A N O R D I N A N C E TO A M E N D T H E L A N D ( S E T T L E M E N T OF T I T L E ) O R D I N A N C E .

B E I T E N A C T E D by the High Commissioner for Palestine, with the advice of the Advisory Council thereof: —

1. This Ordinance may be cited as the Land (Settlement of Title) (Amendment) Ordinance, 1945, and shall be read as one with the Land (Settlement of Title) Ordinance, hereinafter referred to as "the principal Ordinance".

2. Section 69 of the principal Ordinance shall be amended by the repeal of subsection (2) thereof and by the substitution therefor of the following subsections: —

"(2) An order under subsection (1) may provide that where any fee prescribed in any such order is not paid within such period as may be specified in the order there shall be added to such fee such sum, not exceeding twenty per centum of such fee, as may be prescribed in the order.

(2A) The provisions of subsection (3) shall apply to any sum which, by virtue of any order under this section, is added to any fee payable under any such order as those provisions apply to the fee to which such sum is so added.

(2B) The Order contained in the Schedule shall be deemed to be an order, made under this section and shall be in force until it is varied or revoked by any order made under this section.

3. Section 70 of the principal Ordinance shall be amended by the deletion of the words "other than the fees due on survey and registra­tion of the shares" appearing therein and by the substitution there­for of the following proviso : —

"Provided that nothing in this section shall be deemed to relieve any person of any liability to pay any fee in respect of the registra­tion, in the new registers, of any right in land which is recorded in a schedule of partition."

4. Section 71 of the principal Ordinance shall be repealed and the following section shall be substituted therefor: — "Fee where right recorded in existing registers.

71.—(1) Where any land is — (a) registered in the existing registers in the

name of the claimant, and (6) identified by means of a plan produced by

the claimant and certified by the Director of p Surveys to be acceptable for registration pur­

poses, and the right of ownership of such land is recorded without modification in the schedule of rights, no fee shall be charged for the registration of such right in the new registers.

(2) Where any right in land (other than a right of ownership) which is registered in the existing re­gisters in the name of the claimant is recorded with-

5. The Schedule set out at the end of this Ordinance shall be added at the end of the principal Ordinance as a Schedule to that Ordinance.

6. This Ordinance shall come into force on the fifteenth day of November, 1945.

(2) Subject to the provisions of section 70 of the Ordinance, where in the course of settlement any land is partitioned in accordance with the provisions of the Ordinance, a partition fee of 80 mils per dunum or part of a dunum, or a partition fee of 120 mils per parcel, which­ever fee is the greater, shall be payable in respect of the partition of such land, in addition to the fee payable under item (i) or (ii) of sub-paragraph (1) of this paragraph, and such partition fee shall be payable by the person by whom the fee payable under the said item (i) or (ii), as the case may be, is payable.

C3) Subject to the provisions of subsection (3) of section 69 of the Ordinance, i f any fee prescribed in item (i) or (ii) of sub-paragraph (1), or in sub-paragraph (2), of this paragraph is not paid by the person by whom it is payable —

(a) within six months from the date of the posting of the schedule of rights, or of the schedule of partition, in which such fee is entered; or

(6) where such fee is entered in a schedule of rights, or a schedule of partition, in pursuance of any decision given by a settlement officer and determining any right which was not settled before the transmission to the registrar of such schedule of rights or schedule of partition, within six months from the date of such decision,

a sum equal to twenty per centum of the fee payable shall be added thereto and such sum shall be payable by the person by whom, and in the manner in which, such fee is payable. W&&

(4) Subject to the provisions of section 38 of the Ordinance, no instrument for the registration of which a fee is prescribed in item (i i i ) of sub-paragraph (1) of this paragraph, and no copy of such an instrument, and no extract from, and no extract from the land register relating to, such an instrument, shall be delivered by the registrar to any party to such instrument unless such fee has been paid into the Land Registry by such party or by the party liable to pay such fee.

O B J E C T S A N D R E A S O N S . Clauses 2 andlb.

