Recently I had an opportunity to speak with Joe Robson, our NaHB Chairman, and he shared with me that the NaHB economic staff had informed him that, based on all economic indicators, the housing market across the country had appeared to have finally hit bottom! However, it was unfortunately one of those good

news/bad news scenarios, in that the staff also indicated that it appears we will hike along the bottom for a period of time that no one can define with any certainty.

Taking a hike along the bottom of a market is not exactly what we have hoped for, but it sure beats the free fall we have been experiencing for the past several quarters. This year I have shared in this column, as well as with our local

HBas across North Carolina, the importance of perspective when it comes to troubled times both in our businesses and our personal lives. There is also a perspective to taking a hike along the bottom of our market.

Speaking for myself, I would much rather be told I needed a backpack in addition to my tool belt as opposed to realizing that I needed to find something else to do to make a living. There is tremendous value in the hard time we have all experienced, if we choose to view it as an opportunity rather than a curse. The difficult challenges we have all encountered in our businesses have been hard but at the same time they have been an education in the harsh reality of business cycles, which for the most part has skipped North Carolina’s building industry in the past. The education you have acquired is not measured in the dollars you have spent or lost, but rather in the future dollars you will make or save because you will have survived the worst industry conditions that you will see in your lifetime. we all will be tuned in a little better the next time the economy so much as hiccups because of the hard lessons we have learned.

I continue to be encouraged and proud of the resiliency and tenacious spirit of unity that you, our membership, continues to exhibit. Your membership in the HBa is something that provides you value in ways that are often difficult to pinpoint, but like a solid investment, it pays you back over time and the dividend is much larger and better than your original investment.

One of the greatest benefits we enjoy as members of the NCHBa is our very own 21st Century Building Expo & Conference, which will be held in Charlotte Sept. 16-18. Over the past several months, I believe we all have realized the benefit of unity. we understand the need for our industry to stand together for us to get all of our folks back to work and providing even higher levels of excellent contributions to our communities.

I challenge every member of every HBa in North Carolina to attend the 21st Century Building Expo for a couple of reasons. First, because NCHBa needs each of you to attend, and second, I am asking you to do so. we have a group of loyal exhibitors who are providing added value to our members by using this Expo to meet you and expose you to the newest, greenest and most cutting-edge products and services that will enable you to meet the diverse needs of your customers and give you a competitive edge in your business. It is critical at this time that we stand and live up to the reputation that we, the home building industry in North Carolina, have worked so hard to achieve.

I am not asking you to spend a dime beyond the gas it takes you to drive to Charlotte. Members of the North Carolina Home Builders association visited with the North Carolina General assembly June 9-10 as part of

NCHBa’s annual legislative Conference in Raleigh.

On June 9 members enjoyed an evening reception held at the North Carolina Museum of History in honor of legislators, where they were able to begin a dialogue about issues

important to the home building industry. The reception was well-attended by builders, associates and legislators, with all having a great time of fellowship and discussion.

The following morning, members walked the halls of the General assembly, meeting with senators and representatives from their area.

In this legislative session dominated by the severe budget deficit and economic troubles, these “one-on-one” visits were extremely important in creating awareness among our legislative delegation of issues important to the home building industry.

NCHBa’s legislative priorities for this session include:• Extendinglanddevelopment

permits;• Deferringtaxonbuilderinventory;• Prohibitingadequatepublicfacilities

fees;• RepealingtheJordanLakerules;• Endingmoratoriaabuse;• Providingahomepurchasetax

at the time of this writing, the 2009 “long session” is far from over, so we will not know how successful we will be in pushing for issues important to us and advocating against harmful legislation. However, there is no doubt that builder and associate participation in our legislative day was key to advancing NCHBa’s legislative agenda.

