Item No. 41 :— Appointment of Independent Consultant (IC) to independently monitorthe work of the Public Private Partnership Project in Collection,Segregation, Transportation & Delivery of MSW in 6 MCD Zones i.e.Karol Bagh Zone, City Zone, Sadar Pahar Ganj Zone, West Zone, CentralZone & South Zone.

For improving the Solid Waste Management Services in the GNCTD, the MCD in pursuant toSection 201 of the DMC Act, 1957 (amended upto date), upon receipt of authorization from StandingCommittee/Corporation in the form of Resolution No. 322/434, 314/431 and 313/430 respectively, hasalready implemented the work of “Public Private Partnership Project on Design, Procure, Renovate,Operate, Maintain and Transfer (DPROMT) basis, to carry out the functions of collection, segregation,Transportation and Delivery of Municipal Solid Waste in Six MCD Zones namely Karol Bagh Zone, CityZone, Sadar Pahar Ganj Zone, West Zone, Central Zone & South Zone, since the year 2005. Theaforesaid PPP Project at present is in operation in MCD Zones namely Karol Bagh Zone, City Zone,Sadar Pahar Ganj Zone, West Zone, Central Zone & South Zone (main project) through following privateconcessionaires. The jurisdiction of each private concessionaire is defined as here below :—

> Delhi Waste Management (P) Ltd. : South, Central & City Zone> A.G. Enviro Infra Projects (P) Ltd. : K.B. Zone & S.P. Zone> Metro Waste Handling (P) Ltd. : West Zone

As provided for in the concession Agreement Article 4, an Independent Consultant is to beappointed by MCD for the purpose of monitoring of the project. The term of earlier appointed IndependentConsultant, has already been expired. The role and activities of the Independent Consultant are detailedout in the Concession Agreement and RFP of this work. The Independent Consultant is to be appointedthrough an Open bid process.

Accordingly, for appointment of New Independent Consultant, RFP was invited vide No.E.E.(DEMS)P&M/2011-12/RFP-01 dated 13-10-2011 with last date of download/purchase of RFP upto8-11-2011 which was later extended upto 28-11-2011 with the approval of Competent Authority. Widepublicity was given through National Newspaper and MCD website, the detail of publication in Newspaperis as follow :—

Four bidders purchased RFP documents and raised certain queries in Pre-bid meeting, held on28-11-2011 at 3-00 PM, which were later duly replied with the permission/approval of CompetentAuthority and agreed suggestions were incorporated in the RFP. M/s. MSV International Inc. is the lowest bidder [Ll] and its quoted rates is Rs. 2,48,18,400/-(Rs. two crore forty eight lacs eighteen thousand & four hundred only) inclusive of everything except theService Tax.

Justification of rates calculated and duly checked by SW/DEMS works out to beRs. 2,15,15,580/- (Rs. two crore fifteen lacs fifteen thousand five hundred & eighty only) inclusive ofeverything except the Service Tax. As the justified rates are lower than the lowest quoted rates i.e.Rs. 2,48,18,400/-, M/s. MSV International Inc. was called for negotiation vide letter No. 171/EE/DEMS/P&M/2012-13 dated 3-4-2012, so as to bring their rates within the ambit of justified rates.

Negotiations were held on 4-4-2012 at 12-00 Noon in the chamber of C.E.(DEMS)-II and inthe presence of C.E.(DEMS)-II, S.E.(DEMS)-III, A.C.A. (DEMS), Acctt.(DEMS)P&M&T.C.(DEMS)P&M and where M/s. MSV International reduced its rates finally amounting to Rs. 2,15,00,000/- +Service Tax as applicable. Now the rates are reasonable and are recommended for acceptance ofCompetent Authority.

The initial term of the Independent Consultant shall be 3 years or actual date of termination ofmain project (whichever is earlier). The term may be renewed/extended for a period not exceeding2 years at a time.

Although integrated tender has been invited in the erstwhile MCD for monitoring the work ofthe Public Private Partnership Project in Collection, Segregation, Transportation & Delivery of MSW inerstwhile 6 MCD Zones i.e. Karol Bagh Zone, City Zone, Sadar Pahar Ganj Zone, West Zone, CentralZone & South Zone, now since the erstwhile MCD has been trifurcated and K.B. Zone, S.P. Zone & CityZone falls in N.D.M.C. jurisdiction and West Zone, Central Zone & South Zone in S.D.M.C. jurisdiction,therefore separate agreements needs to be done by respective corporations for paying fee to shortlistedL1 bidder proportionately on the basis of No. of wards falling in respective corporations.

