The monthly & New Year meeting of TANSEA PWD, Trichy Branch was conducted in the Meeting hall of “HOTEL AJANTHA”, Trichy on 29.12.2013 Sunday at 10.00am with Tamil Thai Valthu.

Seventy Six members along with family attended the meeting.

The meeting was presided over by Er. M.P.Durairaj President of this branch.

Er.P.Vembadi Secretary welcomed the gatherings and the Chief Guest

The Chief Guest Mr. N.Kanagasabapathi delivered lecture on How to lead a Happy Life. He discussed more than one and half hours. In his speech he informed that a man can achieve only if he dreams about the future. He also explained his ambition in the young age to become a great industrialist, as per his vision he become a great industrialist and Managing Director for R.K.Metals Kajamalai & Thiruverumbur having more than 20 crores out turn. Due to this he become very popular person in Trichy. He also running R K Trust to help to poor Industrial people. & Students from Engineering Colleges & Polytechnics

The monthly meeting of 'TANSEA', Kanyakumari Branch, for the month of January 2014, was held as a 'New Year Family Get-together' with a dinner, in 'Hotel Akshaya', Nagercoil on 01.01.2014 at 6.00 P.M.

The family gathering was very warmly welcomed by Er. L.Selson Muthaiah, Former Superintending Engineer. Seventeen families graced the occasion with their joyful presence.

The members of the families exchanged New Year greetings, with high spirits, to one another. There was good interation between families, with lot of live chit chat, lighter moments and fruitful conversations. Er. P.George Jepamony, former Superintending Engineer, P.W.D., enhanced the 'Happy New Year Mood' by giving feast to the ears of the gathering, by playing two beautiful 'Happy New Year Song' music with his mouth organ, which was enjoyed by all.

The new Year, 2014 Diary and Calendar were distributed to the members with all good wishes.

The dinner went on pleasantly with lot of fun and humour. It was really a very pleasant 'New Year Day Evening' and a very nice experience.

The get together meeting of PWD Senior Engineers was held at Poriyaalar Illam. Thanjavur with the objective of forming the Thanjavur Branch of the Tamil Nadu PWD Senior Engineers Association on 09.11.2013 at 10.30 A.M.

Er.K.Natarajan, State Vice President of TNPWD Senior Engineers Association presided over the meeting. Er.R.V.S.Vijayakurmar, another State Vice President and Er.A.Veerappan, State Secretary of TANSEA have attended the meeting, detailed the achievements of the Association to the members and explained how the members can serve the society with their rich experiences. They also impressed upon the members on the need of forming a Branch at Thanjavur.

Minutes of New Year Get together Meeting on 29-012-13

The first monthly meeting of Thanjavur Branch of TANSEA was held at 10.30 A.M. on 29.12.2013 at Poriyaalar Illam, Thanjavur.

Dr. R. Paranthaman, President of the Branch presided over the meeting, which was attended by a large number of members.

Er. R. Murali, Secretary of the Branch welcomed the gathering. Dr. R. Paranthaman, President spoke about the achievements of the Parent Association, especially in respect of presenting the problems of Mullai Periyar Dam and Cauvery Water Disputes. They also explained the benefits enjoyed by the members from the Association.

There was a detailed discussion among members about the problems confronting the Delta irrigation. The problems from the Sea Water Aquaculture farms were discussed and the Engineers M.S. Md. Ishaque, V. Veerabalan, P.R. Meenakshi Sundaram, M. Paramasivam, M. Jayaraman and R. Annamalai gave their considered views on the issue.

The problem of Coal Methane Gas exploration was also discussed. Er. R. Shanmuga Sundaram and Er. A. Mayuranathan spoke on the issue.

New Year Calendars and Diaries of TANSEA were distributed among the members.

The meeting concluded by 1.00 P.M. with the vote of thanks by Er. R. Murali, Secretary. The meeting was hosted by Er. R. Annamalai.

