Approval of Minutes: On motion, duly seconded, the minutes of the October 13, 2019, meeting were approved.

Report of the Executive Committee – Patrick Mills reported that the Committee had met by conference call that morning at 9:00 a.m. They received reports on membership and reserves.

The Executive Committee approved a resolution that closes the pension plan for new participants not already in the plan as of Monday, January 13, 2020 and stops benefit accrual December 31, 2024. The MSMA Council was presented with a similar resolution that closes the pension plan for new participants not already in the plan as of Monday, January 13, 2020 and stops benefit accrual December 31, 2024. On motion, duly seconded, the resolution was approved. The Council was also presented with a resolution to modify the pension plan document to reflect changes the Council just approved. On motion, duly seconded, the changes to the pension plan document resolution were approved.

The Executive Committee approved a resolution giving authority to change the MSMA Constitution and Bylaws to reflect the addition of the Women Physicians Section, which was added at the 2019 Annual Convention. The Committee requests that the MSMA Council submit a resolution at the 2020 Annual Convention, reflecting that the Council has the authority to modify the Constitution and Bylaws for the addition of the Women Physicians Section, allowing for its creation and its addition to other areas of the Bylaws where Sections are mentioned. On motion, duly seconded, the resolution will be amended to be consistent with AMA Bylaws, and submitted at the Annual Convention for approval.

The Committee also heard updates on marketing, membership outreach, Medicaid expansion, and a healthcare collaboration with MHA.

On motion, duly seconded, the report of the Executive Committee was approved.

Report of Executive Vice President – Patrick Mills asked members to relay recommendations for committee and commission appointments. He referred members to copies of letters in their packets regarding vaping issues, Medicare and surprise billing. He highlighted an article written about Dr. David Barbe, as he has progressed from small-town physician to national and global leader. Council members will be receiving member recruitment letters in the mail, to be signed and returned. He provided updates on Phone2Action and advocacy meetings throughout the state. He reminded members of the dates for the 2020 Annual Convention in St. Louis.

Remarks of the President – James DiRenna, Jr., DO, thanked Patrick Mills and MSMA staff for helping him this past year, and thanked the Council for allowing him to represent them. He reported on his travels throughout the state, as well as other states. He encouraged members to keep in touch with their legislators. He raised the issue of the MSMA President becoming an AMA delegate, and invited feedback on the subject.

Report of the Ad Hoc Committee on the Annual Convention – Betty Drees, MD, reported that the Committee had met three times via conference call and addressed several topics. They will continue to meet and address further topics, and present a proposal at the July MSMA Council meeting.

Report of the MSMA Insurance Agency – George Hubbell, MD, reported that the agency has had a good year financially. The board approved the minutes from the October 2019 minutes, as well as the 2020 budget. Members are urged to utilize the agency for any insurance needs, and to encourage their colleagues to do likewise. There was discussion regarding the status of MPM-PPIA/Physician Standard Insurance Company.

Report of the Commission on Continuing Education – Peggy Barjenbruch, MD, referred members to the report in their packets, which included an outline of general sessions for the upcoming Annual Convention and recent accreditation decisions. On motion, duly seconded, the report was approved.

Report of the Legislative Committee – Ravi Johar, MD, reported that the Committee had met earlier in the day by conference call. Jeff Howell and Heidi Geisbuhler have read 1,500 bills and are following 400 bills that affect healthcare. He encouraged members to sign up for Physician of the Day, and to consider allowing a medical student to shadow. White Coat Day at the Capitol will be March 3, 2020. Phone2Action is a good tool for physicians to connect with legislators; currently, there are 120 physicians signed up.

The Committee recommends that Resolution #1, addressing the issue of tackle football below high school age, not be adopted. Discussion followed. On motion, duly seconded, the recommendation of the Legislative Committee that the resolution not be adopted was affirmed.

