Current Format (December 2012 to Present) Security Characteristics: The most evident new feature is a laser perforation of “MO” that can be seen when held up to a light source. Other security features include a laminate that contains the state seal which will change color when the card is tilted for review and certain graphics that will appear green under UV light. License Format The format is a randomly assigned number consisting of one alpha and five to nine numbers or of nine numbers only. There is no coding based on last name or county of issuance. In 2005, Missouri implemented the requirements of the Federal Intelligence Overhaul Legislation (S2845) which prohibited states from displaying the Social Security Number (SSN) on any driver license or personal identification card. Prior to 12/17/05, the SSN could have been assigned as a DL number.

least 25 years of age who has been licensed for a minimum of 3 years and has received written permission from the parent or legal guardian. The holder of a temporary instruction permit who is 16 years of age or older may operate a motor vehicle with any licensed driver who is 21 years of age or older. Under any condition, the licensed driver riding with the permittee must occupy the seat next to the driver.

Intermediate License For ages 16 to 18, must have driven with an instruction permit for a minimum of 6 months. The qualified person, grandparent, or qualified driving instructor must certify the driver has received 40 hours of behind-the-wheel instruction with a minimum of 10 hours of nighttime driving. The applicant must have no alcohol-related offenses in the last 12 months, and no traffic convictions in last 6 months. Seat belts required for all passengers and no driving alone between 1 a.m. and 5 a.m. During the first 6 months, an Intermediate driver is limited to only 1 passenger who is under 19 and who is not a member of their immediate family. After the first 6 months, an Intermediate driver is limited to less than 3 passengers who are under 19 and who are not members of the driver's immediate family.

Residency As soon as one establishes residency a Missouri license must be secured. If a new resident surrenders a valid current driver license or one that is expired 184 days or less from another U.S. state, Missouri waives the skills and written tests. All applicants are required to pass the Missouri

road sign recognition and vision tests. Non-resident's home-state license is honored on a reciprocal basis.

Renewal Drivers 21-69 years of age receive a license expiring in 6 years or less based on proof of identity verification. Applicants for CDL with a hazmat endorsement are limited to a license term of 5 years or less based on federal regulations. Driver keeps same assigned license number when renewing. One must provide documents to verify name, date of birth, place of birth, SSN, and Missouri residential address. Intermediate license expires in 2 years or less based on proof of identity verification. Drivers 18-20 years or drivers age 70 and over receive a license expiring in 3 years or less based on proof of identity verification. Active-duty armed forces members (temporarily mobilized and deployed outside of Missouri) may obtain a new, renewal, or duplicate permit/driver/non-driver license via a mail-in process or through a power of attorney when required documentation is submitted. Elderly-Related Restrictions Ages 70 and over renew on date of birth of third year. Applicants age 70 and older are eligible for a non-expiring non-driver license (identification card). Applicants age 65 or older renewing a non-commercial driver or non-driver license or instruction permit are exempt from presenting documents for place of birth.

Vehicle Insurance, Title, and Registration Facts Registration Renewal

A vehicle can be operated for 30 days beyond the vehicle's registration date if it is being driven to reset the vehicle's readiness monitors in order to pass the on-board diagnostic (OBD) emission inspection. A copy of the most recent failing OBD test must be kept in the vehicle to present to law enforcement, should they be stopped for expired plates. Certain drivers are eligible to renew vehicle registration online with the Missouri Online Registration Exchange (MORE), if a PIN (Personal Identification Number) is recorded on the renewal application. New Residents New residents must register (and title) vehicles within 30 days of establishing residency. If a boat, then the requirement is 60 days if the boat is kept in Missouri for 60 days, regardless if owner is out-of-state.

Inspections and Emissions Testing A vehicle safety inspection is required statewide. Vehicles are exempt for the first 5 years following the model year of manufacture, as well as vehicles registered in excess of 24,000 pounds or above for a period of less than 12 months. Certain areas require an emissions inspection. Vehicles 1995 and older are exempt from emissions testing requirements. Even model year vehicles must be inspected when the registration expires in even years and odd model year vehicles when the registration expires in odd years. Emissions inspections only apply to residents of St. Louis, St. Charles, Franklin, and Jefferson counties, and the City of St. Louis. The program, known as the Gateway Vehicle Inspection Program (GVIP) combines safety inspections and emission testing into one program. A

number of different vehicles are exempt from an emissions inspection for a variety of reasons. For details, please go to http://dor.mo.gov/motorv/help.php#emissions.