As programmed earlier, the periodical meeting cum picnic of TANSEA / Erode branch

was held at Aasanur in the Sathiyamangalam – Mysore Route on 30.11.2013 &

1.12.2013 (Saturday and Sunday)

Members, Family Members and Guests in all about 35 numbers were gathered at

Aasanur on 30.11.2013 evening in the Farm-House of Er.M.Ayyamuthu,

Co-ordination Secretary and Er.M.Ayyamuthu has given a warm welcome to each

and every members arrived and he hosted an excellent Tea-Snacks and Dinner. Also

he had arranged rooms in a nearly Resorts for he stay on 30.11.2013 & 1.12.2013

for all the members.

The next day (on 1.12.2013) Morning by 6’O clock, we had a 20 km ride in the

Forest Area and the members have enjoyed very much and then have our Break-

Fast hosted by Er.M.Ayyamuthu in his Farm House. Then we had a visit to Tibetian

camp situated Karnataka State which is about 35 km from Aasanur. The Members

have enjoyed by visiting the “Buddha Temple” and the Tibetian villages. After

visiting to Tibetian Camp, we returned back to Aasanur and had an excellent lunch

also hosted by Er.M.Ayyamuthu is his Farm-House.

After the lunch we had the meeting of the TANSEA / Erode branch.

Er.R.Subramnanian, Secretary welcomed the gathrering and the meeting was

presided over by Er.M. Ramasamy, President, Er.M.Ayyamuthu explained to the

members about the subjects discussed in the Executive Committee meeting of

TANSEA, held at Chennai on 16.11.2013 and explained about the future Tours

proposed by our Association. Member discussed about improving the Financial

Position of the Branch and the meeting came to an with the vote of Thanks by

Er.V.Palanisamy, Vice President.

All the members thanked Er.M.Ayyamuthu for the excellent arrangements made for

the meeting and picnic and for hosting delicious Dinner, Breakfast and Lunch in his

Farm House and the members returned back with joyful memories.

The New Year family Get-together 2014 of TANSEA / Erode Branch Members was held at the "Poriyaalar Illam, Erode" on 28.12.2013 (Saturday) at 10.30 AM.

Er. M.Ayyamuthu welcomed the gathering of Members and Family Members and introduced the Special invitee Thiru.Manikandan of "BIRTHDAY BONKERS, SALEM" who conducted a Three Hour Fun & Game Show.

In all, about Sixty Participants including Ladies and Children took part in the Function. Then Thiru. Manikandan of "BIRTHDAY BONKERS" conducted a very interesting FUN AND GAME SHOW for about 3 Hours. All the members, Ladies, Boys and Girls took part

Also Er. M.Durairaju, Former Superintending Engineer and Er. R.Balasubramanian, Former Assistant Executive Engineer were enrolled as new members of TANSEA / Erode Branch and with this, the strength of members of Erode Branch has now come to FIFTY(50).

Minutes of the Executive Committee Meeting of TANSEA held on 16.11.2013 at Chennai

The Executive Committee Meeting of TANSEA was held on 16.11.2013 at 10.30 A.M. in TANSEA Guest House at D-14A, Madura Garden, Maduravaayil, Chennai-95. Er.K. Ramalingam, President, TANSEA Presided over the Meeting. One minute Silence was observed to condole the death of Er.N.Senthurapandian Former SE, Madurai, Er.M.Palaniappan Former CE, Chennai..

Er.K.Ramalingam in his introductory remarks mentioned about the history of construction of bridges across River Mahanathi by the Emperor Asokar. He has informed more literatures are available in the Madras University Library and he is collecting more in formation regarding Engineering skill.

1) Kaveri water- Hand Book & Short film DVD-Impact & Pamphlet on sedusamudram Project.

The Secretary informed that the people those who read the kaveri water Hand book have written appreciation letters to Er.A.Veerappan for his sincere effort Er.A.Mohanakrishnan enquired about Sedusamudram project pamphlet

The secretary also informed that an amount of Rs.118000 was collected as contribution which was more than expected. An amount of excess contribution of Rs. 40000/- in available. The Secretary appreciated the Trichy branch for arranging the function in an excellent manner and made the function a grand success.

2) South Karnataka – North Kerala Tour experience

The Secretary informed that 18 Rivers flowing west are discharging their excess water in the sea in Kerala the tour which was undertaken to south Karnataka and north Kerala was most enjoyable & good. He has further in informed that a tour to Varanasi has been arranged at the cost of Rs.30,000/- per head. There about 48 persons have registered their names for the above tour which in to be undertaken during March 2014. Similarly it has been proposed to arrange tour to Japan, Malaysia & Singapore for 15 days at a cost of Rs.1.75 lakhs per head.