The Committee was updated on the E/M coding revision and Texas v. Azar challenge to the ACA. They also discussed several upcoming legislative issues.

The Committee recommends that the Legislative Award be presented to Representative Robert Ross and Senator Bill White. On motion, duly seconded, the Council supports the presentation of these awards.

Report of the Physicians Health Program – Bill Woods, MD, offered the report as Chair of the Physicians Health Committee. Due to the resignation of Bob Bondurant as of December 31 Mary Fahey has been named Acting Executive Director of the MPHP. The Committee recommended to the Foundation Board that Mary Fahey be named Bob Bondurant’s replacement. The organization chart has been changed so that the Physicians Health Committee will oversee the operations of the MPHP; the finances will be overseen by the MSMA EVP, both will report to the Physicians Health Foundation board.

Dr. Woods outlined the Safe Haven system that is used in some states, which would allow those seeking voluntary help from MPHP from reporting this to the Board of Healing Arts, as long as they are actively involved in the program. MPHP staff will research the issue and come up with recommendations to be presented to MSMA Council and the MSMA Physicians Health Foundation board. The Committee meeting will be April 3 at the MSMA Annual Convention.

Elie Azrak, MD, proposed that a letter of appreciation be sent to Bob Bondurant. With the agreement of the group, the letter will be composed and will be signed by James DiRenna, Alex Hover and Patrick Mills.

On motion, duly seconded, the report of the Physicians Health Committee was approved.

Report of the Publications Committee – On motion, duly seconded, the report of the Publications Committee was approved.

Report of the Membership Committee – Joseph Corrado, MD, reported that the Committee had met on January 7 via conference call. He reviewed current membership numbers, the results of the Councilor-signed recruitment letters, recent advocacy events, and strategies being pursued on the recommendations of High Five Communications. Staff will be connecting with hospital Chief Medical Officers. He encouraged everyone to sign up for Phone2Action.

Actions and Resolutions from the 2019 Annual Convention – Dr. Hover referred members to the updated tracking grid regarding the current disposition of resolutions.

Report of the MSMA Alliance – Gill Waltman reported on the fall conference in Hannibal in October. She thanked all who contributed to the 2019 Alliance Holiday Sharing Card, which raised over $3,200. Sue Ann Greco will be installed as AMA Alliance President next June.

AMA Report– Elie Azrak, MD, reported that the delegation had attended the AMA interim meeting in San Diego in November. A resolution put forth at the 2018 MSMA Annual Convention resulted in a change in AMA policy. The resolution addressed the inclusion of health system science subjects in medical curricula and LCME accreditation. Thank you to Charles Van Way, MD, for editing the delegation’s contribution in the Missouri Medicine article. AMA members are encouraged to read and comment on resolutions, which can be accessed online.

Reports of Councilors – District 3 – IJ Singh, MD, reported that SLMMS will hold its Annual Meeting on Dinner on Saturday, January 25, at the Living World at the St. Louis Zoo; Dr. DiRenna will act as installing officer. Jason Skyles, MD, will be installed as the 2020 SLMMS President. Four physicians will be presented with awards, including Sam Page, MD, who will receive the Schlueter Award and Bill Huffaker, MD, who will receive the President’s Award. Dr. Singh offered an update on the Choosing Wisely program.

District 4 – Keith Ratcliff reported that the Tri-County Medical Society will meet January 29 in Washington; any members are welcome to join.

District 5 – Lisa Thomas reported that Boone County Medical Society had a successful residency forum in October. They will be offering a second session on financial, legal and insurance issues for medical students and resident. BCMS will have its Gala on February 1, which will include the installation of officers by Dr. DiRenna. The BCMS Alliance has been reorganized under the direction of Mary Katherine Heimburger and Donna Corrado, and will be renamed as Central Missouri Medical Alliance. The BCMS board approved a contribution to the MPHP in 2019.

