4. The bidders downloading the tender document are required to deposit the cost of tenderdocument of Rs. 1050/- (Non refundable) in form of DD or Cash receipt in the name of‘A.O. (Cash) O/o DGMM BSNL Kanpur’ payable at Kanpur along with their tender bid,failing which the tender bid shall be rejected.

The bidders (Small scale units) who are registered with National Small Scaled IndustriesCorporation under Single Point Registration scheme are exempted from cost of tenderform and earnest money subject to the following-

1. A proof regarding current registration with NSIC for the tendered items will have to beattached along with the bid.

2. The enlistment certificate issued by NSIC is not permanent and required be renewedwithin two years of its presentation.

3. The units claiming concession of NSIC as required have to submit its monthly turnover in support of claim for meeting the delivery schedule.

4. The SSI units registered with NSIC for the tendered items may be given exemptionfrom payment of Bid Security to the extent of their approved monitory limit or Rs. 50(Fifty) lacs whichever is lower. However, in case of purchase of tender document if thevalue of tender is more than their monitory limit, they are not entitled to free tenderdocument.

8. Eligibility Conditions: The prospective bidder should satisfy following conditions.a) He should have experience of having completed similar type of O.F. Cable

work of at least 10 km of O.F. Cable underground in PLB pipe duct inBSNL/MTNL/ PSU/Govt. department/private telecom operators with aggregatecost of at least Rs. 20 lakh (in all) during last three consecutive financial years.The experience certificate should be issued by an officer of rank of

Addl.GMM/DGM or equivalent level/designation or above.In case of private telecom operators the experience certificate should beissued by an official not below Project Head/ C.T.O. of the circle.

OrHe should have valid registration for valid category with BSNL for

Underground Cable/ O.F. cable Works.Or

Contractors exclusively enlisted by BSNL for HDD/ Microtunneling work havingwork experience in BSNL/MTNL/PSU/Govt. department for at least 10 Kms (in all)during last three consecutive financial years.b) He should have either in the name of the firm OR on lease HDD machinecapable of boring 200 meter in a single stretch.c) He should have blowing machine either in the name of the firm OR onlease.d) He should have splicing machine either in the name of the firm OR on lease.e) For ownership of HDD machine, Blowing Machine, and splicing machine,the contractor should submit documents showing:i) Make of HDD machine, Blowing Machine, and Splicing Machine, its SerialNo. & capacity.ii) Bill of lading and Custom clearance receipt.

f) Those having HDD machine, Blowing Machine, and Splicing Machine onlease should enclose lease deed which should be valid for at least one year fromdate of opening of tender in addition to mentioning make of HDD machine, BlowingMachine, and Splicing Machine, its capacity and Serial No.g) Firm should have valid Service Tax registration

h) Contractor should have valid statutory registration like labour and EPF, etc. ofhis firm in respect of labours/employees employed by the contractor for theexecution of works.i) Self attested Photo Copy of PAN Card of the firm/proprietor.j) Latest Income Tax Return of the firm/proprietor.

9. Following documents are required to be submitted with Technical bid:(I) Technical bid: - Technical bid should invariably contain-a. Bid Security (EMD) in accordance with the tender document in form of DemandDrafts/Cash receipt for the amount as specified in the above table.b. The copy of Enlistment certificate in valid category issued by the competentauthority duly attested or work experience certificate of having completed at least10 Kms of similar type of works in BSNL/MTNL/PSU/Govt. department withaggregate cost of at least Rs. 20 lakh (in all)/ Pvt operator during last threeconsecutive financial years or contractors exclusively enlisted by BSNL for HDD/Microtunneling work having work experience in BSNL/MTNL/PSU/Govt.department during last three consecutive financial years.c. Copy of the registration of the firm. Authenticated copy of partnership deed incases of partnership firm.

d. Bid Form, duly filled in, as per Section-II.

e. Tenderer’s profile duly filled in, of the tender document and attested copy of“Power of Attorney” in case person other than the tenderer has signed the tenderdocuments.

f. Copy of Service Tax registration certificate.g. For HDD works, documents such asI. Make Capacity and serial No. of HDD Machine, Splicing Machine & blowingMachine.II. Bill of lading.III.Custom clearance receipt to verify the ownership in case of those who ownHDD. Those having HDD machines on lease should enclose lease deed whichshould be valid for at least one year from the date of opening of tender. TheHDD Machine should be capable of boring 200 meter in a single stretch.

h. Bid document cost in the form of Demand Draft in case of bidder downloadingthe tender document from website.

j. Proof of statutory registrations wherever applicable in respect of labours /employees employed by the contractor for the execution of works.k. Self attested Photo Copy of PAN Card of the firm/ proprietor.l. Latest Income Tax Return of the firm/ proprietor.The list of total documents is given in section-XII which shall be submitted alongwith technical bid.Note- The contractors/ bidders will be bound to produce the original

documents as mentioned above whenever asked by BSNL forverification.

(II). Financial bid-Financial bid shall contain percentage rate quoted Below/At par/Above the Schedule ofRates for work item Nos. 1 to 28 given in the Quotation of Rates (Financial Bid). If thedocuments in the Technical bid are not as per requirement then the financial bid will notbe opened.

10. Since the work is of top priority and is, therefore, to be carried out in stipulatedtime, only contractors having sufficient resources to complete the work in timeneed to participate.Timely completion of work is the essence of the contract. Therefore, noextension will be granted under normal circumstances.

Four (4) weeks time has been provisioned for ROW/ permissions and organizinginitial setup to start the work.

The duration of completion of work shall be worked out based on execution ofwork at 1 Km per week on an average over the period.

11. Tender will not be accepted/received after expiry of due date and time. If it happens tobe a holiday on any of the dates above, next working day will be applicable.

12. It may be noted that if there is any discrepancy in NIT & Tender document, the termsand condition in the Tender Document will prevail.

13. The contractor shall have to coordinate with various authorities. No separate chargeswill be paid for getting permission. However, the payment of actual ROW/Permissioncharges for reinstatement to Government agencies concerned will be made by BSNL.

14. Before quoting the rate, the contractor is advised to do physical survey of the route forunderground utilities and probable hindrance or difficulties likely to be encounteredduring execution of the work.

15. All payments (Cost of Tender Document/ EMD/ SD etc.,) to BSNL shall be in the form ofDD/Pay order drawn on or after the date of publication of NIT from Scheduled / NationalizedBank in favour of Accounts Officer (Cash), O/o DGMM, BSNL Kanpur. Non MICR DDs will notbe accepted.

16. The tender, which is not accompanied by the requisite bid security, shall be summarily rejected.Tender will not be accepted/received after expiry date and time.

SECTION-IVINSTRUCTIONS TO BIDDERS

INTRODUCTION :

4.1 The tenderer must read carefully all the terms, conditions and specifications beforefilling up the Tender Schedule and his Quotation. Tenderers are requested to get wellversed with the tender conditions/ guidelines written hereunder. Those tenderers whocannot read English may get it translated at their own risk, in a language known tothem and understand the conditions. Any clarification required can be had from theDivisional Engineer concerned, in whose division the tender is called, who is theauthorized representative of the “BSNL”, or the Sub Divisional Engineers or any otherofficer/ official working with him, who may be authorized by him to supervise andoversee the work on his behalf.

4.2 Time along with quality of work is the essence of this contract.

SITE INVESTIGATION BY THE TENDERER:

4.3 The prospective tenderers are advised to make a detailed survey of the routes andlocation for which they are quoting their rates in this tender. The tender shallinvestigate fully all hazards and safeguards against them. The restoration charges willbe paid by BSNL to the road authorities, on submission of estimate, if it is at standardrates. The rate quoted shall include all those factors into consideration.

4.4 It is assumed that the Tenderer has inspected the site and thoroughly analysed thesoil and sub soil conditions and the environment thereof in connection with theexecution of work specified and has made his offer after careful examination of thesurface, soil strata, sub soil and ground, the form and nature of site, general and localconditions particularly those bearing upon transportation, handling and storage ofmaterials, availability of labour, water and power, uncertainties of weather, condition ofground, the character of equipment and facilities needed during the execution of thework and all other matter which may be required for carrying out the work.

4.5 It is also assumed that these inferences are made after local inquiries regarding theabove said matters and also the probable and possible stipulations, delays, riskcontingent upon the nature of sub surface conditions, hindrances or interference to orwith the execution and completion of works as per tender conditions and has arrivedat his own estimate in respect of the rate quoted.

4.6 It is also assumed that the Tenderer has also taken into consideration all possiblecontingencies and likely problems and allied matters, incidental thereto and ancillarythereof affecting the execution and completion of work. Any of the excuses at a laterstage about his unawareness about the above mentioned conditions after the approval

of tender will not be considered. Any failure by the Tenderer in estimating the difficultyor cost properly shall not relieve him of the responsibility of completing or satisfactorilyperforming the work.

4.7 It may be noted that the estimated cost is only a rough assessment by the “BSNL” andthe “BSNL” does not link itself to its full correctness and neither the “BSNL” can beheld accountable for any variations, if any found actually. The tenderers are requiredto make their own detailed assessment and shall quote accordingly.

SIMULTANEOUS WORK IN DIFFERENT ROUTES

4.8 Work in each Division (or part thereof, if awarded so), will be treated as a separatework covered by separate Contract. A tenderer shall have the liberty to participate forthe tender in a single DEs Jurisdiction or in a number of DEs Jurisdictionssimultaneously, provided the Tenderer submits his bid separately for each route.However, if the tenderer is successful in multiple Divisions, and the work is awardedsimultaneously in all Divisions, the tenderer should have enough capacity andresources to carry out the work simultaneously in all routes awarded to him.

4.9 Tenderers who are confident of ensuring the progress of the work in the timestipulated in NIT, by employing the required resources, men and materials may onlyparticipate in this tender offer. The attention of the Tenderer is specifically drawn tothe conditions regarding realization of Compensation for delay and slow progress,which may be strictly enforced by the Divisional Engineer as stipulated in the relevantclauses.

4.10 It is to be specifically noted that, the “BSNL” wants the work to be done simultaneouslyin as many routes as possible, so that the project can be completed in the shortestpossible time. Keeping the interest of the “BSNL” in mind, the competent authority hasfull discretion to award the entire work or part of the work in any route to one or moreTenderers, or to carry out the work by “BSNL” itself or through any other agency byinviting tender/ quotations or by nominations from other reputed and experiencedContractors or by any other means.

DEFINITIONS

4.11 BSNL : The Bharat Sanchar Nigam Limited (A Govt. of India Enterprise)

4.12 Corporation: The Corporation means the Bharat Sanchar Nigam Limited, aGovernment of India Enterprise, under the Ministry of Communications, which invitesthe tenders on behalf of the BSNL. All references of :

4.13 The Additional General Manager (NTR) means the Additional General Manager,Northern Telecom Region, Kanpur and his successors.

