Minutes of the Ordinary Monthly Meeting of Lockhart Shire Council held in the Council Chambers,

Green Street, Lockhart on Monday, 17 November 2014 at 5:02pm.

PRESENT

Cr P. Yates (Mayor), Cr R. Schirmer (Deputy Mayor), Cr J. Morgan, Cr R. McDonnell, Cr D. Douglas, Cr G. Driscoll, Cr G. Verdon, Cr J. Paterson and Cr M. Day.

Also in attendance were the General Manager, Director of Engineering and Environmental Services and the Director of Corporate and Community Services.

The meeting opened with a prayer.

The Mayor, Cr Yates, verbally reported on activities during the past month as follows: 19-21 Oct Along with Councillors Day and Paterson, attended the Local Government

NSW Annual Conference in Coffs Harbour. The General Manager, Rod Shaw was also in attendance.

Fri, 31 Oct Together with Councillor Schirmer and the General Manager, Rod Shaw, attended (by invitation) a round-table discussion on Fit for the Future at Coolamon.

309/14 RESOLVED on the motion of Crs Day and Verdon that following great concern on hearing a news report that Australia would only have enough diesel and petrol to last two weeks if imported supplies were interrupted, Council express its dissatisfaction with this situation by letters to the appropriate Minister and Local Member of Parliament and request advice about how the issue is being addressed at the national level.

3. BILLABONG MOTORS BUILDING AND SITE (L05-035)

Cr Day gives Notice that at the Council meeting to be held on 17 November 2014 he will be moving the following:

That Lockhart Shire Council agree, in principle, that following the advertisement for sale of the old Billabong Motors building and site that this building and site be made available to the Community of Lockhart for the extension of the museum, perhaps for display of motor vehicles and farm machinery in relation to the history of Lockhart as well as provide for an extension to the Lockhart Caravan Park. That if such a proposal is agreed on, that it be conditional on funding to be provided by parties other than Council.

1. MINUTES OF THE TOURISM/ECONOMIC DEVELOPMENT STEERING COMMITTEE MEETING (T26-005) MINUTES OF THE TOURISM/ECONOMIC DEVELOPMENT STEERING COMMITTEE MEETING OF LOCKHART SHIRE COUNCIL HELD AT YERONG CREEK BOWLING CLUB ON 4 NOVEMBER 2014 COMMENCING AT 6.40PM. PRESENT Councillor Derek Douglas, Mr Colin Wiese, Ms Sandra Johnstone, Mrs Myra Jenkyn, Ms Justine Isherwood, Mrs Raeleen Pfeiffer, Mrs Susan Creek, Tourism/Economic Development Officer (Jennifer Connor). APOLOGIES Councillor G Driscoll, Mr Greg Smith, Mr Ian McGee. CONFIRMATION OF MINUTES The minutes of the Meeting held Wednesday, 3 September 2014, as printed and circulated be taken as read and confirmed on the Motion of R Pfeiffer. 1. Yerong Creek Attraction

Following discussions at the last TEDSC meeting, there is movement for a tourist attraction to be located in Yerong Creek. An innovative project has been discussed by members of the community. Mr Ross Edwards and Justine Isherwood outlined details of the proposal to the committee and advised a public meeting in Yerong Creek will be called to discuss the proposal and to ascertain if the community is supportive of the tourist attraction project. The TEDO will keep the TEDSC updated on progress. Recommendation: That the information be noted.

2. Green’s Gunyah Museum The Lockhart Historical Society is absolutely delighted with the new building. They advised at their October meeting that they had a very successful Spirit of the Land weekend, attracting approximately 650 visitors, an increase of more than 200 visitors in comparison to last year. The Friday and Monday adjoining the weekend also had very strong attendance. Visitors were very steady for the whole of the month and it has been their strongest October period to date. Work is ongoing ‘making good’ the original Museum building and the Committee have also been successful in their application for a grant for oral history interpretive screens. Recommendation: That the information be noted.

3. The Rock Museum Council has now received letters from The Rock Hall and Museum Committees requesting they merge as a Section 355 committee under the name “The Rock Hall and Museum Committee”. This request will be put forward at the next Council meeting. The combined Museum and Hall Committee are proactively working in creating the Museum and have been successful in a small heritage grant and have applied for further grants. In addition to building a donations list, they have also sourced a number of cabinets to house the initial exhibits. A number of fundraising efforts are to be undertaken.

4. Billboard Advertising

The TEDO is working on three potential sites between Collingullie and Wagga. Negotiations regarding lease rates and length are ongoing. Images of each site will be tabled at the next meeting. Recommendation: That the information be noted.

