• EESF assumed all meetings were attended by a NEII representative and full informational reports were provided

• It is evident that full information has not been provided to NEII

• This report is informational, touching on key issues

Safe‐T Rider in need of Upgrading

• It has never been the EESF Board’s position that the program is not dated

• It has always been an issue of funding to upgrade the program

• In 2012, EESF searched and engaged WEDU to make these improvements and establish an upgrade budget

• In 2013, an EESF Task Group was formed to plan the upgrade of the program

Delivering Safe‐T Rider Program in 2013/2014

• EESF Bylaws require funds to be spent for specific purposes

• NEII suggested we stop delivery of program

• This could not be done due to Bylaws

• A new campaign has been set up for program upgrade funding in addition to usual program funding.

Fundraising was a Priority

• EESF developed a Business Plan to create new channels of fundraising

• This plan is being implemented today and has already generated new funding

• This was prioritized to have funding for • Succession planning 

• Program delivery improvements

• EESF knew internally that a Succession plan was imminent and necessary 

• We requested funding assistance from NEII for the new hire

• We funded administrative hire with program funds and reserve funds, at the expense of program delivery ratio

Expand Audience for Messaging

• WEDU Proposal expands outlets for larger audience

• EESF is developing PSAs for Transit

• EESF was excited to be part of the NEII Stadium and Arena project but never saw any proposals from NEII

• EESF created the Colleges and Universities Program

• EESF can and does expand our audience, building on prior successes

Box 838 Salem, New York 12865-0838 July 10, 2014 Re: NEII® Roster Web Based Application Dear Mr. Donoghue, I have completed reviewing the details concerning the proposed NEII Roster Web Based Application for 2015. Our budget estimate for this project is Twenty-Nine Thousand Nine Hundred Dollars ($29,900.00). We propose to provide all necessary labor, tools and technology to accomplish the following:

Rewrite the current NEII Roster Access Database to a ColdFusion html web based application. Create all existing tables, forms, reports, search functions and convert existing data to new application. HELPCo will assist users on proper formatting for dot matrix labels and envelope printing.

COMMUNICATIONS Where the acronym NEII® is first used in printed or electronic communications (letters, emails, agendas, minutes, newsletters, press releases, etc.) it shall be italic followed by ®. Thereafter, the acronym can either be italic followed by ® or just italic. NEII® MEMBERS USE OF NEII® LOGO

• NEII® Regular members are permitted to use the NEII® logo subject to the following: o Written notification of where the NEII® logo will be used shall be submitted to

the NEII® Managing Director in writing; and o Use of the NEII® logo shall be in accordance with the policy stated above.

• NEII® Individual members are not permitted to use the NEII® logo.

THIRD PARTY USE OF NEII® LOGO Use of the NEII® logo by third parties is permitted in accordance with the requirements stated in this policy. Written notification outlining use is requested. If a violation of the trademark policy is found in any third-party use, the Managing Director shall initiate appropriate action upon discovery of the trademark violation. If the unauthorized use is not discontinued after notification of the violation, the matter will be referred to the NEII® Legal Advisory Group. APPROVALS: The NEII® Legal Advisory Group is responsible for maintaining this policy. This policy shall be in effect for three (3) years from the date of approval by the NEII® Board of Directors. NATIONAL ELEVATOR INDUSTRY, INC. FIELD EMPLOYEE SAFETY POLICY

Mission To analyze safety issues within the elevator industry, to develop resources and guidance to promote an accident free environment for field employees and to assist employers to comply with government safety standards and regulations. Objective To develop guidance documents for NEII® members and the elevator industry that address compliance, accident prevention and loss mitigation. The goal is to encourage safe work practices and injury prevention in the industry. Plan of Action 1. Study and recommend to the Board of Directors industry safe work practices, amending them as appropriate in light of changing conditions or other factors. 2. Study legislation and regulations that affect work practices in the industry and make recommendations to the NEII® Government Affairs Committee on safety issues. 3. Analyze safety issues and arrange for an exchange of information within NEII® on these issues, solutions, and recommended activity in this area. This includes:

• consulting with members on safety matters; • discuss safety concerns and share safety programs; • arranging conferences, seminars, or speakers to discuss safety matters, and • review and recommend changes in the NEIEP Safety Module.

4. Monitor developments in OSHA, corresponding state agencies and other safety-standard and enforcement organizations; monitor developments in other areas such as loss prevention, worker safety and health, and related areas. 5. Develop and maintain liaisons with governmental bodies, insurance companies and other safety-oriented organizations and testify before such organizations on safety matters as needed. 6. Maintain and update the Elevator Industry Field Employees’ Safety Handbook.