The Jurisdiction of the Additional General Manager (NTR) means Jurisdiction of Addl.GM Northern Telecom Region Kanpur.

4.14 Representative of Additional General Manager (NTR): Representative of theAdditional General Manager (NTR) means officer and staff for the time being in theAdditional General Manager, Northern Telecom Region, Kanpur deputed by theAdditional General Manager (NTR) for inspecting or supervising the work or testingetc.

4.15 Engineer – In – Charge: The Engineer – In – Charge means the Engineering Officernominated by the BSNL, NTR to supervise the work, under the contract. (MinimumSDE level Officer).

4.16 Site Engineer: Site Engineer shall mean an SDE/ JTO of the Corporation who may beplaced by the Divisional Engineer / Additional General Manager(NTR),as in- charge ofthe work at site at any particular period of time.

4.17 A/T : A/T shall mean Acceptance and Testing by BSNL.

4.18 A/T Officer : An Officer authorized by BSNL to conduct A/T.

4.19 Contract : The term contract means, the documents forming the tender andacceptance thereof and the formal agreement executed between the competentauthority on behalf of the BSNL and the contractor, together with the documents

referred to therein including these conditions, the specifications, designs, drawingsand instructions issued from time to time, by the Engineer- In-charge and all thesedocuments taken together shall be deemed to form one contract and shall becomplementary to one another. In the contract, the following expressions shall, unlessthe context otherwise requires, have the meanings, hereby respectively assigned tothem. The expression works or work shall unless there be something either in thesubject or context repugnant to such construction, be construed and taken to meanthe works by or by virtue of the contract contracted to be executed whether temporaryor permanent, and whether original, altered, substituted or additional.

4.20 Contractor : The Contractor shall mean the individual, firm or company, , whetherincorporated or not, undertaking the works and shall include the legal personalrepresentative of such individual or the persons composing such firm or company, orthe successors of such firm or company and the permitted assignees of suchindividual assignees of such individual, firm or company.

4.21 Work: The expression “works” shall unless there be something either in the subject orcontext repugnant to such construction be construed and taken to mean the works byor by virtue of the contract, contracted to be executed whether temporary orpermanent and whether original altered, substituted or additional.

4.22 Schedule(s): The Schedule(s) referred to in these conditions shall mean the relevantschedule(s) or the standard schedule of rates mentioned in the document.

4.23 Site : The site shall mean the land /or other places on, into or through which work isto be executed under the contract or any adjacent land, path or street through which,the work is to be executed under the contract or any adjacent land, path or streetwhich may be allotted or used for the purpose of carrying out the contract.

4.24 Normal time or Stipulated Time: Normal time or Stipulated time means timespecified in the work order to complete the work.

4.25 Extension of Time: Extension of Time means the time granted by the BSNL tocomplete the work beyond the normal time or stipulated time.

4.26 Date of Commencement of work: Date of commencement of work means the dateof actual commencement of work or 7th day from the date of issue of work order,whichever is earlier.

4.27 Due date of completion: Due date of completion shall be the date by which the workshall be completed at site including clearance of site.

4.28 Duration of completion of work : The duration of completion of work or completiontime shall be time specified in the work order plus extension of time granted, if any.

4.29 Excepted risk : Excepted risk are risks due to war (whether declared or not),invasion, act of foreign enemies, hostilities, civil war, rebellion, revolution, insurrection,military or usurped power, any acts of Government, damages from aircraft, acts ofGod, such as earthquake, lightening and unprecedented floods and other causes overwhich, the contractor has no control and the same having been accepted as such, bythe Accepting Authority or causes solely due to use or occupation by the governmentof the part of the work, in respect of which a certificate of completion has been issued.

4.30 The Invitation of bids is open to all as per their eligibility mentioned in NIT of thistender document.

4.32 The Bidder is expected to examine all instructions, forms, terms and specifications inthe bid documents. Failure to furnish all information required as per the BidDocuments or submission of bids not substantially responsive to the Bid Documents inevery respect will be at the bidder’s risk and shall result in rejection of the bid.

QUERIES ON BID DOCUMENTS :

4.33 A prospective bidder, requiring any clarification of the Bid Documents shall notify theCorporation in writing or by fax or by telegram at the Corporation’s mailing addressindicated in the invitation for Bids. The Corporation shall respond in writing to anyrequest for clarification of the Bid Documents, which it receives not later than 7 daysprior to the date for the opening of the bids. Copies of the query (without identifyingthe source) and the clarifications by the Corporation shall be notified in the web sitehttp://tenderwizard.com/BSNL or http://www.ntr.bsnl.co.in andhttp://www.tender.bsnl.co.in. and all such clarification issued by the corporation willform part of the bid document.

AMENDMENT OF BID DOCUMENTS :

4.34 At any time, prior to the date for submission of bids, the Corporation may, for anyreason whether SUO MOTTO or in response to a clarification requested by aprospective Bidder, modify the Bid Documents by amendments.

4.35 The amendments shall be notified in our web site http://tenderwizard.com/BSNL orhttp://www.ntr.bsnl.co.in and http://www.tender.bsnl.co.in and these amendments willbe binding.

4.36 In order to afford prospective bidders reasonable time to take the amendments intoaccount in preparing their bids, the Corporation may, at its discretion, extend thedeadline for the submission / opening of bids suitably.

PREPARATION OF BIDSCOST OF BIDDING :

4.37 The bidder shall bear all costs associated with the preparation and submission of thebid. The Corporation, will in no case, be responsible or liable for these costs,regardless of the conduct or outcome of the bidding process.

DOCUMENTS ESTABLISHING BIDDER’S ELGIBILITY AND QUALIFICATIONS :

4.38 The bidder shall furnish, as part of his bid documents establishing the bidder’seligibility, the following documents :

I. Bid Security in accordance to Clause 4.39 to 4.41.

II. Copy of PAN card (Income Tax card)

III. The registration of the firm. Authenticated copy of partnership deed in cases ofpartnership firm.

IV. Solvency certificate from the banker of the tenderer – up to works costing Rs.20lacs is Rs 2 lacs; For works costing more than Rs 20 lacs is Rs 5 lacs, whichshould be valid for current financial year.

V. Bid Form, duly filled in as per Section II.

VI. Tenderer’s profile, duly filled in as per Section III of the tender document.

VII.Original “Power of Attorney” in case person other than the tenderer has signed thetender documents.

VIII. Certificate by the contractor to the effect that he is not near relative of anyBSNL employee.

IX. Proof of EPF registration wherever applicable in respect of labours/employeesemployed by contractor to the execution of work.

X. Experience certificate as per eligibility conditions.

BID SECURITY :

4.39 The bidder shall furnish, as part of his bid, a bid security (EMD) as specified in theNIT. No interest shall be paid by the Corporation on the bid security for any period,what so ever.

4.40 The bid security is required to protect the Corporation against the risk of biddersconduct, which would warrant the security’s forfeiture, pursuant to Clause 4.45 to 4.48.

4.41 Bid Security shall be paid in the form of Crossed Demand Draft issued by aNationalized/Scheduled bank, drawn for the amount and in the manner indicated inthe NIT/ Part I of the Tender Document.

4.42 A bid not secured in accordance with Clause 4.39 to 4.41, shall be rejected bythe Corporation as non-responsive.

4.43 The bid security of the unsuccessful bidder will be refunded as promptly as possible,but not later than 30 days after the expiry of the period of bid validity prescribed by theCorporation.

4.44 The successful bidder’s bid security will compulsorily be converted to form part ofperformance security deposit in accordance with the relevant Clause.

4.45 The bid security shall be forfeited and the Acceptance of the Tender shall be re-considered and revoked under the following conditions. The Tenderer may bedebarred from participating in similar tenders of Addl. GMM, NTR Kanpur orNTR or BSNL for a period of up to One Year from the date of issue of the orderfor revocation;

4.46 If a bidder withdraws his bid during the period of bid validity specified in the biddocument or

4.47 If the bidder makes any modifications in the terms and conditions of the tender beforeacceptance of the tender, which are not acceptable to the Corporation or

4.48 In case of successful bidder, if the bidder fails :

(i) To sign the agreement in accordance with the relevant clause, or(ii) To furnish Material Security in accordance with relevant clause.

BID PRICES :

4.49 The bidder shall quote the rate in the Tender schedule for excavation to a full depth of165 cm, including charges for reinstatement and coordination for getting Right of Way(ROW) permission etc.

4.50 The contractor shall be responsible for transporting the materials, to be supplied bythe Corporation or otherwise to execute the work under the contract, to site at his/their

own cost. The costs of transportation are subsumed in the standard Schedule Ratesand therefore no separate charges are payable on this account. The offer shall be firmin Indian Rupees.

4.51 Prices shall be quoted by the bidder, both in words and figures; in the Financial bid ofthe document only. Prices quoted at any other place shall not be considered.

4.52 The price quoted by the bidder shall remain fixed during the entire period of contractand shall not be subject to variation on any account. A bid submitted with anadjustable price quotation will be treated as non-responsive and rejected.

PERIOD OF VALIDITY OF BIDS :

4.53 Bid shall remain valid for 240 days from date of opening of the bid. A BID VALID FORA SHORTER PERIOD SHALL BE REJECTED BY THE CORPORATION AS NON-RESPONSIVE.

4.54 The rates quoted in the bid shall be firm and valid for any other work order forextension of the same route or modification of the route or branching in case of spurroutes that may be issued within the above period and remain so until the completionof the work assigned under such a work order.

4.55 Submission of Bid. (Being e-tender)i). Bid cost (i.e. Tender fee), Bid security (i.e. EMD), Power of Attorney as per clause (if

applicable)- All in original have to be submitted before 13:00 Hrs of the day of e-bidopening. The same may be sent through courier or in person. The scanned copies of thebank Guarantee and DD have to be attached in the E-tendering portal i.e.www.tenderwizard.com/BSNL.

