Solicitation Number 19GE5020Q0053
The American Consulate General Frankfurt hereby provides the following Combined Synopsis
and Solicitation for:
Supply and delivery of IT Investigative Equipment for the Police Inspectorate of Kosovo,
on behalf of the Bureau of International Narcotics and Law Enforcement Affairs (INL)
Office at the U.S. Embassy Pristina, Kosovo.
Synopsis:
This is a combined synopsis/solicitation for commercial items prepared in accordance with the
format in FAR Subpart 12.6, as supplemented with additional information included in this notice.
This announcement constitutes the only solicitation; offers are being requested and a written
solicitation will not be issued. The solicitation number is 19GE5020Q0053 and is issued as a
Request for Quotation (RFQ), unless otherwise indicated herein. The solicitation document and
incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC
2020-07, effective August 31, 2020.
Contract Type: The Government intends to award a single, firm fixed-price contract to the responsible offeror
whose offer is evaluated as the lowest-priced and technically acceptable. The total price shall
include all labor, equipment, delivery charges, materials, overhead, profit, insurance, and all
other expenses necessary to deliver the required equipment. No additional sums will be payable
on account of any escalations in the cost of materials, equipment, or labor, or because of the
Contractor’s failure to properly estimate or accurately predict the cost or difficulty of achieving
the results required by this contract. Nor will the contract price be adjusted on account of
fluctuations in currency exchange rates.
Term of Contract:
The ensuing contract shall be effective from the date of the Contracting Officer’s signature and
shall remain valid until all items/services have been received/accepted and until the warranty
period expires. The delivery time is within 30 days from the date of award.

Project Specifications:
Background
INL Kosovo has assisted Kosovo Police, hereinafter “KP”, since this institution was established,
either directly or through our implementing partner International Criminal Investigative Training
Assistance Program (ICITAP), to ensure a responsible, democratic and transparent Kosovo police
service in accordance with the legislation in force and required standards.
Purpose
Kosovo Police investigators, while performing their duties, have police authorities and are required
to exercise them in accordance with the Constitution, the Criminal Code, the Criminal Procedure
Code, the Juvenile Justice Code, and the Law on Police of the Republic of Kosovo. This equipment
will be donated to the KP Investigation Department and will be used by the Directorate for Support
of Investigations.
This equipment will be used during in field by Observation and Technical Support for the
implementation of covert investigative measures, during these operations these teams collect
evidence (video, audio and photo) which should be processed and handed over to investigators for
court presentation. Since these evidence materials have larger space Technical Support needs
storage devices that would allow saving these materials for a longer period of time.
The intent of this document is to provide minimum requirements identified by INL Pristina and
the Government of Kosovo (GoK) for this project. The document is not intended to provide details
that would limit the vendor’s proposal to a specific technology or a particular provider.
All work shall be the sole responsibility of the vendor unless explicitly identified as an element
being provided by the United States Government (USG) or the GOK. For all deliverables, the
following must be included: shipping, delivery, service, labor under the warranty. This applies
to any components, services, or labor of third–party companies. The vendor shall be fully
authorized/certified to supply, upgrade, install, configure, provide warranty service, and
troubleshoot/support the proposed solutions/equipment.
Objective
The objective of this project is to provide additional investigative and surveillance equipment to
the KP to increase its capacity for prevention, detection, documentation and investigation of the
criminal offences.
Warranty: All items must have a minimum of a one-year warranty provided by the vendor.
Delivery Point: The equipment shall be delivered to: U.S. Embassy, 4 Korriku Nr. 25 Arberia,
Pristina, Kosovo 10000.
Compliance with Specifications:
Offerors shall also provide with their offer, at a minimum, existing product literature
substantiating the acceptability of their offered products in accordance with this solicitation’s

