FRIENDS,The Mortgage Bankers Association continues to be among the most sophisticated and effective

trade associations in Washington, DC and that is in no small part because of your continued

support of MORPAC, MBA’s political action committee.

I am proud to announce that, due to your support, 2015 was MORPAC’s biggest year yet. With that

in mind, I am pleased to present the 2015 MORPAC Year-End Report.

In 2015 we raised a record breaking $1,012,881 in individual donations, outpacing our previous one-

year record by over $260,000. Together we have managed to add nearly 1,000 new MORPAC

contributors, and our average contribution increased to $244 from roughly $208 per person in 2014.

We continue to increase our grassroots reach as well. The Mortgage Action Alliance (MAA)

currently enjoys over 11,300 active members and this year we launched MBA’s new Action Center,

making it easier than ever for MAA members to participate in our advocacy programs. Under the

leadership of MAA Chairman Fowler Williams, we are on pace to continue MAA’s growth in 2016.

As a show of gratitude to our dedicated contributors, this report lists all of the individuals and

companies who were part of our 2015 campaign. In addition, you’ll find itemized information about

the goals our political programs achieved, and a comprehensive summary of MBA’s advocacy

team’s legislative and political priorities.

None of the great steps we are taking with our political action committee on our industry’s behalf

would be possible without your involvement in MORPAC, and your continued support is imperative

to our success. Together, we will continue to make this 2015–2016 fundraising cycle the best in

MBA history. I appreciate and thank you for your dedication to MBA, MORPAC and our collective

public policy goals.

LEGISLATIVE AND POLITICAL UPDATE

MBA had numerous legislative and political successes in

2015, ranging from favorable items included in Senate

Banking Committee-passed regulatory relief legislation,

to the introduction of bills that address SAFE Act-related

concerns and the FHFA’s FHLB membership rule, to the

biggest single individual year in MORPAC history. MBA

rounded out 2015 by defeating an attempt to use GSE

guaranty-fees (“g-fees”) to fund a multi-year highway

reauthorization bill and by securing several tax / appropri-

ations priorities in the year-end omnibus and tax package.

While 2015 was dominated by legislative activity, the

2016 agenda will be consumed by election-year poli-

tics. Against this backdrop, the House and Senate will

continue to focus on dialogue related to Dodd-Frank

reforms and financial sector reg relief — though enact-

ment of legislation will remain challenging in the face

of the administration’s ongoing opposition to reopening

the 2010 law. And there may will be fresh discussion of

incremental reforms to the secondary mortgage market,

while a transition to a new housing finance system will

most likely have to wait until 2017 and beyond.

Regulatory Relief LegislationSenate Banking Committee (“SBC”) Chairman Shelby’s

regulatory relief proposal, S.1484, remained stalled in

the Senate since its party-line full Banking Committee

passage in May. The legislation contains a number of

MBA priorities on issues ranging from GSE transition

steps to QM lending standards, FHFA’s FHLB member-

ship rule, TRID enforcement, Basel III and its impact

on mortgage servicing rights, and preferred SAFE Act

amendments. Given the current election year politics,

Chairman Shelby recently indicated that his bill may not

see floor time until after his March primary election, or,

more likely, a predicted post-election lame duck session

in November / December.

Omnibus Appropriations and Tax PackageIn December, Congress passed (and the President signed

into law) H.R. 2029, an omnibus Fiscal Year 2016 funding

bill, coupled with a surprisingly broad tax “extenders”

package. This so-called “taxibus” contained a number

of items impacting the industry, including several tax

priorities, various FHA provisions, and a prohibition

on the sale of shares of GSE preferred stock without

Congressional approval. The “taxibus” specifics are

outlined in more detail below.

Tax ExtendersAs noted above, the package contained several of MBA’s

tax priorities, including:

• A permanent extension of the minimum 9% Low-

Income Housing Tax Credit rate for new construction

and substantial rehabilitation. While the bill does

not establish a minimum, 4 percent credit rate for

acquisition, we will continue working with Congress

to permanently extend this important LIHTC provision.

• An extension of the deductibility of mortgage insur-

ance premiums for an additional two years, for tax

years 2015 and 2016.