Plate Facts Two plates are issued to a vehicle with the exception of a commercial motor vehicle licensed in excess of 12,000 pounds, a commercial bus, or transit bus. The year tab shows in the center of the plate. Any owner of a commercial motor vehicle whose vehicle is licensed in excess of 12,000 pounds has the option to be issued a second license plate at their request. The plates do not indicate the county or city where the plates were issued. When a vehicle is sold, the plates remain with owner.

Insurance and Financial Responsibility Missouri has compulsory insurance and requires all vehicle owners and drivers to be financially responsible and show proof of financial responsibility to the Department of Revenue or to any law enforcement officer when requested. Minimum liability limit amounts are $25,000/50,000/10,000. MO law also requires owners to have uninsured motorist coverage of $25,000 for bodily injury per person and $50,000 for bodily injury per accident. Proof must be carried in the vehicle at all times, electronic insurance cards on a mobile device are acceptable. The state does not have a no-fault insurance provision. Anyone renewing license registration for their vehicle must present their insurance card or other acceptable proof of insurance. Proof is required normally for reinstatement after suspension or revocation and for “certain” violations. SR-22 forms are normally used, but in some instances insurance companies send this information electronically.

Withdrawal Sanctions, and Alcohol and Drug Testing Alcohol and Chemical Testing

Missouri's illegal intoxication level is .08 percent and above, .04 percent if operating a CMV. If blood alcohol content is .08 percent or higher (.02 if under 21), a provision for “license withdrawal” is instituted. Saliva, urine, blood, and breath testing are authorized. Missouri has both an implied-consent violation and a provision for an administrative suspension. Minors arrested or stopped with .02 or more blood alcohol content are also subject to administrative sanctions.

Point System and Suspensions The Missouri point system ranges from 1 to 12 points. Drivers could be suspended with an accumulation of 8 or more points in 18 months or

revoked for an accumulation of 12 or more points in 12 months, 18 or more points in 24 months, and 24 or more points in 36 months.

Suspensions and Revocations • See the Appendix for a list of the federally mandated disqualifications for offenses occurring in a CMV per MCSIA. • A driver under the age of 18 may be denied a license if the driver’s parent or guardian makes a request that the Director of Revenue deny

About Alcohol-Related Offenses • Any person convicted of two intoxication-related traffic offenses within a five-year period is denied all driving privileges for five years. After

five years the privilege to drive can only be restored by court order. • Any person convicted more than twice of an intoxication-related traffic offense is denied all driving privileges for ten years. After ten years

the privilege to drive can only be restored by court order. • Individuals with more than one alcohol offense on their driving record must have an ignition interlock device (IID) installed prior to

reinstatement of their driving privileges OR issuance of a Limited Driving Privilege (LDP) or Restricted Driving Privilege (RDP). The IID must be maintained for the duration of the LDP/RDP and for six months following the reinstatement date without violations. The driver is required to report to a certified IID vendor each month for maintenance to ensure the device is working properly. Failure to maintain the device, removal of the device, or violations during the first six-month period may result in a re-suspension of driving privileges and an additional six-month extension of the IID requirement.

Notes: 1. The Department issues RDPs only for certain alcohol-related suspensions. The driver must file proof of liability insurance (i.e., SR-22 form)

and proof of installation of an IID (if required) with the Driver License Bureau. A person cannot obtain an RDP to drive a commercial motor vehicle.

2. The Department or Circuit Court provides an LDP to those who have lost their driving privilege, but need to drive for employment or other important matters. Eligible drivers may obtain an LDP unless they have certain convictions or losses of license on the driver record. Some convictions or loss of license are so serious that an LDP may not be granted. Details are found at http://dor.mo.gov/drivers/ldp.php. A person cannot obtain an LDP to drive a commercial motor vehicle.

3. Insurance companies must update their file before the 7th working day of each month. This information is then used to determine the insurance status of Missouri motor vehicle owners and operators.

Reinstatement Requirements Reinstatement information is available by telephone at 573-526-2407. Reinstatement fees may also be paid by telephone using a debit or credit card.

Suspension $20 fee; proof of financial responsibility. Revocation $20 fee; proof of financial responsibility; re-examination (except for chemical refusal revocation).

If For Financial Responsibility Suspension First Offense $20 fee; proof of financial responsibility. Second Offense $200 fee; proof of financial responsibility. Third or Subsequent Offense $400 fee; proof of financial responsibility.