specifications provided. Failure to provide this information will result in a ‘non- responsive’
offer and removal from award consideration.
Descriptive Literature Required:
Definition: (a) "Descriptive literature" means information (e.g., cuts, illustrations, drawings and
original manufacturers' brochures) that is submitted as part of an offer. Descriptive literature is
required to establish, for the purpose of evaluation and award, details of the product offered that
are specified elsewhere in the solicitation and pertain to significant elements such as (1) design;
(2) materials; (3) components; (4) performance characteristics; and (5) methods of manufacture,
assembly, construction, or operation. The term includes only information required to determine
the technical acceptability of the offered product. It does not include other information such as
that used in determining the responsibility of a prospective contractor or for operating or
maintaining equipment. (b) Descriptive literature must be (1) identified to show the item(s) of
the offer to which it applies and (2) received by the time specified in this solicitation for receipt
of offers. (c) Data displaying more than one model or size shall be clearly marked so as to
indicate the specific item being offered. (d) Offers which do not present sufficient information to
permit complete technical evaluation by the Government may be rejected. It is the bidder’s
responsibility to prove that their proposed solution meets or exceeds the requested specifications,
subject to any limitations elsewhere in this solicitation.
Other Specific Requirements:
All manuals and literature shall be in the English language.
All proposed equipment MUST be fully operative and functional.

The whistleblower protection of 41 U.S.C 4712 has been removed from paragraph (r) of FAR
clause 52.212-4. The following revised paragraph applies:

Federal contracts; 18 U.S.C. 431 relating to officials not to benefit; 40 U.S.C. chapter 37,

52.204-25 Prohibition on Contracting for Certain Telecommunications and Video
Surveillance Services or Equipment (Aug 2020)
(a) Definitions. As used in this clause—
Backhaul means intermediate links between the core network, or backbone network, and
the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core
telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic,
coaxial cable, Ethernet).
Covered foreign country means The People’s Republic of China.
Covered telecommunications equipment or services means–
(1) Telecommunications equipment produced by Huawei Technologies Company or
ZTE Corporation (or any subsidiary or affiliate of such entities);
(2) For the purpose of public safety, security of Government facilities, physical security
surveillance of critical infrastructure, and other national security purposes, video surveillance
and telecommunications equipment produced by Hytera Communications Corporation,
Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any
subsidiary or affiliate of such entities);
(3) Telecommunications or video surveillance services provided by such entities or
using such equipment; or
(4) Telecommunications or video surveillance equipment or services produced or
provided by an entity that the Secretary of Defense, in consultation with the Director of National
Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an

entity owned or controlled by, or otherwise connected to, the government of a covered foreign
country.
Critical technology means–
(1) Defense articles or defense services included on the United States Munitions List set
forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22,
Code of Federal Regulations;
(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part
774 of the Export Administration Regulations under subchapter C of chapter VII of title 15,
Code of Federal Regulations, and controlled-
(i) Pursuant to multilateral regimes, including for reasons relating to national
security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile
technology; or
(ii) For reasons relating to regional stability or surreptitious listening;
(3) Specially designed and prepared nuclear equipment, parts and components,
materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations
(relating to assistance to foreign atomic energy activities);
(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of
Federal Regulations (relating to export and import of nuclear equipment and material);
(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations,
part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or
(6) Emerging and foundational technologies controlled pursuant to section 1758 of the
Export Control Reform Act of 2018 (50 U.S.C. 4817).
Interconnection arrangements means arrangements governing the physical connection of
two or more networks to allow the use of another's network to hand off traffic where it is
ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of
telephone company B) or sharing data and other information resources.
Reasonable inquiry means an inquiry designed to uncover any information in the entity's
possession about the identity of the producer or provider of covered telecommunications
equipment or services used by the entity that excludes the need to include an internal or third-
party audit.
Roaming means cellular communications services (e.g., voice, video, data) received from a
visited network when unable to connect to the facilities of the home network either because
signal coverage is too weak or because traffic is too high.
Substantial or essential component means any component necessary for the proper
function or performance of a piece of equipment, system, or service.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal
Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13,
2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any
equipment, system, or service that uses covered telecommunications equipment or services as a
substantial or essential component of any system, or as critical technology as part of any system.
The Contractor is prohibited from providing to the Government any equipment, system, or
service that uses covered telecommunications equipment or services as a substantial or essential
component of any system, or as critical technology as part of any system, unless an exception at
paragraph (c) of this clause applies or the covered telecommunication equipment or services are
covered by a waiver described in FAR 4.2104.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for
Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August
13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that

