DEAR MEMBERS :

I’m pleased to announce that in February the FCBA ExecutiveCommittee approved the last step in the year-long IT upgrade– electronic voting. Our research into electronic votingrevealed that the process is not only reliable, secure, and lessexpensive than paper ballots, but has also been demonstratedto significantly increase participation in elections. It will beinteresting to see if this proves true for this year’s election,which features the excellent slate of candidates announced onpage 21 of this newsletter, thanks to the efficient work of theNominations Committee, chaired by Jennifer Warren. Instructions on the newvoting system will be sent out when the elections take place, which will be in thenormal timeframe later this spring. It seems fitting that the FCBA will cut over toelectronic voting in this Presidential election year – hopefully we will provide apositive example of the virtues of electronic voting to the electorate at large!

Implementation of this new enhancement will complete the FCBA’s IT upgrademeasures, which have been time-consuming to implement for the staff, but havealready been saving time and resources on an ongoing basis. You can help the FCBAtake advantage of the resource savings if you – and your assistant – register onlinefor our events, instead of faxing in your registrations the “old-fashioned” way.

This year’s National Telecommunications Moot Court Competition on February 1-2attracted 11 teams from all over the country. The students found the problem thisyear especially timely as it focused on the scope of CALEA’s requirements as appliedto telecom carriers – an issue that sounded all too familiar to the judges! My thanksto the Moot Court Competition Co-Chairs, Michael Cogan, Paul Werner andespecially Russ Hanser, who took the lead in developing the problem, as well as tothe many FCBA members who served as judges, and to The Catholic University ofAmerica, Columbus School of Law, for hosting the event.

The next FCBA-wide breakfast on March 25th will feature a tour of the newly-constructed Newseum that is just being completed on Pennsylvania Ave. This willbe a great chance to get a sneak preview of this amazing new museum, and apersonal tour of its news exhibits. The FCBA calendar in March will also offer apacked schedule of CLEs and brown bags, including a half-day CLE on Privacy andData Security for Communications and Media companies presented by the Privacyand Data Security Committee on March 6th and a CLE on State Implementation ofMerger Conditions presented by the State and Local Practice Committee March11th. Keep an eye out for the announcement of the date for the CongressionalReception, and it’s not too early to think about registering for the Annual Seminar inCambridge, Maryland, May 2-4th, which is described in detail in this newsletter.

alternative views of the political andcommunications future. A completeschedule of the Annual Seminaractivities and events will appear in nextmonth’s FCBA newsletter. In themeantime, here is a preview of what theAnnual Seminar Committee is workingon.

Technology and the Election Process: Isthe technology of the early 21st centurychanging the nature of the politicalprocess the way that the first televisedpresidential debates did in the mid 20thcentury? Are blogs, texting and socialnetworking forever altering the businessof elections? The FCBA has invitedrepresentatives of campaigns, past andpresent, to opine on how technology ischanging modern elections.

Conversation with FCCCommissioners: The FCBA has invitedthe FCC Commissioners to participatein this very popular panel. You willhave an opportunity to hear theCommissioners discuss their views onthe evolving communicationslandscape, with a particular emphasison what lies ahead in the run up to theelection.

Bureau and Office Chiefs: In what hasbecome an Annual Seminar tradition,the FCBA has invited the Chiefs of thevarious FCC Bureaus and Offices todiscuss recent developments relating totheir organizations.

Senior Legal Advisors, Hill Staff, andIndustry Observers: The FCBA hasinvited the Commissioner’s Senior LegalAdvisors and Capitol Hill staff and a fewindustry observers to offer their view ofthe future, with a chance to predict theimpact of the election on thecommunications and media industriesand the transitions ahead.

No Annual Seminar is complete withoutthe host of activities, both organizedand informal, available to Seminarattendees and their family and guests.

To take advantage of being at Maryland’sEastern Shore, two special Saturdayafternoon activities have been plannedfor your enjoyment.

Kayaking in the Blackwater WildlifePreserve – Saturday afternoon from1:00-5:00 p.m. kayak in the BlackwaterWildlife Preserve with experiencedguides and naturalists who will helpeven the novice kayaker make the 1.5mile trip through the preserve whilepointing out the abundant wildlife onthe trip. The registration fee includesall equipment needed. This activity isnot recommended for children under 10years old unless they ride in a tandemkayak with a parent or other adult.Kayakers are responsible for their owntransportation to and from the put-inpoint, only a few miles from the resort.Be sure to include the Kayaking Outingwhen you register.