Technical Bid:Scanned copies of the required document as per clause have to be uploaded on thee-tendering website i.e. www.tenderwizard.com/BSNLFinancial Bid: (price schedule)Financial e-bid containing the price schedule in the excel format has to be filledcarefully in the financial bid e-portal i.e. www.tenderwizard.com/BSNL.Venue of tender opening: Tender shall be opened through Public Online Tender

The bidder should submit all the documents as mentioned in clause 4.55 (i) physically inoriginal in a envelope and this envelope superscripted “Tender for PLB pipe layingworks” along with tender No. in the O/o SDE (Tech) NTR Kanpur. This envelope is to beduly sealed. No indication of the prices will be made in the Technical Bid.

iii). Tenders will be opened on the due date of opening i.e. 1400 Hrs. on 25.10.2016 by anauthorized committee. The opening can be attended by either bidders or his/herauthorized representative only. However only one person per bidder shall be allowed toattend the meeting. Technical Bids of the tenders received will be opened on that day. TheFinancial Bids of only those bidders whose Technical Bid is found qualifying, afterevaluation of details and documents furnished shall be opened and will be such biddersintimated separately. No correspondence in this regard will be entertained. Incompletetender or tender in which both Technical bid and Financial bids are found in the same

envelope shall be rejected.

iv). Bidder shall furnish the documents as per Technical Bid Form as per section XII.v). Rates should be quoted as per the Schedule of Requirement at Section-XIV and should be

enclosed to Financial Bid Form. The format for Financial Bid should not be changed in anymanner. Addition / deletion / alteration of the text will automatically render the tenderinvalid and therefore, will be summarily rejected.

vi). The duly filled tenders must be accompanied with EMD in the form of Demand Draft infavor of ‘Accounts Officer, O/o DGMM, BSNL Kanpur’ payable at Kanpur OR originalcash receipt from the A.O. O/o DGMM, BSNL, Kanpur.

vii). The bidder is requested to examine all instructions, forms, terms and specification in the Biddocuments. Failure to furnish all the information required as per Bid Documents orsubmission of the bids not substantially responsive to the Bid Documents in every respectwill be at the bidder’s risk and may result in rejection of the Bid.

viii). A prospective bidder requiring any clarification on the Bid document shall notify in writing.The BSNL shall respond in writing to any request for the clarification of bid documentwhich it receives not later than 7 days prior to the date of opening of Tender.

ix). At any time, prior to the date of submission of bid, BSNL may, for any reason whether at itsown initiative or in response to a clarification required by a prospective bidder, modify thebid documents by amendments.

x). The amendments shall be notified through website and these amendments will be binding.xi). The bidder shall bear all costs associated with the preparation and submission of the bid.

BSNL in no case be responsible for these costs regardless of the conduct or outcome of thebidding process.

SUBMISSION OF BIDS :

4.56 Postponement of Tender opening: Whenever it is considered necessary topostpone the opening date of tenders, it will be placed in the web sitehttp://tenderwizard.com/BSNL or http://www.ntr.bsnl.co.in andhttp://www.tender.bsnl.co.in at least one day before the original date of opening. Thereasons for postponing the tender shall be recorded in writing. Such notice ofextension of date of opening shall also be put-up on the notice board and alsouploaded in websites in which original NITs have been uploaded. If the date ofopening of bids is declared as holiday, the bids will be opened on the next workingdate at the same time and venue.

4.57 The BSNL if subsequently declares date fixed for opening of bids as holiday, therevised schedule will be notified. However, in absence of such notification, the bids willbe opened on next working day, time and venue remaining unaltered.

LATE BIDS :

4.58 Tenders will not be received after the specified time or closing of the tender and thesame shall be rejected and returned unopened to the bidder. It is the soleresponsibility of the tenderer that he should ensure timely submission of tender.

BID OPENING:

OPENING OF BIDS BY THE CORPORATION:

4.59 The E-tender shall be opened and processed online through Public Online TenderOpening Event (POTOE) on http://www.tenderwizard.com/BSNL as per BSNLguidelines. However, documents submitted offline as per Clause 6.0 (page No. 07 ofPart-I) of E-Tendering Instructions shall be checked and verified physically by acommittee constituted for the purpose.

EVALUATION :4.60 Tender evaluation will be done by online by a committee constituted for the purpose.

The committee shall open financial bid of only those bidders whose technical bid hasbeen found qualifying. A comparative statement of all bidders will be generated by e-tender process

4.61 Technical and Financial Bids shall be evaluated in total to determine whether theyare complete, whether any computational errors have been made and whether bidsare generally in order.

4.62 If there is a discrepancy between words and figures the amount in words shall prevail.Prior to detailed evaluation, BSNL will determine the substantial responsiveness ofeach bid to the bid document. A substantially responsive bid is one, which conformsto all the terms and conditions of bid documents without material deviation. A biddetermined as substantially non-responsive will be rejected by BSNL.

4.63 The evaluation and comparison of responsive bids shall be on the basis of ratesoffered by bidders.

CONTACTING THE CORPORATION :

4.64 No bidder shall try to influence the Corporation on any matter relating to its bid, fromthe time of bid opening till the time the contract is awarded.

4.65 Any effort by the bidder to modify his bid or influence the Corporation in theCorporation’s bid evaluation, bid comparison or the contract award decisions shallresult in the rejection of the bid.

AWARD OF CONTRACT :

4.66 The Corporation shall consider award of contact only to those eligible bidders whoseoffers have been found technically, commercially and financially acceptable.

CORPORATION’S RIGHT TO VARY QUANTUM OF WORK :

4.67 The Corporation, at the time of award of work under the contract, reserves the right todecrease or increase the work by up to 25% of the total quantum of work specified inthe schedule of requirements without any change in the rates or other terms and

conditions.

CORPORATION’S RIGHT TO ACCEPT ANY BID AND TO REJECT ANY OR ALLBIDS :

4.68 The Corporation reserves the right to accept or reject any bid and to annul the biddingprocess and reject all bids, at any time prior to award of contract without assigning anyreason what – so – ever and without thereby incurring any liability to the affectedbidder or bidders on the grounds for the Corporation’s action.

ISSUE OF LETTER OF INTENT :

4.69 The issue of letter of intent shall constitute the intention of the Corporation to enter into the contract with the bidder. Letter of intent will be issued as offer to the successfulbidder.

4.70 The bidder shall, within the time specified in the letter of intent, or 10 days of issue ofLOI, whichever is more, give his acceptance along with Security Deposit or theamount indicated in the LOI, in conformity with clause 5.10 & 5.11 of Section-V andMaterial Security deposit in conformity with Clause 5.6 of section-V, provided with thebid documents.

SIGNING OF AGREEMENT :

4.71 The signing of agreement shall constitute the award of contract on the bidder. Theagreement with the successful bidder shall be signed by the Corporation within a weekof submission of acceptance letter and security deposit as per relevant clause above.

4.72 As soon as the tender is approved by the competent authority, the Bid securitydeposited (EMD) by the successful bidder shall be compulsorily converted in to thePerformance security deposit, which will be held by the Corporation till the completionof warranty period.ANNULMENT OF AWARD

4.73 Failure of the successful bidder to comply with the requirement of relevant clause shallconstitute sufficient ground for the annulment of the award and forfeiture of the bidsecurity, in which event, the Corporation may make the award to any other bidder atthe discretion of the Corporation or call for new bids.

4.74 If a contractor fails to start the awarded work or does not complete the work instipulated time period, the same work will be rescinded and straight away given toother approved contractor(s) at the risk and cost of the defaulter contractor and at thesole discretion of BSNL without giving further notice.

SECTION V

GENERAL (COMMERCIAL) CONDITIONS OF THE CONTRACT

APPLICATION :

5.1 The General condition shall apply in contracts made by the Corporation for theexecution of trenching and pipe laying works.

STANDARDS :

5.2 The works to be executed under the contract shall confirm to the standards prescribedin the construction practices.

PRICES :

5.3 Prices charged by the contractor for the works performed under the Contract shall notbe higher from the prices quoted by the contractor in his Bid.

5.4 Price once fixed will remain valid for the period of contract. Increase and decrease oftaxes/duties will not affect the price during this period.

SUBCONTRACTS :

5.5 The contractor shall not assign, sub contract or subject the whole or any part of theworks covered by the contract, under any circumstances.

SECURITY :

MATERIAL SECURITY :

5.6 The Successful tenderer will have to deposit material security of Rs. 2 lakh in the formof bank guarantee valid up to 18 months from a scheduled bank and in the materialsecurity bond form provided in Route-IX, of the bid document. Material security canalso be submitted in the form of Crossed Demand Draft or FDR drawn in favour ofBSNL in the similar manner as specified for EMD, and mentioned in NIT/ Part I. TheMaterial security will be a non-interest bearing deposit, for any period what so ever.

5.7 The contractor at any point of time will not be issued stores costing more thanmaterials security. If due to any reason more store has to be issued to the contractor,then the material security will be suitably enhanced. In this regard the decision of theAdditional General Manager (NTR) shall be final and binding.

5.8 The proceeds of the material security shall be payable to the Corporation as acompensation for any loss resulting from the contractor’s failure to handle properly thematerial issued to him under the contract.

5.9 The Material security shall be released/refunded within a fortnight from the date of thepayment of the last final bill of the work under the contract or final settlement ofmaterial account whichever is later on production of ‘no dues certificate’ from“Engineer-In-Charge”

SECURITY DEPOSIT:

5.10 The contractor whose tender has been accepted shall deposit an additional sum, atthe time of executing the Contract Agreement, which along with the EMD(compulsorily converted into security deposit) submitted with the tender, will make theinitial security deposit equal to 5% (five percent) of the estimated cost or acceptedtender cost whichever is higher in the form of DD/Pay order. Another 5 % will bededucted from the 1st running or final bill so that the total security deposit will be equalto 10 % (ten percent) of the estimated cost or accepted tender cost whichever ishigher.

5.11 The amount of Security Deposit will be total Security Deposit of all routes forwhich bids are submitted.

5.12 The proceeds of the security deposit shall be payable to the Corporation ascompensation for any loss resulting from the contractor’s failure to complete itsobligations under the contract.

5.13 The security deposit shall be refunded after expiry of warranty period of last workexecuted provided there are no recoveries to be made arising out of poor quality ofwork, incomplete work and/or violation of any terms and conditions of the contract asstipulated in the bid document.

5.14 No interest will be paid to the contractor on the security deposit.

ISSUE OF WORK ORDERS AND TIME LIMIT:

5.15 The work order shall be issued so as to include all items of works for the route allottedto the contractor as put in the NIT.

5.16 The work orders shall be issued by the Divisional Engineer in-charge of trenching andpipe laying works after examining the technical and planning details of the works to beexecuted.

5.17 If due to any reason partial work order is to be issued then the same shall be issuedwith the approval of an officer not below the rank of Additional General Manager.

5.18 The Divisional Engineer shall mention the time limit to execute the work order afterseeing the quantum of work and store availability position.

5.19 The Corporation reserves the right to cancel or modify the scope of work stipulated tobe carried out against the work order in the event of change of plan necessitated onaccount of technical reasons or in the opinion of work order issuing authority or theAdditional General Manager (NTR), the contractor is not executing the work at therequired pace.

PROGRESS OF WORK

5.20 The time allowed for carrying out the work as entered in the tender shall be strictlyobserved by the Contractor and shall be reckoned from the SEVENTH DAY after thedate on which the work order is issued to the contractor.

