Role of the Acquisition Team


The role of the Acquisition Team is to exercise initiative and sound business

judgments to get the best value to meet the Government’s needs


FAR 1.102-4 states that the Acquisition Team is empowered to make decisions

within their areas of responsibility, including selection, negotiation, and

administration of contracts


If a policy, procedure, strategy or practice,

is in the best interest of the Government

and is not specifically addressed in the FAR,

nor prohibited by law, Executive Order or regulations, do not assume it is prohibited


Title VIII of the Federal Acquisition Streamlining Act of 1994 (P. L. 103-355) establishes

acquisition policies resembling the commercial marketplace


Performance Based MethodPerformance Based Method

A Performance Based Statement of Work should be written when the Government can

furnish only guidance and objectives pertaining to the goals of the product needed to

accomplish the task.


Government only states needs and acceptable deliverables

Contractor is solely responsible for success of the contract

Allows the Contractor to use their resources to perform the task


Contractor uses their method to complete the task.

Contractor will be measured on their ability to achieve the needs and

deliverables.

Needs deal specifically with the terms of how the deliverables perform


Contractor must meet the minimum standards that are acceptable.

Where there are accredited industry standards, such as written by NPMA

in conjunction with ASTM, the accredited industry standards

should be referenced by the government.


Design Method

It will contain a Specification or Requirements Section detailing the specific tasks the

Contractor will perform during the contract period

The Statement of Work could include, but not be

limited to, tasks such as design, build, test, and training


It may require the Contractor to perform system engineering, configuration management,

planning, and analysis, etc.

Use established marketing techniques as defined in FAR10.001 to achieve maximum results


1.6 Competition in Contracting Act of 1984 (CICA)

The Competition in Contracting Act of 1984 (CICA), at 10 U.S.C. 2304, requires the Federal

Government to obtain full and open competition


CICA avoids being restrictive to a sole-source allowing the bidder to dictate

terms and costs The government is not tied to a Contractor

and unable to continue if the Contractor is no longer available

A sole source lessens the contractor’s need to be innovative in supplying the latest

and best


CICA can restrict competition, only if the acquisition is supported by a Justification and Approval (J&A) in accordance with

FAR, Part 6

All follow-on efforts must be treated as another contract therefore ; it must meet the

requirements outlined in FAR Part 6, or be supported by an approved J&A

.


FAR Subpart 4.8 requires that each contract be

documented to constitute a complete history of the transaction.

Authorized documents must be on file for any decision when full and open competition is not

sought