Cruise the Choptank River aboard theEmpress Royale with Captains Kelleyand Jerry Cox. Departing from the pierat the resort, the 50 foot EmpressRoyale will take up to 40 people on a 2hour narrated tour of the ChoptankRiver. Both Kelley and Jerry arebiologists and naturalists and willdiscuss the eco system of theChesapeake Bay, point out the manywater foul found on the river, discussthe history of the area, and answer yourquestions along the way. Don’t forgetyour camera! Register to cruise theChoptank on the registration form.

“The visitor will come away with abetter understanding of news and theimportant role it plays in all of ourlives,” said Newseum ExecutiveDirector and Senior Vice President JoeUrschel. “The new Newseum will be

The 2008 National Telecommunications Moot Courtcompetition sponsored by the FCBA and Catholic Universitytook place on February 1 and 2, 2008. This year’scompetition involved the appeal of a mock FCC orderapplying the Communications Assistance for LawEnforcement Act (“CALEA”) to SMS “text messaging”services. The competition featured 11 teams, representing lawschools from California, Colorado, Indiana, New York, andWisconsin, as well as D.C. law schools George Mason,Georgetown, and Catholic.

A highlight of this year’s competition was the stellar final-round three-judge panel consisting of former FCC legaladvisor and current Wilkinson Barker Knauer, LLP, partnerRuss Hanser; recent FCBA President Jennifer Warren, SeniorDirector of Regulatory Affairs at Lockheed MartinCorporation; and current FCBA President Diane Cornell, VicePresident of Government Affairs at Inmarsat Inc.

The winner of this year’s competition was SouthwesternUniversity (Celia Beckwith, Andy Owen, and Lee Previent).Second place went to Catholic University of America (TylerVan Voorhees and Patrick Halley). Andy Owen ofSouthwestern University won the award for Best OralAdvocate and Best Brief honors went to the team fromGeorgetown University (Anthony Biagioli and ZathrinaPerez). Enforcement PracticeCommitteeThe Enforcement Practice Committee isco-chaired by Lynn Charytan ofWilmerHale, Dennis Corbett ofLeventhal Senter & Lerman PLLC, andWilliam Davenport of the FederalCommunications Commission.

During the 2007-2008 term, theCommittee has already sponsored sever-al successful events. We started theyear off with a September 25, 2007brown bag lunch, in which we solicited(and received) ideas for future eventsfrom the members of the Committee,and talked generally about issues ofconcern or interest relating to FCCenforcement.

On October 23, 2007, the Committeesponsored a brown bag with the seniormanagement team of the FCC’sEnforcement Bureau. This sessionincluded introductions to seniorEnforcement Bureau staff, a descriptionof the responsibilities of each part of theBureau, and tips for practitioners beforeEB.

The Committee has also sponsored aFebruary 27, 2008 CLE seminar afford-ing attendees a “nuts and bolts” reviewof FCC hearings and investigations, fea-turing presentations by attorneys fromthe FCC’s Enforcement Bureau, in-house counsel from a regulated compa-ny, and attorneys from private practice.

On March 25, 2008, the Committee willco-host with the International PracticeCommittee a brown bag lunch focusingon wireless site compliance and relatedenforcement issues. The panel willfocus on enforcement-related and otherissues concerning the new back-uppower rules for cell sites, RF safety rulesfor workers and the general public,environmental rules, and siting con-cerns. Among other things, the panelwill explore differences among howthese issues are addressed in the US andother countries. Speakers will includeJeff Steinberg from the Wireless

Telecommunications Bureau; BobCurtis, Chief Scientist of RF Check andformer head of RF safety for OSHA; andChris Guttman-McCabe of CTIA.

The Committee plans to hold a springbrown bag lunch reviewing develop-ments in indecency regulation andother matters of topical interest. TheCommittee is always interested in hear-ing other ideas for topics and panelists.Please feel free to contact any of theCommittee co-chairs with suggestionsor questions.

