Making a claim

It is important to get you back on the road asquickly as possible. That's why the RSA MotorChoice Car Insurance Claims Assist Team areavailable 24 hours a day, 365 days a year. Help isalways just a phone call away.

1. Telephone the RSA Motor Choice CarInsurance Claims Assist Team on1850 665 775 (or 00353 1 290 1978 fromoutside the Republic of Ireland) with the firstnotification of your claim. They will adviseyou what to do next and issue all appropriatedocumentation to you immediately.

2. RSA Motor Choice Car Insurance gives youaccess to an Approved Repairer Network. Ifyou have an accident and Your Car cannotbe driven, our Approved Repairer Networkwill tow it to their premises if you haveComprehensive cover. This will safeguardYour Car from further damage from vandalsor against theft of parts. Repairs can startimmediately. If the Approved Repairers arenot used, obtain an estimate and advise usimmediately and we will appoint an assessorif necessary.

3. An Excess is the first amount of a claim forloss or damage to Your Car that you mustpay. The Excess that applies to your policy isshown in your Schedule. When repairs havebeen completed you may have to pay theExcess directly to the repairer before you cantake delivery of Your Car.

disclosures of false information could result inthe policy becoming void, a claim not beingpaid, claims paid being recovered from you,you becoming liable for additional premiumswhich we reserve the right to collect andTerms and Conditions of the policy beingamended. Should we take any of these actionsagainst you, then you will be obliged todisclose them on any future request for coveror quotation. These are considered as theapplication of Terms and this enforced actionby us, may affect your ability to get insurancecover in the future.

Material information is any fact that RSAInsurance Ireland Limited (RSA) would regardas likely to affect the acceptance orassessment of the risk. Information is materialif it would reasonably change the premium wecharge, or would change a decision to provideyou with insurance. Information we requireincludes for example, current medical detailsor history in respect of you or anyone elseyou propose to drive, and details of any claimspreviously made or submitted by you oranyone else you propose to drive. It isrecommended that you keep a record(including copies of letters) of all informationsupplied for the purpose of this insurance. Ifyou are in any doubt as to whether a fact orchange is material or not, please contact us.Misrepresentation or non disclosure of aMaterial Fact in order to obtain insurance maybe considered fraud. We may provide detailsof any such fraud to the appropriateauthorities and this may result in prosecution.

In return for your premium, we will providethe cover shown in the Schedule for accident,injury, loss or damage that happens within the

This Policy, the Schedule that showsthe cover that applies, anyEndorsements found either at theback of this book or issuedseparately, and your Certificate setout your and our rights andresponsibilities. You should keep allthese documents carefully in a safeplace.

Please read the General Conditions thatrelate to this Policy that are set out on page23 of this document.

Please note that the Schedule and yourCertificate of Insurance form part of thisPolicy and must be read together with thisbooklet as one document.

Duty of disclosureThe information provided by the Insured isshown in the Proposal Form. Please checkthat all of the information is accurate. If thereare any errors please contact us immediately.Your attention is drawn particularly toCondition 1 on page 23 of the Policy. Thecover granted and the premium calculatedfor your risk are based on the informationprovided by the Insured. You must give usimmediate notification of any change in therisk which materially affects this insurance.Failure to disclose all material information, or

geographical limits during the Period ofinsurance.The Geographical limits are:• The Republic of Ireland• Great Britain• Northern Ireland• The Isle of Man• The Channel Islands• Any vessel travelling by sea between any

ports in any of these territories.

All monies which become or may becomedue under this Policy will in accordance withSection 93 of the Insurance Act 1936 bepayable and paid in the Republic of Ireland inEuros unless we specifically say otherwise.

This Policy will operate only while theCertificate of Insurance is in force.

Stamp Duty has been or will be paid inaccordance with Section 5 of the StampDuties Consolidation Act, 1999 (asamended).

Contract LawThe parties to a contract of insurancecovering a risk situated in the Republic ofIreland, are permitted to choose the lawapplicable to the contract. We propose thatthe contract will be governed by Irish Law.

Communications between you and us aboutthis policy will be in English.

The insurer that you have entered a contractwith is RSA Insurance Ireland Limited.

Throughout the text certain wordshave a specific meaning whereverthey appear and we have definedthese below.

Approved Repairer NetworkA number of independent vehicle repairerswith whom we have concluded contractsgoverning repairs to vehicles that are thesubject of insurance claims.

Bodily InjuryInjury resulting directly from an accidentcaused by some external violent and visiblemeans.

Your CarAny vehicle you have given us details of andwhich we have agreed to insure, described in5(a) of the Certificate that is in force underthis policy.

CertificateYour certificate of motor insurance and thecurrent document that proves you have themotor insurance you need by law. TheCertificate shows who can drive Your Car,what you can use it for and what cars you areallowed to drive. It is proof that you can useYour Car on a road or in any other publicplace, as needed by the Road Traffic Acts. TheCertificate does not show the cover you have.