You’ll find a “snapshot” of our NCHBa legislative Conference on the following pages. Thanks to everyone who participated and we hope to see you next year!

the North Carolina Building Code Council will meet Sept. 14-15, 2009 at a location

to be determined. Due to budget constraints, the council has held the past several meetings at the NCDOI offices at 322 Chapanoke Road in Raleigh. The council will hold a work session at 9 a.m. Sept. 14, followed by a public hearing at 1 p.m. The council meeting will be Tuesday, Sept. 15, at 10 a.m. (note the time change from the traditional 9 a.m.) The agenda for the council meeting can be found at: http://www.ncdoi.com/OSFM/Engineering/BCC/engineering_bcc_agenda.asp about two weeks prior to the council meeting.

Transition from 2004 N.C. accessibility code to 2009 Chapter 11 and 2003 ANSI A117.1

What is in effect now? The current 2002 North Carolina

accessibility Code with 2004 amendments is in effect until the North Carolina General assembly goes home. Provisions in the 2009 North Carolina Building Code such as NCBC 1007, NCBC 3409 and appendix E have already been in effect for buildings using the 2009 N.C. Building Code. Some of these provisions may replicate provisions in the 2004 accessibility Code. Some, such as NCBC 1007.3, which requires areas of refuge for all buildings, even sprinklered ones with few exceptions, may be more restrictive. Horizontal exits may be used to access the area of refuge. NCBC 1007.2 requires an elevator for one path of egress in a four-story building.

When does North Carolina Building Code Ch. 11 and ANSI A117.1 go into effect?

The note at the beginning of the 2009 North Carolina Building Code Chapter 11 states that Chapter 11 and aNSI a117.1 (“the rule”) go into effect on the day of adjournment of the legislature’s current session.

On June 9, the North Carolina Building Code Council voted to allow a transition period between the current accessibility Code (NCaC) and Chapter 11 and aNSI a117.1. The transition period will extend from the

time that the legislature adjourns until dec. 31, 2009. during that time, a designer may choose whether to design the building using the 2004 NCaC or 2009 NCBC Ch. 11 + aNSI a117.1.

Beginning Jan. 1, 2010, both the state and local jurisdictions will begin enforcing 2009 North Carolina Building Code Chapter 11, along with the referenced standard aNSI a117.1. The transition time allows for designers and jurisdictions to familiarize themselves with the overlap of the state and federal requirements that go into effect Jan. 1, 2010.

What happens to the ADAAG requirements?

at the same time that North Carolina goes to IBC Chapter 11 and aNSI a117.1 and stops enforcing what has been adaaG, adaaG will continue to be enforced on the federal level by the u.S. department of Justice. It is estimated by uSdOJ that the current adaaG requirements (what is/was in the 2004 NCaC) will remain as federal accessibility requirements until 2012. [an NCaC Cd is available from the NCdOI office that also contains the adaaG requirements.]

May Chapter 11 and ANSI A117.1 be used before the legislature leaves town, i.e., before the enforcement date?

Some jurisdictions have asked if the new requirements may be used before the

enforcement date, particularly on large projects that are pulling foundation permits near the end of the legislative session. This is acceptable based on the use of NCBC Chapter 11 and aNSI a117.1 as an alternate Method under North Carolina administrative Code 105.1. as both NCBC Chapter 11 and aNSI a117.1 have been adopted by the North Carolina Building Code Council and approved by the Rules Review Committee. It is still a matter where designers will have to address the worst case scenario between the applicable codes (NCaC and NCBC Ch. 11/aNSI a117.1), since both will apply on a state and federal level.

Which edition of ANSI is required? 2009 North Carolina Building Section

1101.2 references ICC aNSI a117.1. N.C. Building Code Chapter 35 on page 544 requires ICC aNSI a117.1-03 of the standard. It can be ordered through the International Code Council at www.iccsafe.org. You may wish to order either the standard or the commentary version. The language in the commentary may be helpful in explaining some of the requirements; however, commentary language is not enforceable, it is merely explanatory.