ProfessionalResponsibilityCommitteeThe FCBA’s Professional ResponsibilityCommittee is co-chaired by Frank Jazzoof Fletcher, Heald & Hildreth, P.L.C.,Larry Walke of the National Associationof Broadcasters, and Colin Sandy of theNational Exchange Carrier Association.The Committee is not the “ethicspolice” for the FCBA. However, it canbe a useful resource for members to stayabreast of ethics regulations that have aspecial impact on communications lawpractitioners. As in the past, theCommittee expects to accomplish atleast the following activities: (1) dis-cussing with the Committee and, asappropriate, alerting the FCBA mem-bers to new developments in ethicsrules and relevant court cases that arelikely to have a general impact on FCBAmembers; (2) hosting at least one con-

tinuing legal education seminar onethics; and (3) if necessary, evaluatingand responding to ethics-related com-plaints submitted to the FCBA byclients or others involved in particularmatters.

On October 30, 2007, the ProfessionalResponsibility Committee collaboratedwith the Access to Records Committeeand the Legislative Committee in pre-senting a CLE seminar entitled“Lobbying Rules and Law at the FCCand Congress.” The seminar was taughtby a distinguished panel of expert prac-titioners and government officials. Theseminar was well attended and wellreceived.

With respect to ethics complaints, theCommittee co-chairs are happy toreport that none is currently beforethem. The Committee has no power toconduct lengthy investigations of, orsanction, members, but it will respondto complaints or inquiries by providinginformation about the relevant ethnicalobligations of the Association’s members– attempting, in appropriate circum-stances, to mediate complaints – and,where warranted, referring complainingparties to other Bar authorities.

Access to RecordsAs we have reported in previousnewsletters, the FCC has changed thebank that provides the FCC and itsclients with lockbox services from theMellon Bank in Pittsburgh,Pennsylvania to U.S. Bank in St. Louis,Missouri.

The FCC released an Order announcingthe new lockbox numbers andaddresses and updating rules referringto the lockbox bank (see Order, DA 08-122, released January 25, 2008http://hraunfoss.fcc.gov/edocs_public/attachmatch/DA-08-122A1.pdf. The FCCalso established a 45-day transitionperiod that began on February 19, 2008to mitigate the transition’s impact and toprovide time to resolve anyreconciliation and change-overdiscrepancies. This transition periodwill end on Friday, April 4, 2008.

Filings inadvertently mailed to MellonBank during the transition period willbe date-stamped and recorded asreceived by Mellon Bank, and thenforwarded to U.S. Bank in St. Louis forprocessing. After the transition period,however, any filings or wires received atMellon Bank will be returned to sender.In order to avoid delays, the FCCstrongly encourages the use of itselectronic filing and payment options.Electronic payments can be submittedthrough its secure website athttp://www.fcc.gov/fees/feefiler.html.Electronic payments allow for fasterprocessing of applications and eliminateconcerns that payments are being sentto the wrong location. New EnglandProgram a HugeSuccessOn Thursday, January 31st, the NewEngland Chapter of the FCBA delivered atwo-part program in Boston at the officeof Nixon Peabody. This event had beenrescheduled from December 13th due toa significant snowstorm in New England.In spite of the program beingrescheduled, a record attendance for thisevent was recorded with over 50 people,including individuals from our co-sponsors of the event, the MassachusettsBar Association and the Boston BarAssociation. Doug Denny-Brown, of RNK Communications, andFCBA Co-chair, moderated an expertpanel consisting of Greg Keenan of OneCommunications, Karlen Reed ofNational TelecommunicationsCooperatives Associations, RobMunnelly, outside counsel for the NewEngland Cable Television Association,Garnet Goins of Sprint Nextel, and JayGruber of AT&T, who answeredquestions, deliberated, and providedcompany policy positions on issuesincluding recent FCC forbearancedecisions, the Fairpoint Verizon deal,Universal Service reform, and more.

At the end of the two-part program,Nixon Peabody hosted a fabulousnetworking event for the attendees.The wonderful atmosphere provided agreat opportunity for attendees toconverse with the panelists, our hosts,and members.

The New England Chapter has plans foradditional programs this year. The nextplanned event is a brown bag lunchduring March (time and date TBA) withthe senior staff of the newly organizedDepartment of Telecommunications andCable. In addition, the New Englandchapter is close to finalizing plans to

collaborate with the New EnglandConference of Public UtilitiesCommissioners (NECPUC) on one ormore panel discussions at their annualsymposium in May in Vermont. Staytuned for further details.