5. The Legend of the Fairie Tree An information session on the Legend of the Fairie Tree was held at The Rock Hall on Thursday, 23 October at 6pm to discuss details and community benefits of the project. Approximately 20-25 people were in attendance including a large number of members from The Rock Progress Association who have already given their support to the project. A small number of attendees objected to the project/location and outlined alternative suggestions and locations. A copy of the flyer previously distributed in The Rock was again distributed at the meeting. The flyer was also posted on the Lockhart Shire Tourism website to generate interest and provide in depth information on the project. A number of fund raising initiatives for the Fairie Tree are underway and the TEDO will keep the TEDSC Committee updated on progress. Recommendation: That the information be noted.

6. AC/DC Album Launch at The Rock If you want to be one of the first people in the world to hear the new AC/DC album “Rock or Bust”, Sony Music and Alberts are launching the album at The Rock or Bust Markets on Sunday, 23 November, one week before the official release. While the band will not be in attendance, this is a fantastic opportunity to hear AC/DC’s new album as it rocks The Rock! All publicity for the event is being generated by Lockhart Shire Council, through media and social media and Sony are delighted as news of the launch had hit US, UK and Denmark only hours after promotion of the event commenced. Details of the launch and promotion of The Rock itself has featured nationally and internationally, including London’s Guardian newspaper and the online version of Rolling Stone Magazine, the world’s most read music source. Even more exciting, the Mayor of Lockhart Shire Council has been invited to ‘press the button’ to launch the album. A working committee of The Rock Progress Association are meeting weekly in conjunction with the TEDO to ensure a successful day. Held in The Avenue in The Rock, the Rock or Bust Markets start from 8am. The album launch will run from 12-2pm. The central two blocks of The Avenue will be pedestrianised for the event, which is expected to draw approximately 2000 people to The Rock. Traffic control, toilets, food and drink have all been considered, and Police, SES, St John’s Ambulance have been notified. Community groups from The Rock will be running food and drink stalls, a fantastic opportunity for them to raise much needed funds.

As The Avenue will be closed for the duration, all stall holders must be in, have their things unpacked and vehicles moved out of street by 8am as there will be no vehicle movement in The Avenue between 8am and 2pm. Recommendation: That the TEDO be applauded for her efforts in working with Sony Music to secure AC/DC’s worldwide album release at The Rock.

7. A Touch of Christmas

The TEDO is encouraging widespread community involvement in this year’s Christmas shopping evening on 12 December in Lockhart. Santa will once again arrive by fire truck, elves from Lockhart Central School will hand out lollies donated by IGA, there will be Christmas Solos and a Christmas Choir, Rotary and Lions are running a joint BBQ, Lockhart Ex-Servicemen’s are sponsoring Best Christmas Lights and Lockhart Anglers Club are sponsoring Best Shop Windows. Secret Santa will be answering letters, gifts to the value of $10 can be left at Lockhart Newsagency for Santa to give out (to be confirmed with P&C’s if this will work) and a number of other community groups have been approached to run stalls/raffles etc. Lockhart Central School and St Joseph’s School have been approached to be involved in a Christmas street parade, whereby students would dress up in Festive/red clothes, and if confirmed the Pre-School and Boree Creek School will be invited to join in. If the parade proceeds, the main shopping section of the street will be temporarily closed. A Christmas tree will be placed in the main street, with residents encouraged to decorate by placing a Christmas bauble, etc. In previous years, The Rock held Christmas In The Avenue and the TEDO is encouraging the resurgence of this event. The Rock, Yerong Creek and Pleasant Hills have been approached to see if they would like a live Christmas tree to place in their township. The trees will last a number of years in posts and will be maintained by Council whilst not on display. Each community has been advised they would need to provide decorations for the tree. Recommendation: That the information be noted.

8. Sculpture Trail/Signs The importance of the growing sculpture trail in Lockhart was discussed, with the need to ensure sculptures were positioned for maximum impact. It is envisaged that the newly acquired sculptures will build on the existing sculpture trail, as will the Lockhart Lovelocks and a possible native bird sculpture in Hodgson Park to commemorate the E.E.Heckendorf Aviary. By providing a well-planned and documented sculpture walk, visitors are encouraged to park and look at more than one section of the sculptures available to view. They have a valid reason to extend their time in Lockhart, exploring the town and ensuring foot traffic past the shopping centre and museum. The extension of the sculpture trail through the Shire will provide alternative routes for travellers and will encourage day-drives, however it is important each township can create their own unique twist on the theme to ensure visitor appeal. Tootool have already created a wonderful sculpture park, while The Rock is working on the Fairie Tree, the biggest public sculpture in the Riverina. Residents in Yerong Creek have recently come up with an original and novel idea that will tie in with the sculpture trail theme and encourage visitors to town and the concept is subject to a public meeting in the near future. Pleasant Hills have indicated their interest in having a sculpture, but one that is relevant to their town and the people. They will be working on ideas for this sculpture as part of their ongoing plans for the town.