Note: An additional $25 fee is assessed when the suspension/revocation is alcohol related (unless it was based on an out-of-state alcohol conviction). Successful completion of a Substance Abuse Traffic Offender Program or comparable program is also required. If more than one alcohol offense is showing on the record, an IID will be required.

Section 17 (A) states “...title history, dealer sales reports, license registration information and driving records are not confidential...” The Department of Revenue has issued administrative rules which specifically identify public and confidential records. Missouri has the same exceptions as the federal statute. Missouri statute 32.091(2) states that the “department of revenue may disclose individual motor vehicle records pursuant to Sections 2721(b)(11) . . . and 2721(b)(12) of Title 18 of the United States Code.” Missouri statute 32.091(4) states that the “department of revenue shall disclose any motor vehicle record or personal information permitted to be disclosed pursuant to Sections 2721(b)(1) to 2721(b)(10) and 2721(b)(13) to 2721(b)(14).” Section 302.183.2, RSMO prohibits the sale of data derived from a person’s driver license application for commercial purposes without consent. Departmental policy for electronic requesters requires written approval from the Division.

Request and Consent Forms Driver and Vehicle Records: There are quite a few forms that are in use. Most forms list those eligible for obtaining records. • Request for Motor Vehicle Records with Personal Information

(Form 5091) or Request for Information (Form 4803) may be used to request vehicle or vessel related information.

• Request for Driver License Records and Personal Information (Form 5500) is suggested for those requesting driver related records with personal information. It is very similar to Form 5091.

• If requester is the search subject, then submit a notarized, Request From Driver License Record Holder (Form 4681) to obtain driving record information or Request From Motor Vehicle Record Holder (Form 5499) to obtain vehicle history.

• Request for Security Access Code (Form 4678) must be fully completed and approved before a Requester can obtain access to restricted information.

• Request for Information (Form 1745) can be used to order a driver record or case history, suspension or reinstatement notice, a license photo image, or a Limited Driving Privilege Package. The form does require information on the requester and the subject, but does not call for stating if there is a permitted purpose per DPPA.

Forms are found at http://dor.mo.gov/forms. One may also obtain copies of forms from any license office or the Department of Revenue.

Vendor and Third Party Access Policy Vendors must ensure that those receiving requested records are authorized under the DPPA to receive such information. The vendor must ensure the person/entity they are reselling to is also exempt under the DPPA. Vendors that resell or re-disclose personal information must keep for a period of five years, records identifying each person or entity that receives such information and the permitted purpose for which the information will be used.

Records Ordered For Non-permissible Uses Without consent, records are still released, but personal information is withheld. Personal information includes the person's name, address, date of birth, sex, height, weight, eye color, driver license number, SSN, photograph, telephone number, medical or disability information including restrictions, motor vehicle sales tax information contained in motor vehicle record, and all information contained on a tax return or application. However, casual requesters can obtain records with personal information if consent is given. Use Form 4681 as mentioned above. Notary of subject's signature is required.

Access to Driver-Related Records Driving Records

A convenience fee will be charged for credit or debit card transactions. (The convenience fee for transactions totaling $0.00 to $100.00 will be between $1.25 and $2.15; those totaling $100.01 or more will have a 2.15% convenience fee assessed.) A $2.00 office processing fee may apply if requested in a license office. Electronic access fees vary, see that section. Frequent requesters of driving records should establish an account with the Record Sales area and obtain records through the Dialing for Records process. Note: One may request driver records by mail or walk-in that do not contain the personal information of an individual. Non-personal information includes the driving history showing speeding tickets and other violations. In-Person – Counter service available at the central office in Jefferson City. Most license offices in the state process requests from the record subject. Mail – Requests should include the driver's full name, date of birth, and/or license number. Requests are processed within two days of

receipt of the request. The fee must accompany all requests. No record found requests are charged the full fee. Telephone and Fax – This is only available for approved account holders. Requesters can dial the Bureau's Interactive Telephone Driver Record System via a touch-tone telephone. Fax requests should be faxed to 573-526-7367. Requester must include a major credit card. Driving records will be mailed or faxed within 24 hours. There is an additional $.50 fee per page to fax back. Both certified and non-certified records can be ordered. Driver records will be mailed the following day by first class mail, or faxed to a fax machine within 24 hours of the request. Customers request must include all credit card information (type, number, expiration date, etc.) in order for the request to be processed.