Highlights on changes between the 2006 and 2009 Residential Code

CHAPTER 9 - ROOF ASSEMBLIES

SECTION R903 WEATHER PROTECTION R903.5 Hail exposure. Hail exposure, as

specified in Sections R903.5.1 and R903.5.2, shall be determined using Figure R903.5.

R903.5.1 Moderate hail exposure. One or more hail days with hail diameters larger than 1.5 inches (38 mm) in a 20-year period.

R903.5.2 Severe hail exposure. One or more hail days with hail diameters larger than or equal to 2.0 inches (51 mm) in a 20-year period.

IRC change - Section R903.3 has been added along with Section R903.5.1 that defines a moderate hail exposure area and R903.5.2 which defines a severe hail exposure area. A national map has been added as well to identify these areas. (See Figure R903.5 on facing page.)

SECTION R905 REQUIREMENTS FOR ROOF COVERINGS

R905.2.3 Underlayment. unless otherwise noted, required underlayment shall conform to aSTM d 226 Type I, aSTM d 4869 Type I, or ASTM D 6757. Self-adhering polymer modified bitumen sheet shall comply with aSTM d 1970.

R905.2.4.1 Wind resistance of asphalt shingles. asphalt shingles shall be installed in accordance with Sec tion R905.2.6. Shingles classified using ASTM D 3161 are acceptable for use in wind zones less than 110 mph (49 m/s). Shingles classified using ASTM D 3161, Class F, are acceptable for use in all cases where special fastening is required.

Department of Health and Human Services, Division of Public Health, Hazards Control Unit will present a seminar on the U.S. Environmental Protection Agency’s new rule aimed at protecting children from lead-based paint hazards in places they frequent. The rule applies to renovation, repair or painting work in housing, child-care facilities and schools built prior to 1978. The rule, Lead: Renovation, Repair and Painting Program, requires that firms that perform renovations for compensation use a certified supervisor; that their employees be trained; and that they follow protective work practice standards. Remodelers need risk management, too

Remodelers, isn’t it refreshing to read some good news? NaHB released its first quarter 2009 Remodeling Market Index results, documenting signs of

significant improvement over fourth quarter 2008.

Current market conditions increased 37 percent to 34.5. Even more promising, future expectations — which averages calls for bids, amount of work committed for the next three months, backlog of remodeling jobs and appointments for proposals — increased a striking 61 percent to 30. Projects are in the pipeline! The impressive uptick signals a welcome relief for remodelers.

while you might be chomping at the bit to do the work, your risk-management strategy may be far from ready.

acknowledge the elephant in the room

The major difference between new construction and a typical remodeling job is the “wildlife.” Yes, there’s an elephant in the room: the customer. You may say, “But, I don’t ignore the customer. I focus on their desire for a finely-crafted, functional and well-designed space.”

Yet if you remodel occupied homes, your safety program often ignores the risks your work poses to the customer. don’t forget to package your proposals with a proactive consumer-conscious safety strategy.

Start with a sit-downBefore you begin work, share your

commitment to a safe work environment with every customer. You, your subcontractors and your customers all play a role in safety. don’t simply work around “the elephant.” Set your expectations for what customers should do to steer clear of the hazards. Talk the family through the inherent hazards (electrical, fall and vehicle, for example) that renovations pose to them and how you plan to mitigate them.

when you communicate respect and a concern for your customers’ safety, you build more than a powerful risk management plan. You prime the pump for future referrals. Many risk management methods accomplish both.

visitors won’t be subjected to the hazards of tools, cords, exposed nails and scrap—or how unsightly it can be. You show respect for the customers’ living spaces, and protect them from job site hazards simultaneously, with the same risk-management technique.