EndorsementChanges in the terms of your policy. Thesemay be in this booklet or may be added later.

Green Card CountryA country that is a member of the EuropeanUnion, or a country that has according to theCommission of the European Union, madearrangements to meet Article 7(2) of the ECDirective on insurance of civil liabilities arising

from using motor vehicles (number72/166/EEC) (as amended).

ExcessThe first part of any claim that you have to pay.

Insured PersonA person entitled to the protection of section 1of this policy.

Loss of a limb (section 5A)Having a limb cut off or permanent loss of useof the limb at or above the wrist or ankle.

Period of insuranceThe period of time covered by this policy, asshown in the Certificate, and any further periodthat we agree to insure you for.

Road Traffic ActsThe laws governing motor vehicles of anycountry that this policy operates in.

ScheduleThe document which gives details of the coveryou have. The Schedule forms part of thispolicy.

SpouseYour husband, your wife or your civil partnerrecognised in law. It does not include a personwith whom you cohabit but who is not yourhusband, wife or civil partner.

Section 11A Liability to Third Parties

1 Injury to others and damage toother people’s propertyWe will pay:

• any amount an Insured Person may

have to pay for being legally liable for

a person’s death or Bodily Injury; and• up to a limit of €30,000,000 for an

amount an Insured Person may haveto pay for being legally liable fordamage to property;

arising as a result of an accident causedby or in connection with Your Car or atrailer that is attached to Your Car.

2 Legal costsWe may pay the following legal costs ifthey relate to an incident which iscovered under 1 above.(a) The fees of solicitors asked to

represent anyone we insure at acoroner’s inquest or defence in anydistrict court.

(b) Up to €5000 for the costs ofdefence of an Insured Person againsta charge, under subsection 2(A) ofSection 53 of the Road Traffic Act1961, of manslaughter or causingdeath or serious bodily harm bydangerous driving.

(c) All other legal costs and expenseswhich are run up in defending anyclaim for Bodily Injury or damage toproperty arising as the result of anaccident caused by or connected to

Your Car and for which the InsuredPerson may be legally liable. Youmust have our written permissionbefore we will make any paymentand the most we will pay for theselegal expenses is €7,000,000.

3 Definition of ‘Insured Person’For the purpose of insurance under thissection, the term ‘Insured Person’ means:(a) you;(b) any person whose liability is covered

under section 4 of the Certificate,except a person in the motor tradedriving Your Car for purposes ofoverhaul, upkeep, or repair;

(c) with your permission any person,using but not driving Your Car;

(d) with your permission, any personwho is in, getting into or getting outof Your Car;

(e) the employer or business partner ofany other Insured Person if businessuse is permitted by your Certificate;

(f) The legal personal representatives ofan Insured Person who has died.

4 Compulsory insurance in theEuropean Union and othercountriesWe will extend the insurance under thissection to give the minimum coverneeded by law relating to compulsoryinsurance for vehicles in any Green CardCountry.

1B Driving other carsPlease check your Schedule to see ifyou have this cover.Section 1A above will also apply if you arelegally liable for a person’s death or BodilyInjury, or for damage to property as a resultof an accident caused by or in connectionwith you driving any other private car that isnot owned by you or any other person wholives with you.

Exclusions to section 1Unless we must do so under theRoad Traffic Acts, we will not pay:

1 for damage to property owned by orin the possession or control of anInsured Person;

2 damage to Your Car or any car youare driving under section 1B;

3 for death of or Bodily Injury to anyperson driving Your Car, or in chargeof it for the purpose of driving it;

4 if the Insured Person has cover forthe liability under another policy;

5 for death of or Bodily Injury to anyperson arising out of and in thecourse of that person’s employmentby the Insured Person.

Section 2Loss or damage by fireor theft

We will pay for loss of or damage to YourCar or any part of it or its accessories andspare parts on Your Car, caused by fire, theftor attempted theft.

We may decide to repair or replace YourCar or any part of it; or pay a cash amountfor the loss or damage.

Our maximum payment for any loss ordamage under this section will be the marketvalue of Your Car immediately preceding theincident but will not exceed any valuedeclared to us prior to the loss.

Fire Brigade ChargesIn addition to any claim for damage to YourCar, we will pay up to €1000 if you arelegally liable to pay charges as a result of aFire Brigade being called out to control orput out a fire in Your Car, or to remove theoccupants of Your Car using cuttingequipment.

Any payment under Section 2 will not affectyour no-claims discount.

Section 3Windscreen DamagePlease check your Schedule to see if youhave this cover.We will pay for loss of or damage to theglass in Your Car’s windscreen, windows orsunroof and any scratching on the bodyworkas a result of the breakage.

