Minutes of the 4th meeting of Empowered Committee (constituted
vide Government Order No. 139-F of 2015 dated 19.8.2015) held under
chairmanship of Commissioner/ Secretary to the Government, Finance
Department on 08.02.2016.
Subject:- Creation of posts of "Helper" for regularization of left over
DRWs.

Chief Engineer, PHE, Kashmir was also present in the meeting.
Proposals relating to regularization of left out DRWs of PHE/l&FC
Department and pre-ponement of date of regularization of
regularized DRWs of CA&PD Department were on agenda of the
meeting.
Cases of 423 DRWs of PHE/l&FC Department as per following break
up were examined:-
1. PHE Division Awantipora 315
2. PHE Division Qazigund 108
While examining the case files of these incumbents in terms of
provisions contained in the J&K DRW/WCEs (Regulation) Rules, 1994
notified vide SRO 64/1994 read with Government order No. 26-F of
1994 dated 31.01.1994, the Committee cleared and approved

creation of 302 posts of "Helper" in the pay scale of 2550-3200 (Pre
revised) for regularization of as much number of DRWs from the
dates shown against each in the below matrix. In respect of S. No.
128 to 301, seven years continuous period has been reckoned from
06/1992 i.e culmination of last break:-

The above recommendations are further subject to the
following conditions:-
(i) The Department shall verify HRs/MRs of first 9-10
months of the incumbents to establish genuineness of
their claims.
(ii) Continuous working from the date of initial
engagement and drawal of wages at notified rates shall
be established/certified by the concerned HoD.
(iii) The incumbents are eligible for regularization and fulfill
all conditions as laid down in SRO 64/1994.
(iv) Relaxation of age/qualification, if any, shall be
considered by the Department with prior approval of
the Competent Authority.
(v) Regularization orders shall be issued by the concerned
HOD after formal orders for creation of posts are issued
by the Administrative Department.
(vi) Arears from date of regularization to the date of issue
of regularization order shall be paid in five equal annual
instalments after projecting the same under Annual
Budget Estimates of the Department.

The Department is advised to furnish the desired information
as early as possible, so as to enable the Empowered
Committee to take decision on the issue and make
recommendations accordingly.
In addition, the department has forwarded case files of 11
incumbents belonging to PHE Mechanical Division,
Awantipora, PHE Division, Awantipora and PHE Division
Qazigund which were not registered with Finance
Department. The issue was deliberated and it was decided
that the Empowered Committee has limited mandate to
approve formal creation of 3660 posts only which has been
approved by the Competent Authority. The cases which are
in excess of registered figures can neither be entertained by
the Empowered Committee nor by Finance Department as of
now unless a policy decision to accommodate such left out
daily rated workers is taken. Therefore, the case files which
have been not registered with Finance Department in the
contingent of 3660 referred to above are returned to the
department for the time being. As and when any decision in
this regard is taken, the department(s) will be informed
accordingly.