uses any equipment, system, or service that uses covered telecommunications equipment or
services as a substantial or essential component of any system, or as critical technology as part of
any system, unless an exception at paragraph (c) of this clause applies or the covered
telecommunication equipment or services are covered by a waiver described in FAR 4.2104.
This prohibition applies to the use of covered telecommunications equipment or services,
regardless of whether that use is in performance of work under a Federal contract.
(c) Exceptions. This clause does not prohibit contractors from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming,
or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or
permit visibility into any user data or packets that such equipment transmits or otherwise
handles.
(d) Reporting requirement.
(1) In the event the Contractor identifies covered telecommunications equipment or services
used as a substantial or essential component of any system, or as critical technology as part of
any system, during contract performance, or the Contractor is notified of such by a subcontractor
at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2)
of this clause to the Contracting Officer, unless elsewhere in this contract are established
procedures for reporting the information; in the case of the Department of Defense, the
Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts,
the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the
Contracting Officer(s) for any affected order or, in the case of the Department of Defense,
identify both the indefinite delivery contract and any affected orders in the report provided
at https://dibnet.dod.mil.
(2) The Contractor shall report the following information pursuant to paragraph (d)(1)
of this clause
(i) Within one business day from the date of such identification or notification: the
contract number; the order number(s), if applicable; supplier name; supplier unique entity
identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known);
brand; model number (original equipment manufacturer number, manufacturer part number, or
wholesaler number); item description; and any readily available information about mitigation
actions undertaken or recommended.
(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of
this clause: any further available information about mitigation actions undertaken or
recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or
submission of covered telecommunications equipment or services, and any additional efforts that
will be incorporated to prevent future use or submission of covered telecommunications
equipment or services.
(e) Subcontracts. The Contractor shall insert the substance of this clause, including this
paragraph (e) and excluding paragraph (b)(2), in all subcontracts and other contractual
instruments, including subcontracts for the acquisition of commercial items.

FAR 52.212-2 Evaluation – Commercial Items (Oct 2014)
BASIS OF AWARD
The Government intends to award a contract resulting from this solicitation to the responsible
offeror (as determined within the meaning of FAR Part 9, paragraph 9.104), whose offer
conforms to the solicitation and is determined to be the lowest priced, technically acceptable
offer, including all options. Evaluation will be based on offeror’s submission in Volumes I and II
and the provision at FAR 52.212-2, as provided in this solicitation.
(a) The following factors shall be used to evaluate offerors:
1. Price;
2. Technical acceptability
Technical capability is equal to price.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the
successful offeror within the time for acceptance specified in the offer, shall result in a binding
contract without further action by either party. Before the offer’s specified expiration time, the
Government may accept an offer (or part of an offer), whether or not there are negotiations after
its receipt, unless a written notice of withdrawal is received before award.

Offers submitted in response to this solicitation shall be in the English language. Offers received
in other than English shall be rejected.

FAR 52.225-17 Evaluation of Foreign Currency Offers (Feb 2000)
If the Government receives offers in more than one currency, the Government will evaluate
offers by converting the foreign currency to United States currency using http://ice.cgfs.state.sbu/
in effect as follows:
(1) On the date specified for receipt of offers, if award is based on initial offers;
otherwise
(2) On the date specified for receipt of proposal revisions.

Pursuant to FAR 12.302(d), the provision at FAR 52.212-1, Instruction to Offerors –
Commercial Items (Jun 2020) is augmented as follows: Preparation of Offers - Offerors
shall prepare and submit its offer in two (2) volumes as set forth below.
1) Preparation of Offers - Offerors shall submit a Quotation with enough detail to specify
compliance with the project specifications.

Surveillance Services or Equipment (Aug 2020)
Please note: The offeror must submit a completed copy of this provision with the
offer.
VOLUME II – TECHNICAL CAPABILITY
The proposed equipment shall meet all of the required technical specifications and the delivery
terms contained herein. In addition, the offeror shall provide:
(A) A delivery confirmation providing for delivery within 30 calendar days of award to final
destination.
(B) Warranty provisions as described under Warranty in this solicitation document.
The Contractor agrees that the equipment furnished under this contract shall be covered by the
most favorable manufacturer’s commercial warranty the Contractor gives to any customer for
such equipment and that the rights and remedies provided herein are in addition to and do not
limit any rights afforded to the Government by any other clause of this contract.
The Contractor shall provide a copy in English of the applicable manufacturer’s commercial
warranty with each equipment covered by such a warranty at no additional cost to the
Government. Warranty terms: 12 months.