We may decide whether to repair or replacethe windscreen or to pay a cash amount forthe loss or damage. We reserve the right torequire you to pay the first €30 of any

amount to be paid to replace thewindscreen. This will not apply if you havethe windscreen repaired, or if you have toreplace any other window glass covered bythis section.If you use Allied Irish Windscreens orAutoglass for the replacement or repair thereis no limit applicable. If you use any otherwindscreen repairer we will not pay morethan €225 for either a repair or replacement.Any payment will not affect your no-claimsdiscount.

Section 4

4ALoss of or damage to Your CarPlease check your Schedule to see if youhave this cover.We will pay for loss of or damage to YourCar or any part of it or its accessories andspare parts fitted to it You must pay forsome of the loss or damage. The amountyou will have to pay is shown in yourSchedule and described in more detail inSection 7.

We may decide to repair or replace YourCar or any part of it, or pay a cash amountfor the loss or damage.

Our maximum payment for any loss ordamage under this section will be the marketvalue of Your Car immediately preceding theincident but will not exceed any valuedeclared to us prior to the loss.

4B Driving other carsPlease check your Schedule to see if youhave this cover.If both section 4B of the policy applies, andyour Certificate allows you to drive othercars (if it does, paragraph 5b will be shownon the Certificate), we will pay for loss of or

damage to any private motor car:

• under 2500 cubic centimetres enginecapacity and;

• that you are driving but that does notbelong to you or any other personwho lives with you, and;

• that is not hired to you or to anyother person who lives with youunder a hire purchase or leaseagreement and;

• that is lost or damaged in theRepublic of Ireland; and

• provided there is no other insurancepolicy covering your driving of thatcar; and

• provided you have the owner'spermission to drive the car and it hasbeen under your control for less than30 days.

We may decide to repair or replace theother car you have driven or any part ofit, or pay a cash amount for the loss ordamage up to a total of €50,000.

You must pay for some of the loss ordamage. The amount you will have topay is shown in your Schedule anddescribed in more detail in Section 7.

Extensions to cover applying toSections 2,3 and 4

These extensions will apply if you have avalid claim under any of Sections 2, 3 or 4.

Towing chargesWe will pay the reasonable cost of

protecting and removing Your Car to arepairer that we both agree if, as a result ofany loss or damage insured under sections 2,3 or 4, you cannot drive Your Car. We willalso pay the reasonable cost of delivering itto you at the last address you advised to usafter the repair, replacement, reinstatementor recovery. We will pay the reasonable costof storing Your Car.

Hire-purchase or contract-hireagreementIf we know that Your Car is covered by ahire purchase or contract-hire agreement, wemay pay any claim to the owner described inthe agreement. We will then have no furtherliability for the payment.

Exceptions to Sections 2, 3 and 4

We will not pay for:

1 loss in value, wear and tear, mechanical,electrical or electronicbreakdown or computer failures;

2 damage to tyres by braking, punctures,cuts or bursts;

3 loss of use;

4 loss or damage costing more than thecurrent market value of Your Car at thetime of loss or the amount you haveadvised us that Your Car is worth,whichever is less;

5 any amount over €1000 for loss ordamage to Satellite Navigationequipment , in-car entertainmentequipment including but not limited tocar stereos, hi-fi’s, DVD players,CD players, amplifiers and speakers,games consoles and permanently fittedcar-phone equipment;

6 theft of or from Your Car, orunauthorised taking of Your Car, bymembers of your family;

7 damage caused while Your Car was inthe possession or control of a memberof your family without your permission;

8 theft of or from Your Car if the keys orlocking devices are left in or around it;

9 any more than our share for loss ordamage if, at the time of a claim, there isany other policy covering the loss ordamage;

10 the replacement of locks followingdamage to, or loss or theft of the keys orlocking devices, unless the policy coveryou have bought includes section 5C;

11 for replacing parts that have beencontaminated or damaged as a result ofputting the incorrect fuel in Your Car orfailing to keep the correct amount oflubricant in Your Car;

12 Unless you tell us before you leave, anyloss or damage while You are visiting aGreen Card Country for a single trip ofmore than 31 days, or are making yoursecond or subsequent visit to that or anyother Green Card Country.

Section 5Additional benefits

Depending on the cover you have bought,you may have only some or none of theseadditional benefits. Please check yourSchedule to see which ones apply. Only oneof 5A1 or 5A2 can apply, and only one of5E1 or 5E2 can apply.

5A1 Injury to you and your SpousePlease check your Schedule to see if youhave this cover.We will pay the following benefits:

(a) death €15,000(b) total and permanent

loss of sight in oneor both eyes €15,000

(c) loss of one ormore limbs €15,000

(d) for each complete dayyou or they spend as aninpatient in hospital forup to 20 days €130

if you or your Spouse dies or is injured whilein, getting into or getting out of any privatecar.

