Dear Ms. Honaker:

This letter is an effort to respond to the fourteen different findings associated with the Utility Inspection Report of the Public Service Commission, with the report dated 3/2/2012, arid it is my request that you consider those responses that are addressed to you by Mayor Jeff Proffitt, and Shawn Martin of Martin Contracting, incorporated herein as well.

I will address the findings in numerical order.

1. Tompkinsville Natural Gas System could not provide an updated working

copy of an operation and maintenance plan.

RESPONSE: The natural gas system now has an operation and maintenance plan,

and a copy will be forwarded to you via hard copy likely via Fed Ex.

2. Tompkinsville Natural Gas System had no records to indicate that any

portion of their public awareness plan had been followed.

RESPONSE: The public awareness statements are now believed to be compliant

and up to date.

Attached hereto, please find two newspaper clippings, one being from September

13, 2012 edition of Tompkinsville News, and the second being from the

Tompkinsville News as well, on the 15th day of November, 2012.

3. Tompkinsville Natural Gas System had no records to indicate that any

cathodic protection survey tests had been taken.

RESPONSE: Both rectifiers have been tested and are now properly working, all

four legs of the City system are properly working, and, all steel is protected.

Additionally, the City is planning to replace steel risers currently in existence that

require maintenance with protected anodeless steel risers as a daily course of

business.

4. Tompkinsville Natural Gas System had no records to indicate that patrolling

of known areas of concern of the pipeline system had been checked. It is

known by this investigator that a least one such condition exists a t the creek

crossing a t the Tompkinsville Housing Authority.

RESPONSE: Eddie Bennett and Jessie Emberton were tested as of 11/20/12, and

are awaiting results, letter attached. The entire business system has now been

patrolled and the problem area at the creek crossing at the Tompkinsville Housing

Authority has been patrolled and is evidenced by documentation which can be

provided. The entire area should be documented within three months.

5. Tompkinsville Natural Gas System had no records to indicate that a leak

survey of their business district had been performed in 201 1.

RESPONSE: Of course it is impossible to make records for 201 1 that are not

false. The records are up to date for 2012, an email of said documents will be

forwarded and we now have two employees that sought the training to do the leak

survey and to so document, letter mentioned and attached. Said employees are

Eddie Bennett and Jessie Emberton. To date, 148 leaks have been repaired, and

documentation of such can be forwarded from Martin Contracting via email upon

request.

6. Tompkinsville Natural Gas System had no records to indicate that their

“critical” or “key” valves had been inspected as required.

RESPONSE: Existing records are attached; however, it continues to be a work in

progress. -

7. Tompkinsville Natural Gas System Gas System did not have an operating

recording gauge on their multiple regulator fed district system.

RESPONSE: The recording gauge for the multiple regulator fed district system is

on order, and has yet to become available to the City of Tompkinsville; however,

the City of Tompkinsville represents that the equipment has in fact been ordered

and will be installed within one week of its arrival.

8. Tompkinsville Natural Gas System did not have a DIMP plan.

RESPONSE: The DIMP plan is now in place, copy forwarded via hard mail.

9. Tompkinsville Natural Gas System Gas System had not filed DOT form

PHMSA F 7100-1 for 2011.

RESPONSE: A drug and alcohol policy are in place and will be forwarded along

with the other documents mentioned herein. Premier Integrity does all drug and

alcohol tests; copies of gas employees tests as given are attached. The drug and

alcohol testing program is random for all employees, and, on occasion, it may be

some period of time before the gas employees are selected. If PSC recommends,

the City of Tompkinsville will change its policy to cause the gas employees to be

drug and alcohol tested more often than being placed in the pool with the other

employees for random selection.

10. Tompkinsville Natural Gas System did not install excess flow valves on 7 new

services that were added of Highway 1366 in 2011.

RESPONSE: The City of Tompkinsville acknowledges its deficiency and,

unfortunately, to date the excess flow valves have not been installed; however,

they have been back ordered for approximately six weeks and should be installed

before Christmas, immediately upon their delivery.

11. Tompkinsville Natural Gas System Gas System did not have an operator

qualification plan.

RESPONSE: 0 0 plan is now in place, copy forwarded with other documents.

12. Tompkinsville Natural Gas System had no workers who had current

operator qualification training.

RESPONSE: Two persons, Eddie Bennett and Jessie Emberton, were trained as of

1 1/20/12, documentation attached.

13. Tompkinsville Natural Gas System Gas System did not follow the

manufacturer’s guidelines for calibration of the odorator to be performed

every 12 months. Their’s was due for test a t the end of August 2011.

RESPONSE: The City of Tompkinsville currently has borrowed the odorator of

the Public Services Commission. The City’s odorator was repaired and calibrated

recently and immediately malfunctioned again and has been repaired and

calibrated again. See Heath Consultants’ invoice dated 10/23/12, attached. While

the calibration certificate cannot be located by City employee, Harold Frazier. the

invoice showing that it was calibrated is attached, and, contractor, Shawn Martin,

of Martin Contracting, field tested the machine along with another of his

employees on 11/28/12, to ascertain that it would be working and properly

calibrated and he affirms that

14. Tompkinsville Natural Gas System Gas System had odor reading tests that

were void due to the operator qualification training had expired for all their

employees.

RESPONSE: Eddie Bennett and Jessie Emberton should have qualified and have

tested the entire system UD to date, documentation attached.

Further, this letter offers certain other information not directly requested in the

fourteen bullet points addressed above.

A clerk within the City’s administration, Crystal McPherson, has volunteered to

be the records clerk, for the purposes of the maintenance of the appropriate reports and

the forwarding of the same to the appropriate authorities.

Shawn Martin, of Martin Contracting, has agreed to assist with his services and

contacts to allow her to become properly trained to so function.

The City of Tompkinsville has expressed its willingness to improve their practices

and inventory control and maintenance such that substandard materials will not be used

to maintain the system, such that the proper tools shall be purchased, maintained and used

for the proper maintenance of the system and the City of Tompkinsville has further

decided not to use bolt on T’s in the future.

The two employees mentioned herein, Eddie Bennett and Jessie Emberton,

attended the 0 Q training, and as mentioned above, Crystal McPherson will be the future

records custodian.

The City, in a special meeting on 11/20/12, recognized the need to find and hire a

new gas system/maintenance supervisor. The required salary was discussed with

consultant/contractor Shawn Martin, and the City, with the elimination of other jobs in

the gas system for those people that are not qualified and not willing to become qualified,

to provide the necessary available funds with which to hire an appropriate person.

In summary, the City has made remarkable progress in the ten weeks that these

issues have been addressed. Gas purchased in September and October, being 4,648

decatherms and 2,9 13 decatherms respectively, declined almost one third in a colder

month, due to the repair of the leaks and to the improvement of other issues with the City

of Tompkinsville gas system.

All in all, remarkable progress for the City of Tompkinsville has been made.

An astounding amount of work remains to be completed, but the City has the

mindset that it must and will be done.

The six documents mentioned below in the enclosures section are forwarded with

the request that they be returned to the City of Tompkinsville, perhaps at the informal

meeting scheduled on 12/07/12.