District 6 – David Kuhlmann, MD, thanked Dr. DiRenna for speaking at the Bothwell Regional staff meeting and for attending the holiday party in December.

District 8 – Matt Stinson, MD, reported that GCMS had a medical marijuana discussion led by Lyndall Fraker of DHSS. Kayce Morton, DO, will be taking over the GCMS presidency. Dr. Hover expressed his appreciation for the social and recruiting events hosted by the Alliance.

District 9 – Lirong Zhu, MD, reported that David Barbe, MD, had been named the President-Elect of the World Medical Association. She stated that new members had joined at Mercy Clinic-Rolla and Phelps Health, and they

anticipate more new members in the coming months. They are seeking to fill the vacancy of Vice Councilor-District 9.

Women Physicians Section – Joanne Loethen, MD, reported that they have had three conference call meetings since inception. They will have an information mixer on Friday evening at Annual Convention. They are looking at having networking events across the state in 2020.

Resident and Fellow Section – Jared Lammert, MD, reported the Section had met once since the last Council meeting, and are seeking to be more active by participating as Physician of the Day, attending the White Coat Rally, and encouraging attendance at the Annual Convention

Medical Student Section – Scott Berndt reported that two legislative bills are proceeding in support of the resolution that the MSMA Council passed at AC2019 regarding adverse events suffered by children of incarcerated parents, which was sponsored by the Medical Student Section.

Prerogatives of the Chair – Dr. Hover invited input on the concept on single-day meetings and meeting via teleconference. Discussion followed, and it was decided to try the one-day format again in October for a face-to-face meeting in Jefferson City. Also discussed was the possibility of adding videoconferencing technology. To clarify:

April 2020 – meeting at Annual Convention in St. Louis July 2020 – two-day meeting at Margaritaville in Osage Beach October 2020 – one-day in-person meeting in Jefferson City January 2021 – electronic meeting; possible videoconference April 2021 – meeting at Annual Convention in Kansas City July 2021 – two-day meeting in Jefferson City October 2021 – TBD January 2022 – TBD

On motion, duly seconded, the schedule of proposed meetings and formats was approved.

Dr. Corrado proposed that a formal resolution be crafted and flowers be sent to Sue Ann Greco in recognition of her being named AMA Alliance President-Elect.

Dr. Hover reminded members to please submit a signed Conflict of Interest Disclosure form, if they have not already done so.

Physician reply after lobbyist prompt

I want to get my 2 cents in on HB 2089 as it will cost physicians a lot more than that. As you likely know, the bill eliminates the “per day” modifier and sets the penalty from the date it is appealed. This means the health insurer will be able to hold onto a claim for an infinite period of time without any penalty. The per day penalty was a mechanism to get insurers to promptly pay claims without taking additional time by physicians. Every clinic day, yes, I mean every day I am in clinic I spend time doing pre authorizations for standard care, time refilling or changing prescriptions for patients where the only reason is that they changed insurers, and appeals on behalf of patients. All that is time I don’t see additional patients, the time is not reimbursed, and the burden is driving mid-career physicians out of practice. I appreciate your time to consider this. A problematic bill is scheduled to be heard this week in the House Insurance Policy committee, which meets on Wednesday afternoons. The bill is HB 2089. It is sponsored by Rep. Nick Schroer and makes changes to the state’s prompt payment law. MSMA was integral in getting the Prompt Pay Act passed back in 2010.

Currently, health insurers who violate the prompt pay law (payment after the 45th day of receipt of a clean claim) must pay interest of 1% of the claim per month until it is paid. In addition, there is a penalty of 1% of the total claim per day. These amounts are calculated on the unpaid balance of the claim as of the 45th day.

Under HB 2089, the insurers would still have to pay interest at 1% per month, but the penalty increases to 5% of the total claim without the “per day” modifier. In addition, the interest and penalty would now be based upon the upon balance of the claim from the date it is appealed. This means the health insurer will be able to hold onto a claim for an infinite period of time without any penalty accruing. Back in 2010, the per day penalty was seen as a mechanism to get them to promptly pay claims (duh!). Without that in the law, timely payments will decrease and appeals will increase. We do not need that headache.

