INTRODUCTION This report contains work carried out by Surrey County Council’s Countryside Access Team for the period 1 April 2014 to 31 March 2015. It follows the format of The Rights of Way Statement for Surrey, which was published in January 2010 and set out the policies, procedures and service standards for work on public rights of way in Surrey. This year we have had quite a few staff changes, permanent and temporary. Sarah Jenman retired after many years service and Andrew Saint moved on to work for Somerset CC. We have been able to recruit to fill these posts, so hope the new staff will settle in and continue the good work of Sarah and Andrew. Nicky Scott and Hannah Gutteridge have both undertaken secondment opportunities to gain experience within other teams within the county council. Installation of our new IMT system (Countryside Access Management System - CAMS) has been a fairly slow and quite challenging process. Being the first large IMT project we have dealt with, it has been a steep learning curve as it is an ambitious project, but we are confident that in the end, it will reap rewards for delivering an improved service for managing Surrey’s path network. Both the Legal and Area teams continue to be very busy and we are having to rely on careful prioritisation of work to ensure we are balancing our statutory duties with available resources and making sure public safety is not compromised. We recently counted a backlog of around 2,500 reported ‘live’ issues for the area team at any one time, so responding to these and keeping people informed is quite a challenge. We currently have a backlog of around 3 years for processing Map Modification Orders, but have reviewed and amended our legal priority statement to allow some orders to be processed quicker than this if there is a significant public benefit. Our performance/monitoring measures have continued at a high level (see the section on Performance/Monitoring), so we hope this shows the team are on the right track and are very proud of these results. To mitigate some of the severe budget pressures on our service we have worked to increase to amount of income we receive from ‘rechargeable’ work. This has been a success and we have increased our income for work (mainly legal processes such as temporary closures and landowner deposits) by around 200%. This means our team is now about 20% self-funding for staff costs. We were saddened to hear about the passing of both Denis Holmes and Alan Lewis, who were long-standing members of Surrey Ramblers. The team had worked with both of them for many years and we recognise the huge contribution they made to improve Surrey’s path network for all. Surrey County Council’s Corporate Strategy sets out six key things that we need to get right to ensure we are delivering good public services. Within this report, we hope to show how those six things are embedded in our countryside access work.

Residents - Giving residents influence, control and responsibility. We work closely with local interest groups, volunteers and parish councils. A range of forums are held through the year to report on, listen and discuss our work with Surrey residents. Extensive consultation is undertaken for all changes to the path network.

Value - Create public value by improving outcomes for residents. We set high value for money standards for our suppliers and contractors delivering rights of way maintenance work. Work is awarded following competitive processes and regular monitoring is undertaken. Materials such as signs are standardised and bought in bulk to reduce costs and

periodic value for money bench-marking exercises are undertaken with other authorities. We regularly seek to gain external funding, particularly for improvement projects.

Partners - We will work with our partners in the interests of Surrey. We have worked successfully for many years with a wide range of volunteers carrying out work on the rights of way network. We are continuing to expand this programme and develop new and different ways to encourage and support volunteer engagement. We are working closely with other organisations such as Surrey Wildlife Trust, The National Trust, town and parish councils to deliver shared priorities. This work includes sharing the cost of carrying out path repairs.

Quality - We will ensure the highest quality and encourage innovation. We carry out an annual condition survey which measures our effectiveness against statutory maintenance standards and how ‘easy to use’ paths are for the public (see BVPI 178 in Objective 2).

People - We will develop and equip our officers and members to provide excellent service. All Countryside Access staff regularly undertake relevant specialist training to ensure continual personal development. Team members interact with professional organisations/national forums to ensure they are up to date with developing initiatives and legislative changes. We provide training for council members and other organisations, such as parish councils on different aspects of rights of way.

Stewardship – We will look after Surrey’s resources responsibly. Surrey’s rights of way network is a valuable asset for the county, with the 3472km of public paths making up around 43% of the counties total highway network. It provides free access to every part of our rich and varied countryside. It also provides an important part of the sustainable transport network, allowing residents to walk and cycle in safety to work and school. The path network is a key resource for the improvement of public health and gives residents attractive and safe opportunities for exercise via a wide range of activities including walking, cycling and horse riding. The health benefits of these activities are increasingly being recognised by the government and health organisations as key to improving public health. Protecting and improving this asset is done by creating new paths which are added to our definitive map, paths are physically upgraded to allow increased access and enforcement action is taken where existing paths and public rights are compromised.

The Rights of Way Statement and Annual Report set out three main objectives that we report on: OBJECTIVE 1: LEGALLY DEFINED AND IMPROVED WHERE APPROPRIATE The County Council’s first objective for management of the public rights of way network is as follows.