Accordingly, proposal was submitted before Commissioner/NDMC and Commissioner/SDMCfor approval and the same was accorded. Now the approved revised conditions for entering into contractwith L1 bidder (M/s. MSV International Inc.) shall be as follow :—

1. Separate agreement with the L1 bidder shall be done by NDMC and SDMC in theproportion given below. However letter of intent (LOI) shall be issued by NDMC :

L1 bidder M/s. MSV International reduced its rates finally amounting to Rs. 2,15,00,000/-+ Service Tax as applicable, for 36 Months. The contract fees is to be shared byCorporation and the private concessionaire in 50:50 proportions (50% jointly by respectiveCorporation: 50% by private concessionaire M/s. DWM 25%, M/s. AG Enviro : 16.67%and M/s. Metro Waste 8.33%).

Total rate of L1 bidder for 36 months = Rs. 2,15,00,000/- + Service Tax

Total rate of L1 bidder for 01 month = Rs. 2,15,00,000/- ÷ 36 + ServiceTax= Rs. 5,97,222/- + Service Tax

50% joint share of NDMC & SDMC = 5,97,222 ÷ 2 = 2,98,611/- + Service Tax

Proportionate fee per ward = 2,98,611÷117 = Rs. 2552.23 + Service Tax

Therefore proportionate share of NDMC & SDMC shall be :—

NDMC share = 36 wards @ Rs. 2552.23 = Rs. 91880.28 per month

Say Rs. 91,880/- + Service Tax for One Month

Or

Rs. 33,07,680/- for Three Years

SDMC share = 81 wards @ Rs. 2,552.23 = Rs. 2,06,730.63 per month

Say Rs. 2,06,731/- + Service Tax for one month

Or

Rs. 74,42,316/- for Three Years

2. All other provision in the tender condition, such as taking performance security etc.from the proposed L1 bidder, shall also be proportionately divided as 30.77% and69.23% between NDMC & SDMC respectively :

The L1 bidder has given his consent for entering into a separate agreement with both theMunicipal Corporation namely, North Delhi Municipal Corporation and South Delhi Municipal Corporationvide letter No. MSV/PRJ/MCD/2012-13569 dated 22-8-2012.

Ll bidder has further agreed to extend the validity of his rates upto 28-2-2013.

As per order issued by Secretary (UD) and Director of Local Bodies vide No. PS/Secy./UD/2012/Pt. 1/491-97 dated 18-4-2012, there are 21 posts in the Unified Cadre of Senior Audit Officer. As pernotified RRs for the post of Senior Audit Officer, two years regular service in the Cadre of Audit Officeris required for regular promotion as Senior Audit Officer. At present 17 officers are working as SeniorAudit Officer on regular basis.

North Delhi Municipal Corporation vide their Resolution No. 70 dated 3-9-2012(Annexure ‘A’) had approved the promotion/regularization of 9 Audit Officers as Senior Audit Officers inthe Pay Band 3 : Rs. 15600-39100 with Grade Pay of Rs. 5,400/- on regular basis w.e.f. 16-5-2012/date oftaking over the charge.

Besides these 9 Audit Officers, Sh. Rishi Ram Gupta, Senior Audit Officer (ad hoc) who wasat Sl. No. 3 (above Sh. Manoj Kant Bhatnagar at Sl. No. 4) was also considered for regularization tothe post of Senior Audit Officer. However, since one, out of two RDA Cases, was pending against him,in his case, the recommendation of DPC dated 16-5-2012 was kept in “Sealed Cover”. In the subsequentDPC held on 14-1-2013 the findings were again kept in ‘Sealed Cover’ as the one RDA against himwas still pending. The other 4 eligible Audit Officers were granted promotion as Senior Audit Officeras per approval of North Delhi Municipal Corporation vide their Resolution No. 272 dated 18-2-2013(Annexure ‘B’).

The Departmental inquiry proceedings of both the cases against Sh. Rishi Ram Gupta, SeniorAudit Officer (ad hoc) have now been completed and as per decision of the Disciplinary Authority he hasbeen fully exonerated in both the cases.

Para 17.6.1 of Chapter 3 of Swamy’s Compilation on Seniority and Promotion in CentralGovernment Service provides that ‘On the conclusion of the disciplinary case which results in dropping ofallegations against the Government Servant, the Sealed Cover or covers shall be opened. In case theGovernment Servant is completely exonerated, the due date of his promotion will be determined withreference to the position assigned to him in the findings kept in the Sealed Cover/Covers and withreference to the date of promotion of his next junior on the basis of such position.

Accordingly, the Sealed Cover dated 16-5-2012 has now been opened and as per findings keptin Sealed Cover, the DPC had recommended his case as ‘Fit for Promotion’ and he was assigned theposition above his next junior Sh. Manoj Kant Bhatnagar, Senior Audit Officer.