I ask you to call or email your state representative. He sits on this committee and it’s important that he hears from you prior to this hearing. Feel free to encourage other physicians to reach out as well.

Dear Administrator Verma:

The undersigned state medical associations and national medical specialty societies represent hundreds

of thousands of physicians who treat our nation’s Medicaid patients every day. Our organizations are

writing to comment on the Medicaid Fiscal Accountability regulation recently issued by the Centers for

Medicare and Medicaid Services (CMS). Overall, we are committed to working with the Administration

to improve fiscal accountability and transparency in the Medicaid program.

However, our organizations are concerned that the proposed rule would significantly reduce the federal

commitment to the Medicaid program, physicians, and our patients without appropriate data and a

thorough impact analysis. We respectfully ask that the agency collect data on the current state funding

mechanisms and how the dollars are actually spent in each state, to make more informed policy

decisions before CMS overhauls the Medicaid financing structure.

We strongly urge CMS to withdraw the proposed rule and work with states, physicians, and patients

on alternatives that will ensure not only efficient use of taxpayer dollars, but also protect patient

access to Medicaid services.

The proposal represents a substantial shift in the state-federal Medicaid partnership and a reversal of

more than two decades of policy that allowed states different options for financing our share of

medical care in order to receive federal Medicaid matching dollars. For years, all 50 states have used

hospital fees, Medicaid managed care plan taxes, intergovernmental transfers, state special funds or

other local sources of funding to receive a federal match. The proposed rule would restrict every state’s

ability to use such funding for the non-federal share of Medicaid financing. Moreover, there are no clear

standards by which future state Medicaid financing will be considered, and the rule does not allow

adequate time for states to plan for these substantial changes.

As physicians, we are extremely concerned that the proposed rule would result in significant Medicaid

funding cuts to our most vulnerable patients – children, pregnant women, the elderly and disabled.

Medicaid provides coverage to

21% of Americans

Nearly 50% of our nation’s children

More than 1/3 of our nation’s disabled

More than 10 million seniors

For some states, the cuts could represent up to 50% of their Medicaid budgets. Such drastic cuts would

harm physicians’ ability to continue to participate in the program, exacerbate existing Medicaid

physician shortages, and thus, undermine access to care for these fragile Medicaid patients. The

proposal would disproportionately harm rural and underserved communities who shoulder an even

heavier Medicaid burden.

Finally, we are concerned about the negative impact of the proposed rule on state budgets and states’

capacity to address funding gaps. This rule would create significant funding gaps in state budgets and

leave states without adequate resources or time to prepare for the future. States could be forced to

close budget gaps with either untenable cuts to providers and medical services or burdensome increases

in state and local taxes. Underfunding the Medicaid program shifts the uncompensated care burden to

states and safety net providers on the front lines caring for these patients. The proposed cuts are

unsustainable for states, safety net physicians, and our Medicaid patients- most of whom are children.

If enacted, the proposed rule would negatively impact patients, physicians, and state budgets in all 50

states. We respectfully urge CMS to protect health care services for children, the elderly and disabled

by withdrawing the rule and working with us to improve fiscal accountability in other ways with more

informed data.

Dear Director Lindley-Myers:

Federal officials are taking action to ensure that Medicare, Medicaid and other insurance

coverage is fully primed to respond to the emerging public health threat posed by COVID-19.

They have ensured that COVID-19 testing and treatment will be covered, including telemedicine

services to limit the risk of further transmission. The IRS has issued guidance to minimize cost-

sharing in high-deductible plans of coverage. President Trump and Vice President Pence recently

held a press conference to announce the nation’s largest health insurers’ agreement to waive

copayment requirements for COVID-19 testing and to include coverage for COVID-19 treatment

in their benefit plans.