5A2 Injury to you and your SpousePlease check your Schedule to see if youhave this cover.We will pay the following benefits:

(a) death €30,000(b) total and permanent

loss of sight in oneor both eyes €30,000

(c) loss of one ormore limbs €30,000

(d) for each complete dayyou or they spend as aninpatient in hospital forup to 20 days €130

If you or your Spouse dies or is injured whilein, getting into or getting out of any privatecar.

Exceptions to Section 5 A1and 5 A2We will not pay any benefit

1 if the injury sustained is not the onlycause of death, loss of sight, or loss of alimb; or

2 to anyone other than the legalrepresentative of a person who dies;or

3 for anyone who dies or is injured whilea taking part in racing, rallies, trials,

speed-testing or motorcycling; orb affected (temporarily or otherwise)

by alcohol, drugs or solvent abuse;or

c having a blood or urine alcohol levelabove the legal limit shown in theRoad Traffic Acts and any furtherregulations; or

d living permanently outside theRepublic of Ireland; or

e taking part in or committing acriminal act; or

4 for death or injurya due to suicide or attempted suicide;

orb caused, prolonged or made worse

by any illness or disability you hadbefore the accident; or

c which does not happen within sixmonths of the date of the accident;or

5 if an injured person or their legalpersonal representative does not let usknow as soon as possible of anaccident that might result in a claimunder this section; or

6 if an injured person or their legalrepresentative does not produce, attheir own expense, medical certificates,or other evidence we may need; or

7 if we are refused a post-mortemexamination of a person who has died;or

8 if an injured person refuses to submitor delays in submitting to a medicalexamination by a qualified person.

We will not pay more than one of theamounts payable under the benefits a, b orc under Section 5 A 1 or 5 A 2 inconnection with the same accident.

5B Personal EffectsPlease check your Schedule to see if youhave this cover.We will pay up to €500 for loss of or damageto rugs, clothing and personal effects whilethey are in or on Your Car. If you agree, wewill also pay for these items if they belong toanother person.

We may repair or replace an item, or pay anamount for the loss or damage. We maychoose to pay the owner of the damaged orlost items directly, if this person is not you.

We will not pay for1) money, stamps, tickets, documents,

financial instruments such as sharesor bonds;

2) tools, equipment, goods or samplescarried in connection with any tradeor business;

3) mobile phones;4) personal data assistant (PDA)

devices;5) computers;6) televisions;7) DVD/Video Recorders or players; or8) the component parts or ancillary

equipment or parts of any of theitems listed here;

9) any other electronic device thatperforms any of the functions of thedevices listed here;

10) anything lost or stolen while YourCar was unlocked, or while aconvertible roof was in the loweredposition unless the item was stolenfrom a locked boot.

5CReplacement locksPlease check your Schedule to see if youhave this cover.We will pay up to €1000 in total to replacethe locks or reset electronic locking controlson Your Car if the keys to it are stolen fromthe house you live in, provided the person(s)who stole them visibly damaged your houseor used force to get inside it. You mustreport the break-in and theft of the keys tothe Gardai.

5DMedical expenses andemergency treatmentPlease check your Schedule to see if youhave this cover.

5F New Car ReplacedPlease check your Schedule to see if youhave this cover.If you have a valid claim under either section2 or 4 of this policy and Your Car is stolenand not recovered within 30 days, or in ouropinion is not worth repairing, within twelvemonths of you buying it as new, we willreplace Your Car with a new car of the samemake and model as long as one is availablefor sale in the Republic of Ireland. If we settlea claim on this basis we will own thedamaged or lost car.

If the same make and model is not available wewill not pay any more than the cover providedby Sections 2 or 4 of the policy.

Uninsured Driving Protection

We will ignore any claim when calculatingyour next no-claims discount if;

1 the claim is for damage to Your Carunder Section 4A; and

2 the damage to Your Car was caused by acollision between Your Car and anothervehicle; and

3 the driver of the other vehicle was notinsured to drive it; and

4 the identity of the uninsured driver isknown to you.

If one claim, or incident that might result in aclaim, arises since the start of the policy orsince we prepared your last renewalpremium the no-claims discount applying atthe start or previous renewal will be reducedas follows at your next renewal:

We will not apply this benefit and you willlose no-claims discount if you or the driver ofYour Car is convicted of a drink or drugsrelated driving offence as a result of theincident that results, or might result in a claim.

If no more than two claims and /or incidentsthat might result in a claim arises since thestart of the policy or since we prepared yourlast renewal premium, and they are the onlyclaim(s) that have arisen in the three yearsbefore the next renewal of this policy, we willkeep your no-claims discount at the samelevel it was at the start of the policy or thelast renewal. The no-claims discount will notbe advanced at the next renewal.

Section 7Excess

An Excess is the first amount of any claimfor loss or damage you have to pay beforewe pay.

