Motion carried to approve payment of $630.00 from the fire department budget for lodging and registration for Ty Schreiber, Mark Penner, and Kelly Cook to attend the annual Kansas State Fire Chiefs Conference to be held in Wichita, October 20 thru 23, 2011. Motion carried to accept the proposal from Knudsen, Monroe & Company, LLC, Newton, Kansas for the 2011 fiscal audit in the amount of $7250.00. Motion carried to authorize the request for barricades by the Peabody/Burns High School for the cross-country run to be held on September 15, 2011. Randy Dallke, Marion County Commissioner, Randy Crawford, Superintendent and James (Bud) Druse of Marion County highway Department presented Marion County’s proposal for the improvement of Peabody Street from Ninth Street to just south of Third Street. Druse went over the proposal block by block outlining the replacement of driveway culverts and installation of larger drainage pipes to carry the storm water across the roadway. Druse further explained in the 600 block there were alternatives for end joints which would cross the roadway. Further discussion was delayed until Darren Pickens could come to the meeting. Administrator Manning reported the city received a letter of resignation from Samantha Weerts, Animal Control/ Enforcement Officer effective September 30, 2011. CITY COUNCIL MEETING MINUTES IN A SECOND WATER PROBLEMS PROGRAM The City has a special reporting and monitoring system to gather data that will help us try and pinpoint the exact cause and location of problems within our water distribution system. The two main problems that have been identified to date are 1) being below standard levels of pH and 2) chlorine residuals. We are trying to determine the cause for these two problems which could be non-toxic bacteria growth or improper cross- connection from a private well system. Contributing factors also include reduction of water consumption in specific portions of the system, inadequate turn-over of water, numerous dead-end lines, and a system well beyond its anticipated life expectancy. In efforts to accumulate all the data possible, we urge all citizens/consumers that are experiencing quality of water issues (discoloration, odor, taste) to report the issues directly to City Hall for recording purposes. Motion carried to approve check journal 2011 9A as presented in the amountof $43,637.35.

Manning reported he has been working with Sheri Hilger of Hilger InsuranceAgency on getting coverage for the Baker Buildings. EMC agreed to providelimited coverage until full coverage could be acquired. The problem in gettinginsurance is that the buildings are vacant.

Motion carried to authorize the improvement of Peabody Street with a jointproject with Marion County utilizing the sheet piling and 2”patch mix overlay inthe amount of $16,331.93.

Woodruff requested we look at the different street lights located at alleyentrances between block to see if they are necessary and if we could do awaywith some of those that are unnecessary.

8:44 p.m. Motion carried to authorize the payment of a portion of the building insurance

policy for the Baker buildings in the amount of $3,500.00. Mayor Larsen reconvened the regular council meeting back in order at 8:46

p.m.

September 26, 2011 Motion carried to approve the check journal 2011 9c in the amount of

$17,585.63. Motion carried to approve Ordinance 05-2011 adopting 2011 edition of the

Standard Traffic Ordinance as amended. Motion carried to approve Ordinance 06-2011 adopting 2011 edition of the

Uniform Public Offense Code. Motion carried to approve Ordinance 07-2011 an ordinance revising and

updating the City of Peabody Kansas Zoning Regulations by repealingOrdinance 707 of the City of Peabody Code of ordinances.

Motion carried to approve Ordinance 08-2011 incorporating by referenceOrdinance 07-2011 providing for new zoning regulations for the City ofPeabody, Kansas.

Chief Burke advised the council that based on an ordinance change last yearthe curfew time would be 8:30 p.m. on Halloween night.

Motion carried to go into executive session at 8:44 p.m. for 10 minutes for thepurposed of discussing non-elected personnel and invited Mac Manning andBruce Burke to attend the sessions. The council came out of executivesession at 8:54 p.m. There was discussion about the animal control positionand the ordinance enforcement officer. The council directed the cityadministrator to prepare a report on the various alternatives in solving hisproblem.

Darren Pickens reported that the catch basin that was to be located at 8th andPeabody Street was being eliminated because of the excess amount of graveland other debris that would accumulate in the basin would be an ongoingmaintenance problem.

Motion carried to amend the City of Peabody Personnel Policy by prohibitingthe use of any form of tobacco products on city property or in city ownedequipment.

Woodruff stated that there were quite a few ditches and vacant lots around thecity that needed mowing.

Woodruff conducted a survey of street lights located at alley intersectionsaround the city and had found 26 lights that she believed could be removed.

Manning reported the front door at the police department was in need ofreplacement.

Motion carried to accept the proposal from Mahaney Roofing Company in anamount not exceeding $14,200 for a complete new roof on the back half of 115N. Walnut.

Motion carried to authorize an inter-fund transfer in the amount of $14,220.00between the Water Bond Reserve and the General Fund for a five year periodat 2% annual interest.

Motion carried to go into executive session at 9:45 p.m. for 15 minutes for thepurpose of discussing non-elected personnel and invited Mac Manning andShane Marler. The governing body came out of executive session at 10:00 pm.

Poor Mac’s Almanac

This is a monthly column in the “City Newsletter” by Mac D.Manning, City Administrator/Clerk for the City of Peabody. The purpose ofthis column is to give the straight facts about the street talk and gossipconcerning things that are happening in the City.

I want to open up a business in my home. Just what kind of businesscan I have? What are the restrictions?

What you are referring to is a “Home Occupation”. Examples of permittedhome occupations include, but are not necessarily limited to, the following:bookkeeping, accounting, architecture, engineering, legal counsel, medical,financial, counseling, artist, photography, instruction in the arts, crafts,tutoring, child or adult care of 4 or less persons, secretarial services, beauty orbarber shop, telephone answering, drafting, and millinery.

Uses specifically prohibited include, but are not necessarily limited to, thefollowing: auto and truck repair; auto sales; vehicle painting; storage ofconstruction materials or equipment; retail and wholesale sales; eating ordrinking establishments.

The Planning Commission has developed a new classification under theconditional use category entitled “incubator facility.” The purpose of theincubator facility is to promote and provide a limited startup location forretail businesses, repair shops or light manufacturing. There shall be a timelimit of four (4) years of the operation of the Incubator Facility at a permittedsite. An annual permit of $50.00 is required.