Concerns regarding the need and number of signs in the Shire was also raised, with suggestions that some of the funds allocated to the signs project could be diverted to assist with funding elsewhere. Recommendation: That the information be noted.

9. TEDO Projects The TEDO is currently working on a number of additional projects to improve economic and tourist services in the Lockhart Shire. The TEDO reported briefly on the following projects at the meeting.

Wall/Walk of Fame The potential sites of the Wall/Walk of Fame will be on the agenda for the first meeting in 2015.

The Rock Nature Reserve Upgrade work has commenced with new BBQs installed, the parking area expanded and bollards installed. Work on the new toilet facilities have commenced.

Galore Hill Lockhart Central School have confirmed they are interested in working with Council to create a long term ‘Friends of Galore Hill’ project, with students collecting seeds, propagating and planting under the guidance of Council.

Community Garden Prime have interviewed, Lockhart schools have donated scarecrows.

Youth Opportunities The TEDO has approached the Museum and Red Cross regarding retail opportunities for youth volunteers.

Local Accommodation Accommodation for those looking to move to Lockhart, who are not in a position to build/buy needs to be considered. Ongoing project

Industrial Land Funding Policies

The TEDO is putting together information for a funding policy for the Industrial land. There is potential for an industrial/residential land package. Ongoing project

Next meeting will be held at The Rock Memorial Bowling Club on Wednesday, 4 February 2015 at 6.30pm. Recommendation: That the information be noted.

200/14 DW Fixing Country Roads - State Government Funding Initiative Council’s priority list of projects to be submitted as an EOI is as follows: 1) The Rock Road - from Ford St to Vincents Rd, 5km

and major culvert upgrade, $1M 2) Grubben Rd - from Shire boundary to Eulensteins

Ln, 1.5km seal and culvert upgrade, $500k 3) Boree Creek Rd - from Narrandera Rd to Boree

Creek, 12km rehab and widening and culvert upgrade, $2M

4) Urana-Boree Creek Rd - from Yuluma to Shire boundary, 12km rehab and widening and culvert upgrade, $2M, and

5) The Rock Road - from East St to Milbrulong, 12km rehab and widening and culvert upgrade, $2M.

EOI’s submitted 4/8/2014. Transport for NSW has advised that all 5 of our submissions have been accepted to proceed to next stage of application. Information session in Wagga 6 Nov 2014. Next stage to be submitted by 5 Dec 2014.

Ground a) Council to accept the proposed agreement with

NBN Co for NBN Co to remove the existing flood light tower at the Lockhart Recreation Ground and replace it with a similar facility in approximately the same location with Council’s floodlights attached

b) NBN Co payment of $20,000 to be placed into reserve for future Lockhart Recreation Ground improvements

to the Lockhart Local Environmental Plan 2012 a) Planning Proposal – Amendment No. 1 to the

Lockhart LEP 2012 to be adopted as exhibited b) Amended document to be forwarded to the Dept of

Planning & Infrastructure with a request to draft and finalise the Planning Proposal.

Executive Summary Report from Fit For the Future (FFF) Workshop held on Thursday 6 November 2014. Report A Council Workshop was held on Thursday, 6 November to discuss structural change options for the LG Industry associated with the FFF package recently outlined by the State Government. The notes taken from the Workshop are attached and need to be endorsed by Council. The important consensus reached at the workshop were: - to have discussion/talks with neighbouring Councils: Wagga Wagga, Greater Hume; Urana; and

Narrandera - Financial considerations discussed with regards to Own Source Revenue (OSR) and being

sustainable - This is a preamble to community consultation - Further report to future Council Meetings as information comes to hand, with possibility of Extra-

2. SECTION 355 COMMITTEE MERGER (GM/C70-035) Executive Summary Proposal for merger of The Rock Hall Section 355 Committee with The Rock Historical Society. Report Council is aware that negotiations have been proceeding over the last few months to utilise The Rock Hall to house the proposed The Rock Museum, and how best the controlling bodies could work to bring it about. Following meetings with the two community groups, a letter has now been received from The Rock Hall Committee advising that its Section 355 Committee would like to merge with The Rock Historical Society to create The Rock Hall and Museum Section 355 Committee. This is an entirely acceptable request and receives full support from staff as a good outcome for both community groups – it provides a home for the proposed museum and will increase the usage of the hall to a more viable community facility, as well as increasing patronage and visitation to The Rock when the museum becomes established. 3. CHRISTMAS OFFICE CLOSURE (GM/S30-005) Executive Summary Details of proposed normal Christmas office closure. Report Council normally closes its office for the three working days between Christmas and New Year. Staff work up the time for these days through time accrued for rostered days off. This year New Year’s Day falls on Thursday and staff would normally return to work the day after, on the Friday. Because of the lack of activity at this time of year, and minimum inconvenience to the community, it is proposed that the office remain closed on the Friday, and re-open on Monday, 5

