The Council’s Charter

A council has the following charter:

- to provide directly or on behalf of other levels of government after due consultation, adequate, equitable and appropriate services and facilities for the community and to ensure that those services and facilities are managed efficiently and effectively

- to exercise community leadership

- to exercise its functions in a manner that is consistent with and actively promotes the principles of cultural diversity

- to promote and to provide and plan for the needs of children

- to properly manage, develop, protect, restore, enhance and conserve the environment of the area for which it is responsible, in a manner that is consistent with and promotes the principles of ecologically sustainable development

- to have regard to the long term and cumulative effects of its decisions

- to bear in mind that it is the custodian and trustee of public assets and to effectively account for and manage the assets for which it is responsible

- to facilitate the involvement of councillors, members of the public, users of facilities and services and council staff in the development, improvement and co-ordination of local government

- to raise funds for local purposes by the fair imposition of rates, charges and fees, by income earned from investments and, when appropriate, by borrowings and grants

Notice of Motion 1. ROAD CLASSIFICATION – KRAUSES LANE (R40-015)

Cr Morgan gives Notice that at the Council meeting to be held on 18 July 2016 he will be moving the following:

That the northern 2.5km of Krauses Lane be reclassified to Grade 2 Gravel.

Director Engineering and Environmental Services’ Comments • This matter was previously discussed by Council in February 2015, with no change to

classification resolved. • Krauses Lane runs from Wagga Road north to Hollies Road - length of approximately 5.2km. • It is classified Class 2 gravel road from Wagga Road to private quarry - length of 2.7km, leaving

2.5 km as earth formation classification. • There are no primary accesses along Krauses Lane and as such it appears that the northern

section of Krauses Lane was downgraded from Class 2 to earth formation in 2001 when a full road classification review was undertaken.

• The southern section of Krauses Lane was gravelled as part of DA conditions for the Clay Mine. • Hollies Road is classified Class 1 gravel road and provides suitable access in all weather

conditions. • Cost to upgrade from earth formation to Class 2 is $62,500. • Additional maintenance costs to upgrade the road classification equate to $6,125/annum. • Council has also received written submission from Peter Schirmer requesting the northern

section of Krauses Lane be reclassified to Gravel Class 2 to allow more direct access from his property on Maffra Lane to property on Krauses Lane.

• Agreeing to this may result in other roads requiring upgrading of classification.

Committee Reports 1. TOURISM/ECONOMIC DEVELOPMENT OFFICER REPORT – JULY 2016 (T26-005) Due to prior commitments by a number of committee members, the July 2016 Tourism and Economic Development Steering Committee was not held however a brief report by the TEDO on recent projects is as follows: 1. Economic Development

The community consultation sessions were held in The Rock and Lockhart, with a focus on the Lockhart Industrial Estate and The Rock CBD area. At the public meetings, Crowe Horwath sought engagement and genuine feedback, and based on these outcomes will draft a Feasibility Study and a Community Consultation Summary for review.

2. Lockhart Shire Business Excellence Awards

The TEDO has met with Rotary and has compiled an official proposal for their consideration in relation to hosting the Lockhart Shire Business Excellence Awards. It is hoped that the Business Excellence Awards will not only raise the profile of local businesses, but will also raise the profile and member numbers of Rotary, who continue to work for the benefit of our community. The TEDO has requested Rotary consider the proposed dates, categories and presentations of the Awards and revert following discussions.

3. Business Survey

The Annual Business Survey has been sent to Shire businesses and is available to complete in paper format and online. The purpose of the Survey is so we can better understand the state of business in the Shire and the needs of the business community. The survey will be used to obtain the views of business to influence, shape and inform the development and delivery of future plans and strategies, to assist promotion of our area and to use the data in submissions for funding and advocacy. The closing date for the survey is Friday, 15 July 2016. Completed surveys may be posted or hand delivered to Lockhart Shire Council. The survey may also be completed online.

4. Shop the Spirit and Win - Lockhart

Shop The Spirit and Win is an 8 week spring shop locally campaign targeting Lockhart town centre. The campaign will run from Saturday, 8 October (Spirit of the Land Festival) to Friday, 9 December (Spirit of Christmas evening), with an aim to revitalise shopping in the town, to promote businesses to the wider community and to encourage shopping locally. A number of local businesses have agreed to participate in the campaign, with each businesses sponsoring a $50 shopping voucher to be redeemed in their store. The TEDO will be contacting The Rock Progress Association for suggestions on a possible Shop Local promotion for their town centre.

5. Lockhart Shire Photo Competition

The winners of the Love Lockhart Shire Photography Competition have been announced, with a good mix of both local and non-local winners. The winning photos have been loaded on to the Lockhart Shire Facebook page and has received strong support. Judging was undertaken by Eastern Riverina Arts, and displays of the photographs throughout the Shire will follow. Details of the 2017 competition are available on the website with promotion as relevant.

