 A Performance Based Statement of Work should be written when the Government can

furnish only guidance and objectives pertaining to the goals of the product needed to

accomplish the task.

 The Competition in Contracting Act of 1984 (CICA), at 10 U.S.C. 2304, requires the Federal

Government to obtain full and open competition

CICA avoids being restrictive to a sole-source allowing the bidder to dictate

terms and costs The government is not tied to a Contractor

and unable to continue if the Contractor is no longer available

A sole source lessens the contractor’s need to be innovative in supplying the latest

and best

CICA can restrict competition, only if the acquisition is supported by a Justification and Approval (J&A) in accordance with

FAR, Part 6

All follow-on efforts must be treated as another contract therefore ; it must meet the

requirements outlined in FAR Part 6, or be supported by an approved J&A