X. Subsection (2) of section 69 of the Land (Settlement of Title) Ordinance, Cap. 80 (hereinafter referred to as "the principal Ordinance") as amended by section 2 of the Public Officers (Change of Title) Ordinance, No- 12 of 1940, provides that the Director of Land Settlement shall cause a valuation of the land to be made in a manner prescribed for the purpose of assessing registration fees. Since the registration fees prescribed under the said section 69 are payable by reference to the area of land and not by re­ference to its value, i t is considered that the provisions of subsection (2) of that section are unnecessary and Clause 2 of the B i l l therefore repeals that subsection and replaces it by new subsections (2), (2A) and (2B).

2. The proposed new subsections (2) and (2A) of section 69 provide for the imposi­tion of a penalty not exceeding 20 per centum in cases where any fee prescribed by any order made under the section has not been paid within the period specified in such order.

3. It is proposed to combine— (a) the survey fee payable under the Survey Ordinance, Cap. 136, in respect of the

survey of land carried out by the Department of Surveys for the purpose of land settlement, and

(6) the registration fee payable under the principal Ordinance jn respect of the re-gis/ration of rights in land which nave been settled under that Ordinance,

in a new registration fee which will b־ prescribed under section 69 of the principal Ord­inance. The new subsection (2B) and f btv.-r 5 of the Bill, therefore, insert, as a Schedule to the principal Ordinance, an Order prescribing such new registration fee. Such Order will remain in force until varied or revoked by any order by the High Commissioner made under section 69 of the principal Ordinance.

The Order set out in the Schedule to the Bill prescribes, inter a l i a , a partition fee, but section 70 of the principal Ordinance provides for certain exemptions from the pay­ment of this fee.

'4, Clause 3 of the Bill removes the reference to "survey fees", occurring in section 70 of the principal Ordinance, so as to give effect to the proposal mentioned in paragraph 3 above.

5. Clatise 4 of the Bill repeals and replaces section 71 of the principal Ordinance. Subsection (1) of the existing section 71 provides that where the following condition

is fulfilled, namely, where any right to land registered in the existing registers in the name of the claimant is recorded without modification in the schedule of rights, no fee shall be charged for the registration of such right in the new registers. The new sub­section (1) deals only with the registration of rights of ownership of land and imposes a further condition to the grant of such exemption from payment of registration fees, namely, that the claimant should haw produced a plan identifying the land in question and certified by the Director of Surveys to be acceptable for registration purposes.

6. Subsection (2) of the existing section 71 provides that where any right to land regis­tered in the existing registers in the name of the claimant is recorded in the schedule of rights subject to modification, the Settlement officer may waive, in whole or in part, any fee which would otherwise be due in respect of the registration of such right: and a proviso to the subsection provides that where a survey of bind has been carried out by the Department of Surveys, there wi l l be no exemption from payment of survey fees unless they had already been paid. The new subsection (2) differs from the existing subsection in the following respects:—

(a) it deals only with the registration of rights in land other than rights of ownership (which latter are dealt with in the new subsection (1)); and

(6) it provides for the grant of t o t a l exemption from payment of registration fees, but only in cases where the right in question is recorded in the schedule of rights without modification ; and twee^S

(c) no reference is made to the survey fee in view of the proposal to incorporate it in the new registration fee mentioned in paragraph 3 above.

7. Clause 6 provides for the Amending Ordinance to come into force on the 15th Novem­ber, 1945, i.e. on the same date on which the Ordinance amending the Survey Ordinance, Cap. 136, will come into force.

Short title. Cap. 136.

Amendment of section 2 of the principal Ordinance.

1. This Ordinance may be cited as the Survey (Amendment) Ordin­ance, 1945, and shall be read as one with the Survey Ordinance, here­inafter referred to as "the principal Ordinance".