January 2015. Staff would be required to use an appropriate form of leave to cover for the closure on that day. As is routinely the case, staff will be available to cover for any emergencies which may occur over this period. Executive Summary Review of funding arrangements Report It is a time honoured tradition for the Mayor to have a Christmas party each year which is held in various parts of the shire and to which the Mayor invites members of the local community to attend. It is also traditional in Lockhart Shire for the Mayor to bear the cost of the party, that cost being seen as a component of the Mayoral allowance. This year the party is to take place at Osborne and the cost is in excess of $1,000.

In my experience in the industry, this Council is the only one which expects the Mayor to meet the cost of its Christmas party from his own pocket – others take the view that the Mayoral allowance is well and truly expended on the many duties and time required by the Mayor to adequately perform his civic duties, and that the Christmas party is a legitimate governance cost and an appropriate way for the Mayor to show appreciation for support received from various parts of the community throughout the year. The time commitment by the Mayor in the past 12 months has been ramped up considerably by the Fit for the Future discussions currently taking place.

In these circumstances, it may be appropriate for Council to meet either the partial or the total cost of the Christmas party. Nominations for citizenship awards are currently open and close on Friday, 5 December 2014. An Awards Committee needs to be determined to make recommendations to Council’s December Meeting on award recipients. This will follow ranking sheets being forwarded to Councillors following closure of nominations on 5 December. Last year, the Committee was The Mayor and Councillors Schirmer, Paterson and Douglas. STANDING TREES (GM/R40-107) Executive Summary Review of the current policy 2.35 titled ‘Collection of Firewood from Council Road reserves and Dead Standing Trees’. Report This policy was last reviewed in 2009 and its object is to define the manner in which dead wood may be collected from road reserves for residential heating purposes and the removal of dead standing trees from road reserves for the same purpose. The existing policy needs to be amended to take account of the dwindling supplies available on our road reserves and to ensure that applicants are residents of the shire. 7. POLICY REVIEW - NOXIOUS WEEDS CONTROL (GM/N10-035) Executive Summary Review of the current policy 2.24 titled ‘Noxious Weeds Control’. Report This policy was last reviewed in 2011 and its object is to make all lands within the Shire as free of noxious weeds as possible. The existing policy is substantially effective, and except for procedural changes for legislative titles and organisational positions, only one section of the existing policy is proposed to be changed, by its complete deletion. The section proposed for deletion is Clause 4.4 relating to Management Plans as an enforcement option. Clause 4 currently contains 4 enforcement options as follows: - Section 20 of the Act (allows for Council to enter the land and control the weeds at the owner’s

expense) - SEINS (Issue a penalty notice for not controlling weeds, in accordance with the Act and

Regulations) - Prosecution (In accordance with section 19 of the Act, including Court proceedings) - Creating a Management Plan in cooperation with the property owner. This last option is now redundant, having been highly ineffective in the past, by not restricting the growth and spread of noxious weeds. This occurs because at least 3 or 4 months have already occurred and four chances have already been given to the landowner to control weeds on the property. The creation of a Management Plan will take a lot longer, will likely have limited success, and will encourage the next generation of weeds before any action gets taken. The other three enforcement options are more effective and are considered sufficient to ensure compliance. Attached is a copy of the current and the proposed policy with changes marked. Executive Summary Monthly report on Engineering Matters. Background Information a) Works Report: All three grader crews are working on construction projects, being Osborne-

Yerong Creek Road, Alma Park Road and Urana-Boree Creek Road. Works on MR543 has commenced with culvert widening and expect pavement works to commence shortly. Contract to win and crush gravel at Council managed gravel pits has been let and works are now 80% complete. A marked up programme for the next 12 months will be presented at the meeting.

b) Flood Mitigation: First meeting was held 14 October 2014. A meeting with LLS and NSW Fisheries to discuss creek vegetation is to be held late November 2014. Community awareness days to be conducted by SES are set for 14 March 2015 (Lockhart) and 21 March 2015 (The Rock).

c) Road Safety Officer: Nil to report.

d) Traffic Committee: Nil to report.

e) Lockhart Local Emergency Management Committee: Meeting was held 17 October 2014. RFS is conducting a community consultation evening in Pleasant Hills on Friday, 5 December 2014.

f) Fleet: Orders have been raised for all fleet replacement programme for 2014/15 as per Operational Plan. Most new fleet replacement has been delivered with last two items due first quarter in 2015.