You must an pay an Excess of the amountspecified on your Schedule against item 7Afor any claim that arises under section 4 ofyour policy.

When repairs have been completed you mayhave to pay the Excess directly to therepairer before you can take delivery of YourCar.

If a claim under section 4 is for damage as aresult of Your Car being driven into floodwater, onto a submerged road or into anyother body of water, the Excess payable byyou will be twice that shown against item 7Aon your Schedule.

A. Specified (you must contact usfirst to arrange this cover)

Section 1 of this policy will be extended tothe minimum cover necessary to meet theinsurance requirements of the Road TrafficActs in respect of the use of a trailer ownedby you or in your possession while it is notcoupled to Your Car, provided that we givespecific agreement to such cover.

B. Unspecified (this cover appliesautomatically if item 8 is shownas applying on your Schedule)

Section 1 of this policy is extended to theminimum cover necessary to meet theinsurance requirements of the Road TrafficActs in respect of the use of a trailer ownedby you or in your possession while it is notcoupled to Your Car, provided that thetrailer has a single axle and weighs less thanone tonne when unloaded.

The benefits under both A and B above:1. will not apply while the trailer is being

used for any purpose other thansocial, domestic or pleasurepurposes; and

2. do not apply if the trailer is a caravan,mobile home, trailer tent, or boattrailer or if it has machinery or otherequipment attached to it; and

3. apply only if you keep to the otherterms, exceptions and conditions ofSection 1 as far as they can apply,and the terms exceptions andconditions of the whole policy.

Section 9RSA Motor Choice BreakdownAssistancePlease check your Schedule to see if youhave this cover.

RSA Motor Choice Breakdown Assistance is a24 hour accident, emergency & breakdownrecovery service. It is there to assist you inyour time of need. The choice of assistancesupplied depends on the options available tous and our service provider at the time of therequest for assistance. You should be awarethat the cover provided will be at the ourdiscretion as not all options are available at alltimes. For example car hire in a rural area maybe impossible to obtain in the early hours ofthe morning.

BenefitsIf Your Car cannot move as a result of amotor accident, electrical or mechanicalbreakdown, fire, theft, attempted theft,malicious damage, punctures that requireassistance to fix or replacement of a wheel,lost or stolen keys, keys broken in the lock orlocked in Your Car or you running out of fuelwe will arrange and pay for the benefits setout below.

1 Breakdown Assistance

We will arrange• One hour’s free labour at the roadside if

Your Car can be repaired where it is; or• towing of Your Car to the nearest

competent repairer or to a garage ofyour choice, whichever is closer and wewill pay the cost of public transportationfor you to collect Your Car after therepair.

• Somebody to assist you in the event of abreakdown at your home.

2 Completion of Journey within the islandof Ireland

If Your Car cannot be repaired at theroadside, and has broken down away fromhome, we will arrange and pay for either:• transportation for you and the

Passengers home or onward to theirintended destination within the island ofIreland; or

• use of a Class A replacement hire car forup to 48 hours while repairs are carriedout; or

• overnight Bed and Breakfastaccommodation for you and thePassengers for one night only, while YourCar is being repaired. The most we willpay for accommodation is €40 perperson and €200 in total in the Republicof Ireland, or Stg£40 per person and£200 in total in Northern Ireland.

If You are away from home and Your Carhas been stolen and not recovered within 24hours, we will provide a replacement car forup to five days or up to when Your Car isrecovered, whichever is sooner. You musthave reported the theft to the Gardai.

9B RSA Motor Choice BreakdownAssistance in Europe

Please check your Schedule to see if youhave this cover. If your Schedule shows thatyou have cover under this section, you alsohave all the benefits described in section 9Aabove.

For benefits 1 and 4 described in Section 9A,and for benefit 6 shown below, the territoriallimit is extended to the European UnionexcludingA. Andorra, Gibraltar, Liechtenstein,

Norway, San Marino, Switzerland,Monaco; and

B. for the avoidance of doubt does notinclude the Isle of Man, Channel Islandsor any offshore island of any country inthe European Union not accessible byroad.

Conditions to Sections 9A and 9B

A. You must call for assistance through thephone numbers provided above and wemust authorise assistance before it isprovided.

B. You must report a theft of Your Car tothe Gardai or appropriate Policeauthority, before we provide anyassistance or pay any benefit that isrequired due to the theft or attemptedtheft of Your Car.

C. The Policy Number must be quoted whencalling for assistance. You may be asked toprove your identity by showing any formof photographic identification such as adriving licence, or showing a debit or creditcard in your name, before assistance isprovided.

D. If you cancel this policy or this section ofit, no return of premium will be allowedin respect of the assistance portion of thepremium.

E. We are free to choose the car hire firm toprovide you with a replacement vehicle.We do not have to seek alternative firmsif the firm we choose cannot or will nothire you a car. The firm we choose maynot have any cars available, may be out ofcontact, or may have rules about hiringcars that you do not or cannot complywith. These include, but are not limited torequiring you to have a full clean driver’slicence, and requiring you to pay cash orcredit card deposits.

