It is submitted that the above mentoned case (illegal dispossession) came up for hearing before Hon’ble Mr.Justice Mian Saqib Nisar and Hon’ble Mr.Justice Ejaz Afzal Khan on 13.11.2014 and the Hon’ble Court was pleased to pass the following order:- “In order to resolve the inconsistency in the dicta mentioned above and for the purpose of creating parity and comity in law, we are of the view that matter must be heard and resolved by a Larger Bench of this Court, not less than five members, if already not constituted on the subject.And thus the file be placed before the Hon’ble Chief Justice of Pakistan for appropriate order”. 21. Accordingly on 24.11.2014 the matter was placed before the Hon’ble Chief Justice of Pakistan for constitution of a Larger Bench upon which the Hon’ble Chief Justice of Pakistan was pleased to constitute a Larger Bench comprising of the following Hon’ble Judges of this Court with further direction that the matter be fixed in court after consulting HJ(3):- MR.JUSTICE MIAN SAQIB NISAR MR.JSUTICE AMIR HANI MUSLIM MR.JSUTICE EJAZ AFZAL KHAN MR.JSUTICE IQBAL HAMEEDUR REHMAN MR.JSUTICE MUSHIR ALAM 22. It is further respectfully pointed out that after obtaining the order from the Hon’ble Mr. Justice Mian Saqib Nisar of the above mentioned matter was to be fixed on 3 rd March,2015 at 1.00 O’clock and notice was also issued to the parties. 23. Now, as per Court programme for the week commencing 2 nd March,2015 out of five two Hon’ble Judges of the above Bench are not available at main registry, therefore, the matter cannot be fixed on 3 rd March,2015. 24.