11. WASTE CONTRACT 2015/16 (DEES/LD4D-10)

Executive Summary Council’s current waste contract is due for completion 1 July 2015. Background Information Council’s current waste contract is due for completion 1 July 2015. Transpacific Cleanaway has provided excellent service under the current contract. The Director of Engineering & Environmental Services has been in discussions with both Wagga Wagga and Urana Council’s about a joint tender/service for 2016/17 year and beyond. Wagga Wagga’s current contract does not expire until 20 June 2016, and Urana’s is due for renewal shortly. It is expected that such a joint tender should provide some economies of scale and savings to Council. It should also be noted that Wagga Wagga runs a three bin collection service. 12. NOXIOUS WEEDS (DEES/N10-025)

Executive Summary Monthly report on Noxious Weeds. Report Property Inspections Targeted inspections were carried out on properties that had previously known weed infestations or weed possession that was evident from roadside areas or from neighbouring properties. Some property owners were unaware that the plants present were classified as noxious or were unable to identify the weed species. Attitudes towards control weeds have been encouraging, and many property owners have requested information in regard to plant identification and appropriate weed control methods. The weeds most commonly found were Bridal Creeper (Asparagus asparagoides), Privet (Ligustrum sp.), Horehound (Marrumbium vulgare), Prickly Pear (Cylindropuntia sp.), and Lippia (Phyla sp.). Small infestations also included Wild Radish (Raphanus raphanistrum), Green Cestrum (Cestrum parqui), and Lantana (Lantana camara).

Inspections on these properties showed evidence of sufficient weed control, and inspections were used to ensure follow up control was carried out. Spray Program Priority for spraying has been given to the control of Horehound (Marrubium vulgare), Bridal Creeper (Asparagus asparagoides), and St John’s Wort (Hypericum perforatum) on shire roads, as well as monitoring known areas of Silverleaf Nightshade (Solanum elaeagnifolium) and Spiny Burr Grass (Cenchrus sp.). Red Guide Post Program Following identification by a travelling member of the public, a population of Coolatai Grass (Hyparrhenia hirta) was located close to the Lockhart Shire’s boundary on the Olympic Way, just north of Henty. These plants have been eliminated and the appropriate red guide posts have been installed to alert vehicle operators of the possible present of noxious weeds in this area, and the potential spread of noxious weeds through vehicle contamination. ERNWAG Councillor Jim Morgan and Council’s Noxious Weeds Inspector attended an ERNWAG meeting held on 16th October at Albury. Issues that were raised included: the responsibility for noxious weed control on roads maintained by Roads and Maritime Services; the proposal initiation of the Red Guide Post Program to become state-wide; and the implications of the proposed DPI collection of weed data. Legislative Policy and Planning Implications The Natural Resources Commission has published their ‘Review of Weed Management in NSW’. The NSW Government has prepared a response outlining supported recommendations. The NSW Invasive Species Plan for 2015-2020 is still being developed by a planning group. The Weeds Action Program 2015-2020 is still being developed by DPI. Local Land Services will have an increasing role in regional weed management; the framework for this role is being developed.

13. PARKS AND GARDENS REPORT (DEES/P10-005)

Executive Summary Monthly report on Parks & Gardens. Report General maintenance Regular duties include inspections of parks and public facilities to remove litter, clean BBQ’s, check for damage or vandalism, clear footpaths and empty public and roadside bins. Most areas undergo inspections twice per week, including Galore Hill, where crews also clean and check the toilet facilities. Contract cleaners attend to the public toilet facilities in Lockhart, The Rock and Yerong Creek. Playgrounds in the shire are being inspected regularly as per Australian Standards, with any maintenance being noted and completed as necessary. CWA Park The “Emu Family”, kindly purchased by Bendigo Bank has been installed at CWA Park, joining the Farm Art Sculptures Trail. The new ‘Spirit of the Land’ signage was also erected in the park to promote the Festival; it also explains the presence of the sculptures at CWA Park and hopefully encourages visitors to explore the Shire further. The park now has quite a nice balance between sculptural installations and landscape; the gardens are not yet to their mature size but it is all coming together nicely. The lawn area has been kept clear as it was originally designed, to cater for marquees to complement the Hall’s facilities. Sculpture Trail The creator of ‘My Waratah’, Raeleen Pfeiffer has meet with Council staff and discussed her preferred positions to display her work. Raeleen was concerned that placing the piece into an existing garden would detract from it and mask the base and stem. Taking into consideration the growing sculpture trail walk in Lockhart, which aims to create a natural walking trail through the town, it was felt that the existing circular garden bed at the end of Cowin Gardens was a suitable position to showcase ‘My Waratah’. Cowin Gardens is already the home of Keith Simpson’s work, ‘The Good Old Days’ which encourages many people to stop at this site, and the placement of Raeleen’s sculpture in this position at Cowin Gardens would create a link to ‘The 9 Martyrs’ at Walter Day Park. There are currently only two plum trees toward the back of the garden bed at the proposed site, so the sculpture can take centre stage, with further landscaping designed around the piece. The Sculpture Trail now extends from Walter Day Park to the Caravan Park at the western end of town and The Pastoral Shadows of Brookong at the eastern end. Pools Both pools are up and running, with Council staff conducting regular vacuuming and water testing. The amenities buildings, gardens and lawns will also be prepared before handover to the contractors. Our newest contractor, Sophie Driscoll has been receiving instruction from a Council staff member at The Rock Pool to ensure she is confident in her role. Megan McKenzie is running the Lockhart Complex again.