5.21 To ensure good progress of work during the execution of the work, the contractor shallbe bound to complete ONE-THIRD of the whole of the work before ONE-HALF of thewhole time allowed under the contract has elapsed, TWO-THIRD of the work beforethe WHOLE time allowed under the contract has elapsed. The slow progress duringthe initial period is allowed in consideration with the time required for arranging theinitial set-up for work.

5.22 If the contractor fails to start the work by the due date, after the issue of work order,(or) does not maintain the progress as mentioned above, the tender is liable to beterminated by BSNL without waiting for completion of the whole time allowed as “Timeis the essence of the contract”, and BSNL desires no time overrun in completion of theproject.

EXTENSION OF THE TIME LIMIT (EOT):

5.23 In each work order, the work order issuing authority shall specify the time allowed forcompletion of work consistent with the magnitude and urgency of work. The timeallowed for carrying out the work is to be strictly observed by the contractor and shallbe reckoned from seventh day from the date of issue of the work order, or an earlierdate if work is urgently required, and indicated in the work order.

5.24 In as much as “the time being deemed to be the essence of contract”, throughoutthe stipulated period of contract, the work is to be proceeded with all due diligence onthe part of the contractor.

Application for Extension of the Time and Sanction of Extension of Time (EOT) :

5.25 There may be some hindrances, other than covered under force majeure, whileexecution of work and in such cases the contractor shall apply in writing to theEngineer-In-Charge for extension of time (EOT), on account of which he desires suchextension within three days of occurrence of hindrance. The Engineer-in-Charge shallforward the request to the competent authority (an Officer of the rank JAG level in-charge of trenching and pipe laying work) with his detailed report and photocopy of thehindrance register within three days of receipt of request from the contractor. TheCompetent Authority is empowered to grant extension of time for completion of workon certain conditions. He shall exercise such powers, if the following conditions aresatisfied.

I. The Application contains the ground(s), which hindered the contractor in execution ofwork.

II. The Engineer-in-charge is of the opinion that the grounds shown for extension of timeare reasonable.

5.26 The competent authority shall consider the request keeping all the facts andcircumstances in view and shall grant extension of time, if in his opinion, there are

reasonable and sufficient grounds for granting such extension and the reasons fordelay are not ascribable to the contractor.

5.27 The Competent Authority may also grant extension of time for completion of work incases where reasons for delay are ascribable to the contractor, but such extension oftime shall be with LD Charges dealing with penalty for delays in execution of works.

5.28 The competent authority shall grant EOT with time period for completion of workexpressly mentioned.

5.29 If the competent authority is of the opinion that the grounds shown by the contractorsare not reasonable and sufficient and declines to grant the extension of time, thecontractor cannot challenge the soundness of the opinion by reference to arbitration.The decision of the competent authority on period of extension of time or refusal forextension of time shall be final and binding on the contractor.

Grant of Extension of time without Applications :

5.30 There are, at times, practical difficulties like non-availability of materials etc, reasonsof which are ascribable to the Corporation. In such cases, the Engineer-In-Chargewith the approval of competent Authority to sanction EOT may issue extension of timesuomoto without waiting for contractor to make an application for EOT. Entry ofhindrances shall be made in the Hindrance Register. The BSNL will, however, not beliable to the contractor for any losses or damages, costs, charges, or expenses thatthe contractor may in any way sustain/suffer due to delay in making the aboveavailable.

MEASUREMENT,INSPECTION,TESTING,&ACCEPTANCE TESTING :

Measurement :

5.31 The measurement books are to be maintained by the Officer in-Charge of the work orhis immediate engineering subordinate not below the rank of Junior Telecom Officer.The entry shall be made in ink. No entry shall be erased. If a mistake is made, itshould be corrected by crossing out the incorrect words or figures and inserting thecorrections, the corrections thus made shall be initialed & dated by the Officerconcerned.

5.32 Responsibility of taking and recording measurements: The measurement ofvarious items of work shall be taken and recorded in the measurement book issuedwith each work order. The measurement shall be taken and recorded by an officer notbelow the rank of Junior Telecom Officer supervising the work. The Junior TelecomOfficer/Sub Divisional Engineer, directly responsible for supervision of work, shall beresponsible for accuracy of 100% of measurements. The Sub Divisional Engineerwhere Junior Telecom Officer is supervising officer shall be responsible for conductingtest check of 50% of measurements. The Divisional Engineer shall be responsible forconducting test check of 10% of measurements.

5.33 Method of recording of nomenclature of items : Complete nomenclature of items,as given in the agreement need not be reproduced in the measurement book forrecording the measurements but corresponding item code as provided, shall be used.

5.34 Method of Measurements: The measurements of the work shall be done for activitywise as and when the item of work is ready for measurement. The methods ofmeasurement of various items are enumerated as under :

Measurement of depth of trenches :5.35 The cable routes of one work order shall be divided into a number of segments each

of maximum 200 Meters length bounded by identifiable landmarks at both the ends ofthe segments. The measurement of depth shall be recorded at each point ofmeasurement (POM) in the measurement book in meters in the multiples of 5 cm. Forexample 97 cm will be recorded as 95 cm and 103 cm as 105 cm. The points ofmeasurements shall preferably be at an interval of 5 Meters, starting from 0 (Zero)meter in that segment provided the depth of excavation is uniform in that interval.

5.36 The efforts required to excavate trenches is not proportionate especially withreference to depth. Therefore, normally the workers tend to dig shallow trenches. Asstandard depth of the trench is important for future life and protection of cables, thistendency has to be discouraged. In order to encourage the contractor to achieve bestpossible depth in the face of site constraints, the following scale of payment shall beapplied for digging trenches of lesser depths, subject to condition that relaxation hasbeen granted by the competent authority for lesser depths.

Depth of Trench : 165 cm

Depth between Reduction in rate< 165 cm to>150 cm 5% of approved rates.

< 150 cm, to > 130cm 12.5% of approved rates.

< 130 cm to > 100 cm 25% of approved rates.

Below 100 cm 40% of approved rates

5.37 If the area is predominantly rocky or full of hindrances, the Addl. GM may decide tocall the tenders for a curtailed depth of 140/120 cm of trench. The rate reductionschedule for such trenches is given below. The sections where tenders are called forsuch lower depth will be specified in the NIT. In these sections also the nominal depthto be taken is 165 cms, in which case proportional rate for the larger depth will bepaid.

5.38 Depth of Trench : 140 cms

5.41 Measurement of lengths and profiles of strata and protection

The measurements of length of trenches are on running meter basis, irrespective oftype of soil encountered while digging.

The type of protection provided (Item code-wise) in a segment shall be recorded inthe measurement book in the sheet provided for this purpose.

5.42 The contractor shall sign all the measurements recorded in the measurement book.This will be considered as an acceptance by the contractor, of measurementsrecorded in the MB. In case contractor fails to attend at the measurements or fails tocountersign or to record the difference within a week, then in any such events themeasurements taken by Engineer-in-charge or by the subordinate as the case may beshall be final and binding on the contractor and the contractor shall have no right todispute the same.

5.43 The Divisional Engineer before passing the bill for sections covered by each set ofmeasurement may carry out test check by re-opening trench at as many locations asnecessary as specified in document ‘procedures for underground trenching and pipelaying’ and bills will be passed only when he is personally satisfied of the correctnessof entriesin the “measurement book” and also when he is satisfied of other aspects ofthe work as per the terms of the contract. The contractor shall provide the necessaryassistance of labour for re-opening of trench for test check by the Divisional Engineer.Separate payments shall not be made to the contractor for excavation of such testchecks, however such test pits shall not be more than 10% of the PLB pipe layingwork.

Inspection, and Quality Control :

5.44 The Quality of works : The importance of quality of trenching and pipe laying worksneed not be over-emphasized. The quality and availability of long distance media andefficiency of the reliable media connectivity to exchanges depends upon quality of

trenching and pipe laying. Further, the OF Cables are vulnerable to damages due towork of other agencies.

5.45 The quality of OF Cable plant depends upon the quality of individual items of workinvolved viz Depth of Cables laid, care while paving & laying, Protection, Jointing ofCables and Terminations in equipment room and at last but not the least ondocumentation of cable network. In order to ensure quality in cable construction work,each component of work needs attention. The works shall be carried out strictly inaccordance with specifications laid down to achieve the requisite quality aim.

5.46 It is imperative that the contractor(s) is/are fully conversant with the constructionpractices and shall be fully equipped to carry out the work in accordance with thespecifications. The contractors are expected and bound to ensure quality inconstruction works in accordance with specifications laid down. The contractor shallengage adequate and experienced supervisors to ensure that works are carried out asper specifications and with due diligence and in a professional manner. Thecontractors shall satisfy himself/themselves that the work conforms to the qualityspecifications before offering the same to A/T Wing for Acceptance Testing.

5.47 An assessment of extent of interest shown by the contractors in executing the workswith requisite quality shall be recorded and used in evaluating the contractor’sperformance Rating (CPR).

5.48 In addition to Acceptance Testing being carried out by A/T Wing and supervision byConstruction Officers, all works at all times shall be open to inspection of theCorporation. The Contractors shall be bound, if called upon to do so, to offer theworks for inspection without any extra payment.

5.49 Site Order Book: The site order book is one of the primary records to be maintained bythe JTO/ SDE supervising the work during the course of execution of works. Thenoting made by Officers as well as contractors, will form as basis for operation ofmany contractual clauses. The contractor shall remove all the defects pointed out bythe Corporation in the site order book. The site order book is to be maintained in theprescribed format. The Contractor or their authorized representatives shall also be atliberty to note their difficulties etc in these books. The site order book shall invariablybe consulted at the time of making final payments to the contractor.

Testing and Acceptance Testing :

5.50 The work shall be deemed to have been completed only after the same has beenaccepted by the A.T officer. The contractor shall make test pits at the locations desiredby A.T. Officer for conducting test checks without any extra payment. The Contractorshall restore the pits after test measurements to its original shape. The contractor shallbe responsible to provide test/measurement tools and testers for conducting varioustests.

5.51 Scope of Acceptance and Testing: The purpose of acceptance and Testing is toverify integrity of measurement and quality of work done. The A.T Officer shall not beresponsible for recording of measurements for the purpose of billing and contractual

obligations. However, if the measurements taken by A.T Officer are found to be lesserthan the measurements recorded by the Officer responsible for recording themeasurements, the measurement taken by A.T Officer shall prevail without prejudiceto any punitive action against the contractor as per provisions of the contract and theofficer recording the measurements. The contractor shall be obligated to removedefects/ deficiencies pointed out by A.T Officer without any additional cost to theCorporation.