The importance of technological changeto our economy raises a series ofimportant questions for policymakers.One important set of questions revolvearound government investment in basicresearch and the nature of thetechnological landscape. In a number oftechnology markets today, includingwireless communications, the Internet,and biotechnology, government supportfor basic research as well as basicresearch by dominant firms laid thefoundation for later innovations. Today,however, there is an increasing level ofconcern that such basic research is notadequately being supported.

A second set of questions revolvesaround whether and how start-up firmscontribute to the pace of innovation. Onone view, these firms are able to conductrisky experiments and basic researchwith the promise of being bought out bymore established firms. In other cases,upstart firms worry about the ability ofestablished firms to undermine theirsuccess once the upstarts establish thepopularity of a new product-particularlywhere the upstart must rely on theplatform of an established firm. In somecases, upstarts call for regulation, suchas the call for open access to wirelessphones, to prevent such conduct and tofoster innovation.

A final set of important questionsrelated to innovation revolves aroundthe role of intellectual propertyprotection. On one view, including thatof “neo-Schumpeterians,” strong patentrights enable firms to develop a firmposition in today’s market and providesthose firms with powerful incentives toinvest in innovations. Others, however,are concerned that today’s incumbents-or even others who strategically investin patents and not innovation per se-areable to abuse the patent system for theiradvantage.

To evaluate the appropriate role forgovernment policy in facilitatingentrepreneurship and innovation, thisconference will bring together a group

of industry leaders to examine thesequestions.

FCBA FoundationNow AcceptingApplications forFunding of UnpaidLegal Internships atGovernmentAgenciesFor the fifteenth consecutive year, theFederal Communications BarAssociation (FCBA) Foundation willaward stipends to law students from itsChairman Robert E. Lee Scholarshipand Internship Fund. In 2008, theFoundation will award at least five$5,000 stipends to law studentsemployed as unpaid summer interns inpositions with the FCC and other gov-ernment agencies or entities with a con-nection to the communications industry(i.e., broadcasting, cable television, tele-phony, satellite, wireless, and informa-tion technology).

In addition, the Foundation will selectone outstanding intern among thosechosen to receive an additional stipendof $600 for the summer—the “MaxPaglin Award.” Mr. Paglin was the for-mer General Counsel and ExecutiveDirector of the FCC, and the founder ofthe Golden Jubilee Commission onTelecommunications, which compiled adefinitive legislative history of theCommunications Act.

Applicants will be selected on the basisof: (1) a demonstrated interest in thecommunications field, (2) havingsecured or having pending, an unpaidsummer position (internship) for atleast 8 weeks in communications with agovernment agency, (3) dependence onfinancial assistance in order to acceptthe unpaid internship in a governmentagency or entity involved in communi-cations; and, (4) community activities.To the extent a recipient receives unan-ticipated funding for the unpaid intern-ship, the FCBA Foundation’s general

policy is to reduce its scholarshipawards by any amount that a recipient’stotal funding (including all sources) forthe internship would otherwise exceed$7,000.

Volunteer Outreachfor Martha’s Table –March 30 Many of us are stretched for time thesedays, but why not consider spending afew hours on a Sunday to help theFCBA Foundation’s partner charities?For several years now, the FCBA hasbeen providing volunteers to Martha’sTable and McKenna’s Wagon. Theseorganizations rely on the good work ofour members each month, so grab afriend, colleague or family member andjoin your fellow FCBA volunteers!

Martha’s Table feeds hundreds of hun-gry, homeless adults and children on thestreets of Washington daily, through itsmobile soup kitchen. Children andfriends are also welcome. We will beginat 10:00 am and work until 1:00 pm.Martha’s Table is located in a yellowbuilding at 2114 Fourteenth Street, NW,in the District, near the intersection of14th and U Streets. On-street parking isavailable. Volunteers are asked to bring

food if possible, (e.g., cold cuts, bread,peanut butter, jelly, vegetables and pota-toes) because the center often runs outof donated food.