The average customer has no idea of the hazards that fall protection mitigates. Talk through the layers of protection your safety program provides for them. First, always use OSHa-compliant ramps or stairs instead of walkboards or planks for entrance and egress. Inclines greater than 30 inches require handrails as well. while you don’t want to encourage unwanted visitors in a construction zone, you want to provide safe entry and exit for customers who occupy their homes during a renovation. Second, install temporary rails on any unprotected openings such as window openings, open-sided stairs or landings. during the drywall stage, remodelers often overlook this formidable fall exposure. Third, protect any open trenches with orange safety fencing, guardrails or other barricades. Finally, be vigilant in protecting both workers and customers from falling objects (especially if your project involves scaffolding).

Explain that you will provide signage and fencing or barricades to create a construction perimeter, which keeps unwanted visitors out and construction materials, machinery and equipment in.

Your hiring practices also will win big points in your customers’ eyes. describe how you and your subs run criminal background checks as part of your pre-employment screening processes so customers feel safe and sound with these employees working in their homes.

Remember to reinforce these messages with your subs, even detailing your expectations in your subcontractor agreements. again, you, your subs and your customers share the responsibility for safety on the job site.

Get it in writingafter your chat, document your commitment

to your safety program in your formal proposal to your customer. also include a sample change order, and explain how any requested changes will impact the original quote and timeline. CYa: cover your…“affairs,” right? Require signed change orders for any project deviations

after the original contract has been signed.Only surprise your customer with small

added touches, such as employees reporting for work in company shirts and keeping their personal business away from the job site (i.e. smoking or making calls). This added layer of respect and professionalism will impress customers and encourage them to be forgiving of any unexpected issues that arise.

dot each “i” in “builders risk policy”

You need more than a written safety policy. You need a builders risk policy; each of your jobs should have this insurance coverage. If you predominantly remodel buildings (constructed in the last 40-50 years) and specialize in cosmetic upgrades as opposed to structural overhauls, you’re a prime candidate for a Builders Mutual Builders Risk policy. On the other hand, if you chiefly provide more extensive renovation work, further underwriting will be necessary.

are you remodeling something you plan to flip, or is your renovation at the homeowner’s request? do you want to require your customers to include coverage for the structure in their homeowners’ policies and only include the value of improvements in your builders risk policy to save the difference in premium? as a trade contractor doing specialized remodeling work, will you opt for an installation policy instead? Its coverage, targeting your specialty, offers a lower rate than a true builders risk policy (based on installation receipts). Regardless of your business plan, your agent can help you find the right coverage.

Remodeling work means a host of differentiating hazards to consider in your risk-management strategy. Go ahead, remodel yours. let it leave a lasting impression on your customers that will surely translate into future referrals.

NChBa members unite to defend membershipNational Membership day 2009 was another

great achievement for NaHB and North Carolina, even in the midst of challenging economic times.

Throughout the nation, nearly 400 local associations phoned the National association of Home Builders on May 19 with a total of 5,158 new member pledges, according to preliminary results from the annual drive.

North Carolina played a large role in the success of this year’s nationwide effort, and for the sixth consecutive year had 100 percent participation (one of only nine states to achieve that distinction) in NaHB’s Commit to Call and National Membership day call-in efforts.

North Carolina called in 343 new member pledges for May and also led the nation in new members recruited for the campaign period of March, april and May.

Local HBAs celebrate anniversaries

The Home Builders Association of Raleigh-Wake County celebrated its 50th

anniversary this year with a grand celebration June 11. In the photo at top left are many of the HBa’s past presidents, along with current president Richard Gaylord (second from left).

The Home Builders Association of Winston-Salem also celebrated 50 years in grand style June 23, when 23 HBawS Past Presidents (pictured at bottom left) were recognized during a special ceremony. Not only has the HBawS been active locally, it was one of seven associations that recommended the charting of NCHBa in 1963. Since that time, HBawS has had more NCHBa Presidents than any other association in the state, including Phil Robinson, James w. (Bill) lester, Herschel Redding, Harris Gupton and Paul Mullican. NaHB Chairman Joe Robson (pictured tenth from left on back row) joined the group to bring congratulations from the national level.

succeeds John Q. Beard, who announced his retirement earlier this year.
