue to maintain a drug-free workplace. To this end, employees engaged in school worksites as a result of federal grant moneys shall in addition to complying with requirements of the programs shall also be in strict compliance with this policy. Drug and Alcohol Testing The Rutherford School District is committed to the establishment of a drug and alcohol misuse prevention program among school bus drivers that meets all applicable requirements of the Omnibus Transportation Employee Testing Act of 1991. The purpose of the testing program shall be to help prevent accidents and injuries resulting from the misuse of alcohol and controlled substances by employees performing safety-sensitive functions. In addition to all prohibitions in the first sections of this policy, all employees with commercial drivers' licenses shall be prohibited from:

The use of any controlled substance on or off duty, unless a written prescription from a licensed doctor or osteopath is provided along with a written statement from the doctor or osteopath that the substance does not adversely affect the employee's ability to safely operate a motor vehicle or perform other safety-sensitive functions;

B. The misuse of alcohol that could affect performance on the job including use on the job, use during the four hours before performing a safety-sensitive function, having prohibited concentrations of alcohol in their systems while performing a safety-sensitive function and use during eight hours following an accident.

"Controlled substance" in this policy refers to those covered by the Omnibus Act, including, but not limited to, marijuana, cocaine, opiates, amphetamines and phencyclidine (PCP). All covered applicants and employees shall be subjected to pre-employment or pre-duty, reasonable suspicion, random, post-accident, return-to-duty and follow-up alcohol and drug testing pursuant to procedures set out in the federal regulations. These procedures use an evidential breath testing device for alcohol testing. For controlled substances testing, urine specimen collection and testing by a laboratory certified by the U.S. Department of Health and Human Services shall be required. Pre-employment testing shall be administered to an applicant offered a position in the district prior to the first time the employee performs any safety-sensitive function for the district. An applicant who tests positive will not be hired for any safety-sensitive position. Random alcohol testing shall be limited to the time period surrounding the performance of safety-related functions which includes just before or just after the employee performs the safety-related function. Controlled substances testing may be performed at anytime while the employee is at work. An employee covered by the federal regulations may not refuse to take a required test. Consequences for an employee's refusal shall be the same as for a positive result of the test. If the testing confirms prohibited alcohol concentration levels or the presence of a controlled substance, the employee shall be removed immediately from safety-related functions in accordance with the federal regulations. Before an employee is reinstated, if at all, the employee shall undergo an evaluation by a substance abuse professional, comply with any required rehabilitation and undergo a return-to-duty test with verified test results. The board retains the authority consistent with federal law to discipline or discharge any employee who is an alcoholic or chemically dependent and whose current use of alcohol or drugs affects the employee's qualifications for and performance of the job. The district is not required under federal law requiring drug and alcohol testing to provide rehabilitation, pay for substance abuse treatment or to reinstate the employee. All employment decisions involving reinstatement, termination or dismissal shall be made in accordance with applicable state law, board policies and negotiated agreements. The district shall maintain records in compliance with the federal regulations in a secure location with controlled access. With the employee's consent, the district may obtain any of the information concerning drug and alcohol testing from the employee's previous employer. An employee shall be entitled upon written request to obtain copies of any records pertaining to the employee's use of alcohol or controlled substances including information pertaining to alcohol or drug tests. Statistical records and reports shall be maintained and made available to the Federal Highway Administration for inspection or audit in accordance with federal regulations. Records shall be made available to a subsequent employer upon receipt of a written request from an employee, and only on the expressly authorized terms of the employee. The chief school administrator shall ensure that supervisors receive proper training to administer the drug and alcohol testing program and that employees receive the notifications required by federal regulations. Transportation contracts approved by the board shall contain assurance that the contractor will establish a drug and alcohol testing program that meets the requirements of federal regulations and this policy and will actively enforce the regulations of this policy as well as federal requirements. STAFF DEVELOPMENT; INSERVICE EDUCATION/VISITATIONS/CONFERENCES The board of education recognizes its legal obligation to provide inservice activities to further the ability of the teaching staff to progress toward achievement of district goals and objectives. It is of particular concern to the board that continuing education for teaching staff provide demonstrable contributions toward student achievement of the Core Curriculum Content Standards. The chief school administrator shall develop a comprehensive management system for staff professional improvement and shall assist staff members in the area of professional improvement by providing relevant information regarding workshops, professional meetings and course offerings. To be in compliance with state requirements, each teacher employed in this district as of the effective date specified in code shall complete 100 clock hours of state-approved continuing professional development and/or inservice every five years. It is the individual teacher’s responsibility in accordance with district policies, to assure that the teacher meets the professional development requirement. There is no mandated financial obligation on the part of the district. The 100-hour requirement may be satisfied through a combination of state-approved experiences Including: formal courses and conferences sponsored by colleges, district boards of education, professional associations, training organizations or other entities recommended by the Professional Teaching Standards Board and approved by the Commissioner of Education. Part or all of the 100-hour requirement may be satisfied through an inservice program that has been approved by the County Professional Development Board under standards established by the Commissioner based on the recommendation of the Professional Teaching Standards Board. PLACEMENT ON THE SALARY GUIDE I. In order for an employee to receive a salary increment after July 1 of the following year, 10 month employees