McKenna’s WagonSeeking Volunteersfor March 23McKenna’s Wagon is a mobile soup andsandwich wagon that goes “on location”to deliver food to the needy. For thosewho have volunteered, it has been awonderful experience and a great wayto help the needy in the D.C. communi-ty. This is an especially good experiencefor the teens and pre-teens among uswho do not have a full appreciation ofthe many privileges they enjoy.Community service credits are alsoavailable.

The Wagon is a white van that is loadedup with sandwiches, snacks and soup.We meet at Martha’s Table at 4:45 pm incomfortable clothes and shoes. Martha’sTable is located in a yellow building at2114 Fourteenth Street, NW, in theDistrict, near the intersection of 14thand U Streets. On-street parking isavailable.

Upon arrival we get assignments (someof us will distribute snacks and sand-wiches, others will serve soup), and puton aprons before we depart in the van to5th and New York Ave., NW (near thenew Convention Center). We are dri-ven by one of our experienced volun-teers and the trip to distribution loca-tion takes about 10-15 minutes.

We serve about 30-75 people per visitincluding a few mothers who come forfood for their families. The area is well

takes about one hour and we usuallyreturn to Martha’s Table by or before6:30 pm.

Many thanks fromour beneficiary KidPower-DC!Kid Power-DC is a civics-based organiza-tion that provides academic, artistic, andservice-learning opportunities for youthin under-served neighborhoods in theDistrict of Columbia. Kid Power-DCempowers youth to become informedand engaged advocates for change intheir own lives and in their communi-ties. Currently, Kid Power serves nearly200 DCPS elementary and middleschool students in the District throughpartnerships with three independenthigh schools, one charter school, and anetwork of professionals and volunteers.Its major projects include:

The Citizenship Project: Using a litera-cy-building and civic engagement cur-riculum, elementary school studentsand their high school mentors investi-gate the fundamental building blocks ofcitizenship, produce visual and per-forming art works, and implementyouth-led community action projects.

CookieTime!: With the assistance of theCakeLove bakery, middle school stu-dents operate a small baking business,

use the proceeds to fund local serviceprojects, and travel outside the Districtto replicate this social entrepreneurshipmodel.

Kid Power-DC is so honored and grate-ful to benefit from this year’s auctionand to have worked with such animpressive and hard-working group ofvolunteers. After our experience withthe auction, we feel energized about KidPower-DC’s future and the strength ofour youth programs. The auction pro-ceeds will support the expansion of ourmiddle school program “CookieTime!”by helping to fund our service trip toNew Orleans in August 2008. Twentyof our middle school students will travelto New Orleans to work with a group oflocal students in order to create theirown version of “CookieTime!”, and todesign service projects that will benefitneighborhoods damaged by HurricaneKatrina.

3.08.6FCC Attorney – The FCC Enforcement Bureau,Telecommunications Consumers Division, seeksto fill several Attorney Advisor positions (at the GS11/12/13/14 grade level). TheTelecommunications Consumers Divisioninvestigates the practices of companies engaged invarious telecommunications-related activities,including common carriers; manufacturers oftelecommunications equipment; telemarketers;and companies utilizing telecommunicationsequipment for the sending of unsolicited faxadvertisements or prerecorded messages. Based onthese investigations, the Division recommends andinitiates enforcement actions to address consumer-oriented problems including drafting or issuingcitations, show cause orders, notices of apparentliability, forfeitures, and consent decrees. Interested in Hosting an FCBA event?The FCBA greatly appreciates the support of our members’ firms and companieswho provide space for our brown bag lunches, committee meetings, and CLESeminars throughout the year. We are, however, always looking for new loca-tions that can host FCBA events. We will be experimenting with some new pre-sentation technology in future CLE seminars, which require more technicalsupport than we have needed in the past.

In general terms, we need conference rooms that can seat at least 30 (more ifpossible) people at tables for brown bag lunches and committee meetings andconference rooms that can seat a minimum of 60 for CLE seminars. Firms andcompanies hosting brown bag lunches provide beverages and desserts; firmsand companies hosting CLE seminars provide beverages and snacks. CLE semi-nars are generally held from 6:00 – 8:30 p.m. Additionally, for CLE seminars weneed facilities that can provide technology support for microphones for as manyas six speakers on a panel, the ability to tie the house sound system into a tele-conference bridge, video projection capabilities for PowerPoint presentations,and access to the internet for presentations by speakers.