5.52 Offering the work for acceptance and testing: The Sub Divisional Engineerresponsible for construction, after having satisfied himself of completion of work readyfor A.T, shall offer the work to A.T Officer for conducting Acceptance Testing. Thework shall be offered for A.T as soon as part of work is complete in all respects. Thework against any work order can be offered for A.T in a number of stages.

5.53 The contractor shall provide labour, if demanded by the A.T Officer for digging of testpits and other necessary infrastructure for carrying out the A/T work. No extrapayment will be made for the digging of test pit.

WARRANTY & DEFECTS LIABILITY

5.54 If the contractor or his working people or servants break, deface, injure or destroy (i)any building, road, road kerb, fence, enclosure, water pipe, cables, drains, etccontiguous to the area in which the work or any part is being executed (ii) or if anydamage shall happen to the work while in progress, from any cause whatever (iii) or ifany defect, shrinkage or any other faults appear in the work within a twelve monthsafter a certificate fin or otherwise of its completion shall have been given by theEngineer-in-charge as aforesaid arising out of defect or improper materials orworkmanship. The contractor shall upon receipt of a notice in writing on that behalfmake the same good at his own expense or in default the Engineer-in-charge causethe same to be made good by other workmen and deduct the expense from any sumsthat may be due or at any time thereafter may become due to the contractor, or fromhis security deposit or the proceeds of sale thereof or of a sufficient portion thereof.

5.55 The security deposit of the contractor shall not be refunded before the expiry of twelvemonths in case of works costing more than Rs. 10 lakhs, and six months in case ofworks costing less than Rs. 10 lakhs, after the issue of the certificate final orotherwise, of completion of work, or till the final bill has been prepared and passedwhichever is later.

5.56 In addition to any and all other guarantee and warranty mentioned in the contractdocuments the Contractor guarantees that the entire work will be done in asatisfactory manner and free from any defects in material, workmanship, constructionand finish and in conformity in all aspects with the Construction Specifications anddirections. The Contractor also undertakes to repair or replace as the case may be athis own cost and risk any part of the work which may be damaged or that may developany defects due to bad workmanship or otherwise due to the fault of the Contractor.

5.57 The contractor shall warrant that the work shall be of the highest grade and consistentwith the established and generally accepted standards for works of the type orderedand shall perform in full conformity with the specifications and drawings. Thecontractor shall be responsible for any defects that may develop under the conditions

provided by the contract and under proper use, arising from faulty materials, design orworkmanship such as corrosion of the material, inadequate quantity of materials, lowdepth, breakage of pipes etc. and shall remedy such defects at his own cost whencalled upon to do so by the Corporation who shall state in writing in what respect thework or stores are faulty. This warranty shall survive inspection or payment for, andacceptance of works, and or payment of Security deposit, but shall expire except inrespect of complaints notified prior to such date, twelve months after the written finalacceptance testing.

5.58 If it becomes necessary for the contractor to repair, replace or renew any defectiveportion/portions of the work under this clause, the provisions of the clause shall applyto the portion/portions work or material so repaired, replaced or renewed or until theend of the above mentioned period of twelve months, whichever may be later. If anydefect is not remedied within a reasonable time, as prescribed by the Corporation, theCorporation may proceed to do the work at the contractor’s risk and costs, but withoutprejudice to any other rights which the Corporation may have against the contractor inrespect of such defects.

5.59 Rectification under warranty clause shall be made by the contractor free of all chargesat site including freight, insurance, cost of works and other incidental charges.

AUDIT AND TECHNICAL EXAMINATION :

5.60 BSNL shall have the right to cause an audit and technical examination of the work andthe final bills of the contractor including all supporting vouchers, abstract etc., to bemade after payment of the final bill and if as a result of such audit and technicalexamination any sum is found to have been overpaid in respect of any work done bythe contractor under the contract or any work claimed by him to have been done byhim under the contract and found not to have been executed, the contractor shall beliable to the refund the amount of over payment and it shall be lawful for BSNL torecover the same from him in the manner prescribed in the relevant clauses, or in anyother manner legally permissible and if it is found that the contractor was paid lessthan what was due to him under the contract in respect of any work executed by himunder it, the amount of such under payment shall be duly paid by BSNL to thecontractor.

5.61 Provided that BSNL shall be entitled to recover any sum overpaid, nor the contractorshall be entitled to payment of any sum paid short where such payment have beenagreed upon between the Divisional Engineer or his subordinate officer on one handand the contractor on the other under any term of the contract permitting payment forwork after assessment by the Additional General Manager (NTR) or his subordinateofficer.

5.62 Any sum of money due and payable to the contractor (including security depositreturnable to him) under this contract may be appropriated by the BSNL for thepayment of a sum of money arising out or under any other contract made by thecontractor with the BSNL.

PAYMENT TERMS :

5.63 80% payment shall be processed on running bills based on certification of completionof PLB pipe laying work in the total length of 4 km & above in the awarded work.

5.64 90% payment (after adjusting 80% payment if paid) shall be processed by the site in-charge based on certification of completion of work in all respect in the awarded work.

5.65 100% full and final payment (after adjusting 90/80% payment if paid) shall beprocessed by the site in-charge based on acceptance of completion of work from thedesignated Inspection Circle officer in the awarded work& submission of materialaccount for the work.

5.66 The security deposit will be kept as per clause 5.10& 5.11.

5.67 Applicable levies and taxes, if any, for the said work will be paid to the approvedbidder with the 2nd running bill on production of receipt of payment of such taxes of the1st running bill.

Procedure for payment for sub standard works :

5.68 The contractors are required to execute all works satisfactorily and in accordance withthe specifications. If certain items of work are executed with unsound, imperfect orunskilled workmanship or with materials of any inferior description or that anymaterials or articles provided by him for execution of work or unsound or of a qualityinferior to that contracted for or otherwise not in accordance with the contract (referredto as substandard work hereinafter), the Divisional Engineer in-charge shall make ademand in writing specifying the work, materials or articles about which there is acomplaint.

5.69 Timely action by construction officers: Timely reporting and action, to a greatextent, can prevent occurrence of sub standard work, which will be difficult orimpossible to rectify later on. It is incumbent on the part of Construction Officers topoint out the defects in work in time during progress of the work. The Junior TelecomOfficer/Sub Divisional Engineer responsible for execution and supervision of workshall without any loss of time submit a report of occurrence of any sub standard workto the Divisional Engineer in-charge besides making an entry in the site order book. Anotice in respect of defective work shall be given to the contractor by DivisionalEngineer in-charge in writing during the progress of work asking the contractor torectify/replace/remove the sub standard item of work and also definite time periodwithin which such rectification/removal/replacement has to be done. After expiry ofthe notice period, if the contractor fails to rectify/replace/remove the sub standarditems, the defects shall be got rectified/replaced/removed by the corporation orthrough some other agency at the risk and cost of the contractor.

5.70 Non-reporting of the sub standard work in time on the part of Construction Officer(s)shall not in any way entitle the contractor to claim that the defects were not pointed outduring execution and as such the contractor cannot be absolved of the responsibilityfor sub standard work and associated liabilities.

5.71 Authority and procedure to accept sub standard work and payment thereof: Theremay be certain items of work pointed out as sub standard which may be difficult torectify and in the opinion of the Additional General Manager/GM (NTR), the items inquestion will not materially deteriorate the quality of service provided by theconstruction, the Additional General Manager / GM(NTR), shall appoint committee towork out the reduced rates payable to the contractor for such sub standard work. Thecommittee shall constitute one Divisional Engineer other than the one who is directlyin-charge of the work, involving sub standard items of work, as Chairman and oneS.D.E. and an Accounts Officer as members. The committee shall take into accountthe approximate cost of material/work pointed out as sub standard and recommendthe rates payable for sub standard work which shall not exceed 60% of the approvedrates of the item in question.

5.72 Record of sub standard work: The items adjudged as sub standard shall be enteredinto the measurement book with red ink.

PENALTY CLAUSE :

Delays in the contractor’s performance :

5.73 The time allowed for completion of the work as entered in the tender shall be strictlyadhered by the contractor and shall be deemed to be the most important aspect ofthe contract on the part of the contractor and shall be reckoned from Seventhday from issue of work order by the Corporation or an earlier day if specified inthe work order. The work shall, throughout the stipulated period of contract, beproceeded with all due diligence to achieve the desired progress uniformly, and thecontractor shall pay as penalty an amount equal to 0.25 percent of the estimatedamount per day of delay in completion of work, subject to a maximum of 10 (ten)percent of the cost of the work awarded.

5.74 On any date the penalty payable as above, reaches 10(ten) percent of the estimatedcost of the work, the contractor should proceed with the work further only on getting awritten instructions from the Divisional Engineer that, he is allowed to proceed furtherwith the work. It will be in the discretion of the Divisional Engineer to allow thecontractor to continue with the work on the basis of any written agreement reachedbetween the contractor and the Divisional Engineer one of the conditions of suchagreement may be a stipulation for the contractor to agree for realization of penalty fordelay at a higher rate as may be agreed between the Divisional Engineer andcontractor.

5.75 Penalty for delay in completion of the work shall be recoverable from the bills of thecontractor and /or from the bills of any other contract or at the time of final settlementof bills on completion of work.

5.76 In case of slow progress of the work in a Division which have been awarded to aparticular contractor, and the public interest does not permit extension of time limit forcompletion of work, the Additional General Manager will have the full right to order thatthe scope of the contractor may be restricted to such fraction of the whole of the workand get the balance executed at the risk and cost of the contractor. All such paymentsshall be recovered from the contractor’s pending bills or security deposit.

5.77 The Additional General Manager (NTR) reserves the right of cancel the contract andforfeit the security deposit if the contractor fails to commence the work within 7 daysafter issue of the work order.

Penalty for causing inconvenience to the Public :

5.78 To ensure progress during the execution of work and to cause minimuminconvenience to the public, the contractor shall not dig a trench of more than 200meters at a stretch in a route at a time. He shall cause to lay pipe and close suchtrenches expeditiously. Under any circumstances a stretch of trench of maximum 200meters shall not be kept open for more than 4 days in case of pipe laying by diggingpaved surfaces. In the event of contractor failing to comply with, these conditions, apenalty of recovery up to Rs.300/- per day the trench is kept open beyond the timelimit allowed may be imposed by the Corporation. This penalty will be in addition tothat payable for delay or slow work.

5.79 If any such penalty is levied on a contractor for more than 2 occasions, then his/hercontract could be terminated. In this regard the decision of Additional GeneralManager (NTR) shall be final and binding.

Penalty for cutting/damaging the old cable / Utilities :

5.80 During excavation of trench utmost care is to be taken by the contractor, so that theexisting underground cables/ utilities are not damaged or cut.