must be hired prior to February 1; 11 and 12 month employees must be hired prior to January 1. II. Professional Requirements for Advancement to the Next Level on the Salary Guide a. A satisfactory administrative rating. b. A bachelor's degree from an approved college is required for the four year training level. 1. In the event of personnel taking advanced degrees under a fully matriculated program from an

approved college or university, it shall be necessary to submit only the initial approval form to the Superintendent. The form should state the program.

2. Undergraduate courses may be substituted for graduate courses in cases of additional certification,

preparation for advanced degree, etc. when such have been approved by the Superintendent. c. Formal courses taken at approved professional institutions must be approved in advance by the Principal

and Superintendent on the form provided. They must relate to the teacher's field, be desirable for the background of the teacher, or be required to complete a degree.

d. In case of non-approval of the selection of a course, the teacher may request a conference with the

Principal, Superintendent, and, if necessary, the Board of Education. e. Credit for courses shall be validated by an official transcript. f. No teacher may be excused from any required school duties more than once a week to pursue college

courses. III. Professional Requirements for Receiving an Increment a. A satisfactory administrative rating. b. A teacher must accumulate three (3) in-service credits every three (3) years. In-service credits can be

either academic or non-academic.

"Academic" shall be defined as approved college courses, and shall be rated as one in-service credit for each college point. These can be used for both vertical and horizontal movement on the salary guide. Non-academic in-service credits can be used for vertical movement only on the salary guide.

c. The requirements for in-service credit shall terminate at age 55 or the attainment of MA + 30 on the salary guide.

d. In-service Credit: 1. One point credit for 30 hours work and/or one point for each college point. 2. No credit for work done during school hours. 3. No credit for work when extra compensation is paid by the Board for that work. 4. There shall be a maximum of two in-service credits per year for any non-academic activity. 5. In order to insure a credit in any activity for in-service work, a teacher must receive the approval of

the Superintendent before the activity is undertaken. 6. Activities for which in-service credit may be earned: i. Participation on Administrative Committees: Credit shall be granted for participation on

administrative committees. This recognition shall be based on (1) regular attendance except when excused by sponsor; (2) research resulting in definite contributions to educational advancement. In cases where the Superintendent has committees working on curriculum, T & E, etc., when no stipends are paid, credit will be granted for time put in after regular school hours. This does not, however, pertain to Monday which is specifically set aside for school related activities.

Similar procedures and recognition shall apply to work on a county, state, or national basis when approved by the Superintendent.

ii. Taking In-Service Courses: One point credit will be given for every 30 hours work. Tuition and expense reimbursement are not to be considered salary or stipend. Summer

activities under the above will also receive credit. iii. Travel: Credit for travel must be approved prior to such travel and must be evaluated in terms

of the relationship to the teacher's teaching field. Each teacher desiring credit under this classification must submit, within two months of his or her return, a written report describing the trip and indicating its value to him or her in his or her particular field.