The Office of the Chief Auditor is still functioning as a combined Audit Office for North,South and East Delhi Municipal Corporations. Therefore, being the lead Corporation the North DelhiMunicipal Corporation through the Standing Committee of North Delhi Municipal Corporation may berequested to approve the promotion of Sh. Rishi Ram Gupta, Senior Audit Officer (ad hoc) in the PayBand 3 : Rs. 15600-39100 with Grade Pay Rs. 5,400/- on regular basis with effect from 16-5-2012 i.e. thedate from which his immediate junior Sh. The material will be auctioned as per terms and conditions as per Annexure ‘C’.

Finance has seen and concurred in the proposal.

The matter may be placed before the Corporation through Standing Committee for approval ofthe recommendation of the Condemnation Board to declare these J.C.Bs. and Jetting machine and tippertrucks etc. and spare parts condemned and to accept the reserve price fixed for each vehicle and spareparts. The auction Board may be authorized to accept the highest bid at the spot, if it is more than thereserve price, get the full amount deposited and allow the highest bidder to remove the auctioned articlesas per terms and conditions for the auction.

As such to streamline the procedure to Condemnation and Auction of the Municipal vehiclesand used spare parts, the following Board is hereby proposed :—

The finance has concurred.The case may be placed before the Standing Committee to approve the Condemnation and

ANNEXURE ‘C’

TERMS & CONDITIONS FOR THE AUCTION

1. Auction bid will be strictly on terms on as “As is where is basis”.

2. Intending bidder shall deposit earnest money of Rs. 10,000/- in cash or Bank Draft withthe Cashier. Failing which no one shall be permitted to participate in the bid. The earnestmoney will be returned subject to Condition No. 5.

3. Materials will be auctioned in lots on the spot. The full amount of the lot will be depositedat the fall of hammer with the Cashier immediately, so that auction for other lot could bestarted.

4. The highest bid is subjected to the acceptance by the Auction Board/Chairman on thespot.

5. If the highest bidder fails to deposit 100% of the bid at the fall of the hammer. His earnestmoney will be forfeited and bid of the second highest may not be accepted by theChairman of the Auction Board.

6. The highest bidder shall remove the condemned materials at his own cost within 4 daysafter acceptance from the premises, otherwise demurrage charges @ 1% of the highestbid per day of delay will be levied up to the maximum of 10% of the cost.

7. Auction Board reserve the right to reject the bids without assigning any reason.

8. Parties should arrange to take delivery of the auctioned material within the stipulatedperiod after accepting the bid by the competent authority.

9. The successful bidder must produce cash receipt (G-8) and acceptance letter issued byEE(Auto) before taking delivery. In the event of loss of cash receipt. M.C.D. will not beresponsible for delivery.

10. In case of any dispute arising during the conduct of auction, the decision of the Chairmanwill be binding on the parties.

of completion of this work is Six months reckoned from the 10th day of issue of work

order. Rates are valid upto 31.05.2013.

These are the main link roads connecting Aryapura from Roshanara Road in Malka Ganj Ward C-9/CLZ. During the inspection of the area along with Hon’ble M.P. Sh. Jai Prakash Aggarwal, area MLA and MCD officials. During the inspection it was decided to improve the riding quality of roads by providing 25mm thick mastic asphalt after correcting the surface. The area MLA have given budget out of his constituency funds of AC-3 under Head of A/c XL-VIII-S.

Accordingly, an estimate amounting to Rs. 43,21,200/- has been have been prepared to cover the cost of the above said work under head of account XL-VIII-S. Administrative approval and expenditure sanction to this estimate was accorded by Wards Committee, Civil Line Zone vide resolution No. 17/15 dated 20.12.2012.

Tenders for the above said work amounting to Rs. 39,38,871/- were invited through E-tendering system vide NIT No. EE(M-II)/CLZ/TC/2012-13/36, item No. 1 dated 28.01.13, vide tender No. 182126 after giving wide publicity in the following news papers :-

The total cost of this work comes to Rs. 33,11,000/-(Rest.) due to UD Amt.) chargeable to Head of A/c XL-VIII-S. The time of completion of this work is five months and the rates are valid upto 14.07.13.

Being ABNORMALLY LOW RATE CASE 100% Test Check by AE and 50% Test Check by EE-concerned is required.

reasonable & well within the justification of rates. Hence, recommended for acceptance. 

M/s. Satya Constructions is a registered contractor under Class‐III/ M.C.D. and is eligible 

to tender for this work. The firm is not black listed/debarred as on date. The contractual amount 

of the work comes to Rs. 1,42,90,159/‐. The time of completion of the work is 12 months to be 

reckoned from the 10th day after issue of the work order. The validity of rates is available upto