All of Surrey will be covered by a Definitive Map and Statement which correctly records the line and legal status of all rights of way in the County.

Improvements to the rights of way network will be made, particularly to meet present and likely future needs of the public, to give opportunities for exercise, recreation and enjoyment and having regard to the needs of blind and partially sighted people and those with mobility difficulties.

Definitive Map and Statement The Definitive Map and Statement is publicly available at County Hall - Kingston-upon-Thames, Merrow Depot - Guildford and at borough and district council offices for inspection during normal office hours. Priority Statement for Public Rights of Way The Priority Statement (legal definition) sets out the County Council’s priorities for keeping the Definitive Map and Statement under continuous review. It is available for public inspection. Legal Event Order The annual Legal Events Order to update the Definitive Map and Statement will be made during May 2015. It will cover Legal Events as a result of orders made under the Highways Act 1980 or Dedications accepted the County Council during the last year.

Map Modification Orders The County Council investigates applications (formal claims under schedule 14 of the Wildlife & Countryside Act 1981) to modify the Definitive Map and Statement. Within the year to 7 April 2015 the position was as follows. Register of Declarations, Statements and Maps A register of Highways Act 1980 Declarations, Statements and Maps is available on the County Council website: www.surreycc.gov.uk/rightsofway Temporary Path Closures We processed 39 temporary path closures orders, which involved 50 paths, for reasons of public safety or essential works. Anomalies We are currently aware of 184 path ‘legal anomalies’, most of these are minor variations between the Definitive Map and Statement (DMS) and the used path on the ground. The target in the Rights of Way Statement is to resolve at least of these 10 anomalies a year. During 2014/15, 2 anomalies have been resolved and removed from the list by legal diversion orders.

Creation, Diversion and Extinguishment of Rights of Way The County Council has powers under the Highways Act 1980 and Town and Country Planning Act (TCPA) (where we are the planning authority) to make legal orders to create, divert and extinguish public rights of way. We processed 1 TCPA diversion, FP 602 Dorking, on behalf of Mole Valley District Council. During the year, 9 Highways Act (HA) diversion, creation, extinguishment orders were confirmed and a dedication agreement completed. These were:

Map Modification Order case study Footpaths 599, 600, 601 Witley – These paths were the outcome of a successful claim and Map Modification Order to add them to the Definitive Map and Statement. The order was confirmed in August 2014 by the Secretary of State following a public Inquiry.

Traffic Regulation Orders A Traffic Regulation Order restricting the use of motorised vehicles was made during the year on BOAT 278 Bramley. The route had suffered from significant surface erosion which created a safety issue and two vulnerable protected species (Great Crested Newts and Fairy Shrimps) were then found within the BOAT. Rights of Way Improvement Plan The County Council has a statutory duty under the Countryside and Rights of Way Act 2000 to prepare and update the Rights of Way Improvement Plan (ROWIP). The plan was first published in 2007 and provides a framework to guide efforts to improve rights of way in Surrey. During this year we have reviewed and updated the plan to ensure it reflects current policies and initiatives to provide us with guidance and support for improving public rights of way. We do not have a specific budget for ROWIP improvements, so rely on gaining addition funding for projects where available. This can come from planning contributions, grants and from other parts of the county council. Individual improvements contributing to the ROWIP Action Plan objectives completed during since 2007 are reported in the revised document. Improvements completed this year include:

Replacing over 80 stiles with gaps, gates or (standard) kissing gates to improve accessibility. Most of this work was done by volunteers.

Improvement case study Bridleway 434 Worplesdon - We have recently completed a scheme with the Council’s Highways Service to create a safer bridleway crossing in Saltbox Road, Guildford. The bridleway exits onto the road very close to a railway bridge with poor visibility making crossing difficult. A safer crossing has now been created further away from the bridge, with much better sight lines and all path users can now cross safely. The bridleway and linking paths has been surfaced and fenced at the road, with funding from the Local Partnership Committee and Surrey County Councillor.