Lockhart Shire Council Ordinary Meeting – 17 November 2014

EE Heckendorf Aviary The aviary has been removed and the site tidied up for use during the Spirit of the Land Festival. A garden commemorating EE Heckendorf will be designed and installed on the site at a later date. Bond Street, Lockhart 14 Eucalyptus leucoxylon and Melaleuca lanceolata have been planted in the Bond Street subdivision to fill a gap in the existing fence line planting; offering potential purchaser’s privacy and screening neighbouring properties. Mowing and Slashing Irrigated areas are being mowed and edged at least fortnightly. The spring slashing schedule has been a high priority leading up to the many major events in and around the Shire recently including the Picolight Fly-in, Lockhart Show, Henty Field Days, Lockhart Picnic Races and Spirit of the Land Festival and The Rock Show. Now that these events are over, the hot dry weather is upon us and Christmas becomes the focus. Slashing has already been completed at Pleasant Hills, Mundawaddery Cemetery, Milbrulong, The Rock and Yerong Creek H/way and Lockhart Airstrip. All slashing is scheduled to be completed shortly to avoid the risk of fire. Parks and Gardens The Shire’s roses are in full bloom, dead heading will be scheduled regularly to keep them at their best. Irrigation issues have already been experienced and dealt with. Routine checks and maintenance will continue throughout the irrigation season. Routine maintenance is being conducted including regular weeding, spraying, pruning, watering, planting of replacement shrubs and mulching. Weed Control Regular weed control is being conducted on Council property including hand spraying and weeding of gardens. Khaki and cathead are coming into season, know problem areas will be monitored throughout the warmer months. Legislative Policy and Planning Implications Nil. Budget and Financial Aspects Will be conducted within Council’s allocated budget. Attachment Nil. Recommendation: That the information be noted.

333/14 RESOLVED on the motion of Crs Paterson and Schirmer that the information be noted. 15. POLICY FOR KEEPING OF LIVESTOCK IN RESIDENTIAL AREAS (MES/H10-035)

Executive Summary Following an overwhelming number of submissions, Council resolved at its February 2013 meeting to not adopt a Keeping of Livestock in Residential Areas Policy. As a result of recent incidents in the Shire involving keeping of animals, Council requested at its October 2014 meeting to revisit the Policy. Background Information The larger allotment size and rural setting of the Shire and its residential areas is generally encouraging for property owners to house animals on their land for companionship or as a hobby. Occasionally, Council staff receive notification from concerned residents about the health of these animals, or the environment on which they are kept. Dust, odour and escapees are the most common issues raised. In light of these issues, Council staff were requested to present a draft Policy on the keeping of livestock in residential areas. The policy was aimed to provide guidance to property owners and occupiers on keeping on livestock, while maintaining the amenity of the area for other residents. The draft policy, which when displayed for public consultation in 2012, was not well received, and Council thus resolved to not adopt the policy. In an attempt to kerb frequenting issues from repeat offenders, Council requested at its October 2014 meeting to revisit the Policy. Policies referenced during the October meeting from Griffith City and Forbes Shire Councils have been attached to this report, and while they do provide detailed information to residents, Lockhart Shire Council is still faced with the dilemma of having no compliance/ranger staff available to enforce such extensive regulations. Meanwhile, previous requests for Wagga Wagga City Ranger services to extend their current contract beyond companion animals have been declined. In revisiting the Policy, Council must consider its relevance to the Lockhart Shire – the larger block sizes, anticipated level of compliance, the level of service staff employed by Council – these factors play a significant role in determining its success. Noting these issues, the policy objective should only be to act as a guiding document to landholders.

