Article 6 of the Charter of The Metropolitan Government of Nashville and Davidson County shall be amended by adding the following paragraph: “Sec. 6.16. Appropriations or expenditures supporting the prosecution of criminal offenses based upon the simple possession of marijuana by an adult. (a) Notwithstanding any other provision of this Charter to the contrary, The Metropolitan Government of Nashville and Davidson County shall not appropriate any resources supporting, nor in any way monetarily support, the prosecution of an adult for a criminal offense based upon the simple possession of less than two (2) ounces of marijuana. (b) This provision shall be broadly construed to effectuate the intent of the voters to forbid the appropriation or expenditure of any resources of The Metropolitan Government of Nashville and Davidson County for any purpose related to the prosecution of an adult for a criminal offense based upon the simple possession of less than two (2) ounces of marijuana. (c) This provision confers a private right of action to bring suit for all appropriate remedies, both legal and equitable, from an appropriate court of competent jurisdiction. Any taxpayer residing in Davidson County shall have standing to sue The Metropolitan Government of Nashville and Davidson County for violations of this provision, and any organization, including tax-exempt organizations, within Davidson County shall have standing to bring suit under this provision on behalf of its members. (d) Any individual or organization prevailing in a lawsuit against The Metropolitan Government of Nashville and Davidson County shall receive $1,000 in damages and payment of all costs and reasonable attorney’s fees for each proven violation of this provision from The Metropolitan Government of Nashville and Davidson County. (e) This provision shall take immediate effect upon ratification by the voters on August 6, 2015.” We the undersigned registered voters of Metropolitan Nashville, in the county of Davidson, State of Tennessee, hereby request that the above amendment to the Charter of The Metropolitan Government of Nashville and Davidson County be submitted to the voters of Metropolitan Nashville and Davidson County for ratification to be voted on in the election to be held on the sixth day of August, 2015. We request that such amendment be printed on the official ballot. (You must include your name and address as they appear on your voter registration card .)