Our organizations urge the Department of Commerce and Insurance to act to ensure comparable

standards are in place for insurance coverage under the regulatory jurisdiction of the Missouri

Department of Commerce and Insurance.

Some states have gone beyond the federal standard to bar commercial insurers from imposing

prior authorization requirements for COVID-19 testing. To the extent this is pertinent to the

Missouri insurance market, we urge your department to follow suit.

Also, federal, state and local public health agencies and officials advise those with symptoms

indicative of possible COVID-19 infection to consult their primary care practitioner. To that, we

urge the department to take immediate action to ensure that insurers’ provider directories are

accurate.

2020 Annual Convention Planning:

The Annual Convention program was presented to Commission members for approval of the AMA PRA

Category 1 Credits and ABIM MOC Points. Following a brief discussion, staff was directed to find a

virologist to also serve as faculty for the Coronavirus General Session. Staff informed the group that an

electronic vote would be emailed once the additional speaker was confirmed.

Commission members were reminded to submit their disclosure forms to staff.

Staff will email an outcomes survey to convention attendees six weeks following the convention to

ascertain from learners if they implemented a practice change based on what they learned in the

educational sessions. All surveys participants will be entered in a drawing for $100.

Provider Updates:

Accreditation decisions since January conference call:

Phelps Health-Accreditation for 4 years and Southeast Health-Accreditation for 4 years with a progress

report due within 1 year

All accredited providers received correspondence requesting the submission of the annual maintenance

fee ($2500) and report by Friday, March 13, 2020.

MSMA staff conducted new provider training on Wednesday, February 26, 2020 at MSMA headquarters.

Three new CME coordinators attended the training.

Miscellaneous:

Staff will attend the ACCME’s Annual Spring Meeting May 5-9, 2020 in Chicago, IL. Additionally, the

ACCME/AMA State Medical Society Meeting will be held December 9-10, 2020 in Chicago, IL.

Commission members should let staff know of their interest in attending the meeting by September 1,

2020.

Commission members received an updated member roster. Staff informed the Commission that Dr.

Tyler Fisher had to resign due to new professional obligations and responsibilities. Commission

members were encouraged to share names of potential members with staff. Staff reminded the group

that in order to serve on the Commission an individual must be an MSMA member.

Remaining 2020 Conference Call Dates: June 30th and October 12th at 5:30 pm

Missouri State Medical Association Alliance

This will be my last official MSMA Council meeting as I come to the end of my second term as Alliance president. Despite many achievements, this year has not run as smoothly as last, with first bad weather and now the coronavirus disrupting our own as well as the Council’s meetings, our activities, and work, travel and home routines. With the necessary cancellation of the MSMA Annual Convention, I am saddened not to be able to give the traditional Alliance report to the House of Delegates, that the James Bond-themed fundraiser will not take place after all the preparation by Alliance Foundation Chair Kathy Weigand and her committee, but especially that Dr. George Hruza, Diana Corzine and their respective officers will not be installed and celebrated in the style they deserve, and to which we have all become accustomed. This year, the Alliance moved its Winter Board Meeting and Day at the Legislature to coincide

with the MSMA White Coat Day held on Tuesday March 3 in Jefferson City. Legislation Vice

President Kirk Doan arranged for members to stay in a brand-new Holiday Inn & Suites and

coordinated his efforts on behalf of the Alliance with the staff at MSMA. Alliance members

attended the winter board meeting the previous day in person, or by conference call, and met

for dinner at Madison’s Café the night before for a briefing by the MSMA lobbyists Jeff Howell

and Heidi Geisbuhler, and Executive Director Pat Mills.