While stocking rates should be a matter of common sense, with land availability being the determining factor, the proposed policy (if adopted) is predestined to target those who already choose to heavily stock small portions of land. If the policy to become enforceable, the major issue will be forcing those who already have animals in their possession to de-stock, in order to meet policy requirements. Council remains severely restricted with regards to resources required to adequately enforce and/or prosecute those deemed non-compliant. To provide such a service, Council would have to commit substantial funding towards training, personal protective and handling equipment, legal authorization, handling/impounding facilities (yards, loading ramps, transport), and in severe cases, measures to permit euthanising of animals. Previously, in some significant cases, Lockhart Shire Council staff have been required to issue infringement notices to some landholders for improperly keeping stock, or for roaming stock - and often with mixed results. Staff have acknowledged how issuing of notices have had little effect in preventing recurring events, and landholders rarely demonstrated a change in behaviour towards keeping of their animals. Recently, and as an alternative to prosecution, Council staff have operated on the premise that, rather than paying an infringement notice, the offender was better off using that sum of money to apply measures for ensuring future compliance, including purchase of fencing materials. Such an approach has been graciously received, and positive results have been documented. Currently, in instances where high stocking rates or animal are already a cause for concern, neighbouring landholders are swift in notifying Council, Police or the RSPCA of any issues, and these are addressed accordingly on a case by case basis. Council staff currently take a proactive approach and work with the offender(s) to ensure the issues are rectified, and only in specific cases where no reasonable action is undertaken, do Council issue orders under the Local Government Act 1993. Integrated Planning and Reporting Reference D3.2.1 - Clearly define land use requirements and developments in line with State Government Regulations. Legislative Policy and Planning Implications - Revisit of Keeping of Livestock in Residential Areas Policy, as originally reviewed by Council in

February 2013. - Council staff have few avenues for enforcement of compliance with the policy. - Compliance with noise and odour from keeping animals may be regulated under the Local

Government Act 1993. Budget and Financial Aspects Significant cost implications based on level of enforcement of policy regulations. Attachments 1. Recommendation: That Council: - does not pursue the drafting of an enforceable policy for keeping of livestock in residential

areas; - consults with residents of the Shire to create guidelines on keeping of animals in residential

areas; and - continues to work with landholders on a case by case basis as matters of concern regarding

animals are brought to attention.

1. Meeting held 15 October 2014. 2. Gary Hiscock returned as Chairman; Greg Verdon Deputy Chair - both unopposed. 3. Southern Trunk Main (held up due to Kapooka Bridge) is now well underway 4. Council asked to investigate separate water supply for southern area of The Rock, currently fed

directly off main. 5. Council has reviewed its decision to build 1:100 year levy around site and has agreed to proceed. 6. Council has supported REROC’s application to be a trail ROC. 7. Attended Local Government Conference at Coffs Harbour as part of RWCC. 8. Council has also agreed to conduct its February meeting at Lockhart, to include tour of western

facilities. 9. Council Auditor happy with checks and balances now in place. Cr Greg Verdon

Riverina Regional Library (RRL) Advisory Committee - November 2014 I attended the RRL Advisory Committee Annual General Meeting on 5 November 2014 at Wagga Wagga City Council. Key Items of Interest: 1. Election of Chairperson/Deputy Chair

• Cr Yvonne Braid re-elected unopposed, Cr Halliburton elected Deputy • Executive Committee - Ken Trethowy GM Cootamundra, David Smith Greater Hume, Barry

McFarlene Urana Shire and Kevin Poynter Wagga City. 2. 2013/14 Budget Report

• Final result was a small surplus of $7,256 • Unrestricted funds are $472,809 • Main operational impact for the financial year was the admission Corowa, Urana, Tumbarumba

and part of Greater Hume Shires • Overall result considered satisfactory - report adopted.

3. Items of Interest

a) Admission of Bland Shire to RRL. b) Upper Murray Regional Library Liquidation Funds were directed to RRL in the amount of

$165,000. These funds placed in Reserve. c) Extension project to RRL Headquarters has been approved. Application for grant unsuccessful,

will resubmit. d) RRL Management Team will visit all Councils over next 18 months. e) No increase in State Government funding. f) State Library Council visited Wagga on 29 October, which I attended. Council consists of 2

former Cabinet Ministers, Andrew Tink and Rodney Cavalier. g) Customer Perception Survey undertaken in 2009 showed 71% approval rating. The 2014

survey showed 100% approval. h) RRL Annual Report is available. i) Lockhart Shire has one of the lowest usage rates for library services.

Women in Local Government NSW Leadership Summit 2014 – 22-23 October 2014

The summit was a great experience that allowed an insight into the workings of larger councils and shires. The speakers were interesting and wide ranging. Two examples of topics covered were: Katherine O’Regan, Deputy Mayor, Woollahra Council We are operating in new and different times. Building cultures and communities of innovation and collaboration is a national imperative. It requires Local Government leaders to think and act big as well as think and act small. It requires Local Government leaders to reach out to new partners and new methods. Leaders must pilot ideas for the community as well as deliver services tailored to individuals. In the session Katherine shared practical strategies to lead innovation and collaboration systems: • Innovation strategy, return on investment • Leading innovation • Recognising, cultivating and retaining collaboration. Cathy Henderson, Director, Waverley Council Any effective leader knows that change and uncertainty is ever present in today’s world. There are libraries full of helpful theories and approaches to change management but translating principles into practice can be challenging. For all leaders in Local Government, agility and strong leadership are critical skills in times of transition and uncertainty. The session considered issues leaders may find themselves grappling with during such times. We looked at: • Strategies addressing uncertainty and the unexpected • How to use leadership skills for the best outcomes. I would like to explore avenues to engage our youth in government and the opportunities they may like to challenge themselves with. Cr Gail Driscoll ERNWAG Meeting, Albury – 16 October 2014