6. Galore Hill Signage

Having submitted an application to NSW’s State Government Tourist Attraction Signposting Assessment Committee (TASAC) for installation of Brown Tourism Signage on the Sturt Highway directing visitors to Galore Hill, the TEDO was given the opportunity to present a report to the Committee. The Committee advised the TEDO there were two points in the criteria against the application, the first being the distance from the Sturt Highway (10kms maximum is preferred), and the second being access by gravel road (not preferred). Having sent through a comprehensive report, and armed with a portfolio of images including the new improvements, the TEDO was delighted to be advised the Committee agreed Galore Hill was of regional significance and approved the requested signage, noting it can take up to six months for the production of the signs through the RMS process.

7. NSW Regional Tourism Awards (Formerly Inland Tourism Awards)

The TEDO submitted two entries in the 2016 Regional Tourism Awards. Subsequently a judge from the Tourism Award Committee conducted site visits to Lockhart in mid-June to inspect the Lockhart Sculpture and Heritage Trail (Tourist Attractions category) and the Greens Gunyah Museum (Cultural Tourism category). Despite an increase in applications from the Riverina region, there were only four finalists announced from the Riverina region, and the TEDO was absolutely delighted to learn that two of these were based in Lockhart Shire. Both Lockhart Shire’s submissions were named as finalists for the second year running. This is a great recognition for Lockhart Shire as these awards cover most of NSW west of the Great Dividing Range. Notes:

Linen plan completed, lots in process of being registered. Entry road has been re-aligned. Expect registration completed by end of July 2016.

Last year, the fee adopted for Councillors, was the minimum plus 5%. If this strategy was carried forward to this year, the fee would become $8,967. Discussion also ensued about whether that fee should be increased by 5% annual quantums until it reached 25% above the minimum. In relation to the Mayoral fee, prior to last year it was set at the mid-point between the minimum and maximum amount. However, last year it was raised to the maximum due to the additional workload caused by Fit For the Future and setting up of the Joint Organisation. If that strategy is continued, the Mayoral Allowance will increase to $24,630. General Manager’s Note It would be expected that the duties of the Mayor and Deputy Mayor, will continue to remain higher than normal in 2016/17. The additional workload associated with Joint Organisation set up will continue, as well as reviews of the Local Government Act which will be placed higher on Government agenda now that the round of mergers is substantially completed, if only for the time being. As well as this, furthering options for increasing the scale and capacity of our shire to keep us independent will also result in higher workloads for the Mayor and Deputy Mayor. On top of this, our Improvement Plan under FFF also commences, also increasing the workload. These factors need to be taken into account when setting the Mayoral Allowance. 3. SPECIAL RATE VARIATION APPLICATION (GM/S20-005)

Executive Summary Need for a Council resolution to signify Council’s intent to apply for a special rate variation to commence in the 2017/18 financial year. Report As Councillors are aware, and as re-identified at the June Council meeting, Council identified a series of strategic actions in its submission to IPART and the FFF program which it needed to accomplish in order to satisfy IPART and the NSW Government that our Council is and will continue to be FFF. One of those was a special rate variation (SRV) of 4.6% per annum for the next 10 years to raise revenue to pay for future infrastructure such as swimming pools refurbishment and flood mitigation works. It was intended to start in this financial year but was delayed as our Council was involved in a merger proposal. Having now kept our independence, it needs to be commenced from the 2017/18 financial year. There are several month’s preparatory work required to complete a submission to IPART, which is required by IPART in January 2017. IPART then assesses our application, and if considered OK, notification is received by us in April or May to enable our budgeting process to be completed by 30 June as usual. To enable preparatory work to commence, a Council resolution is required to signify our intent to apply for an SRV to commence in the 2017/18 financial year. Delay of this resolution will mean it won’t be dealt with until the new Council is in place, which will severely limit the preparatory time available to complete the application to IPART. I don’t believe it necessary at this stage, to set out all the details in the resolution – that can occur via another report to Council closer to the date after community consultation occurs, so that if material evidence emerges from that process, Council will have the opportunity to reassess its position. 4. REQUEST FOR LEGAL ASSISTANCE (GM/S20-020)

Executive Summary LGNSW request for legal assistance from members. Report Bathurst City Council has requested legal assistance from members of LGNSW as per LGNSW policy for costs associated with a court case which it believes has relevance for local government throughout the State. The case related to the ability of councils to enter into contracts that include fees for services, the NSW Court of Appeal identifying in the judgement that:

‘even when the Local Government Act confers a power in terms upon councils to reach an agreement or arrangement with a landowner, the price it can charge for work performed by it remains subject to Part 10 of Chapter 15. To that extent at least, the ‘general power to contract’ cannot permit a Council to escape the statutory restrictions upon it’.

Financial contributions are sought from Councils, in our case $437.21. There is no obligation on Council to contribute, and in this case I’m doubtful whether the case has a lot of relevance to our circumstance. However there may be time when our Council is defending a case and we may need to similarly seek assistance from other councils to contribute to the costs. 5. COMMUNITY SATISFACTION SURVEY (GM/I13-010)

Executive Summary The Community Satisfaction Survey circulating in the shire is now closed and responses collated. A summary of responses is shown below and the full results attached. Report A total of 127 responses were received from our Community Satisfaction Survey (CSS). This somewhat better than the last survey in 2014 when 104 responses were received, however it still represents only a small percentage of our population. It represented a prime opportunity for residents to have a say on how they feel their Council is performing and to provide Council with some input about future allocation of resources. The responses received represent 4.2% of the shire’s population and were fairly evenly distributed across our population centres.

