2) At the outset, the Chair, reiterated that the Empowered Committee shall make its recommendations strictly within the frame work of SRO 520 dated 21.12.2017. It was decided that all the Administrative departments shall issue regular engagement order(s) in favour of "GSA" uniformaly as per enclosed "Model Government Order" Annexure "X".

3) It was also deemed necessary to assign a "Unique Identification Number" to every CSLW who is recommended for regular engagement under SRO 520 dated 21.12.2017.

4) Fifty (SO) cases were scrutinized by the Empowered Committee. Twenty Two (22) cases of different departments were found eligible for "Regular Engagement" on the basis of documents/ certificates etc furnished by the concerned Administrative Departments and the recommendations of the departmental committee. In respect of remaining cases, certian deficiencies as detailed in the enclosed recommendations were observed. The Members/ Representatives of the concerned departments present in the meeting were advised to expedite the submission of requisite information /documents to enable the Empowered Committee to examine such cases in right perspective. Abstract details and recommendations of Empowered Committee in each indiviual case are enclosed as per Annexure "A" & Annexure "B" to these minutes. 5) The cases cleared by the committee are, however, subject to verification of genuiness of certificates and other documents provided by the departments. The departments will further ensure that:-

(i) on the date of initial engagement of CSLW, his/her age was within the minimum and maximum age limit as prescribed for appointment in Government service.

(ii) the orders of relaxation of age/qualification, wherever required, shall be considered by the Department.

(iii) work and conduct of CSLW has remained satisfactory during the entire period for which the incumbent(s) has worked.

(iv) the CSLW(s) must have completed atleast Ten(10) years/ 120 months of aggregrate working in the department.

(v) no disciplinary action or criminal proceedings are pending against him/her.

(vi) the CSLW(s) fully qualifies the conditions as laid down under SRO 520 dated 21.12.2017.

(vii) the Hospital Development Fund (HDF) & local Fund Workers shall continue to be paid from Hospital Development Fund (HDF)/ Local Funds as the case may be.

In pursuance of Rule 6 of the Jammu & Kashmir Casual and Other Workers (CSLWs) - Regular Engagement Rules, 2017 read with recommendations of the Empowered Committee conveyed vide No , Sanction is hereby accorded to the Creation of ___ (Number) position(s) of "Government Services Assistants (GSA)" and Regular engagement of following CSLWs as 'GSA' against these positions. 2. The detailed particulars of incumbents as recommended by the Empowered Committee are given in Annexure-A to this Government Order. The regular engagement of CSLWs as GSA shall be subject to the following terms and conditions: i) The position(s) shall be co-terminus with the vacation of the

position by the incumbent upon his/her attaining age of 60 years/ resignation/ removal! dismissal etc whichever is earlier. The budget provisions under the wages component shall correspondingly be reduced in the current year's Budget of the concerned Division/office.

ii) A CSLW on regular engagement shall be entitled to all consequential benefits as per SRO-520 dated 21.12.2017.

iii) (The Concerned Head of the Department) will allow "GSA" to join formally only after verifying the following certificates/documents in original:-

a. Academic Qualification Certificates. b. Relevant Technical Qualification Certificate, if any c. Age/ Date of Birth Certificate. d. Permanent Resident Certificate. e. Any other certificate required under rules.

3. The GSA(s) shall be paid out of Detailed Head "Remuneration". However, CSLWs paid presently out of Local Fund or Hospital Development Fund on his/her regular engagement as "Government Services Assistant" shall continue to be paid from respective funds, as the case may be.

4. For verifying Date of Birth, in such cases, where school Leaving Certificates are not available, certificate of Medical Board only shall be entertained as proof of Date of Birth

5. The regular engagement of CSLW shall be subject to the outcome of writ petition(s), if any, pending adjudication before any Competent Court of law.

6. The order of regular engagement shall be deemed to be cancelled ab-initio, in case, at any stage, it emerges that the certificates/documents produced by the concerned are fake or forged.

* Sanction is also accorded to grant of relaxation of Upper agel qualification bar in favour of the incumbent(s) as indicated in column 9 & 10 of Annexure "A" to this order in terms of Sub-Rule (3) of Rule 4 of the Jammu & Kashmir Casual and Other Workers (CSLWs) - Regular Engagement Rules, 2017.