• Continued tax relief for mortgage debt forgiveness

through 2016. This will prevent homeowners from

being taxed if their lender reduces their principal or

their home is subject to a short sale. The provision

also applies to qualified principal residence indebt-

edness that is discharged in 2017, if the discharge is

pursuant to a written agreement entered into in 2016.


• Two key provisions specifically related to Real Estate

Investment Trusts (REITs), one which places restric-

tions on tax-free spinoffs involving REITs and a second,

which reduces the percentage limitation on assets of

a REIT which may be taxable REIT subsidiaries.

HUD AppropriationsThe year-end bill also contains several housing-related

appropriations provisions:

• For the second year in a row, Congress rejected HUD’s

unprecedented request to fund a portion of FHA’s

administrative costs through a fee on residential

lenders who use the program.

• $375 million for salaries and expenses at FHA, $130

million for FHA administrative contract expenses, and

Ginnie Mae with $23 million for Ginnie Mae salaries

and expenses.

• In response to MBA’s urging for additional resources for

FHA and Ginnie Mae, the bill contains volume-based

incentives so that FHA could receive as much as

$160 million and Ginnie Mae could receive as much

as $26 million.

• HUD’s full request of $30 billion in commitment

authority for the General and Special Risk Insurance

(GI / SRI) Fund in FY 2016. Other key funding highlights

include $950 million for the HOME program and $10.2

billion for project-based Section 8.

• The legislation also maintains the statutory prohibi-

tion on the use of Ginnie Mae securitizations in HUD’s

risk sharing programs by Housing Finance Agencies.

• The bill bars HUD from requiring or enforcing the

Physical Needs Assessment.

• Continued prohibition on federal funds being used

to facilitate eminent domain seizures of performing

mortgage loans.

• Under H.R. 2029, HUD will receive $47 million for

housing counseling. The legislation also explicitly bars

FHA from implementing the Homeowners Armed

With Knowledge (HAWK) program — HUD’s proposal

to reduce insurance premiums for homebuyers who

commit to housing counseling.


GSE ReformWe continue to believe that neither SBC Chairman Shelby

nor House Financial Services Committee (“HFSC”)

Chairman Jeb Hensarling (R-TX) will choose to dedicate

the significant amount of political capital (or time needed

to build a policy consensus) necessary to advance an

issue as complicated as GSE reform in an election year,

so the debate will likely remain on hold until 2017.

However, there was meaningful congressional activity

related to the GSEs in 2015. President Obama signed

legislation to cap the pay of the CEOs at Fannie Mae and

Freddie Mac at January 1, 2015 levels, and the year-end

Omnibus contained a two-year prohibition on the sale of

the Treasury’s preferred GSE shares absent explicit con-

gressional authorization. In order to continue advancing

our GSE policy principles, MBA orchestrated a well-at-

tended January 25th House / Senate briefing on Capitol

Hill designed to underscore the fact that thoughtful

GSE reforms are more important now than ever given

conservatorship and ongoing mortgage market realities.

SAFE Act AmendmentsFollowing the introduction of H.R. 2121, the SAFE

Transitional Licensing Act, in late April, we have seen

a growing number of bipartisan members (38) join the

bill as cosponsors. The legislation, originally introduced

by Reps. Steve Stivers (R-OH), Terri Sewell (D-AL), Lynn

Westmoreland (R-GA), Joyce Beatty (D-OH), Luke Messer

(R-IN), Kyrsten Sinema (D-AZ), and Ed Perlmutter (D-CO)

would mandate that states regulators allow MLOs tran-

sitional authority to continue originating mortgages for

up to 120 days should they leave a federal depository

to take a new job working for a non-bank and / or cross

state lines to do so.

Given the negotiated compromise on topic with the

Conference of State Banking Supervisors (“CSBS”), we

remain hopeful that H.R. 2121 will be marked up in the

full House Financial Services Committee early in 2016.

Language identical to H.R. 2121 was included in Title I

of Shelby’s Senate regulatory relief package (Ranking

Member Sherrod Brown’s (D-OH) substitute bill contained

substantially similar language).