Credit for domestic or foreign travel will be granted only when the trip consists of at least four

weeks of consecutive travel. One credit may be granted for domestic or foreign travel consisting of six consecutive weeks.

iv. Supervision of Student Teaching: Not more than one in-service credit may be granted for

supervision of a senior student teacher. This may be used only once during a three year period. For those not having a student teacher full time, pro rata credit may be given. Junior Practicum supervision will be credited on a pro rata basis of one/fifth credit. No more than two junior practicum students may be credited during any three year period.

For a full year internship a total of two non-academic credits will be allowed once in a three

year period. One credit is to be recorded for each six month period. v. Authorship of Books and Articles: This applies to articles based upon individual research or

experience. For a published book or the equivalent of a book, a maximum of two in-service credits may be given. For any article published, a maximum of one in-service credit may be granted.

vi. Educational Experiments shall be those conducted within a school or school system. A report

of such experiments must be submitted to and evaluated by the Superintendent for credit. e. Miscellaneous Considerations Involving Increment Credits 1. Community activities shall be regarded as part of the normal life of a good citizen for which no credits

are expected. 2. If a teacher has reached the age of 55 or reached the MA+30 level before the end of the three year

period for meeting the professional requirements to receive an increment, the requirement shall not apply.

3. "Exchange" teachers who are granted a leave for a year will receive an increment for the year they

are on leave. The three year period for earning credits toward increment will be extended one year and no in-service credit will be given for the exchange year. "Exchange" teacher applies to one who is working under a program approved by the Board.

4. Teachers who are granted a leave of absence for a year will not receive an increment for the year

they are absent. 5. Part-time teachers will be required to earn two in-service credits in a three year period. 6. Evaluation of all in-service credit will be made by the Superintendent's Office. f. In-Service Course The Board shall provide an appropriate in-service course without charge at least every three years. Such

course shall be acceptable as credit toward fulfillment of salary increment to meet the requirements for vertical movement only.

TUITION REIMBURSEMENT For any staff member not included under the terms of a collective bargaining agreement or individual contract the Board will pay a maximum of $1000 per person per school year for tuition of graduate courses approved by the Superintendent to a maximum of $26,000 per year. Only course work approved by the superintendent of schools shall be eligible for educational level and step advancement. Tuition will not include cost of books, meals, etc. This policy applies to tenured employees only. Payment will be made upon completion of the course and presentation of a report card, transcript, or letter stating such. The college bill will be submitted to the business office for reimbursement. for the following school infrastructure project: Replacement of two (2) 1989 Superior hot water boilers at Rutherford High School,

one of which has failed a recent insurance inspection and is currently inoperable. PIERREPONT LOWER 4. WHEREAS, on June 23, 2006, the Board of Education advertised for bids to

renovate AREA FACULTY ROOM and reconstruct a new faculty room in the lower area of Pierrepont School, and; RENOVATIONS WHEREAS, the Board of Education did not receive any bids; WHEREAS, the Board of Education re-advertised for bids for the work and

received one bid in the amount of $296,400 from William Kohl Construction Company of Lincroft, NJ;

WHEREAS, the bid was rejected by the Board of Education as exceeding the cost estimate for the work;

WHEREAS, Preziosi Construction Corp has agreed to provide the services for the work in the amount of $225,600;

WHEREAS, the services are not available from any agency or authority of the United States, State of New Jersey, the County of Bergen or any municipality in close proximity to the Board of Education; and

WHEREAS, quotations have been received from other vendors and the services cannot be obtained at a lower cost from any other contractor;

BE IT RESOLVED, that pursuant to N.J.S.A. 18A:18A-5(c), the Board of Education awards the contract for the Pierrepont Lower Area Faculty Room Renovation to Preziosi Construction Corp. in the amount of $225,600.