3) Printing of Senior Engineers Dairy & Calendar

The Secretary informed that orders for Printing of Senior Engineers Calendar 2014 has been placed in Sivakasi and the Senior Engineers Diary 2014 in Chennai. And both the Diary & Calendar will be printed in time and released.

4) Co-option of Joint Secretaries in Place of Er.O.Veerabaghu and Er.T. Kolanchinathan.

The Secretary in formed the one Post of Joint Secretary fallen vacanct due to the death of Er.O.Veerabaghu and another post of Joint Secretary in to the filled up as the present incumbent Er.T.Kolanchinathan who is in abroad. He has suggested co-option Er.M.Ayyamuthu former AEE, Gobi as Joint Secretary in the place of Er.O.Veerabaghu and Er.M.Moorthy former CE, Chennai as Joint Secretary in the place of Er.T.Kolanchinathan. The Committee congratulated the new Joint Secretaries Er.M.Ayyamuthu & Er.M.Moorthy.

5) Opening of TANSEA branch in Thanjavur on 9.11.2013

Accordingly Er.A.Veerappan Secretary/TANSEA took initiative in consultation with the Trichy Branch & Er.R.Paranthaman Former CE, for the information of New Branch at Thanjavur on 9.11.2013 The meeting was attended by Er.A.Veerappan Secretary & Er.K.Natarajan Vice President / TANSEA. Er.S.Jayaraman EC Member / TANSEA and also the office bearers of Trichy Branch. The Office bearers were elected in the above meeting Er.R.Paranthaman former CE, was elected as President of the Branch. It was informed that New year get together meeting was arranged on 28.12.2013 in Institution of Engineers, Chennai and requested all the member of participate. The Calendar & Diary will be released in that function. He has also informed that Guest Lecture on “Dementia” by Dr.S. Anand Kumar MD (DSY), Athma Research Institute, Thillai Nagar, Trichy – 620 018 has been arranged in the above function for the use of our engineers.

One rank and One Pension

- Parity in Pension for those retired befoe 01.01.2006

At Present there is a difference in person drawn by the pensioners retired before 01.01.2006 & after 01.01.2006.

However various High Courts and Supreme Court rules that there cannot be any discrimination between these categories of Govt. staff and hence there should be parity in pension between them as there is one rank and one pension.

Accordingly Govt. of India issued Specific orders (F.No.38/37 /08-P&PWCA) GOI dated 28th January 2013 – page 10 & MP – March –April 2013) to that effect, granting equal pension for these 2 categories of retired Govt. employees w.e.f. 24.09.2012. However, even though appealed, Go TN is yet to issue such an order granting equal pension in pusunace of GOI orders. Various pensioners Associations (including TANSEA) are pursing Thins matter with GOTN.

Let us hope that GOTN will soon issue such an order

– TANSEA.

The New Year gettogether function of TANSEA, was held on 28.12.2013 saturday at 10.30 AM in the Institution of Engineers Tamilnadu State Centre Chennai-5. Since Er.K.Ramalingam president was not doing well, Er.K.Natarajan, Vice-President / TANSEA presided over the function.

Er.E.A.Veerappan, Secretary / TANSEA informed the gathering about the demise of Dr.S.Panchanathan and two minutes silence was observed to condole his death. The Secretary remembered the good qualities of Dr.S.Panchanathan, Er.A.Veerappan informed when he was Spl.CE, Groundwater in 2001-02 named the PWD complex at Thanjavur after Dr.S.Panchanathan, thereby showing highest regard and respects to the best services by Dr.S.Panchanathan.

Er.A.Veerappan welcomed the gathering especially Er.C.Appavoo Chief Electrical Inspector to Govt. Dr.S.Muthukumaran, Former VC, Bharathidasan University, office beares of AOE & AEA, TNPWD, Dr. Anand Kumar the guest speaker.

Er.A.Veerappan expresed that the year 2014 would be best year feet all sections of the society.He conveyed his best wishes to the new cabinet headed by Aam Aadmi Party in New Delhi.