F. If a replacement vehicle is provided itmust be returned to the place you pickedit up from unless both We and the carhire firm we choose agree otherwise.

G. You are responsible for arranging

insurance for and paying for any fuel used in areplacement car.H. When we provide roadside assistance or

towing, you must be with Your Car whenthe repairer arrives. If you are not withYour Car and our repairer cannot assist,any subsequent assistance will be at yourown cost.

I. If a repairer we arrange for has to make aforced entry to Your Car because youare locked out of it we will not be liableto repair the damage. You may be askedto confirm this by signing a declaration.

Exceptions to sections 9A and 9B

1. We will not arrange for, pay for orprovide any assistance or benefitA. unless Your Car is a private car or car

derived van;B. in the European Union, apart from

Ireland and the UK, if Your Car ismore than 10 years old;

C. if Your Car has been modified for oris taking part in racing, trails or rallying;

D. for towing if Your Car hasmodifications to wheel arches,bumpers or suspension;

E. if Your Car is in an inaccessiblelocation, including ground that isunsafe to drive on or would lead toour towing operator becoming stuckor bogged down;

F. in circumstances where the personproviding assistance to you thinks thatyou are under the influence of drinkor drugs;

G. if You are entitled to similar benefitsfrom another insurer or can recoverthe cost of the assistance we provide

from another source;H. if Your Car is carrying more

Passengers than or is towing a greaterweight than that for which it wasdesigned, as stated in themanufacturer’s specifications;

I. for any accident or breakdowncaused by or contributed to by anavoidable or wilful or deliberate actcommitted by you;

J. for the cost of any parts, keys,lubricants, fluids or fuel required toput Your Car back on the road.

2. We will not be liable forA. any loss you suffer as a result of us

giving you assistance;B. any claim caused by fuels, oil,

hydraulic fluid or any othercorrosive or flammable material,explosives or toxins carried in oron Your Car;

C. the cost of repairing Your Carother than the roadside repairs wecarry out;

D. any failure to provide assistance orbenefits where we are preventedfrom doing so by extraordinarycircumstances, labour disputes,government controls, restrictions orprohibitions, or if any governmentor authority does something or failsto do something that prevents usfrom providing assistance orbenefit; and

E. any failure to provide assistance orbenefit if any supplier, agent orother person fails to provide anyassistance for reasons outside ourreasonable control.

Use in Europe

Liability to Third Parties

The insurance under Section 1 is extended togive the minimum cover needed by lawrelating to compulsory insurance for vehiclesin any Green Card Country.

Fire, Theft, Windscreen and AccidentalDamage

The cover you have bought under Sections 2,3 and 4 will apply while Your Car is in anyGreen Card Country for a single visit lastingup to 31 days. You may extend the length ofthis cover by calling us, but depending on thecover you have bought we may ask you topay an additional premium. The cover youhave bought will also apply while Your Car isbeing transported between any ports in theGreen Card Countries. If you claim for a riskwe insure, we will also cover any costs youhave as a result of being forced to paycustoms duty.

We will not pay for the following exceptwhere it is necessary to meet therequirements of the Road Traffic Acts.

1 Any accident, injury, loss, damage orliability that happens while any vehicleshown in the Certificate is being drivenor used other than as allowed under theterms of the Certificate,

2 Any liability an Insured Person has underan agreement which they would not haveif the agreement did not exist.

3 Any accident, injury, loss or damagearising during or as a result of:(a) an earthquake; or(b) a riot or civil commotion unless you

can prove that the loss, damage orinjury was not caused by that riotor civil commotion.

4 Loss or damage (except under section 1)directly caused by pressure waves as aresult of aircraft and other flying objectstravelling at or above the speed of sound.

5 Any injury, loss or damage to anyproperty or any indirect loss or expense(consequential loss), or any legal liabilitydirectly or indirectly caused by,contributed to or arising from:

• ionising radiation or contaminationby radioactivity from any irradiatednuclear fuel or from any nuclearwaste from burning nuclear fuel; or

• the radioactive, toxic, explosive orother dangerous properties of anyexplosive nuclear assembly or partof it.

6 Any consequence of war whether war bedeclared or not, including invasion, act ofa foreign enemy, hostilities or warlikeoperations, civil war, rebellion revolution,insurrection, civil commotion assumingthe proportions of or amounting to anuprising, military or usurped power, civilwar, revolution or any similar event.

7 Any consequence of an act of terrorism,including any action taken to control orprevent an act of terrorism. If an InsuredPerson alleges that this policy covers anevent that we have decided is notcovered because of this exception, it willbe up to the Insured Person to prove thatthe event was not an act of terrorism.Terrorism means an act or threat offorce or violence by any person orgroup, whether acting alone or inconnection with any organisation orgovernment committed for political,religious or other purposes, whoseintention is to influence any governmentor to place the public, or any section ofthe public, in fear.