5.81 Cable owned by BSNL : In case any damage/cut is done to the existing cablesowned by BSNL, a penalty as per the schedule given below will be charged from thecontractor or the amount will be deducted from his running bills;

Besides the above penalty, the contractor shall carryout such repairs for restoration ofthe damaged cable free of charge. The cost of jointing kit shall also be borne by thecontractor. If contractor fails to repair the damage, the cost of repair (including cost oflabour + Jointing kit) shall be recovered from the contractor.

5.82 Cable / Utility owned by Other Agencies: Damage caused for any other utilities thecontractor shall be held fully responsible. The damage charges whatever claimed by theaffected agency shall be borne by the Contractor. To this effect the amount shall bededucted from his bills / Security deposit or any other amount with BSNL.

Penalty to damage stores / materials supplied by the Corporation while laying :

5.83 The contractor while taking delivery of materials supplied by the Corporation at thedesignated place shall thoroughly inspect all items before taking them over. In case ofexecution of the work, if any materials are found damaged/working unsatisfactorily,then a penalty equivalent to the cost of material plus (+) 17.5 % as penalty shall berecovered from the contractor’s payment/securities.

5.84 However, contractor will not be penalised for any defect in workmanship of thematerials, which shall be taken up separately with the supplier of the stores.

RESCISSION / TERMINATION OF CONTRACT

5.85 Circumstances for rescission of contract: Under the following conditions thecompetent authority may rescind the contract.

a) If the contractor commits breach of any item of terms and conditions of the contract.

b) If the contractor suspends or abandons the execution of work and the engineer in-charge of the work comes to conclusion that work could not be completed by the duedate for completion or the contractor had already failed to complete the work by thatdate.

c) If the contractor had been given by the officer-in-charge of work a notice in writing torectify/replace any defective work and he/she fails to comply with the requirementwithin the specified period.

5.86 Upon rescission of the contract, the security deposit of the contractor shall be liable tobe forfeited and shall be absolutely at the disposal of the BSNL as under:

5.87 Measurement of Works executed since the date of last measurement and up to thedate of rescission of contract shall be taken in the presence of the contractor or hisauthorised representative who shall sign the same in the MB. If the contractor or hisauthorised representative do not turn up for joint measurement, the measurementshall be taken by the officer authorised for this purpose after expiry of due date givenfor joint measurement. The measurement taken by the officer so authorised shall befinal and no further request for joint measurement shall be entertained.

5.88 The unused material (Supplied by the Corporation) available at site, shall betransported back by the Corporation to the Telecom Store at the risk and cost of thecontractor. If any such materials is found damaged/lost then the penalty shall also berecovered from the contractor as per conditions in tender documents /bid.

5.89 Upon rescission/termination of the contract, the contractor shall be debarred fromparticipating in any of the tenders pertaining to that Division in case the Breach ofcontract is committed for first time, or that pertaining to all the Divisions under thejurisdiction of Additional General Manager, in case the Breach of the contract iscommitted for second time or further, for a period ONE YEAR from the date of issue ofrescission/termination order by the Engineer-in-charge.

5.90 The certificate of the Divisional Engineer in-charge of work as to the value of workdone shall be final and conclusive against the contractor, provided always that actionshall only be taken after giving notice in writing to the contractor.

Termination for Insolvency :

5.91 The Corporation may at any time terminate the Contract by giving written notice to thecontractor, without compensation to Contractor, if the Contractor becomes bankrupt orotherwise insolvent as declared by the competent court provided that such terminationwill not prejudice or affect any right or action or remedy which has accrued or willaccrue thereafter to the Corporation.

Optional Termination by BSNL (Other than due default of the contractor):

5.92 The BSNL may, at any time, at its option cancel and terminate this contract by writtennotice to the contractor, in which event the contractor shall be entitled to payment forthe work done up to the time of such cancellation.

5.93 In the event of the termination of the contract, the contractor shall forthwith clear thesite of all the contractor’s materials, machinery and equipment’s and hand overpossession of the work/operations concerned to the BSNL or as the BSNL may direct.

5.94 The BSNL may, at its option, cancel or omit the execution of one or more items ofwork under this contract and any part of such items without any compensationwhatsoever to the contractor.

Issuance of Notice :

5.95 The Divisional Engineer, in-charge of work shall issue Show cause notice givingdetails of lapses, violation of terms and conditions of the contract, wrongful delays orsuspension of work or slow progress to the contractor directing the contractor to takecorrective action. A definite time schedule for corrective action shall be mentioned inthe show cause notice. If the contractor fails to take corrective action within thestipulated time frame, the Divisional Engineer in-charge shall submit a draft of finalnotice along with a detailed report to the competent authority who had accepted thecontract.

5.96 The final notice for rescission of contract to the contractor shall expressly state theprecise date and time from which the rescission would become effective. Thefollowing safe guards shall be taken while issuing the final notice:

a) During the period of service of notice and its effectiveness, the contractorshould not be allowed to remove from the site any material/equipmentbelonging to the Corporation.

b) The contractor shall give in writing the tools and plants he would like to takeaway/remove from the site. Such of the materials as belong to him and whichmay not be required for future execution of balance work may be allowed by theDivisional Engineer in-charge of work to be removed with proper records.

c) No new construction beneficial to the contractor shall be allowed.

d) Adequate security arrangement by the Corporation in replacement of thecontractor watch and ward shall be made forthwith. Expenses on this account are

recoverable from the security deposit or any amount due to the contractor.

INDEMNITIES :

5.97 The contractor shall at all times hold the BSNL harmless and indemnify from againstall action, suits, proceedings, works, costs, damages, charges claims and demands ofevery nature and descriptions, brought or procured against the BSNL, its officers andemployees and forthwith upon demand and without protect or demur to pay to theBSNL any and all losses and damages and cost (inclusive between attorney andclient) and all costs incurred in endorsing this or any other indemnity or security whichthe BSNL may now or at any time have relative to the work or the contractorsobligation or in protecting or endorsing its right in any suit on other legal proceeding,charges and expense and liabilities resulting from or incidental or in connection withinjury, damages of the contractor or damage to property resulting from or arising out ofor in any way connected with or incidental to the operations caused by the contractdocuments. In addition the contractor shall reimburse the BSNL or pay to the BSNLforthwith on demand without protect or demur all cost, charges and expenses andlosses and damages otherwise incurred by it in consequences of any claim, damagesand actions which may be brought against the BSNL arising out of or incidental to or inconnection with the operation covered by the contractor.

5.98 The contractor shall at his own cost at the BSNL’s request defend any suit or otherproceeding asserting a claim covered by this indemnity, but shall not settle, compoundor compromise any suit or other finding without first consulting the BSNL.

FORCE MAJEURE :

5.99 If any time, during the continuance of this contract, the performance in whole or in partby either party or any obligation under this contract shall be prevented or delayed byreason of any war, or hostility, acts of the public enemy, civil commotion sabotage,fires, floods, explosions, epidemics, quarantine restrictions, strikes, lockouts or act ofGod(herein after referred to as events) provided notice of happenings, of any sucheventuality is given by either party to the other within 21 days from the date ofoccurrence thereof, neither party shall by reason of such event be entitled to terminatethis contract nor shall either party have any such claim for damages against the otherin respect of such non-performance and work under the contract shall be resumed assoon as practicable after such event may come to an end or cease to exist, and thedecision of the Corporation as to whether the works have been so resumed or notshall be final and conclusive, provided further that if the performance, in whole or partof any obligation under this contract is prevented or delayed by reason of any suchevent for a period exceeding 60 days either party may, at his option terminate thecontract.

5.100 Provided also that if the contract is terminated under this clause, the Corporation shallbe at liberty to take over from the contractor at a price to be fixed by the Corporation,which shall be final, all unused, undamaged and acceptable materials, bought outcomponents and stores in the course of execution of the contract, in possession ofthe contractor at the time of such termination of such portion thereof as theCorporation may deem fit excepting such materials bought out components and storesas the contracts may with the concurrence of the Corporation elect to retain.

ARBITRATION :

5.101 In the event of any question, dispute or difference arising under this agreement or inconnection there with except as to matter the decision of which is specifically providedunder this agreement the same shall be referred to sole arbitration of the ChiefGeneral manager, Northern Telecom Region or in case his designation is changed orhis office is abolished then in such case to the sole arbitration of the officer for the timebeing entrusted whether in addition to the functions of the Chief General ManagerNorthern Telecom Region or by whatever designation such officers may be called(hereinafter referred to as the said officer) and if the Chief General Manager, NorthernTelecom Region or the said officer is unable or unwilling to act as such to the solearbitration or some other person appointed by the Chief General Manager, or the saidofficer. The agreement to appoint an arbitrator will be in accordance with theArbitration and Conciliation Act, 1996. There will be no objection to any suchappointment that the arbitrator is BSNL Servant or that he has to deal with the matterto which the agreement relates or that in the course of his duties as BSNL Servant hehas expressed views on all or any of the matter under dispute. The award of thearbitrator shall be final and binding on the parties. In the event of such arbitrator towhom the matter is originally referred, being transferred or vacating his office or beingunable to act for any reasons whatsoever such Chief General Manager or the saidofficer shall appoint another person to act as arbitrator in accordance with terms of theagreement and the person so appointed shall be entitled to proceed from the stage atwhich it was left out by his predecessors.

5.102 The arbitrator may from time to time with the consent of parties enlarge the time formaking and publishing the award, Subject to aforesaid Indian Arbitration andConciliation Act 1996 and the Rules made there under, any modification thereof forthe time being in force shall be deemed to apply to the arbitration proceeding underthis clause.

5.103 The venue of the arbitration proceeding shall be the Office of the Chief GeneralManager, Northern Telecom Region or such other places as the arbitrator may decide.The following procedure shall be followed.

I. In case parties are unable to reach a settlement by themselves, the disputeshould be submitted or arbitration in accordance with contract agreement.

II. There should not be a joint submission with the contractor to the soleArbitrator.

III.Each party should submit its own claim separately and may oppose the claimput forward by other party.

IV.The onus of establishing his claims will be left to the contractor.

V. Once a claim has been included in the submission by the contractor, areiteration or modification thereof will be opposed.

VI.The “points of defence” will be based on actual conditions of the contract.

VII. Claims in the nature of ex-gratia payments shall not be entertained bythe Arbitrator as these are not contractual.

VIII. The question whether these conditions are equitable shall not receive

any consideration in the preparation of “points of defence”.

IX.If the contractor includes such claims in his submission, the fact that they arenot contractual will be prominently placed before the Arbitrator.