CMBS Risk RetentionMBA is working with a coalition of sister trade groups

to raise concerns regarding the implementation of the

CMBS risk retention rule that was included in Title IX of

Dodd- Frank. The coalition has held a number of meetings

with key congressional staff to raise awareness about

this issue and outline industry’s concerns in an attempt

to persuade members of Congress to weigh in with key

regulators on the rule and possibly introduce legislation.


It is MBA’s belief that the rule, as drafted, will increase

borrowing costs, lead to a deterioration in credit quality,

and reduce liquidity in the market. The proposed lan-

guage that the coalition has drafted would allow certain

low-risk commercial real estate mortgages to qualify as

qualified commercial real estate (QCRE) loans, a category

of loans that are exempt from the risk retention require-

ments given their historical performance. In particular,

the language would allow for Single Borrower / Singe

Credit transactions to be considered QCRE loans. We

expect legislation to be introduced in the House during

the first quarter of 2016.

FHFA Membership RuleThis past fall, a bipartisan group of lawmakers introduced

H.R. 3808, legislation to require the withdrawal and study

of the Federal Housing Finance Agency’s (FHFA) pro-

posed rule regarding Federal Home Loan Bank (FHLB)

membership. The legislation would address a contro-

versial FHFA rule, since finalized, that limits the ability

of mortgage Real Estate Investment Trusts to access

the FHLB system via captive insurers. MBA continues

to work at increasing the number of bipartisan House

cosponsors of the bill in an effort to continue to increase

momentum behind the proposal. The Senate regulatory

relief package contains similar language.

Housing-Related “Pay-fors”In December, MBA worked to successfully kill a Senate

conference committee proposal that would have partially

paid for a proposed multi-year highway reauthorization

bill via an extended increase in Fannie Mae and Freddie

Mac guarantee fees. MBA’s success was a direct result

of months of sustained advocacy by members of the

Mortgage Action Alliance, who urged Congress not to

use homeowners as a piggybank for unrelated spend-

ing. After the Senate had included the g-fee increase

in its initial version of the legislation, MBA successfully

marshalled support for overwhelming passage of a

House floor amendment to remove the g-fee “pay-for”

(estimated at $2B over five years).


Flood InsuranceSenate Banking Committee members Dean Heller (R-NV)

and Jon Tester (D-MT) and House Financial Services

Committee members Dennis Ross (R-FL) and Patrick

Murphy (D-FL) introduced the Flood Insurance Market

Parity and Modernization Act in July. MBA sent letters

of support for the House (H.R. 2901) and Senate bills (S.

1679) at the request of the authors.

On January 13, MBA lender member Steve Bradshaw, EVP

for New Orleans-based Standard Mortgage Corporation,

testified in support of H.R. 2901 before the HFSC’s

Subcommittee on Housing and Insurance at a hearing

regarding the private flood insurance market. The legis-

lation provides additional access to an expanded set of

flood insurance coverage options by providing incentives

to accelerate the development of a private flood insurance

market (with consumer protections overseen by state

insurance regulators). Full House committee action on

the Ross / Murphy bill is expected later this year.

High Volatility Commercial Real Estate ExposuresMBA, in conjunction with allied trades, has continued

lobbying targeted congressional offices to discuss

concerns about the Basel III treatment of high volatility

commercial real estate exposures (HVCRE). HVCRE loan

status requires a higher capital charge for acquisition,

development and construction (ADC) loans that, among

other things, have a loan-to-value ratio of greater than

80 percent and less than 15 percent equity contribution

by the borrower. MBA is concerned that tight restrictions

placed on ADC loans could result in the unwarranted

higher capital treatment for many ADC loans, which

could negatively impact bank ADC lending decisions.

MBA has also raised strong concerns with the Federal

Reserve, Comptroller of the Currency, and the Federal

Deposit Insurance Corporation and is seeking guidance

from these agencies that would provide greater flexibility

for the structuring of ADC loans to avoid HVCRE status.

This is part of a broader strategy to raise the issue directly

with Members of Congress in hopes that they will also

weigh in with regulators.