Council’s goals from the survey were to: • Gauge Council’s performance overall and for individual services • Gauge our level of customer service satisfaction • Gauge some feedback about future priorities • Provide a comparison with the base level established in 2014 for a number of indicators which

Council needs to include in its End of Term Report to comply with IPR legislation. That report needs to be presented to our August Council Meeting.

The results in the main were very positive about Council’s performance. Some samples of responses are: 1. How satisfied are you with the interactions you have had with Council? – out of 127 responses,

only 14 indicated non-satisfaction, indicating a satisfaction rating of 89%. 2. How satisfied are you with the level of communication Council has with the community? – out of

126 responses, 14 indicated non-satisfaction, indicating a satisfaction rating of 89%. 3. When presented with a list of 29 services and facilities provided and asked to rank them in

importance and the level of satisfaction with their performance, almost all of the services were ranked as being of high importance. Predictably, the level of satisfaction with individual services was somewhat lower than the importance factor. Standouts are: • In importance, provision of cycle paths and walking tracks, and availability of and access

to public transport ranked noticeably lower than all the others, which is exactly the same response as in 2014

• In satisfaction, most services performed well over 70%, however there was a noticeable trend in some services for the degree of dissatisfaction to be higher. These were: ° Dog control ° Cycle paths and walking tracks ° Availability of and access to public transport ° Support for tourism ° Drainage ° Rural roads ° Opportunities for the community to participate in Council decision making ° Managing development and growth This list has changed slightly and has fewer entries than in 2014

4. When asked overall about satisfaction with the performance of Council, out of 119 responses,

only 10 indicated non-satisfaction, indicating a satisfaction rating of 92% 5. When asked overall to rate Council’s image within the community, out of 119 responses, only

14 indicated non-satisfaction, indicating a satisfaction rating of 88%. 6. When asked whether respondents agreed or disagreed with a series of statements about a

variety of 20 services, the results were generally very positive with 70% or higher being the rating for 16 of the 20 categories. There were notable low levels of agreement in 3 categories, these being: • Local availability of employment opportunities • Adequate services for youth • Quality of telecommunication services This list has halved since the 2014 responses. It is interesting to note that these are services for which Council does not have sole fiscal responsibility but are shared with other levels of government and our role is limited to funding being provided or advocacy.

7. Respondents were asked whether they would be in favour of the introduction of a Green Waste

Service. Only 29% were supportive of this new service, while 39% were against it. A high undecided figure of 33% made up the balance. Compared to 2014, the responses were slightly more in favour of the new service, but there is still significant opposition.

8. A number of questions were asked for which respondents were required to provide a written

response. The object of these questions was to ascertain trends. The results of these haven’t been collated yet but should be available at the Council Meeting. Likewise, I expect to have some comparisons with the 2014 survey available for your information.

6. COUNCIL CARETAKER PERIOD (GM/C70-005)

Executive Summary Office of Local Government (OLG) has advised that the caretaker period prior to the Council election commences on Friday 12 August 2016 and has also given advice about the type of decision making that can take place during the caretaker period. Report OLG advises the Caretaker Period commences on Friday, 12 August 2016 and ends on Saturday, 10 September 2016, after the election results become known. During this period, Councils are expected to ensure that major decisions are not made which would limit the actions of an incoming council. Actions which neither Councils, General Manager or delegates of the council are permitted to exercise during the caretaker period are: • Enter into a contract or undertaking involving expenditure equal to or greater than $150,000, • Determine a controversial development application, • Appoint or reappoint a general manager. In some circumstances, these functions may be exercised with the approval of the Minister.

7. ECONOMIC DEVELOPMENT STRATEGY (GM/E05-020)

Executive Summary Report of economic development community consultation sessions and discussion about next steps Report Council has commissioned Crowe Horwath to conduct a feasibility study to explore economic opportunities to support its population growth aspirations into the future. Previously, Council determined by discussion with Crowe Horwath to concentrate initially on opportunities for the Industrial Park in Lockhart, and the Commercial Precinct in The Rock. The final stage of this process was the conducting of community consultations in each of those centres to gain an appreciation of the local views of residents about these issues. The study outlined two core approaches: a business as usual approach and a differentiation approach. Community feedback clearly demonstrated support for a business as usual approach at both centres. No appetite existed for either a Council or community funded differentiation approach. The study has highlighted a number of important matters that should be progressed/implemented: • The advantage of positioning Council as “open for business’ and ‘business friendly’. In order to

support these claims, Council must ensure that it works to understand business needs and tailors its offering and support to assist owners/tenants in achieving their needs,

• Positioning The Rock as a “destination” town, attracting both day-trippers and weekenders to come and sample its offerings,

• The need to develop a Strategic Marketing Plan and ensure marketing materials focus on the value proposition of the business location, community and municipality,

• The requirement to tailor incentives to meet individual business needs and ensure sufficient funding is available to support staff in negotiating such incentives,

• The creation of a town masterplan at The Rock to identify the preferred location of a commercial hub that will support availability of commercial shopfronts, and how to effectively create linkages between the Olympic Highway and this nominated commercial hub, and

• The importance of working with building owners in the existing commercial hub of Urana Street, The Rock in order to support retention of viable shopfronts.