5.104 The award of the sole Arbitrator shall be final and binding on all the parties tothe disputes.

SET OFF:

5.105 Any sum of money due and payable to the contractor (including security depositrefundable to him) under this contract may be appropriated by the Corporation or theGovt. or any other person or persons contracting through the Govt. of India and set offthe same against any claim of the Corporation or Govt. or such other person orpersons for payment of a sum of money arising out of this contract made by theContractor with Corporation or Govt. or such other person or persons contractingthrough Govt. of India.

SECTION –VI

SPECIAL CONDITIONS OF CONTRACT

GENERAL :

6.1 The work shall be accepted only after Acceptance Testing carried out by T&D team,designated by the Corporation, as per prescribed schedule and work/material passingthe test successfully.

6.2 The Corporation reserves the right to disqualify such bidders who have a record of notmeeting contractual obligations against earlier contracts entered into with theCorporation.

6.3 The Corporation reserves the right to black list a bidder for a suitable period in case hefails to honour his bid without sufficient grounds.

6.4 The Corporation reserves the right to counter offer Price(s) against price(s) quoted byany bidder.

6.5 Any clarification issued by Corporation, in response to query raised by prospectivebidders shall form an integral part of bid documents and it may amount to amendmentof relevant clauses of the bid documents.

6.6 Tender will be evaluated as a single package of all the items given in the priceschedule.

6.7 All work to be executed under the contract shall be executed under the direction andsubject to the approval in all respects by the Divisional Engineer or Site Engineer, in-charge of work site who shall be entitled to direct at what point or points and whatmanner they are to be commenced, and from the time to time carried on.

6.8 The work in each route may be split up between two or more contractors or acceptany tender in part and not entirely if considered expedient by the Additional GeneralManager/GM (NTR).

6.9 If the contractor shall desire an extension of time for completion of the work on thegrounds of unavoidable hindrance in execution of work or on any other ground heshall apply in writing to the Divisional Engineer within 3 days of the date of hindranceon account of which he desires such extension as aforesaid. In this regard thedecision of Additional General Manager shall be final.

6.10 If at any time after the commencement of the work, the Corporation may feel thatexecution of whole or part of work, as specified in the tender is not required to becarried out, then the Corporation shall give notice in writing of the fact to the contractorwho shall have no claim to any payment of compensation whatsoever on account ofany profit or advantage which he might have derived in consequence of the fullamount of the work not having been carried out neither shall he have any claim for

compensation by reason of any alterations having been made in the originalspecifications, drawings, designs and instructions which shall involve any curtailmentof the work as originally contemplated.

6.11 Whenever any claims against the contractor for the payment of a sum of money arisesout of or under the contract, the Corporation shall be entitled to recover such sum byappropriating in part of whole the security deposit of the contractor, and to Sell anyBSNL promissory notes etc., forming the whole or part of such security or running /Final bill pending against any contract with the Corporation. In the event of thesecurity being insufficient or if no security has been taken from the contractor, then thebalance or the total sum recoverable as the case may be, shall be deducted from anysum then due or which at any time there after may become due to the contractorunder this or any other contract with BSNL. Should this sum be not sufficient to coverthe full amount recoverable the contractor shall pay to Corporation on demand thebalance remaining due.

6.12 No official of Gazetted rank or other Gazetted officer employed in Engineering oradministrative duties in an Engineering Department or any other Department of theBSNL is allowed to work as a contractor for a period of two years after his retirementfrom BSNL service without the previous permission of BSNL. This contract is liable tobe cancelled if either the contractor or any of his employees is found at any time to besuch a person who hadn’t obtained the permission of BSNL as aforesaid beforesubmission of the engagement in the contractor’s service as the case may be.

6.13 In the event of the contractor being, adjudged insolvent or going voluntarily intoliquidation of having received order or other order under insolvency act made againsthim or in the case of company, of the passing of any resolution, or making of anyorder for winding up whether voluntarily or otherwise, or in the event of the contractorfailing to comply with any of the conditions herein specified, The Additional GeneralManager(NTR), shall have the power to terminate the contract without any notice.

6.14 Without prejudice to any of the rights or remedies under this contract, if the contractordies, the Additional General Manager (NTR) on behalf of the CMD, BSNL canterminate the contract without compensation to the contractor. However the AdditionalGeneral Manager at his discretion may permit contractor’s heirs to perform the dutiesor engagements of the contractor under the contract, in case of his death. In thisregard the decision of the Additional General Manager (NTR) shall be the final.

6.15 In the event of the contractor, winding up his company on account of transfer ormerger of his company with any other, the contractor shall make it one of the termsand stipulations of the contract for the transfer of his properties and business, thatsuch other person or company, shall continue to perform the duties or engagement ofthe contractor under this contract and be subject to his liabilities there under.

Interpretation of the contract document :

6.16 The representative of the Additional General Manager (NTR) and the contractor shallin so far as possible by mutual consultation, try to decide upon the meaning and intentof the contract document. In-case of disagreement, the matter shall be referred to theAdditional General Manager (NTR) whose decision shall be final. Any change in the

contract documents shall be set forth in writing by the representative of the partieshereto. It shall be the contractor’s responsibility to thoroughly familiarise all of hissupervisory personnel with the contents of all the contract documents.

Notification

6.17 The contractor shall give in writing to the proper person or authority with a copy to theDivisional Engineer such notification as may be mandatory or necessary in connectionwith the commencement, suspension, resumption, performance and/or completion ofthe contracted work. All notice shall be given sufficiently in advance of the proposedoperation to permit proper co-relation of activities and the contractor shall keep allproper persons or authorities involved and advised of the progress of operationsthroughout the performance of the work and/or with such other information and/orsupporting figure and data as may from time to time as directed or required.

Shut down on account of weather conditions :

6.18 The contractor shall not be entitled to any compensation whatsoever by reason ofsuspension of the whole or any part of the work made necessary by the BSNL ordeemed advisable on account of bad weather conditions or other force majeureconditions.

STORES SUPPLIED BY THE CORPORATION :

6.19 At no point of time the contractor shall be issued stores of value more than thecontractor’s material security as per the relevant clause. If at all the work requiresmore amount of materials to be issued to the contractor, then the security shallsuitably be revised before the issue of the store and the contractor will not have anyobjection to it.

6.20 The contractor shall transport (including loading and unloading) all stores issued tohim from Store dump of respective Division or any place within the jurisdiction of theDivision as directed by the Engineer-in-charge, to the site of work at his own cost.The Corporation shall not pay any transportation charges to the contractor,

6.21 All materials supplied to the contractor by the Corporation shall remain the absoluteproperty of Corporation and shall not be removed from site of the work except for usein the work and shall be at all times open to inspection by the Representative ofAdditional General Manager. In case the materials like cable and accessories aretaken delivery of by the contractor and stored at the site office/store of the contractorsuch site office/store will also be treated “as site” for this purpose. Any such materialsremaining unused at the time of the abandonment, completion or determination of thecontract shall be returned to the Corporation at a place informed to him by theCorporation, failing which the cost of the unused materials shall be deducted from thecontractor’s material security or any of his pending bills or from any other security.

6.22 The contractor shall be responsible for the transportation of store, storage and safecustody of all material supplied to him by the Corporation, which in the contractor’scustody whether, or not installed in the work. The contractor shall satisfy himselfregularly the quantity and quality of the materials supplied to him and he will be

responsible for any subsequent deterioration and discrepancy (inclusive of theft) in thequantity/quality of the materials.

6.23 The contractor shall submit a proper account every month of all the materials suppliedto him by the Corporation and those consumed for items of work any discrepancy ofdifference between the materials issued to the contractor and those consumed in thework as per the “Corporation’s calculation” (which shall be final) will be charged to thecontractor or deducted from his bills at 17.5% over and above the prevailing standardprice including freight, handling charges, storage charges etc.

6.24 The contractor shall ensure that only the required materials are issued to him. Uponcompletion of work, the contractor shall return to the Corporation at the laterdesignated store in good condition, free of charges, any unused materials that weresupplied by the Corporation.

EASEMENTS, PERMITS, LICENCES AND OTHER FACILITIES :

6.25 The contractor shall obtain/provide at his own cost all easements, permits and licensenecessary to do its work including Right of Way / Way leave permission.

PERMISSION (ROW)

6.26 The BSNL shall assist approved bidder to obtain way leave permission (right of way)from the concerned road/forest/rail/local authorities, including permission for workingfrom police/ District authorities. This will include the works of preparing the requisitionfor permission along with the necessary drawings as required by the highwayauthorities, get the same duly signed by the Divisional Engineer (Mtce.) in charge ofthe work, and submit the same to the road/forest/rail/local authorities. The rate quotedfor trenching shall also include the charges for undertaking the work to get permission.No separate rates will be applicable for getting permission.

6.27 The permission should be obtained in the most cost effective method for BSNL. Thecontractors should peruse to get the least restoration charges, and get the lowest BTcutting charges. The permission shall be applied under the supervision of the SDE-in-charge, and after satisfaction of the DE-in –charge.

6.28 The restoration charges shall be payable to the highways authorities directly by BSNLon obtaining the estimate along with written permission; provided

a) the rates are as per standard rates of the respective agency;b) the stretch of BT/ Berm are not more than the actuals.c) width payable shall be for ≤ 60 cm only. Where the widths beingcharged by the respective agency is higher the approval of ADDL. GM shall betaken.

6.29 The Contractor shall be fully responsible for angling and obtaining all necessaryeasements, permits and licenses, for moving all construction equipment, toolssupplied materials and men across Railways and Highways, across public or privateroad as well as premises of any public utility within the right of user and for bearing allcosts that may be incurred in respect of the same.

6.30 The contractor is to confine his operation to the provided construction “Right of User”unless it has made other arrangement with the particular property owners and/ortenants such other arrangements shall be entirely at the responsibility of the contractoras to cost and arrangement as also breach and claim and shall be entitled with a copyto the Divisional Engineer.

6.31 The contractor will not be entitled to extra compensation for hardship and increase incost by the cable trench being routed adjacent to or across other pipeline, Highways,Railways, telephones or poser poles and wires or guy wires, embankments, cliffs,streams or other obstacles which may physically or otherwise In any manner, restrictor limit the use of the construction “Right of User”. Some construction and suchcontingency shall be deemed to have been providing for in the rates.

6.32 At location where the OF Cable trench is routed across or along railways or roads thecontractor shall without extra cost provide and maintain such detours and roadcontrols as are required by the railways or BSNL or local agencies having jurisdiction.

QUALITY OF WORK :

6.33 The Corporation shall be the final judge of the quality of the work and the satisfactionof the Corporation in respect thereof set forth in the contract documents. Laxity orfailure to enforce compliance with the contract documents by the Corporation and/orits representative shall not manifest a change or intent of waiver, the intention beingthat, notwithstanding the same, the contractor shall be and remain responsible forcomplete and proper compliance with the contract documents and the specificationthere in. The representative of Additional General Manager (NTR) has the right toprohibit the use of men and any tools, materials and equipment which in his opinion donot produce work or performance meet the requirement of the contract documents.