♦ Editor’s Note on Electronic Access:

The electronic access of driving records in Missouri is very unique. The fee schedule is not based on the traditional method used in other states of using a per-record cost per the specific names submitted in a request. Approved users and vendors may purchase electronic records in either a batch or database mode. See the next section for details.

access code. Records are processed Monday through Saturday. Batches sent by 2AM will be available for pick-up at 6AM the same day. The fee is $52.00 per batch submitted, regardless of the number of requests within the batch. For further information, call 573-526-3669 option or email [email protected]. Bulk – The Office of Administration Information Technology Services Division provides a driver license database purchase program that enables approved users to purchase the entire driver file with or without driver history information. In addition, the user can purchase monthly or daily updates. At press time the fee for the initial purchase of the entire database is $2035 with driver history data or $1035 without the driver history data. Monthly or daily updates are then priced on a per record basis ($.0043 per record for the first 50,000 records and $.0003 per record for every record over 50,000). Users must also initially pay for programming set-up time. For more information, call 573-526-3669. By Person of Record – Missouri drivers may obtain their driving record by mail or walk-in as described in previous section. Use of Form 4681 (or perhaps 1745) is suggested. See above for form locations. At present, there is no program for drivers to order or view their own record online. Requests can also be emailed to [email protected].

Notification/Monitoring Program Missouri does not offer a specific monitoring system or notification program to employers or insurance companies to track incidents of drivers. However, the Bulk Purchase Program enables entities to construct their own monitoring programs for themselves or clients.

Crash Reports Reporting – All crashes resulting in damage, injury, or death must be reported to the Missouri State Highway Patrol within 20 days by the local police or investigating jurisdiction. Reports are made to Missouri State Highway Patrol, P.O. Box 568, Jefferson City, MO 65102. In addition, all accidents occurring in Missouri that result in property damage in excess of $500, death or personal injury and which involve an

uninsured motorist must be reported to the Department of Revenue. Reports are accepted for up to one year after the accident occurs. Copies of statements from the attending physician or an appraiser's estimate of damage must accompany reports involving personal injury or property damage. The 1140 Form is found at http://dor.mo.gov/forms/. Record Access – Missouri State Highway Patrol, Patrol Records Division, PO Box 568, Jefferson City 65102, 573-526-6113. www.mshp.dps.missouri.gov/MSHPWeb/PatrolDivisions/PRD This agency is the central repository for all accident records in the state. Record access with personal information is governed by the DPPA. The availability of information about a specific crash, and actual copies of crash reports is contingent upon the finalized Missouri Uniform Accident Report reaching the Patrol Records Division and entered into STARS. If not investigated by the MSHP or if not available, a report must be obtained from the investigating municipality. Records are available from 1997 forward from this agency. Requests for report copies of crashes that occurred in 1996 or earlier, certified crash reports, crash report photographs or crash reconstruction reports must be forwarded to the Patrol Records Division. The fee is $3.75 for the standard 4-page report. Add $2.00 for certification. Reconstruction reports are also available; fees depend on the extent of the document, call first. Personal checks are accepted. In general, the records are open to the public from 1941 to present. Requests must be in writing or in person and should include the driver's name and date and location of the accident. A form is available at the web page. A self-addressed stamped envelope is recommended. Note that while crash reports are always available, crash reconstruction reports may be closed due to an ongoing investigation. The reconstruction reports may be ordered on CD. Records cannot be e-mailed. Preliminary information on accidents investigated by the MSHP is found at https://www.mshp.dps.missouri.gov/HP68/search.jsp. Data is held here for one year. There is also a list of recent crashes displayed.

Driving Record Content and Reciprocity What’s On or Not On the Driving Record

• A record without personal information is released to casual requesters.

• Records with personal information are provided to authorized requesters.

• Accident involvement is stored in the Department's computer, but does not appear on the driving record unless a related suspension or revocation action is taken.

• The state does not permit completion of a driver improvement program in lieu of conviction, but will permit such attendance in lieu of assessment of points. The conviction will display on the record with zero points assessed.

• SSNs, medical information, and eye exam data is not shown.

CDL Medical Certification Data Medical Certification Information on CDL drivers is provided on both the manually processed and electronic version of the CDL driving record.

Data Retention Non-major convictions are retained on a CDL driving record for a minimum of four years and major convictions are permanently retained. Non-CDL convictions are retained on the driving record for a minimum of three years. DWI-related Convictions, Suspensions and Revocations

and Mandatory Insurance Suspensions are permanent. All other Suspensions and Revocations are retained for a minimum of five years after reinstatement. CDL driver records are purged per Federal guidelines (see the Appendix). Surrendered licenses are held until reinstated or expired.