2 Section 2 of the principal Ordinance shall be amended by the substitution for the definition of "public survey" appearing therein, of the following definition:—

,public survey" means any topographical survey" '־or town survey, carried out by the Department of Surveys, or any survey carried out, whether before or after the date of the commencement of tie Survey (Amendment) Ordinance, 1945, by th<* Department of Surveys in connection with

8. Sections 17 and 18 of the principal Ordinance are hereby repealed and the following section substituted therefor:— 'Recovery of 1?- Any fee, or other payment, payable under any fees and other rules made under section 16 may be recovered under payments. the Taxes (Collection) Ordinance which shall apply Cap. 137. to the collection of such fee or other payment, as

though it were a tax within the meaning of that Ordinance"

9. The Schedule set out at the end of this Ordinance shall be added at the end of the principal Ordinance as a Schedule to that Ordinance•

10. —(1) Any survey carried out by the Department of Srirveys before the date of the commencement of this Ordinance which was not, at the time such survey was carried out, a public survey within the meaning of section 2 of the principal Ordinance in force at that time but which would have been a public survey within the meaning of section 2 of the principal Ordinance, as amended by section 2 of this Ordinance, had this Ordinance been in force at the time such survey was carried out, shall be deemed to have been a public survey within the meaning of section 2 of the principal Ordinance in force at the time such survey was carried out, and any act done, before the commencement of this Ordinance, for the purpose of, or in connection with the carrying out of, any such survey as aforesaid, shall be deemed to have been validly done if it would have been validly done had such survey been a public survey within the meaning of section 2 of the principal Ordinance in force at the time such survey was carried out.

(2) For the removal of doubts it is hereby declared that the following rules were lawfully made: —

Repeal and replacement of section 8 of the principal Ordinance.

Insertion of heading in the principal Ordinance.

T H E S C H E D U L E . 1. These Rules may be cited as the Survey (Fees) Rules, 1945.

i for the following work carried out by nt of Surveys, that is to say —

(a) a survey for which application is made ty the owner of any land, or

(6) checking the plan prepared by a licensed surveyor and deposited by the owner of any land in connection with the registration of any transaction in *and under the Land Transfer Ordinance, or

(c) any other work carried out by any officer of the Department of Surveys on the application of any person,

shall be paid at the rate of five hundred mils for each hour, or part OT an hour, during which each such officer is employed upon any such work.

(2) In addition tc the fee specified in sub-rule (1) of this rule, the person applying for any work to be carried out by any officer of the Department of Surveys shall pay, in respect off"••:

( a ) the cost of the materials required for such work, and (6) the travelling expenses of any such officer employed upon such

work, such sum as may be fixed by the Director.

3. Any person applying for any work to be carried out by any officer .of the Department of Surveys shall, i f so required by the Director, before sUch work is commenced by any such officer, make a deposit, on account of the fee payable under sub-rule (1), and the sum payable under sub-rule (2), of rule 2 of these Rules, of such amount as may be fixed by the Director, and where such deposit is made the sum payable under that rule shall be defrayed out of such deposit and the balance thereof, i f any, shall be refunded to the depositor.

O B J E C T S A N D R E A S O N S .

1. Clauses 2, 3 an I 10(1). By virtue of section 8 of the Survey Ord­inance (hereinafter referred to as "the principal Ordinance") the provisions of Part I I I thereof apply to any survey declared by the High Commissioner, by order, to be a public survey. With one exception, however, namely, the survey declared to be a public survey by the Survey (Iraq Petroleum Company Limited) Order, none of the Burveys carried out by the Department of Surveys under the principal Ordinance have been declared to be public surveys by an order under the said section 8.

cribed the fees to be paid in respect of surveys carried out by the Department of Surveys in connection with land settlement.

4. It is now proposed to provide for the levying of a new registration fee under the Land (Settlement of Title) Ordinance, Cap. 80, combining —

(a) the registration fee payable under that Ordinance in respect of the registration of rights in land which have been settled under that Ordinance, and

(6) the survey fees which are at present levied under the Survey Ordinance, Cap. 136, in respect of the survey of land carried out by the Department of Surveys for the purposes of land settlement.

5. Clause 7 of this B i l l therefore replaces section 16 of the principal Ordinance by a section which —

( a ) contains no reference to public surveys of land, and (b) empowers the High Commissioner by rules to prescribe the fees,

and other payments, to be paid for any survey or other work carried out by officers of the Department of Surveys on the ap­plication of any person. •

6. In order to remove doubts as to the validity of the enactment of rule 5 of the abovementioned Public Survey Fee Rules (for the enact­ment of which, i t is arguable, section 16 of the principal Ordinance conferred no power) and as to the validity of the collection of all other fees and payments which became payable under those Rules, clauses 10(2) and 10(3) of the B i l l validate those Rules and the col­lection of all fees and other payments which became payable there­under, and, in view of the proviso to the new section 16 and the rules contained in the Schedule to the B i l l , clause 11 revokes the Public Survey Fee Rules.