Ongoing and proactive focus is required in order to identify and win businesses into our shire area. Next Steps Attached is a copy of the Feasibility Study and Community Consultation Summary. There is a lot to take in and Council now has to grapple with the actions it wishes to take to turn our aspirational goals into reality. I suggest another workshop be held, again with Crowe Horvath facilitating, to hone in on the more specific actions which Council wishes to take to promote economic development and to determine how it wishes to resource the actions to be taken. It would also be beneficial to invite the non-Council members of the Tourism and Economic Development Committee as well as a representative of our marketing agents to attend. 8. LOCAL GOVERNMENT AMENDMENT BILL 2016 (GM/L15-025)

Executive Summary Notification of the Local Government Amendment (Governance and Planning) Bill 2016. Report The Local Government Act has been in the preliminary stages of planning for amendments for about the last 3 years now. A complete rewrite was explored in Professor Sansom’s Independent Review Panel Report, but that strategy has now been replaced by a series of discussion documents which will eventually become parts of the amended Act. Eventually a new Act will be the result. The first stage of this is the attached Local Government Amendment (Governance and Planning) Bill 2016. Council has previously had the opportunity to comment on the various components of this Bill, but this is the first time the actual wording of the various sections has been disclosed. The Bill has been introduced to Parliament, but I understand it will not be debated until after the winter recess, sometime in August. That will give Council time to comment on the various parts of the Bill if it wishes to do so. The objects of the Bill are as follows: a) To extend the purposes of that Act and to set out principles for councils, b) To include expanded descriptions of the roles of councils, mayors and councillors and the

functions of general managers, c) To enable councils to apply to reduce councillor numbers or mandated meetings or change

wards, before the next council elections after the proposed Act commences, d) To increase the term of office for mayors elected by councillors from 1 year to 2 years, e) To require councillors to take an oath or make an affirmation of office, f) To enable postal voting to be used for elections by all councils and to postpone the use of

countbacks instead of by-elections until after a day to be specified by regulations, g) To limit the role of councils in determining the staff organisation of a council to senior positions, h) To enable councils to delegate the function of accepting tenders (other than for services

currently provided by council staff members) and granting financial assistance, i) To provide for a model code of conduct for meetings, j) To streamline provisions in the Principal Act relating to the integrated planning and reporting

framework and enable regulations to be made about consultation and other procedural matters, k) To provide for the council auditor functions to be exercised by the Auditor-General (or a person

appointed by the Auditor-General) and to confer other auditing functions relating to local government on the Auditor-General,

l) To require councils to establish Audit, Risk and Improvement Committees, m) To enable the appointment of a financial controller for a council if an improvement order is

issued for the council, n) To make it clear that an administrator appointed to a council has the functions of a mayor, o) To provide for misconduct by councillors relating to disclosures of pecuniary interests to be

dealt with in the same way as other misconduct, by including disclosure requirements in mandatory code of conduct provisions and applying the same disciplinary provisions that apply to breaches of the code,

9. LOCAL GOVERNMENT NSW 2016 ANNUAL CONFERENCE (GM/S20-005)

Executive Summary Need for Council to determine attendees and voting delegate at the Conference. Report The LGNSW Conference is to be held this year in Wollongong from Sunday 16 to Tuesday 18 October. Information about the Conference will be made available as it comes to hand. It is desirable that numbers are determined early to enable travel and accommodation arrangements to be put in place. Council needs to determine attendees to the Conference as well as its voting delegate. In past years, 3 Councillors plus General Manager has attended. In addition, Councillor Verdon usually attends as a delegate from Riverina Water. Our voting delegate is normally the Mayor. In anticipation of high demand, I have made tentative bookings for 5 rooms which can be altered as needs permit. Travel to Wollongong is also not straight forward. If flying, will require a plane to Sydney and then airport train to Wollongong followed by taxi to accommodation. The alternative is to take Council vehicles, which in this case is a viable option. Maybe a combination of the two will work the best, depending on individual needs. Integrated Planning and Reporting Reference E3.1.1 - Provide opportunities for relationship building and development. 10. RURAL FIRE SERVICE – NEW FINANCIAL ALLOCATION MODEL (GM/B35-030)

Executive Summary Notification of a new district allocation model with various funding implications for individual councils. Report State Level The NSW Rural Fire Service has outlined a new district funding model which the State Government has directed to take effect from the beginning of this financial year. The main reasons for the change are: • Non-alignment of State Government budget and Council budget cycles • Difficulty for Councils to forecast probable contribution • Current 12 month bid and allocation model not conducive to the Integrated Planning and

