History of Fuel Cycle in Romania

Uranium mining activity was definitive stopped since the second half of the 90s at Avram Iancu, Ciudanovita and Natra mines. In present, decommissioning activity of these mining facilities and environment remediation works are in progress.

Also, in Romania there are approximately 50 sites where in the past were performed mining activities for the geological researches of uranium ores. These need closing (decommissioning) and remediation works from radiation protection point of view. The amplitude of remediation work will be distinct for each site, depending on local conditions.

Current regulatory framework for Fuel Cycle Facilities - Purpose

The purpose of Romanian nuclear legislation in uranium mining and milling field is:

To ensure that the mine or mill workers, the public and the environment are adequately protected against radiological hazards while the mine or mill is in operation;

To provide protection before the opening of the mine (during the period of exploration) and after the closure of the mine or mill;

To ensure that waste rock (from the operation of the mine) and mill tailings are treated as radioactive waste.

Current regulatory framework for Fuel Cycle facilities

Fundamental provisions of Nuclear Law

At the present time, all the nuclear practices in Romania, including design, possession, sitting, construction-assembly, commissioning operation, conservation and decommissioning of the mining and milling facilities for uranium and thorium ores and of the waste resulted from the mining and milling are regulated by Nuclear Law 111/1996, republished, and require an authorization issued by the Romanian regulatory body (National Commission for Nuclear Activities Control - CNCAN) in compliance with the authorization procedure typical of each kind of activity.

The Romanian regulatory body (National Commission for Nuclear Activities Control) is empowered to issue regulations for the detailed specification of the general requirements for nuclear safety, for protection from against ionizing radiation, as well as any other regulations necessary for the authorization and control activity in the nuclear field. 7

The provisions of the present law shall apply to the following

activities and sources: art.2): design, possession, sitting, construction-assembly,

commissioning operation, conservation and decommissioning of the mining and milling facilities for uranium and thorium ores and of the waste management facilities of the waste resulted from the mining and milling thorium ores.

The activities and sources stipulated under Article 2 require an

authorization issued by the Commission in compliance with the authorization procedure typical of each kind of activity or source, and with the provisions of Art. 5

Based on the provisions of Law 111/1996, CNCAN issued a group of Radiological Safety Norms for Uranium and Thorium mining and milling, as it follows:

Legal responsibility for decommissioning

Three state enterprises have legal responsibility with respect of remediation of uranium production legacy sites in Romania:

The Uranium National Company S.A. is responsible for administrating and processing the uranium resources existing in Romania, including uranium mining exploitation, uranium ore processing and uranium concentrates conversion to UO2

By the Government΄s Decision No. 729/2004 the geological activities for uranium are transferred to a new company named “Radioactiv Mineral Magurele S.A.”

Annex no. 3 at Government΄s Decision No. 729/2004 contains the list of all sites where the Uranium National Company carried out geological research for uranium 13

Assurance of decommissioning funds (1)

By the Government΄s Decision No. 313/2002 modified and added up by

Government΄s Decision No. 173/2003 and Government΄s Decision No. 1158/2004 was set up a new trading company named “CONVERSMIN S.A.” with the main activity object:

a) the conservation of mines and processing facilities from shut-

down until starting subscription of the decommissioning contract;

b) Closing of underground mines and ecological remediation;

c) operating, maintenance and remediation of the facilities resulted by the break-up of decommissioning activity, in order to preserve the designed environmental parameters;

d) Post-closure monitoring of closed mining facilities.

Assurance of decommissioning funds (2)

Financial funds of the trading company “CONVERSMIN S.A.” are constituted by:

1. The amounts allocated from state budget by the budget of Economy and Finances Ministry to carry out the works included in National Annual Program for conservation, decommissioning, ecological reconstruction and post-closing surveillance of mining and processing facilities (including uranium facilities).

1. Own capital realized by contracting and executing works financed

by the programs and financial projects based on the agreements between Romania and international institutions.

The conservation and decommissioning of each mining and processing facilities, including uranium production sites, are approved by Government΄s Decision. Also, the mentioned Government΄s Decisions contain the amounts approved for the elaboration of the technical decommissioning documentation and, separately, for conservation, decommissioning and remediation works, for each mining and processing facility, including uranium production sites.