Court to Repository Conviction information is sent from the courts to the state via either paper abstracts or electronic reporting. The courts must forward convictions to the DMV within 7 days, who, in turn, must forward to the Missouri State Highway Patrol within 15 days.

State Reciprocity for Non-CDL Drivers • May suspend driving privilege of Missouri driver for out-of-state

convictions and for failure to appear or pay for moving violations occurring out-of-state.

Access to Vehicle-Related Records General Information and Fees Department of Revenue, Motor Vehicle Bureau, 301 W. High St., Room 370, PO Box 2048, Jefferson City, MO 65105, Phone: 573-526-3669, option 6; Fax: 573-526-7367. http://dor.mo.gov/motorv/ The Department of Revenue maintains record information on all terrains, boats, motors, mobile homes, trailers, and motorcycles as well as passenger and commercial vehicles. Lien information shows on title records. Registration/title records are computerized. Records are available from 1968 to present. All requesters of personal information must qualify to receive such information under the DPPA. The SSN, sales and use tax information is not shown on records. The Department of Revenue will not take vehicle record requests by phone, nor does it offer billable accounts for customers. Fee for records obtained by walk-in, mail-in, or per email is $2.82 per record. A convenience fee will be charged for credit or debit card transactions. (The convenience fee for transactions totaling $0.00 to $100.00 will be between $1.25 and $2.15; those totaling $100.01 or more will have a 2.15% convenience fee assessed.) In-Person or Mail – See fees above. The physical address is Motor Vehicle Bureau, Harry S Truman State Office Building, 301 West High Street, Room 370, Jefferson City, MO 65101. Credit cards are accepted. One may also visit a license office; an additional $2.00 processing fee is charged. For mail requests, a self-addressed stamped envelope is requested.

Fax – This is only available for approved account holders. Submit request via fax at (573) 751-7060. Records may be returned by fax for an additional $.50 per page. Electronic – Vehicle lienholder data and registration and ownership information is available to registered requesters. There is an approval process since records are only released per permissible use. Two forms are required. The applicant must qualify to have a security access code (DPPA number) issued by the Department. Application is made using Request for Security Access Code (Form 4678). Customer must also complete an Application for Online Account (Form 5017), accessible at the web page. The service allows qualified businesses (lienholders, motor vehicle and boat dealers, etc.) to file notices of lien (NOLs) online. The $0.0382 record fee is automatically debited from the requester's ACH (Automated Clearing House) account or credit card account. For more information, call 573-526-3669, option 2. Forms are found at http://dor.mo.gov/forms. Bulk – The Office of Administration Information Technology Services Division has a number of databases and files available for extraction. Most of the file purchases are affected by the DPPA. Therefore, the requester will be required to obtain a Security Access Code, as described above and submit a Bulk/Customized Record Request Form (Form 5153). Fees vary. Access to Vessel-Related Records General Information, Access and Fees Records are available from the Motor Vehicle and Driver Licensing Division, see http://dor.mo.gov/motorv/watercraft/. Missouri law requires that all motorized boats/vessels and any boat/vessel more than 12 feet in length powered by sail alone be titled and registered, unless

exempt by law. This includes jet skis and motorized water bikes. Any vessel regardless of length which is solely propelled by oars or paddles is not required to be titled or registered. Trolling motors are exempt from title and registration requirements.

License Classes, Restrictions, and Endorsements How License Class is Displayed on License Document

The CDL driver license will have either the words “Commercial Driver License” or the letters “CDL” on the face of the license. All CDL driver records will show Class A, B, or C. No other field in the record will indicate CDL. Any driver with Class E, F, or M will be a non-CDL driver.

License Classes– Commercial Class A Combination vehicle 26,001 pounds GVWR or more with trailer over 10,000 pounds GVWR. Class B Single vehicle 26,001 pounds or more GVWR. Class C Vehicle under 26,001 pounds GVWR placarded for hazardous materials or designed to transport 16 or more people, including the

driver.

License Classes– Non-Commercial Class E Operator for hire not required to have Class A, B, or C - single vehicle under 26,001 GVWR. Class F Operator. Class M Motorcycle. Class ND Non-drivers (ID Card). Also, a Limited Driving Privilege (LDP) hardship license is issued for those in work or alcohol programs, medical treatments, school, etc.