He also mentioned about the formation of new branch at Thanjavur, activities undertaken by the TANSEA in Mullaiperiyaru issue and Cauvery water issue, National water policy, Sethu Canal Project, conducting seminar, publishing pamphlets hand books and CD and Tele discussion. In this connection Er.A.Veerappan thanked Er.Kargil Subramanian for his partnership activities with TANSEA.

He also mentioned about the Tours organised and the future Tour programmes to Shridi during Feb 2014, 5 days Tour to Kasi during March and 12 days Tour programme to Singapore, Malaysia & Japan during May 2014 and he requested the Senior engineers to enroll themselves for the above tour programmes well in advance.

He informed that Er.M.Ayyamuthu, Secy–Coordination/TANSEA/Erode Branch & Er. M.Moorthy former CE, PWD have been co-opted for the vacant post of Jt Secretaries in TANSEA.

The lecture was very much useful and everybody keenly observed the above lecture. In appreciation of Dr.S.Anandakumar Er.N.Selvaraj Treasurer TANSEA Presented a Memento to Dr. S.Anandkumar.

150 YEARS HISTORY OF THE PWD

CHAPTER NO - 17 : WRCP AND IAMWARM WORKS (contd....)

Financing implications were discussed with Secretaries Finance, State Planning Commission, PWD and the Chief Secretary. At present, Tamil Nadu’s Eighth Plan had a modest entry for this against NWMP (presently 64 crore rupees). As an illustration, if 1 million hectares were to come under sage I at NWMP’s 1993 terms upper limit per hectare of 4000 rupees (US$ 140 per hectare), a sum of 400 crore (US $ 140 million) would be needed. It says, 0.5 million hectares also came under Stage II, at an assumed average per hectare incremental investment of Rs.5000 per hectare, a further Rs.250 crore (US$ 88 million) would be needed. It was agreed that Plan allocations could be adjusted to accommodate the program, and that this would be discussed with GOI. It was also commonly appreciated by GOTN and the Mission that the feasible extent of farmer contributions to the investment would be an important alleviating factor to the Government funds required.

I. Maintenance and Funding of O&M

Effective maintenance, technically well executed and fully funded to the required level to ensure that irrigation/bulk water supply infrastructure does not deteriorate is indispensable. Otherwise the huge investment in assets will deteriorate and irrigated area decline (negative investment). Maintenance should be regarded as a prior charge for irrigation sector expenditure, before financing modernization or expansion. Like other states, Tamil Nadu has not lived up to this critical need, a fact well recognized by GOTN. Part of the reason has been the serious financial crunch and the low water -charge payments by farmers (averaging Rs.37/ha for paddy). Compounding this, PWD execution and monitoring of maintenance could be improved, and in some commands, infrastructure is so dilapidated that routine maintenance expenditure may be wasted until proper upgrading has been achieved. Nevertheless, it is imperative that a solution be found. GOTN advised the mission that this is well recognized and that full maintenance should be an achieved objective under the WRCP.

In its Status Report for the WRCP, PWD had reviewed and commented on the undesirable state of scheme maintenance in Tamil Nadu. The Ninth Finance Commission had recommended average “maintenance norm” of Rs.180/ ha for maintenance plus Rs.65 for regular establishment charges and Rs.36 for special repairs (RS.281 in all). It has recommended a 5% annual increase to these norms to account for inflation, though the actual increase for materials and labor in Tamil Nadu has been 51% (compared with 17% over the three years 1989/90 to 1992 base on the Finance Commission’s recommended annual increase). Correspondingly, such “norms” would be Rs.210/ha (maintenance only) going by the Finance Commission, and

Rs.272/ha accounting for actual inflation in Tamil Nadu. The CE Irrigation, PWD has commended an average maintenance allocation of Rs.250/ha for 1993/94.