Councillor Morgan attended this meeting with Council’s Noxious Weeds Inspector. The meeting highlighted again the Red Guidepost Program to control noxious weeds on roads. Cr Jim Morgan

(i) Entrance to Lockhart Depot - Cr Morgan noted that some people are finding the entrance to the Lockhart Depot difficult to find with the gates now moved to Federal Street and requested that a sign be put up on the old gates, directing traffic to the new gates.

Response - Director of Engineering and Environmental Services DEES advised he will investigate and take appropriate action.

(ii) Verandahs in Lockhart Shopping Precinct – Enquired as to who owns the verandahs in the

Lockhart shopping precinct.

Response - Director of Engineering and Environmental Services DEES advised that the property owners own the verandahs, but Council maintains the footpath. The verandahs are heritage listed and as such, Council needs to be consulted before any works are to occur.

Cr McDonnell (i) MR59 West Shoulder Widening - Cr McDonnell enquired as to when this widening might

occur?

Response - Director of Engineering and Environmental Services DEES advised as per 10 year program in the budget, works are set to commence 2016/17 year.

(ii) Statement - Butcher’s Shop now open in Lockhart.

Cr Schirmer (i) Kurrajong Tree in Front of Museum Extension – requested this tree be considered for

removal.

Response - Director of Engineering and Environmental Services DEES advised he has previously written to the Historical Society to advise that removal will be considered in the future, however the tree will remain for the time being.

(ii) Statement – Thank you to DEES for sorting out B-Double Issue that arose on the weekend

of 15-16 November.

Cr Douglas (i) Request re. Future Program for Mowing and Vegetation Management – requested that

intersections such as Osborne-Yerong Creek Road and Ryans Lane be included on future program.

Response – Director of Engineering and Environmental Services DEES advised that staff are currently attending to major intersections and he will investigate this further.

(ii) Historical Information Sign at front of Post Office in Lockhart – noted this sign is badly faded and not legible.

Response - Director of Engineering and Environmental Services DEES advised that he is aware of this and it is already listed on jobs to be undertaken.

Cr Driscoll

(i) Involvement of Local Youth in Local Government - Requested that Council possibly explore avenues for local youth to be involved in Local Government, e.g. an awareness program?

Response - Director of Corporate and Community Services DCCS advised that this is already underway with Council’s new shared Youth Officer and further information will be advised in due course.

(ii) Requested that a Playground and BBQ Facilities for The Rock Recreation Ground, just

north of the Pool Complex, be included in future Budget considerations.

Response - Director of Engineering and Environmental Services DEES advised that this has been discussed at staff level previously and he will investigate and advise likely costs.

Cr Verdon

(i) Status of Dump Point for The Rock – Enquired re. status and advised that there is funding available through “grey nomads”.

Response - Director of Engineering and Environmental Services DEES advised he has yet to make any progress on this matter but it is on the list of actions to do.

(ii) Maintenance of Gardens at The Rock Medical Centre - enquired as to who is responsible for this maintenance.

Response - Director of Corporate and Community Services DCCS advised that he will check the lease agreement and advise.

Cr Paterson (i) Requested that Urana Street, The Rock receive special attention in preparation for

upcoming markets and launch of new AC/DC Album – to include removal of weeds in pavers/any loose pavers and sweeping up of leaf litter.

Response - Director of Engineering and Environmental Services DEES advised that this was in hand but would check on staff progress.

Cr Day (i) Modification of Lockhart Town Sign on Wagga Road by Progress Association – requested

that modification be adjusted.

Response - Director of Engineering and Environmental Services DEES advised that he will move the new sign down below the section of sign which was covered.

Cr Yates (i) Large Number of Rabbits within the Rail Corridor in the stack of sleepers at Yerong

Creek - Cr Yates requested that a letter be written to ARTC advising of the problem.

Response - Director of Engineering and Environmental Services DEES advised he will write to ARTC.

(ii) Poor State of Olympic Highway (particularly just south of The Rock) – requested Council

write to Daryl Maguire, Local Member for Wagga Wagga, RMS Wagga Wagga and The Hon. Duncan Gay, Roads Minister, stating our dissatisfaction with the road.

Response – General Manager GM will write letters as requested.