1. Keeping to the policy conditions

You and any other Insured Person must keepto the terms, exceptions and conditions ofthis policy before we will make any paymentunder this policy.

a The answers in any proposal anddeclaration for this insurance must betrue and complete as far as you know.The proposal and declaration will formthe basis of this contract.

b You or any other person on whosebehalf payment is claimed must keep tothe terms and conditions of this policy.

c You must let us know about any relevantfacts that may possibly affect our decisionto provide insurance that have becomeapparent, since the start of the policy orsince we last prepared your renewal. Ifyou do not tell us these facts, your policymay not provide the cover you need ormay not be valid at all.

d Any person whose driving is covered bythe terms of the Certificate must hold alicence to drive the vehicle they aredriving or, if they have held a licence todrive that vehicle, must not have beendisqualified from holding that licence.

2. Claims

You or any other person we cover underparagraph 4 of the Certificate must:a Let us know immediately about any

event which may lead to a claim underthis policy, with all the details we mayneed;

b Tell us immediately if you become awareof any prosecution, inquiry or inquest inconnection with the event;

c not admit, deny, negotiate or settle aclaim without our written permission;

d send us all documents, proof, informationand any letter or legal summons orsimilar document we may reasonablyneed; and

e co-operate fully with us in investigatingand handling any claim.

3. We may do the following:

a We may take over and carry out in yourname (or that of any person defined asan ‘Insured Person’ under section 1 ofthis policy) legal proceedings to defendor settle any claim, or to prosecute inyour name (or the name of anotherperson) any claim for our own benefit.We will decide how any proceedings arecarried out or how any claim is settled.

b If we have to meet any legal liabilitiesunder this insurance by the law of acountry this policy provides insurance for,we have the right to ask you (or anyother person) to repay us if you have notkept to the terms, conditions andexceptions of this policy.

c If the law of any country in which thispolicy applies, or an agreement betweeninsurers and government (for example,the Motor Insurers’ Bureau of Irelandagreement) says we must make anypayment on your behalf which we wouldnot otherwise have paid, we have theright to:• get the amount back from you; or• get the amount back from the

person who was responsible; or• get the amount back from both of

You.

4. Other insuranceApart from claims under Section 1, Liabilityto Third Parties, Section 4B, Driving otherCars and Sections 5A and 5B, Injury toDriver, we will not pay more than our shareof any claim if there is more than one policyof insurance covering the loss, damage orliability. We will not pay any share of a claimthat an Insured Person has under section 1 ifthere is another policy of insurance coveringthat person’s liability and we will not pay anyshare of a claim that you have under section4B if you are covered to drive that car underany other policy.

5. Mid term changesIf you make a change to your policy (forexample you might change the cover youhave bought, change Your Car or decide toadd or delete other drivers) and the changeresults in an adjustment to the premium, wewill not charge you for premium adjustmentsless than €25, nor will we refund you anypremium amounts of less than €25.

6. CancellationA. Cancellation by you1. Cooling off period - your right to

withdraw from the contract in the first14 days -

Provided you have not made a claim youhave the right to cancel your policy, within 14days of the latest of:

(1) the starting date of cover; or(2) the date on which you receive this

document containing the full termsand conditions of your policy.

This means that no policy was ever in place,and you may exercise this right by sending usnotice in writing to RSA Motor Choice CarInsurance, PO Box 384, Tuam Road, Galway,quoting your policy number. If you exercise

this right we will refund you the premiumyou have paid.

2. If you cancel during thefirst Period of insurance, the refund will bebased on our short period table of rates. If youcancel at any other time, the refund will beproportional to the time left on the policy thatyou have cancelled.

B. Cancellation by usWe may cancel this policy by sending 10 daysnotice, or, in the case of cancellation due to adefault of instalment payments 21 days, toyou at your last known address. Provided youhave had no claims during the Period ofinsurance we are cancelling, we will refund apremium for the unused portion of the year,less a fixed expense of €65 (plusGovernment levy). The refund will be basedon our short period table of refunds whichmay not be in proportion to the timeremaining on the policy.

C. Cancellation proceduresYou must return the current Certificate anddisc to us before we give you any refund forcancelling or withdrawing from the policy,whether you cancel it or we do. We maydeduct a fixed expense of €65 (plusGovernment levy), from any return due toyou. If the final refund calculated is less than€25 we will not refund anything.

7. FraudIf any claim is fraudulent in any way, or if youor anyone acting on your behalf has used anytype of fraud, you will lose all benefit underthis policy and we will have the right not todeal with any ongoing or future claims. Wewill also have the right to a repayment of allclaims costs previously paid under this policy.This will also apply if you exaggerate a claimor if you or anyone acting for you sendforged or false documents to us.