7. Clause 8 of the B i l l , which enacts a new section 17 (which provides that any fee, or other payment, payable under the new section 16 may be recovered under the Taxes (Collection) Ordinance, Cap. 137) is consequential to the new section 16. The clause also repeals section 17 of the principal Ordinance which is no longer necessary since a similar provision is contained in section 12 of the Taxes (Collection) Ordinance. BSBH

8. Clauses 4 and 6 of the B i l l are designed to remove certain in­consistencies in sections 11 and 15 of the principal Ordinance.

9. Clause 12 provides for the Amending Ordinance to come into force on the 15th November, 1945, i.e. on the same date on which the Ord­inance amending the Land (Settlement of Title) Ordinance, Cap. 80, will come into force.

B E IT E N A C T E D by the High Commissioner for Palestine, with the advice of the Advisory Council thereof: —

1• This Ordinance may be cited as the Interpretation (Amendment) Ordinance, 1945, and shall be read as one with the Interpretation Ordin­ance, 1945, hereinafter referred to as "the principal Ordinance".

2. Section 2 of the principal Ordinance shall be amended by the repeal of the definition of the word "law" appearing therein and by the sub­stitution therefor of the following definition: —

"" law" includes — (a) such Acts or parts of Acts, and such Orders by His Majesty in

Council or parts of such Orders, whether passed or made before or after the commencement of this Ordinance, as are now, or have heretofore been, or may hereafter be, in force in Palestine; and

(b) orders, regulations, rules, byelaws, proclamations, directions, notices, or other instruments, not being enactments, made or issued, whether before or after the commencement of this Ordinance, under any such Act, Order, or part thereof as is referred to in paragraph (a) of this definition, being orders, regulations, rules, byelaws, proclamations, directions, notices, or other instruments, which are now, or have heretofore been, or may hereafter be, in force in Palestine; and

(c) enactments: and (d) Ottoman law. religious law (whether written or unwritten), and

the common law and doctrines of equity of England, which is^or are now, or has or have heretofore been, or may hereafter be, in force in Palestine :".

3. Section 18 of th׳:> principal Ordinance shall be repealed and the following section shall be substituted therefor: — "Effect of repeal 18. Where, after the commencement of this Ordin of Ordinance on ance, any Ordinance repeals any former Ordinance regulations and and substitutes other provisions therefor, all regula-appointmtnta. tions and appointments made or issued in virtue of

such repealed Ordinance, and in force at the time of such repeal, shall remain in force so far as they are not inconsistent with the provisions of the repealing Ordinance, and. unless the contrary intention ap­pears, until they have been revoked or replaced by regulations and appointments made or issued under the provisions of the repealing Ordinance."

4. This Ordinance shall be deemed to have come into force on the date of the commencement of the principal Ordinance.

, O B J E C T S A N D R E A S O N S .

Clause 2 of this B i l l amends the definition of law" in section 2 of the Interpretation Ordinance, 1945 (hereinafter referred to as "the principal Ordinance"). The obje6־fej|p the amendment is to include laws which have at any time been in force in Palestine, but have ceased to be so in force befo c the enactment of the principal Ordinance. The amendment is necessary in connection with section 35 of the principal Ordinance dealing with the taking of judicial notices of iaws. F o r example the courts may have to take judicial notice of any Ordinance notwithstanding that it was replaced before the passing of the principal Ordinance.

2. Clause 3 of this B i l l replaces section 18 of the principal Ordinance- The object is to clarify the scope of the section by making it clear that regulations and appointments made under a repealed Ordinance remain in force under the repealing Ordinance only where the repealing Ordinance substitutes other provisions for those of the repealed Ordinance.

. IV. CESSATION OF POSTAL AND TELEGRAPH CENSORSHIP IN PALESTINE.

Postal and Telegraph Censorship in Palestine wi l l cease after 30th September, 1945. 2. Although censorship restrictions wi l l no longer be applied in Palestine after the above date

certain restrictions wi l l still remain in force in other countries until such time as the approp­riate authorities in those countries notify that they may cease. This applies particularly to enemy countries and countries formerly occupied by the enemy.