Reporting requirements of DLG • Peaks and troughs in VASS and contribution especially when allocation of large capital items

such as station or FCC • Allocation to districts often delayed due to requirement for end of year accounting close prior to

allocation • Shortened timeframe for Councils and district offices to deliver on large projects due to late

allocation advice. The revised model is to determine the estimated expenditure in each Rural Fire District as a percentage of the overall budget of the whole of the State RFS based on the 20 year history of allocations for that District. This long term average is seen to fairly reflect the expenditure over time and smooths out any peaks and troughs which may have been caused over time between councils because of differing amounts of infrastructure replacements occurring. This new model certainly has its advantages over the existing one because it will be more timely and more in sync with our budget cycle, and also far more simpler to calculate and keep track of. No longer will there be sharp differences in allocations from year to year because of new equipment purchases because these purchases are now going to be controlled from state level, and the percentage of the total cake that we pay will be averaged over time. Unfortunately, the infrastructure program developed by our District will now be included in a state hierarchy, so our intended new infrastructure may be pushed further back in the pecking order. Simply put, in the new model, if our District has a 20 year average of 2% of the total state budget, the Council’s in our District will collectively pay the statutory contribution of 11.7% of the District contribution. The down side is that the currently existing reimbursement that we receive in the following year’s allocation has now disappeared, which means a substantial increase for all councils. In our case in excess of $40,000. The other downside is that we still don’t have any control on increases that occur at State level. If the State allocates an extra large percentage year on year, we will have to pay our proportion of that increase regardless of its size. District Level The other variable for the Riverina RFS, is that with the loss of Urana from the District because of its merger with Corowa, the District allocation is now proportioned over 4 Councils rather than 5. This means that each of the Councils in the District will bear a larger proportion of the cost. As an aside, RFS has indicated that talks are on foot to re-align fire districts in the wake of the council mergers around the State. It is likely that Lockhart’s proportion will increase from 13% to 18% as a result of the re-proportioning of Urana’s contribution, and a re-averaging of contributions paid by ourselves and the other remaining Councils in the District over the last 15 years.

Budget Implications For Lockhart, the implications are significant considering the size of our budget .Our contribution will increase by: • The loss of the annual reimbursement • The higher proportion of the District budget payable • At the whim of any large variations in the State budget allocation for firefighting. Taking 2015/16 figures as an example, the following would have been the case for Lockhart with the new model and with the deletion of Urana out of the calculations

The effect on 2016/17, even though we don’t have actual numbers yet, is likely to be much greater, as outlined below. The reason for the much lower estimate is because a new firetruck which was intended for us was deleted from the District budget, thereby reducing our estimate accordingly

This difference of $91630 will be the likely adverse effect on our 2016/17 budget. It won’t have any effect on future years except for inflation. Please note: • the average increase in the total State RFS budget over the last 5 years is 3.72% • the average percentage over the last 20 years of the Riverina Zone’s proportion of the State

budget is 2.37%, which is the percentage to be used for future calculations. General Manager’s Note I am extremely disappointed about the following points associated with these changes: • The first notice of these changes occurring has only been in the last couple of weeks – not even

an inkling of imminent change occurring. There has been absolutely no prior consultation about them. We were called to a meeting in Wagga Wagga last week when they were thrust upon us to be effective straight away. Obviously, our 2016/17 budget has already been set, and the additional amount payable by us is a significant additional impost. The increase in itself represents over 4% of our total general fund rates income. More consultation is required and the changes need to be delayed until the following budget year.

• The abolition of the reimbursement is a significant change in the funding model, and it represents about half the expected increase. The reimbursement has been operating for many years and losing it in one hit without consultation is just a cash grab by the State Government, and another example of cost shifting. At the very least, a phasing out of the reimbursement over say 3 years would be beneficial to us and our whole industry.

• The Riverina District has one less Council area to manage, but there doesn’t seem to be any reduction in the amount to be allocated to it from the State budget. That means the other Councils all pay more.

Integrated Planning and Reporting Reference A1.4.1b - Foster effective detection and suppression of bush fires by maintaining well-equipped fire brigades with adequately trained personnel.

express its strong disappointment to the Minister for Emergency Services about the following • Lack of consultation about, and the timing of the changes, with the effect that Council has

had no opportunity to budget for them. The changes should not become operative until the 2017/18 budget year

• The abolition of the total reimbursement immediately, after it being a significant component of the funding model over many years. If the reimbursement is to be abolished, it needs to be phased out over say 3 years to enable a reasonable transition in Council’s budget.

• The additional financial impost on each of the Councils in the Riverina District caused by the lack of reduction in the Riverina District budget as a consequence of the loss of the former Urana Shire area from the district

b) Request a meeting be called of the 4 remaining Councils in the Riverina District to discuss strategic action which may be warranted.

Executive Summary Request for financial assistance received from Leia Thiele on behalf of her daughter Melinda Thiele. Report Melinda Thiele has been given an opportunity to attend workshops and a photo shoot session (to provide a portfolio) conducted by the New Faces Talent Academy which specialises in discovering and developing aspiring new talent in the entertainment industry. Melinda’s dream is to be an actor. She has attended several drama camps and has performed in Wagga Wagga High School productions. Melinda is a member of School of Arts Community Theatre (SOACT) and she has also just completed work placement at the Playhouse for Life in the Spotlight. Support has been requested to assist Melinda with her acting endeavours and an amount of $300.00 to $500.00 has been suggested. Executive Summary Monthly report on engineering matters. Background Information (a) Works Report: Construction projects have been suspended for the winter months, and will be

recommenced in mid/late spring. All three grader crews are undertaking re-sheets and maintenance grading in accordance with program. A new 12-month programme will be presented at the meeting. Concrete crew is currently undertaking miscellaneous culvert and footpath works around the Shire, as well as sign and flood markers maintenance.

