    Answer:

    AchainfallfallswithinthemeaningofothersimilarapparatusinthedenitionofhoistingapparatusAnydeviceorpieceofequipmentusedtoliftorlowermaterialorequipmentisconsideredahoisting

    apparatus.Examplesinclude,butarenotlimitedto:

    come-a-longusedtolift jacks turfer lever-operatedhoists handchainhoists manualpullers

    Itshouldbenotedthat,sincetheJune2001amendments,theexemptionforhoistingapparatuseswitha

    liftingcapacityoflessthan1,815kgappliesonlytothelogbookrequirement.Thosewhorepairtheequipmentdonothavetobecertiedbyanagencybutmustbecompetent.

    A competent person would include a certifed mechanic or a person who met the requirements o thedenitionofcompetentinRegulation 91-191.

    210.01(1)Anemployershallensurethatahoistingapparatusisinspectedevery12monthsbyacompetent person to ensure that the apparatus meets the manuacturers specifcations.

    Question:Subsection210.01(1)requiresthatacompetentpersoninspecthoistingapparatusesannuallyandcertifytheapparatusmeetsthemanufacturersspecications.Howwillyouknowifapersoniscompetenttocertifythehoistingapparatus?

    Answer:

    Competencyrequirementswillvarywitheachtypeofequipment.However,sincetheRegulationmakesreferencetoseveralCanadianStandardsAssociation(CSA)standardsthataddressthisissue,

    WorkSaeNB will reerence the requirements outlined in these standards or guidance.

    OtherstandardssuchastheAmericanNationalStandardsInstitute(ANSI)andtheAmericanSocietyofMechanicalEngineers(ASME),whichcovertypesofhoistingapparatusesnotcoveredbyCSA,mayalsobeusedforguidanceindeterminingcompetency.

    Itisrecommendedthatemployers,whoareresponsibleforappointingcompetentinspectors,alsoollow these guidelines to assist them in ensuring their appointments are appropriate.

    Theswivel,hook,hooknutandblockassemblyofamobilecraneshallbeinspectedbyacompetentpersoninaccordancewiththetimeframessetoutinsubsection207.2(2)ofGeneral Regulation

    91-191andeveryveyearsthereafter.Theinspectionshallbecompletedinaccordancewithsection4.3.5.2ofCSAStandardZ150-98.

    Mobile Crane Inspection Requirements

    Anengineerorcompetentpersonsupervisedbyanengineershallinspectashallinspectamobilecraneevery12monthsandcertifyinwritingthattheapparatusmeetsthemanufacturersspecicationsasspecifed in subsection 213.21(1) oRegulation 91-191. This inspection must be completed in accordancewithclauses4.3.3.1,4.3.4.1and4.3.5.1ofCSAstandardZ150-98,Safety Code on Mobile Cranes.

    Theresultsoftheannual/periodicinspectionincludingrepairs,adjustmentsandotherndingsshallbeincludedinthelogbookandmadeavailabletoanofceruponrequest.

    General Regulation 91-191denescompetentas:

    (a) qualied,becauseofsuchfactorsasknowledge,trainingandexperience,todoassignedworkinamannerthatwillensurehealthandsafetyofpersons,

    (b) knowledgeableabouttheprovisionsoftheActandtheregulationsthatapplytotheassignedwork,and

    (c) knowledgeableaboutpotentialoractualdangertohealthorsafetyconnectedwiththeassignedwork.

    Mobilecranesequippedwithatelescopicboomshallhaveacompletestructuralinspectionoftheboominaccordancewiththetimeframessetoutinsubsection207.1(2)ofGeneral Regulation 91-191 andevery10yearsor10,000hoursofservice,whichevercomesrst.The inspection shall be completed inaccordancewithsection4.3.6ofCSAStandardZ150-98.

    Mobilecranesmustbeinspectedbytheoperatoronadailybasiswheninuseasspeciedinsubsections213.31(1) and 213.31(2) oGeneral Regulation 91-191with the results o the inspection recorded in alogbook as specifed in subsection 213.31(4) oGeneral Regulation 91-191.
