Summary of Occupational Safety & Health(Notification of
Accident, Dangerous Occurrence, Occupational Poisoning and
Occupational Disease) Regulations 20041. Compliance with these
regulations shall be deem to have complied with the provisions
of:bulletsections 31 and 32 of the Factories and Machinery Act
1967bullet regulation 13 of the Petroleum (Safety Measures)
(Transportation of Petroleum by Pipelines) Regulations 1985;
andbullet regulation 23 of the Occupational Safety and Health
(Control of Industrial Major Accident Hazards) Regulations 1996 2.
The employer must notify the nearest DOSH office immediately, and
send a report on the approved form within seven days whenever any
accident arising in connection with work that caused:bulletdeath to
any person; orbullet serious bodily injury as specified in the
First Schedule, which prevents the person from performing his
normal work for more than four calendar days; orbullet where a
dangerous occurrence as specified in the Second Schedule has taken
placed3. The employer must notify the nearest DOSH office on the
approved form within seven days, whenever any work accidents has
caused bodily injury which prevents the person from performing his
normal work for more than four calendar days4. The employer must
inform the Director General of DOSH in writing should an employee
who has been involved in an accident described in (2) above, dies
within one year of the date of the accident5. Where a person
suffers from or likely suffer from occupational poisonings or
occupational diseases specified in column 1 of the Third Schedule
and the work as specified, the employer shall send a report to the
nearest DOSH office on the approved form within seven days 6. A
registered medical practitioner or medical officer attending to the
patient who he believes is suffering from occupational poisonings
or occupational diseases specified in column 1 of the Third
Schedule shall report the matter to the nearest DOSH office on the
approved form within seven days, and notify the employer7. Where an
accident or dangerous occurrence causing death, serious bodily
injury or serious damage to property, no person unless authorized
by DOSH shall remove, interfere or disturb the scene of the
incident, except to the extent of saving lives, prevent further
injury, maintain access to the site or prevent further damage or
serious loss of property or environment8. All employers shall
record and maintain a register, in an approved form, all accidents
and dangerous occurrence which have occurred, and all occupational
poisoning and occupational disease which have or or are likely to
occur9. Every entry in the records shall be kept for at least 5
years10. The employer shall send an extract for for the last 12
months from the records every year to the DG before 31st January of
the following year11. The DG may served notice for further
information after the initial notification made by the employer12.
Maximum Penalty for non compliance is RM10,000 or 12 months