HAIFA HARBOUR (RECLAIMED AREA) ESTATE.

Tenders are hereby invited for the lease of Parcel No. 5, Block No. 86, in the Haifa Har­bour (Reclaimed Area) Estate measuring about 2,000 square metres, for a period of one year as from 15th October, 1945, for use as a cont­rolled car park.

A solid building containing "a hal l , 4 rooms and a shower is existing on the site. The use to which this building may be put wil l be re­stricted to storage of drivers' personal effects and use as an office.

The conditions under which an agreement wi l l be granted may be obtained from the Agent, Haifa Harbour Estate, 57, Harbour Street (P.O. Box 642), Haifa, daily between 8 a.m. and 12 noon.

Contractors equipped for and experienced in the construction of premix asphalte carpets are invited to tender for extensive works of repair and construction of sidewalks in the City.

Only contractors thoroughly experienced in such work and who have the necessary plant consisting of premix machines, concrete mixers, and haulage vehicles readily available need apply. . ׳

The amount of work to be required of any or each contractor employed wi l l be dependent upon the amount of first class work he is cap­able of producing per day and contractors in tendering must state their guaranteed output of finished work.

Further details of the work required, spe­cifications, forms of tender and conditions of contract may be obtained from the City En­gineer's Department, on or after 21st Septem­ber, 1945. A charge of £P .2.—will be made for each set of documents.

J U D G M E N T .

The Lat in Patriarchate of Jerusalem brought an ex parte action through advocate George Berouti under section 3(a) and (6) of the Land Courts Ordinance, which is shortly that—

(1) 68 years ago, Father Sam'an, a Lat in priest, bought a piece of land situated at Lydda which was registered in his name under Turkish Kushan No. 1 Kanun Awal 1295, Daimi (Exhibit A) .

(2) This transaction was effected by Father Sam'an as agent of the Patriarchate and regis­tered i t in his name as nam musta'ar for the Latin Patriarchate of Jerusalem because the law at that time forbade the registration of lands in the name of the Latin Patriarchate.

(3) The said priest Sam'an died in 1893 with-• out effecting any change in the said registra­tion and the Lat in Patriarchate did not apply after his death for; the correction of the land register. Other reasons were given, seven in all, and as a result, application was made that the Court do decide that the plaintiff is the real owner of the said land and that it be re­gistered in its name at the Land Registry in accordance with the plan produced in file No. 406/44 of the Land Registry Office of Jaffa.

Upon hearing the pleadings of plaintiff's attorney and the witnesses and perusing the documents produced, the Court finds as a fact:

That the land the subject matter of kushan Exhibit A which was registered in the name of the priest Sam'an under date 1 Kanun Awal 95 Daimi, and which is still so registered, was registered in his favour while he was the Lat in priest of Lydda and that after the death of the said priest, for a period exceeding forty years, the Latin Patriarchate of Jerusalem was in possession. Therefore we decide and declare that the Lat in Patriarchate of Jeru­salem has the right to be substituted for Khouri Sam'an in the Tabo registration containing the name of Khouri Sam'an (Exhibit A) dated Kanun Awal 1295, Daimi, in respect of the land situated in Lydda Village and bounded: Suleiman Ash-Sheikh Qasem, Rizk al Munay-yer, road and the purchaser, because the priest Sam'an registered' this land in his name when he was at the time the Lat in priest of Lydda and because the Lat in Patriarchate has posses­sed this land exclusively from the death of Fa­ther Sam'an t i l l now, that is a period exceeding forty years. This what the Court can decide in respect of the land, leaving to the Land Registry to decide the relation of this land to the plan produced by the Lat in Patriarchate and to correct the boundaries as shown on the plan produced in file No. 1406/44; because these are administrative matters which have to be investigated and decided by the Land Regis­try if there is no opposition. But in case there is opposition to the correction, then it is for the court to investigate the matter in an action properly brought before it. The judgment of this court shall not be executed before its pub­lication in the Palestine Gazette and the local newspapers twice, between each time a period of 15 days has to lapse and service thereof on the Attorney-General and a period of one month passes after the publication and the said service.