(b) Flood Mitigation: Stage 3 design works for new flood mitigation structures are now 100%

complete and handover of full design documentation has occurred. Council has submitted grant applications for Stage 4 construction of flood mitigation structures in both Lockhart and The Rock for 2016/17 & 2017/18 years. Voluntary Purchase of flood affected properties is continuing in both Lockhart and The Rock, with first settlements completed and second round of property purchases due to commence shortly.

14. NOXIOUS WEEDS (DEES/N10-025)

Executive Summary Monthly report on Noxious Weeds. Report Property Inspections Inspections occurred on both residual and rural properties, with the majority of inspections occurring on residual properties, due to limited access on rural properties. The weeds most commonly found were Bridal Creeper (Asparagus asparagoides), Horehound (Marrumbium vulgare), Privet (Ligustrum sp.), and Bathurst Burr (Xanthium spinosum). Other weeds found in lower frequency were Sweet Briar (Rosa rubiginosa), Lippia (Phyla canescens), Prickly Pear (Opuntia sp.), Athel Pine (Tamarix aphylla), Green Cestrum (Cestrum parqui), Willow (Salix sp.), African Boxthorn (Lycium ferocissimum), and Prairie Ground Cherry (Physalis hederifolia).

As illustrated by the large number of Section 18As issued, the majority of landholders were not obliging in applying control measures. Various reasons for this includes illness, undesirable weather for spraying, limited access to properties due to saturated soils, and identification problems. Council’s noxious weeds inspector has made arrangements with many landholders in order to resolve these problems. Correspondence has also occurred with John Holland in regards to the control of privets on railway land at Yerong Creek and The Rock. Spray Program Priority for spraying has been given to the control of Bridal Creeper (Asparagus asparagoides), Horehound (Marrumbium vulgare), and African Boxthorn (Lycium ferocissimum) on Shire roads. Regional Weed Risk Assessments Public Consultation The Riverina Regional Weed Committee is seeking community input on significant local weed species to include on a priority weed list for the region. The list is a critical part of the new regional strategic weed management plans that the committee will develop as part of next year’s implementation of the Biosecurity Act 2015, which replaces the Noxious Weeds Act 1993. The Committee is seeking input from land managers and community groups about weeds of significance in their area, and asking them to go through the steps to have them considered for inclusion on the list. The Weed Committee will consider a weed for inclusive once it has undergone a Weed Risk Assessment, the details of which, together with local contact information, can be found on the Riverina Weeds Action Program website at www.riverinaweeds.org.au. Roadside Environment Training On 21 June Council’s noxious weeds inspector and many members of staff from Council’s roadworks operations, including the Works Manager, grader operators and vegetation control staff, attended the Roadside Environment Training at Culcairn. This training was made available by the Murray Local Land Services, and also attended by staff from the Greater Hume Shire and the Albury City Council. This training was essential in providing future guidance in the planning and implementation of projects, in particular, construction of road infrastructure, protection of native vegetation, reduction in potential weed infestation and spread, legislation, and protection for litigation. Galore Hill Projects There are currently two projects occurring at the Galore Hill Nature Reserve, both of which have been funded by the Riverina Local Lands Service through the community grants funding. The Galore Hill Scenic Reserve Rehabilitation project commenced in June and its works are concentrated on the south west corner of the reserve, beginning at the entrance to the Galore Hill and extending to the division in the road to the saddle and summit. Objectives of this project include: the removal of environmental weeds, particularly those that have been previously planted and are now spreading within the reserve; removal of dead vegetation material from planted species, which are providing habitat for feral pests and noxious weeds; removal of redundant identification signage, which presents potential safety issues for visitors of the reserve; and direct seeding of local native plant species to re-establish areas that have been degraded from grazing, and providing conductivity between the local native species within the reserve and the previously planted areas. Through the implementation of this project, improved focus of the conservation of local native vegetation should be achieved, as well as encouraging public use and enjoyment of Crown Land, by providing an area that is much more accessible and aesthetically pleasing. In June the bulk of the manual work has been completed, including the physical removal of dead planted vegetation and redundant signage. The removal of environmental weeds has begun will the removal of Cootamundra Wattle (Acacia baileyana) and Silky Oaks (Grevillea robusta). This work will continue in July. The Galore Hill Reserve Biodiversity and Cultural Study will commence in July, and will involve the comprehensive study of the biodiversity at the reserve, completed by an established ecological company. This survey will be instrumental for: applying for future funding for the reserve; highlighting the presence of endangered or threatened species; exploring the health and value of the local native species, both flora and fauna; promoting the reserve in regards to its ecological conservation, appreciation and cultural heritage; and providing essential foundations for the management plan of the reserve. 15. PARKS AND GARDENS REPORT (DEES/P10-005)