8. Duty to take careYou must take all reasonable steps toprevent accident, injury, loss or damage, andmust keep Your Car in a roadworthycondition. You must allow us to examineYour Car at any time.

9. Resolving DisputesAny dispute between you and us about ourliability over a claim or the amount to be paidshould first be referred to the FinancialServices Ombudsman’s Bureau (FSOB). If theFSOB make a finding, it will be binding onboth you and us and can only be changed byappealing the finding to the High Court. Ifyou appeal the finding, RSA will not pay thecost of doing so. If the FSOB decides that itcannot make a finding over the dispute, theymust communicate that to you before youtake legal proceedings over the dispute.

10.Disclosure of Penalty PointsIf you, or any driver whose driving is coveredby this policy, are convicted of any offenceunder the Road Traffic Acts this is a materialfact and the following information must bedisclosed at the next renewal date of thepolicy.

1. The type of offence(s)2. The number of penalty points

imposed for the offence(s)3. The date(s) of conviction(s)4. The driver number, printed on the

driving licence, of the driver onwhom the penalty points have beenimposed

11.Treatment of convictions foroffencesIf you or any other driver of Your Car thatyou have named has been convicted on anyoffence you must tell us. We may take theoffence(s) into account when calculating yourpremium and the cover we offer at the nextrenewal, or if we wish any future renewal.

Insurance Link DatabaseInformation about claims (whether by ourcustomers or third-parties) made underpolicies that we provide is collected by uswhen a claim is made and is placed on aninsurance industry database of claims knownas Insurance Link. This information may beshared with other insurance companies, selfinsurers or statutory authorities. Insurancecompanies share claims dataa) to ensure that more than one claim

cannot be made for the same personalinjury or property damage

b) to check that claims information matcheswhat was provided when insurance coverwas taken out

c) and, when required, to act as a basis forinvestigating claims when our recordedinformation is incorrect or when wesuspect that insurance fraud is beingattempted.

Notes for the guidanceof Policyholders(not forming part of the Policy)

DriversYour Policy is on a ‘named driver’ basis.No person other than those named on theCertificate may drive. If you want to changeor add a driver we shall require a form to becompleted in respect of the new drivershowing that persons name, age and drivinghistory. Depending on the total number ofdrivers, their driving history and experience,an additional premium may be required.

Remember - no driver may driveYour Car without a valid Certificate.

Going abroadFull policy cover applies only in the Republic ofIreland and the United Kingdom. To ensurethat your current level of protection ismaintained for travel to any other country youmust let us know before you make a triplasting more than 31 days, or more than onetrip in the same policy year.

We will need to know the dates of your tripand the countries to be visited. We will tellyou if there is an additional premium andissue a Foreign Use Extension which includes:

� Confirmation of the dates and countriesto be visited;

� Claims procedure notes - what to do ifan accident occurs;

� Accident Statement Form - to help youat the scene of an accident; and

� Claims Settling Agents List - who tocontact abroad and where.

Green Cards are not necessary for travel inmost European countries. For travel to acountry which still requires a Green Card tobe issued, this will also be included at noadditional expense.

You must remember to take your Policy andCertificate with you.

Help us to help youAt the time of the accident don’t admitliability. Many people feel apologetic aboutaccidents for which they are not responsible(aggression doesn’t signify innocence either).Let us deal with the liability issue! Pleasemake a note of the name, address andinsurance information (company & policynumber) of the other people involved. Makea note of the registration numbers andpositions of any vehicles.Obtain names of any witnesses and Gardaiinvolved.Tell us about the accident as soon as possibleby calling 00353 1 2901978.We do not require an accident report formto be completed in every case.We operate an Approved Repairer Networkwhich may be able to provide you withassistance in relation to the damage to YourCar.Please forward any communication receivedto us without delay

What the law requires in the caseof an accidentFor your guidance paragraphs a) to d) beloware extracted from the ‘Rules ofthe Road’:a) Any driver involved must stop his/her

vehicle and keep it at the scene of theaccident for a reasonable time.However, to avoid obstruction anddanger to other road users, thepositions of the vehicles should bemarked and the vehicles moved off theactual carriageway as quickly aspossible.

b) Any driver must, if requested, give- his/her name and address- the name and address of the

vehicle owner- the vehicle registration number- evidence of Insurance to a Garda,

or if no Garda is present, to anyonepresent who was involved in oraffected by the accident - in anyother case the information must begiven, if requested, to anindependent witness.

c) Where a person or persons are injured,the accident must be reported at thenearest convenient Garda Station if noGarda is present at the scene ofthe accident.

d) Where damage to property only isinvolved it is not necessary to reportthe accident at a Garda Stationprovided the driver gives necessaryparticulars as b) above to the personwhose property has been damaged.