The MSMA Alliance Annual Meeting that is usually held in conjunction with the MSMA Annual Convention has, of course, been cancelled too. President-elect Diana Corzine and I have worked together, with the help of Allene Wright, to combine a belated annual business meeting with our Alliance Executive Board meeting in Columbia in May. We have chosen Tuesday May 5 for an all-day condensed annual business meeting, installation and awards luncheon and executive board meeting. I will still be the presiding officer for the morning session; Diana and her officers will be installed, awards presented, followed by her executive board meeting. We will plan a COVID-rain date for the end of May. If it is still not safe to congregate and that also gets cancelled, we will conduct business by conference call. For those who are interested, the in-person Cabi Fashion Show (another small fundraiser) scheduled to be held at the convention has been cancelled but plans are underway to hold a

virtual show by Zoom in the near future. Contact me if you would like to be kept informed about this. Proceeds from the event will benefit MSMF. Match Day Events: Match Day events were planned across the state for the week of March 16-

20 and all have been cancelled due to the virus. Most will be conducted virtually but exclude

any outside guests. Many thanks to Millie Bever and Angela Zylka for organizing these thwarted

events and for the local Alliance members who planned to participate in Columbia, Kansas City

and St. Louis. Millie is looking into some form of ceremony or recognition for the students at

the time of their graduations, assuming those even take place.

Current Alliance Activities: The Alliance has vice presidents for four focus areas in its efforts to support the family of medicine and its physicians in Missouri; Health, Membership, Legislation and Foundation. Health Vice President Kelly O’Leary has taken our Drugs are Not for Me program around the state to different counties during the year. In addition to the opioid crisis, the presentation now includes the dangers of electronic cigarettes. We had hoped to piggy-back onto the presentation on Vaping by Dr. Donald Bohnenkamp at the MSMA Convention to learn the latest updates, but it was cancelled. The topic will be included in our community health programs going forward. Membership continues to decline in most counties, mostly by attrition and the difficulty in recruiting new members. Although Cape Girardeau has an active local alliance membership, VP Jennifer Gast has not had much success re-recruiting her Cape Girardeau fellow members to participate at the state level. We are delighted that Mary Catherine Heimburger, with the help of Donna Corrado and the support of Boone County Medical Association, have formed a new alliance combining three former counties. It will be known as Central Missouri Medical Alliance and it is already attracting members. This is our fastest growing alliance. Legislation Vice President Kirk Doan organized our Day at the Legislature at the Capitol to coincide with the MSMA White Coat Day on March 3. (See above.) Foundation Vice President Kathy Weigand was denied her chance to fulfill the exciting Friday night James Bond event at convention as that was also cancelled. Although the expected funds to be raised at the event will not materialize, the results of the Alliance efforts to fundraise for MSMF looks unusually successful this year. In addition to the $3220.00 raised from the Holiday Sharing Card, arrangements were made at the end of July to turn over the former Alliance Scholarship monies to MSMF. This amounted to $74,084.81 and will now be managed and disbursed to medical schools by MSMF. We had hoped to present this amount to Dr. David Chalk, the incoming MSMF Chair, during the HOD speech, in the form of a large cardboard check. This is a fortuitous donation in these troubled times. Other Upcoming Events: We are hoping that the AMA and AMA Alliance annual meeting will still take place in Chicago in June (still uncertain) particularly because Sue Ann Greco is being

installed as AMA Alliance President. Jana Wolfe will keep everyone informed by posts on Facebook as more details emerge. We would like to thank the MSMA Council members and MSMA staff for their support during the year, particularly our tireless Alliance liaison Liz Fleenor. We will miss Stephen Foutes as he moves on, and thank him for his involvement with us during his time at MSMA. We would also like to remember the many contributions made to Missouri physicians and their families by Bob Bondurant at MPHP. The Alliance is sending a donation in his memory to MPHP. The Alliance wishes everyone a safe passage through the next few unpredictable months, especially those of you on the front lines. We are living in unprecedented times and it is hard to make any future plans! Hopefully starting in the summer, we look forward to another productive year working with the MSMA.