Executive Summary Monthly report on Parks and Gardens. Report Playgrounds A replacement spring rocker and new powder coated platforms to replace the split and weathered plastic coated platforms on the existing equipment have been delivered for installation at Stan Galvin Park; completing the upgrade of the playground which also included a new double swing set and Cellula Rope Unit. New platforms and a four way spring rocker have been installed at Lockhart Recreation Ground; the culmination of the refurbishment that started last financial year. New spring rockers have also arrived to replace the two aging rockers at Yerong Creek Recreation Ground. A replacement slide has also been installed at Wal Alexander Park; the old slide had deteriorated and become brittle. The swings at Galore Hill have had to be replaced due to the originals being stolen. A rotary hoe has been used to rejuvenate the softfall at all shire playgrounds. Sculpture Trail and Urana St Lighting Quotes were accepted for lighting of ‘Eagle’ and ‘Rain Dragon’ in Lockhart and the Gallipoli panels and APC at The Rock. Solar panels will be installed for all except the APC which had mains power readily available. Parts have been ordered and installation should start early in July. Galore Hill Nature Reserve The grant funded project that includes removal of dead shrubs and trees in the old plantation sights to clear the ground for direct seeding of indigenous species has continued. The plant markers for these specimens are also being removed along with some old fencing. Street Cleaning Attention is being focused on urban guttering that the streetsweeper cannot access. Priority will be given to streets that are not tarred to the gutter as they tend to get a build-up of grass that then catches debris and blocks water flow. Parks and Gardens Irrigation systems have been turned off at most sites. Routine garden maintenance is being conducted including regular weeding, spraying, pruning, redefining garden edges and some replacement planting and transplanting. Winter pruning of roses will be scheduled toward the end of July and into August. Tree A cherry picker was hired to remove a number of dead or dying trees at The Rock and one considered to be at risk of dropping large limbs. The annual pruning of the Shires many Peppercorns has been completed. Pruning of urban lanes and formative pruning of smaller street trees will continue throughout winter. Mowing and Slashing Milbrulong, Lockhart airstrip and Osborne Recreation Ground mowing has been completed. Pleasant Hills and Munderwaddery Cemetery will be scheduled in the next month, weather permitting. Mowing and edging of most irrigated areas is being conducted as required. Weed Control Regular weed control has been hindered by persistent wet weather.

Contract cleaners attend to the public toilet facilities in Lockhart, The Rock and Yerong Creek. 16. ROADS PROGRAMME 2016/17 (DEES/T10-005)

Executive Summary Council once again has a significant roads construction programme planned for 2016/17 year. Report Council’s adopted Operation Plan for 2016/17 has allocated $4,071,025 to roads and footpath capital works. 17. TERM CONTRACT PROJECT OFFICER POSITION (DEES/S30-005)

Executive Summary Council’s upcoming special projects requires additional resource to deliver the works to the community. Report Council is potentially going to be undertaking a number of special projects over the next 2-3 years that will require significant supervision and management to deliver successfully. These projects include: - Tertiary ponds upgrade at The Rock Sewerage Treatment Plant - Sewer extension at The Rock - Sewer mains cleaning and relining - Swimming Pool upgrades at both Lockhart and The Rock - Flood Mitigation construction works at both Lockhart and The Rock - Demolition of Voluntary Purchase Scheme properties. Council does not have sufficient resources in house to manage these projects along with undertaking large roads programme due to increased R2R funding and successful grant funding. All of the above listed projects will be contracted out rather than use of own day labour, thus lends itself to a project manager to facilitate design, liaise with affected stakeholders, engage contractors and supervise the works. It is proposed the position be called ‘Term Contract Project Officer’, be Grade 17 on Council’s salary structure and to include a leaseback vehicle, with length of position to two years with possible extension of a further one year.

Report The next round of the Country Passenger Transport Infrastructure Grant Scheme is now open. Council was successful in last round to enable construction of the two bus stops in The Rock. The criteria and grant limits have changed slightly for this round of funding. New bus shelters are capped at $10,000 and they must be used for Transport for NSW services (i.e. community transport, school buses, Country Link, etc.). Council staff propose to upgrade the bus stop on Matthews street, Lockhart outside the Post Office. The current stop does not meet disabled access requirements, has many trip hazards and looks worn and outdated. It is proposed to install a new bus shelter, same as The Rock, replace footpath and remove grass area, repair damaged pavement, improve nearby pram crossings to allow Gofer use, as well as general tidy up with new bin and signage. The existing bus shelter donated by Lockhart Rotary is to be moved to Walter Day Park next to the information bay to tie in with the new toilets and access in this area, allowing another bus stop for tourist coaches to use. This would enable buses to stop, use the toilets as well as have easy access back to the Museum. Staff have consulted with Post Office, Roadhouse owner as well as Lockhart Rotary and they all are very supportive of the proposal. c) A loan with annual repayment of approximately $150,000/year, Councils Fit For The Future Improvement Plan rate increase of 4.6% would take 4 years before the rate increase would cover the repayment. In the meantime, the additional cost to Council would need to be either from other Council services or reserves.