Actual maintenance allocations in Tamil Nadu were Rs.103/ha and Rs.58/ha respectively for major and medium/minor irrigation in 1989/90. Financial allocations have improved since the averaging Rs.134 and 79 respectively in 1991/92. Further, for 1992/93 the mission was advised that the maintenance (including staff allocation) allocation was about Rs.120/ha. The Finance Secretary advised the mission that the Finance Commission norms were being aimed for, though the fiscal crisis made this difficult. He envisaged progression to this over the next two years. In the wind-up meeting, Secretary PWD committed to a maintenance allocation of Rs.200/ha for 1993/94 and of Rs.250/ha for 1994/95. Secretary PWD also advised that it was GOTN policy not to increase staff numbers. The Mission fully supports this policy. Finally, Secretary PWD instructed the PWD staff to prepare for the projects Command modernization and O&M components a massive training program to gear staff to the technical and farmer outreach need of these thrust areas. Preparation of this program would form part of the O&M Study. In parallel, there is a need to tighten field planning, budgeting and monitoring of maintenance expenditures and actions, to ensure that the extra funding is used well.

WATER CHARGES : In several meetings, the Mission commented that water charges were extremely low relative to O&M funding needs. Water charges range by crop, season and other factors, but appear to be generally less than Rs.40/ha, and rates have not been changed since 1962 (Collection rate are reported to the mission to be about 75 to 85%). The water charge however, are less than 20% of O&M financing needs. GOTN advised that increasing water charges was seen as clearly desirable but was politically sensitive. However, the Mission advise that water charges represent the equivalent of less than 10 kg of paddy or less than 0.3% of typical irrigated paddy crop yield. Alternatively, water charges as a cost item for the farms compare with expenditures by irrigated farmers on fertilizer of Rs.2000 to 3000 or more per hectare, or less than 2% of the farmers fertilizer expenditure. If farmers paid the full O&M cost it would-still only amount to about 10% of the fertilizer expenditure and less than 2% of his growth crop revenues. Social welfare and affordability constraints appear, thus to be fully surmountable, perceived political feasibility being perhaps the key difficulty for GOTN.

The mission recommends further reflection by GOTN on how to find revenues to finance O&M, a matter that the mission will also reflect on. The mission advises that a move on cost recovery now will immeasurably increase the Bank’s receptivity to Tamil Nadu’s Proposal for a WRCP. In the interim, additional to the most important need which is to increase the levels of water charges, the following preliminary suggestions for consideration are offered, pending further illumination under the O&M Study.

(i) Discuss and consider the recommendations in the “Report of the Committee on Pricing of Water “(Vaidyanathan Committee, September, 1992) (this is currently under review by GOTN).

The undersigned directed to draw attention to the requirement of applying for family pension in Form 14 as given in rule 81 (2)(A) (ii) of the CCS (Pension) Rules 1972.

This Department has been receiving representations from various quarters to do away with the condition of applying for family pension in Form 14 as it is causing inconvenience to windows, who find it difficult and embarrassing to present themselves before two Gazetted Officers/persons of repute for attestation of Form 14.

Before commencement of family pension, personal identification details of the spouse such as specimen signature, personal mark of identification and left hand thumb impression, proof of age/date of birth of spouse and an undertaking from him/her for recovery of excess payment are to be obtained by the bank. Form 14 serves as a standard processing sheet, which defined and delineates the exact requirement of information to be given to the pension disbursing Bank. It was apprehended that in the absence of this standard, the windows may be asked to submit any relevant information by the bank. This could also lead to delay in commencement of the family pension.

4. The matter has been examined and it has been agreed that in case the pensioner and spouse are holding a joint account, the possibility of claim for family pension from someone else does not arise. Therefore, in such cases, there is no requirement of Form 14. The spouse may inform the Bank for commencement of family pension, through a simple letter. He/she may enclose a copy of death certificate of pensioner, PPO, proof of his/her own age/date of birth and un undertaking for recovery of excess payment. In other cases, i.e., where the pension is not being credited to the joint bank account of the pensioner and his/her spouse, Form 14 will be continued to be obtained by the banks. However, the condition of attestation of Form 14 has been done away with and witnessing by two persons has been considered as sufficient.

5. For all future cases, Head of Office will forward to the PAO, along with similar details for the pensioner, the specimen signature, personal mark of identification, left hand thumb impression, the proof of age/date of birth and an undertaking from the spouse regarding recovery of excess payment. After the death of the pensioner, the spouse of the deceased pensioner will be required to provide only death certificate to the paying bank, who will identify the spouse based on the information given in the PPO and its own “Know your Customer” procedures. Where the pensioner and his/her spouse do not have a joint account, Form 14 will be required as in para 4 above.