OBJECTIVE 2: PROPERLY MAINTAINED The County Council’s second objective for management of the public rights of way network is as follows. • Rights of Way should be open and available for use so that any user can find the start, follow the line of the path and use it in accordance with its legal status. The Priority Statement (maintenance and enforcement) sets out how we deal with practical problems on the rights of way network is annexed to the Rights of Way Priority Statement 2010. It can be accessed via our website - http://www.surreycc.gov.uk/environment-housing-and-planning/countryside/explore-surreys-countryside/looking-after-the-countryside/our-work-to-manage-surreys-countryside/footpaths-byways-and-bridleways/find-out-about-rights-of-way/rights-of-way-statement-for-surrey-january-2010 Path Inspection Paths are normally only inspected on a ‘reactive’ basis, as and when we are made aware of an issue that needs investigating. We receive around 5,000 reports per year by members of the public of path issues for investigation. We prioritise these issues in accordance with the Priority Statement (maintenance and enforcement). We currently have around 2,500 ‘live’ issues to deal with. Public safety issues are inspected as a high priority. Routes that are actively promoted by the County Council, such as the North Downs Way and Thames Path are normally inspected on a ‘pro-active’ basis, once a year, to ensure they are maintained to a high standard.

Vegetation Clearance The annual vegetation clearance programme is normally carried out between May and August. All paths likely to becoming obstructed by annual vegetation growth received one cut during the growing season. Some paths received 2 cuts where resources allowed. In total around 900km of overgrown paths were cut during 2014/15. Signposting and Waymarking Pro active inspections have been carried out on around 40% roadside signs (finger posts) across the whole county and missing signs replaced where necessary. Waymarks are placed along routes where needed, often by our Volunteer Path Wardens. Bridges and Other Structures Small structures such as sleeper bridges (under 2m span) and small culverts (under 1m diameter) are maintained on a reactive basis. Larger bridges and other structures are inspected once every 2 years and maintenance/replacement prioritised normally within 2 years. We are currently working to reduce maintenance costs on bridge materials and installations and plan to run a trial whereby we (the Countryside Access Team) manage bridges on all public rights of way in Surrey. Up until recently, the Council’s Structures Team have managed all bridges, but we are proposing a 2 year trial to inspect and maintain ourselves to reduce costs and improve prioritisation of works, for a more effective approach. Stiles and Gates The County Council has continued to: • assess any application for new gates and stiles on a “least restrictive access” basis • remove or change stiles for gates on routes to improve accessibility – Over 80 stiles have been removed. Surface Maintenance and Improvement The County Council’s aim is to ensure that no paths are kept closed due to dangerous surface conditions for more than 12 months. Enforcement The County Council addresses enforcement issues, firstly by negotiation, then by direct action, within a time limit established for each case. Enforcement work can be very time consuming for staff, so issues are prioritised in accordance with the Priority Statement (maintenance and enforcement). We served several Enforcement Notices this year and all were complied with. There were no prosecutions during the year. Ploughing and Cropping The County Council carried out inspections of paths across cultivated agricultural land, where problems were reported. Enforcement Notices were served under the Rights of Way Act 1990 where paths were not reinstated after cultivation or growing crops were found to be obstructing paths. Working in Partnership The County Council was grateful for partnership working with many landowners, volunteers, community and user groups, parish and town councils who take responsibility for appropriate maintenance and improvement projects and programmes. Volunteers - Volunteer groups continue to carry out a significant amount of maintenance and improvement schemes. The level of volunteer involvement in rights of way work in Surrey is one of the highest in the country and the County Council is extremely grateful for this. Volunteer Path Warden Scheme - We have continued to roll out our Volunteer Path Warden Scheme, running several training/induction sessions through the year. Over 200 wardens from across the county have now been trained and issued with tools and equipment. Wardens are encouraged to carry out minor maintenance tasks such as vegetation clearance and waymarking ‘as and when’ they come across them. These are the type of tasks we often struggle to do and local volunteer wardens are well placed to resolve these issues simply and effectively. The volunteers have contributed significantly to the good performance/monitoring results achieved in this year. This year, we have supported/facilitated around 1,000 days work by volunteers working on practical tasks within groups on the public path network. In addition to this, volunteers surveyed 250 paths for our BVPI 178 condition survey and over 200 Volunteer Path Wardens carried out countless minor maintenance tasks in their areas as well. Apart from the other many benefits of voluntary work, we estimate the total labour value of this work during 2014/15 is over £80,000. Performance/monitoring Best Value Performance Indicator (BVPI) 178 – ‘easy to use’ path survey During May and November, a random 5% sample of paths were surveyed and assessed whether they were ‘easy to use’ or not. The survey was carried out on our behalf by volunteers from the Surrey Ramblers. It follows nationally agreed methodology and is undertaken by most other authorities managing public rights of way. It provides a consistent and comparable tool for measuring our performance against statutory duties, the effect on the public and how we compare with other authorities. 81% of paths were found to be ‘easy to use’ in 2014. This is slightly less than last year’s figure, which was 82%. Whilst we always aim to increase the figure, a rating of over 80% is considered high when bench marked against other authorities and it is expected that 81% will be comfortably in the top quartile for County Council’s nationally.