Executive Summary Council has undertaken community consultation on its updated 30-year capital works and financial plan. Council’s new 30-year capital works plan is dominated by the proposed sewerage extension at The Rock, and includes renewals and upgrades to all sewerage infrastructure items. Council’s financial plan requires an increase in typical residential bill of 20% above current rates and charges revenue, to reach $565 in 2015/16 phased in over 3 years. Council has undertaken community consultation at The Rock, Lockhart and Yerong Creek, who are contributors to and beneficiaries of our Shire wide sewer fund. The consultation provided information about our infrastructure plans over the next 30 years in the whole shire and how those plans can be reasonably funded as per our financial model. The extension planned for The Rock is just one of the projects on the list. The community meetings showed support for the new financial plan as well as proposed sewer extension at The Rock. Generally, the community could see the benefit of the sewer extension to enable the Shire to grow and become more sustainable into the future. 22. LOOSE-FILL ASBESTOS INSULATION (MES/B25-060)

Executive Summary The NSW Government has introduced a suite of changes, including financial assistance and support to homeowners, to deal with loose-fill asbestos in homes. Report Loose-fill asbestos was sold as ceiling insulation In the 1960s and 1970s for residential and commercial premises mainly by one company trading in the ACT as Mr Fluffy. A number of properties in south east NSW have been identified as containing this type of insulation, and so the NSW Government has offered free ceiling insulation testing services of pre-1980 homes in selected Councils (including Lockhart). Property owners that would like to register for the free testing should do so on the NSW Fair Trading website. The NSW Government is providing some immediate options to affected residents to ensure their safety. This may include relocating families while their home is decontaminated, or demolishing the home (depending on its market value and expense of clean up). Affected home owners that fail to act on the issue risk significant financial loss and potential legal action. While Councils has been tracking testing of homes prior to this announcement, no homes have yet to be confirmed to contain loose-fill insulation. Furthermore, the Home Building Act 1989 requires the Secretary of NSW Fair Trading to maintain a register of residential properties that have been tested and verified as containing loose-fill asbestos insulation. NSW Fair Trading is responsible for informing local councils of any identified properties located within their boundaries, which will in turn be listed on any appropriate 149(2) planning certificates. 23. REVIEW AND UPDATE OF PLANNING POLICY (MES/P25-030)

Executive Summary NSW Government Planning and Environment Department have introduced changes through the State Environmental Planning Policy (Integration and Repeals) 2016 and accompanying amendments to the Standard Instrument (Local Environmental Plans) Order 2006 (Standard Instrument Order) and the Environmental Planning & Assessment Regulation 2000 (Regulation). Report Following public exhibition and consultation in 2015, the Department of Planning & Environment has amended legislation to update and simplify a number of State Environmental Planning Policies (SEPPs). The newly introduced State Environmental Planning Policy (Integration and Repeals) 2016 repeals 16 existing SEPPs, and transfers certain provisions of these SEPPS to other environmental planning instruments, including the Standard Instrument Order. While many of the amendments do not affect Lockhart Shire directly, some notable changes include the repeal of the Riverina Regional Environmental Plan No. 1, which regulated the preservation of optimum operational capability of the Defence Communications Facility near Morundah, NSW. Council’s LEP will be amended to include a clause that ensures the ongoing preservation of the Facility. 24. CONTAMINATED LAND MANAGEMENT POLICY (MES/E30-055)

Executive Summary Legislative requirements place even more burden on Local Government to assist in the early identification, management and awareness of contaminated lands within their Local Government Area. In light of these responsibilities, a Policy has been development to govern this responsibility. Report Councils are planning and consent authorities and are thereby expected in relation to the management of land contamination to act in “good faith” in accordance with the requirements of the NSW Contaminated Land Management Act (CLM Act). “Good faith” provisions also extend to the subordinate State Environmental Planning Policy No.55 – Remediation of Land (SEPP 55), and its Planning Guidelines. Furthermore, Councils also have responsibilities under the Environmental Planning and Assessment Act (EP&A Act) in regard to the early identification of contaminated sites, the consideration of land contamination issues in planning functions, data and information management regarding land contamination, and to informing the public on contamination matters (e.g. Section 149 planning certificates). Under the CLM Act, the EPA regulates contaminated sites where the contamination is significant enough to warrant regulation. Contaminated sites that are not regulated by the EPA are managed by local councils through the land-use planning processes. It has identified that for some of the Councils in the ROCs are not sufficiently equipped to manage contaminated land, with this limitation assumed to relate to resource constraints and to a lack of corporate knowledge of legacy contamination. As such, RAMROC and REROC successfully made a joint application to the Regional Capacity Building Program, under the Contaminated Land Management Program administered by the New South Wales (NSW) Environment Protection Authority (EPA) as funded by the NSW Environmental Trust. The Contaminated Land Management Project aims to develop the capacity of Councils on the regulatory framework that underpins management of non-regulated contaminated sites, and to develop expertise and technical capacity to carry out regulated functions under the CLM Act in regards to managing land contamination in planning functions. Developing a contaminated land management policy and procedures as well as a contaminated land site register is expected to enable councils to become better equipped and empowered to confidently ensure that decisions are made in “good faith” and in accordance with regulatory requirements. The policy (attached) has been drafted and reviewed by a Contaminated Land Working Group, made up of Council project participants, and has been through a rigorous process of review being undertaken by Kell Moore Lawyers, EPA and Sutherland Shire Councils contaminated land management team leader.