‘Pension cannot be denied without authority by law’

BREAKTHROUGH: SC says no employee can be deprived of this right even if criminal proceedings are pending against him.

NEW DELHI: Treating a citizen’s right to receive pension and gratuity as right to property, the Supreme Court has rules that no government employee can be deprived of this right even if departmental or criminal proceedings are pending against him.

A bench of justice K.S.Radhakrishnan and Justice A.K.Sikri further held that gratuity and pension were an employee’s hard earned benefits and not bounties. “This right to property cannot be taken away without the due process of law as per the provisions of Article 300A of the Constitution of India”, the bench said, faulting the Jharkhand government’s decision to withhold dues of its retired employee facing corruption case.

“An employee earns these benefits by dint of his long, faithful and unblemished service. It is thus hard earned benefit which accrues to an employee and is in the nature of property”, it held.

SC decided Jharkhand’s act to deny pension and gratuity to its retired employee Jitendra Kumar Srivastava on the basis of an executive order. Noting that there were no provisions in the Pension Rules permitting the government to withhold retirement benefits, the bench was of the view that the 1998 executive order denying pension to Srivastava affected his fundamental rights.

“A person cannot be deprived of this pension without the authority of law, which is the Constitutional mandate enshrined in Article 300A of the Constitution. It follows that attempt of the appellant to take away a part of pension or gratuity or even leave encashment without any statutory provision and under the umbrage of administrative instruction cannot be countenanced,” the top court held.

SC dismissed Jharkhand’s appeal against state High court order directing it to release the withheld dues to Srivastava. HC had on October 31,2007 held that the Bihar Pension Rules didn’t empower the government to withhold gratuity, pension and leave encashment at any stage either prior to or after conclusion of departmental proceedings.

HC gave its order on Srivastava’s petition who had retired from the post of Artificial insemination Officer, Ranchi in 2002, seeking release of part of his pension and other dues. Srivastava had jointed the Animal Husbandry and Fisheries in Bihar government in 1966. In 1966 two cases were registered against him for alleged financial irregularities while he was posted as Artificial insemination Officer, Ranchi. After the formation of the state of Jharkhand he became an employee of Jharkhand and two years later faced a department inquiry. Eight months later Srivastava retired from service.

ORDER:- In the Government Order first read above, the Government have constituted a fund called Tamil Nadu Government Pensioners Health Fund with effect from 1.7.1995 to provide financial assistance to pensioners for undergoing specialized treatment / surgery when they are affected by major ailments and the maximum limit entitled for the pensioner is Rs.1.00 lakh or 75% of the actual cost of the treatment whichever is less. Subsequently, the above concession was extended to the spouse of the Pensioner with effect from 17.2.2009.

2. In the Budget Speech 2013-2014, the Hon’ble Minister for Finance has announced in the floor of the House to launch a separate Health Insurance Scheme in line with the Government Servants Insurance Scheme to reduce the burden of the health related expenses of the pensioners.

3. The Government after careful examination has decided to launch the New Health Insurance Scheme for the Pensioners (including spouse) / Family Pensioners. Accordingly, the Government direct that New Health Insurance Scheme for the Pensioners (including spouse) / Family pensioners shall be formulated on the following basis:-

i) the New Health Insurance Scheme shall operate on a CASHLESS basis and it shall be made compulsory to all the Pensioners (including spouse) / Family Pensioners.

ii) the quantum of assistance shall be fixed as Rs.2.00 lakh for both Pensioners (including spouse) and Family Pensioners for a block period of four years from the date of the launch of the scheme.

iii) if the spouse of the pensioners is also a pensioner, the recovery of subscription shall be effected from one person only, based on the option exercised by them.

iv) the New Health Insurance Scheme shall be implemented by the Insurance provider finalized from among the Public Sector Insurance provider by following due tender procedure.

v) the New Health Insurance Scheme shall be implemented through the Commissioner of Treasuries and Accounts as is being done in the case of New Health Insurance Scheme for the Government Employees.

vi) the amount of Pensioners contribution to the scheme will be decided after the selection of the Insurance Company and finalization of the costs.

4.Further modalities / terms and conditions for the New Health Insurance Scheme for the Pensioners (including spouse) / Family pensioners will be issued separately.