7. Develop position papers to establish and promote positions of NEII® with respect to safety matters of concern to the elevator industry. Organization Other organizations interested in field employee safety are encouraged to become liaison members of the NEII® Field Employee Safety Committee. No NEII® organizational changes are required. Motivation To implement this policy, it is essential that members of the NEII® Field Employee Safety Committee take an active role in their assignments, keep abreast of developments in this field and communicate effectively with NEII® and liaison members. Control The NEII® Field Employee Safety Committee shall implement this policy and shall report periodically to the Board of Directors. The NEII® Code and Safety Consultant Director may be used in the implementation of this policy. APPROVED: The NEII® Field Employee Safety Committee is responsible for maintaining this policy. In his role at Otis, Chris is responsible for leading and directing the legal function, providing counsel to senior Otis Americas leadership and a uniform and structured platform for all Otis Americas legal processes. Chris brings 14 years of legal experience to this role including 12 with Otis' parent corporation, United Technologies Corporation. • Provide a bridge between the model code/standard development exercised by the NEII Central Code Committee (CCC) and NEII Code & Safety Director and the adoption/application of those codes/standards by Authorities Having Jurisdiction (AHJs) supported by the efforts of the NEII Government Affairs Committee (GAC) and NEII Government Affairs Director, applying technical code expertise to local regulations that adopt the model codes.

• Promote the harmonization of model code requirements for building transportation equipment by tracking code developments in the ASME, ICC, A117, NFPA, ASHRAE, ASCE, etc. committees/venues, developing proposed changes and revisions for consideration by the CCC and submission to the respective code writers.

• Communicate NEII®’s purpose, goals and objectives by coordinating efforts with the NEII

Communications Committee, writing for NEII Now, the Insider and other NEII

publications on code-related matters and providing interviews with the media as warranted.

• Ensure that NEII members receive current and accurate information regarding codes and standards adopted and/or modified by local AHJs through maintenance of the NEII

CodeFinder database. CORPORATE CHALLENGE: NEII focuses its code efforts on the development and maintenance of model codes and standards that can be adopted by local jurisdictions. Its principal focus is on the ASME A17 elevator codes and standards and on those ICC and NFPA codes and standards that directly affect building transportation (e.g., building, fire, fire alarm, accessibility codes/standards). Second-tier codes and standards developed by ASTM, ASCE, ASHRAE and other consensus bodies are also monitored. NEII’s code efforts have traditionally focused on developing a product that can be adopted by local entities. employee safety and sound engineering practices and technologies within the industry. It does so by cooperating with governmental and regulatory bodies and taking other action to further the interests of the industry in relation to laws and regulations affecting the installation, repair, service and operation of elevators, escalators and related building transportation equipment. Government affairs focuses on the application of the code product at a local level. With the addition of a Government Affairs Director, NEII has enjoyed an exponential growth in in its ability to affect the application of model codes in states, provinces and localities. The challenge is that, except in those few jurisdictions that adopt the codes without amendment, adoptions involve modifications to technical code requirements that require technical expertise to understand and/or challenge, an expertise not always available to NEII’s GAC lobbyists in the field. Even where technical expertise can be provided by local company representatives attending meetings or hearings, the quality of the information provided and its consistency with NEII positions and policies cannot be assured. A single NEII resource that can facilitate the correct application of the model code products in state, provincial and local legislation and regulations provides an essential link between the CCC and GAC and their respective goals and work. Regulatory Accomplishments

Previously submitted elevator code conformance documentation (CCD) to various AJH’s across Canada prior to installation of new or modernization projects to obtain regulatory approval for the scope of work.

Worked on the receiving end and evaluated CCD’s on behalf of Ontario’s elevating device regulator, TSSA. Issued permits or rejections as appropriate.

Worked cooperatively with original elevator equipment manufacturers (OEM’s) on non-compliant or deficient CCD’s to clarify compliance requirements that aligned with regulatory requirements.

Made proactive visits to various elevator equipment manufacturers, by invitation, to evaluate new products or innovations in advance of site-specific installations. Address concerns to avoid unforeseen issues and streamline acceptance process into the jurisdiction.

Manage inspector expectations with respect to new technologies and testing methods. Follow scripted requirements of either A17.1 or A17.2 to ensure alignment of adopted methods to avoid jurisdictional inspection flavours.

As TSSA engineering manager, provide safety guidance to the statutory director. Draft adoption of new codes, performance based codes and permit alternative technologies with minimal provincial amendments.

Played a major role in drafting and obtaining consensus of the A17.1 alternative testing language for no load Category 5 tests as recently reflected in the 2013 code.

Draft and finalize on behalf of the Statuary Director numerous Director’s Orders, Safety Order’s, Interpretations, Enforcement Procedures and CAD’s in a consultative manner with industry and other safety partners following adopted protocols.

Lead, organize, prepare, delegate, train, and instruct; industry, staff, engineers, inspectors, contractors and consultants on upcoming code adoptions via “what’s new” learning sessions, for several code adoptions (A17.1/B44-2000 code through 2010). Relate enforcement implications to industry and TSSA staff.
