BACKGROUND

• 15th FC in it’s report has recommended grant for Urban Local Bodies for the FY 2020-2021

• Grants divided in two categories: (i) Tied Grants and (ii) Untied Grants.

• Ministry of Finance has issued operational guidelines for implementation of 15th FC recommendations

• Ministry of Housing and Urban Affairs (MoHUA) has been mandated to develop city-wise and year-wise targets service level indicators for 2020-25 and recommend disbursal of tied grants.

• Accordingly, MoHUA has prepared a marking scheme for tied grants and shared with States.

15TH FC RECOMMENDATIONS FOR URBAN LOCAL BODIES

Mandatory Conditions for grant:

• 2020-21: No conditions

• 2021-2022 and onwards:

ULBs to notify floor rates for Property Tax and thereafter show consistent improvement in collection in tandem with (SFC) suitably modified to accommodate the Cantonment Boards (59 in 17 States). In the growth rate of State's own Gross State Domestic Product (GSDP)

Timely submission of audited accounts

Basis for distribution of grant:

a) Million-Plus Cities/Urban Agglomerations (UAs): City-wise distribution of grants for 2020-21 is on population basis. The city wise and sector wise quantum of funds is specified by the Commission.

b) Non Million-Plus cities: Grant to be disbursed on the basis of accepted recommendations of the latest State Finance Commission case of non-availability of SFC recommendation for distribution within a particular category, the allocations will be on the basis of population and area in the ratio of 90:10. Allotment to Cantonment Boards within States should be on Population Basis.

SECTOR WISE ALLOCATION OF FUNDS WITHIN THE ULBS

Non- Million Plus Cities:

Rs. 20,021 cr. allocated to other than Million plus cities, consists of two equal parts - 50 per cent basic grants and 50 per cent grants tied to (a) Drinking water (including rainwater harvesting and recycling) (b) Solid waste management each.

These ULBs shall earmark one half of the tied grants each to above mentioned two critical services

and this amount will be in addition to the funds received from relevant CSS.

If any Urban local Body has fully saturated the needs of one category, it can utilise the funds for

the other category.

Grants for ULBs (other than Million-Plus category) shall be released in two equal instalments in

June 2020 and October 2020.

Distribution of Grant to ULBs by State:

The States shall transfer grants to the local bodies within ten working days of receiptfrom the Union Government.

Any delay beyond ten working days will require the State Governments to release the same with interest as per the effective rate of interest on market borrowings/State Development Loans (SDLs) for the previous year.

CONDITIONS FOR CLAIMING TIED GRANTS No conditions is stipulated by 15th FC for disbursement of tied & untied grant for million

plus & other than million plus cities for FY 2020-21.

As per 15th FC, Mandatory conditions for claiming any grant from FY 2021-22 and onwards are as under:

• States will have to appropriately notify floor rates for Property Tax ( Notification to be uploaded on city finance portal)

• Audited accounts published for all ULBs on ULB website for the year before the preceding year w.r.t the award year (for 2021-22: ULBs have to submit audited accounts for year 2019-2020)

Other Conditions:

• Grants for 2021-22 will be released on submission of Baseline data, targets, other information like Water, sanitation and Solid waste management

• Grants for the year of 2022-23 and onwards shall be released on achievement of the targets set for Service level indicators for previous year.

• ULBs will intimate baseline indicators and yearly targets by 31st December 2020 against Water Supply and Solid Waste Management

City will implement this/ these project/s by the year 2023-24 for being eligible for tied grants for the year 2024-25 and onwards. In case the city does not have any water body, it will select one community based Rain Water Harvesting project.

In order to qualify for 2nd installment of tied grant for 2021-22, ULBs shall be required to:

1. Prepare a waste water management plan. City will share waste water management plan to claim the second instalment of tied grant for the year 2021-22.

2. For being eligible for second instalment of tied grant for the year 2021-22, by August, 2021 ULBs has to:

Select at least one project for recycling/ reuse of water

Select at least one project for rejuvenation of water bodies by August, 2021. In case the city does not have any water body, it will select one community based Rain Water Harvesting project.

AWARDING OF MARKS

• Allocation of tied grants vis-à-vis score obtained for non-million plus ULBs:

• Total undistributed tied grants due to insufficient score will be distributed by the State among the ULBs with more than 60 marks (main land States)/ 50 marks (North East and Hill States) in proportion to the share of their grants.

• In case some of the cities are not able to score minimum marks, State shall constitute a “Remedial Action Committee” under the chairmanship of Principal Secretary/ Secretary (UD) to evaluate the reasons for lower achievements and to chalk out the plan for improvement.

15TH FC GRANT AUTOMATION MODULE ON CITYFINANCE

• Module aims to Integrate and streamline the activities of ULBs, State UDD, and MoHUA with respect to grant management