TAXES AND DUTIES :

6.34 Contractor shall pay all rates, levies, fees royalties, taxes and duties payable or arisingfrom out of, by virtue of or in connection with and/or incidental to the contract or any ofthe obligations of the parties in terms of the contractor documents and/or in respect ofthe works or operations or any part thereof to be performed by the contractor and thecontractor shall indemnify and keep indemnified the Corporation from and against thesame or any default by the contractor in the payment thereof.

6.35 Works contract tax will be levied wherever applicable. Service tax along witheducational cess will be paid as per the rates in force. The contractor should provideService Tax registration number to claim the service tax. The Service tax number hasto be reflected on all the bills received from the contractor for availing service tax.

PROTECTION OF LIFE AND PROPERTY AND EXISTING FACILITIES :

6.36 The contractor is fully responsible for taking all possible safety precaution duringpreparation for and actual performance of the works and for keeping the constructionsite in a reasonable safe condition. The contractor shall protect all life and propertyfrom damage or losses resulting from his construction operations and shall minimize

the disturbance and inconvenience to the public.

6.37 If the excavation of trench alters the contours of the ground around road and highwaycrossing in such locations dangerous to traffic, the contractor shall at his own cost,take all necessary precautions to protect public and shall comply with all thedepartment regulations as to placing of warning boards (minimum size 3’ x 2’), trafficsignals, barricades, flags etc., at such location. If the contractor does not put thewarning signals, as per above directions, then a penalty of Rs.500/- per day shall belevied on the contractor till the directions are complied by the contractor. Thecontractor shall take due precautions to avoid damages to other pipe lines, watermains, sewers, telephones, telegraphs and power conduits, laid wires poles and guywires, railways, highways, bridges or other underground or above ground structureand/or property crossing or adjacent to the cable trench being excavated.

6.38 Attention of the contractor is drawn to the rules regarding laying of cables at roadcrossing, along Railways, Bridges, Highways and the safety precautions while workingin public street. The contractor in writing shall obtain the detailed engineeringinstructions from the Divisional Engineer of the area.

6.39 The contractor shall be solely responsible for location through approved nondestructive means and ensuring the safety of all existing underground pipeline,electrical cables, and or other structures.

6.40 The contractor shall be solely liable for all expense for and in respect of repairs and /ordamage occasioned by injury of or damage to such underground and above structuresor other properties and undertake to indemnify the Corporation from and against allactions, cause of actions, damages, claims and demands what so ever, either in lawor in equity and all losses and damages and costs (inclusive between attorney andclient), charges and expenses in connection therewith and/or incidental there to. Thecontractor shall take all responsibilities and risk in crossing other pipelines and cablesand shall be responsible for protecting all such existing pipe lines, poles, electric lines,sewers, cables or other facilities from damage by the contractors operation inconnection with the work. The contractor without cost of the Corporation shall promptlyrepair any damage incurred.

6.41 The current market value of any commodities lost as a result of any damage to theaforesaid existing facilities shall be paid by the contractor together with such additionalsums necessary to liquidate the personal of property damages, resulting there from.

LABOUR WELFARE MEASURES AND WORKMAN COMPENSATION :

Obtaining Licence before commencement of work :

6.42 The contractor shall obtain a valid labour license under the Contract Labour(Regulation and Abolition) Act 1970 and the Contract Labour (Regulation andAbolition) Central Rules 1971, before commencement of the work, and continue tohave a valid license until the completion of work. The contractor shall also abide bythe provisions of the Child Labour (Prohibition and Regulation) Act 1986. Any failure tofulfill this requirement shall attract the penal provisions of this contact arising out of theresultant non execution of work.

EPF and Misc. provisions Act 1952 :

6.43 The contractor shall comply with all provisions available towards fulfillment/compliance of the provisions of EPF and Misc. provisions Act 1952 and employeesProvident Fund Scheme 1952 in respect of Labourers / Employees engaged by themfor performing the works of BSNL.

6.44 Each Claim bill of the Contractor must accompany i) the list showing the details /Employees engaged, ii) Duration of their engagement, iii) Amounts of wages paid tosuch employees / labours for the duration in question, iv) amount of EPF Contributions(both employer’s & employee’s contribution) for the duration of engagement inquestion, paid to the EPF Authorities, v) Copies of authenticated documents ofpayment of such contribution to EPF authorities and vi) a declaration form thecontractors regarding compliance of the conditions of EPF Act, 1952.

6.45 If the certificate and the challan/receipt as above are not furnished, 16% of the billamount will be deducted and retained as deposit. The deposit will be refunded to thecontractor only on submission of the challan / receipts or document for exemption.

Contractors Labour Regulations:

Working Hours

6.46 Normally working hours of an employee should not exceed 9 hours a day. Theworking day shall be so arranged that inclusive of interval for rest, if any, it shall notspread over more than 12 hours on any day.

6.47 When a worker is made to work for more than 9 hours on any day or for more than 48hours in any week he shall be paid over time for the extra hours put in by him.

6.48 Every worker shall be given a weekly holiday normally on a Sunday, in accordancewith the provisions of Minimum wages (central ) Rules 1960, as amended from time totime, irrespective of whether such worker is governed by the minimum wages act ornot.

6.49 Where the minimum wages prescribed by the Govt. Of India, under the minimumwages act, are not inclusive of the wages for the weekly day of rest, the worker shallbe entitled to rest day wages, at the rate applicable to the next preceding day,provided he has worked under the same contractor for a continuous period of not lessthan 6 days.

6.50 Where a contractor is permitted by the Engineer - in - charge to allow a worker to workon a normal weekly holiday, he shall grant a substituted holiday to him for the wholeday, on one of the five days, immediately before or after the normal weekly holiday,and pay wages to such worker for the work performed on the normal weekly holiday atthe overtime rate.

6.51 When the local authorities like Police, District Collector, Municipalities etc., or theEngineer – in - charge demand that the work be done during night hours, the

contractor shall provide suitable lighting facilities, and other welfare measures to thelabourers. BSNL shall not pay any additional charges for night work. The contractorwhile quoting the rates shall also take such factors into consideration.

Display of Notice Regarding Wages Etc.

6.52 The contractor shall ,before he commences his work on contract, display and correctlymaintain and continue to display and correctly maintain, in a clear and legiblecondition in conspicuous places on the work, notices in English and local Indianlanguages spoken by the majority of the workers, giving the minimum rates of thewages fixed under Minimum wages Act, the actual wages being paid, the hours ofwork for which such wage are earned, wages periods, dates of payments of wagesand other relevant information.

Payment of Wages.

6.53 The contractor shall fix wage periods in respect of which wages shall be payable.

6.54 No wage period shall exceed one month.

6.55 The wages of every person employed as contract labour in an establishment or by acontractor, where less than one thousand such persons are employed, shall be paidbefore the expiry of seventh day and in other cases before the expiry of tenth day afterthe last day of the wage period in respect of which the wages are payable.

6.56 Where the employment of any worker is terminated by or on behalf the contractor, thewages earned by him shall be paid before the expiry of the second working day fromthe date on which his employment is terminated

6.57 All payments of wages shall be made on a working day at the work premises andduring the working time and on a date notified in advance and in case the work iscompleted before the expiry of the wage period, final payment shall be made within 48hours of the last working day.

6.58 Wages due to every worker shall be paid to him direct or to other person authorized byhim in this behalf.

6.59 All wages shall be paid in current coin or currency or in both.

6.60 Wages shall be paid without any deductions of any kind except those specified by theCentral Government by general or special order in this behalf or permissible under thepayment of Wages Act 1956.

6.61 A notice showing the wages period and the place and time of disbursement of wagesshall be displayed at the place of work and a copy sent by the contractor to theEngineer-in-charge under acknowledgement.

6.62 It shall be the duty of the contractor to ensure the disbursement of wages in presenceof the site Engineer or any other authorized representative of the Engineer-in-chargewho will be required to be present at the place and time of the disbursement of wages

by the contractor to workman.

6.63 The contractor shall obtain from the site Engineer or any other authorizedrepresentative of the Engineer-in-charge, as the case may be a certificate under hissignature at the end of the entries in the “Register of Wages” or the “Wage-cum-Muster Roll”, as the case may be, in the following form:-

6.64 “Certified that the amount shown in the column No………….has been paid to theworkman concerned in my presence on……… at……….

Fines and deductions which may be made from wages

6.65 The wages of a worker shall be paid to him without any deduction of any kind exceptthe following :-

(a) Fines

(b) Deductions for absence from duty i.e. from the place or the places where by theterms of his employment he is required to work. The amount of deduction shall bein proportion to the period for which he was absent.

(c) Deductions for damage to or loss of goods expressly entrusted to the employedperson for custody, or for loss of money or any other deductions which he isrequired to account, where such damage or loss is directly attributable to hisneglect or default.

(d) Deduction for recovery of advances or for adjustment of overpayment of wages,advances granted shall be entered in a register.

(e) Any other deduction, which the BSNL may from time to time, allows.

6.66 No fines should be imposed on any worker save in respect of such acts and omissionson his part as have been approved of by the Labour Commissioner.

6.67 No fine shall be imposed on a worker and no deduction for damage or loss shall bemade from his wages until the worker has been given an opportunity of showing causeagainst such fines or deductions.

6.68 Every fine shall be deemed to have been imposed on the day of the act or omission inrespect of which it was imposed.

Labour records

6.69 The contractor shall maintain a Register of Persons employed on work on contractin Form XIII of the Contract Labour (R&A) Central Rules 1971.

6.70 The contractor shall maintain a Muster Roll register in respect of all workmenemployed by him on the work under contract in Form XVI of the Contract Labour(R&A) Central Rules 1971.

6.71 The contractor shall maintain a Wage Register in respect of all workmen employed byhim on the work under contract in Form XVII of the Contract Labour (R&A) Central

6.72 Register of Accidents – The contractor shall maintain a register of accidents in suchform as may be convenient at the work place but the same shall include thefollowing particulars

a) Full particulars of the laborers who met with accident

b) Rate of wages

c) Sex

d) Age

e) Nature of accident and cause of accident

f) Time and date of accident

g) Date and time when admitted in hospital

h) Date of discharge from the hospital

i) Period of treatment and result of treatment

j) Percentage of loss of earning capacity and disability as assessed by Medicalofficer.

k) Claim required to be paid under workmen’s Compensation Act.

l) Date of payment of compensation

m) Amount paid with details of the person to whom the same was paid.

n) Authority by whom the compensation was assessed

o) Remarks.

6.73 The contractor shall maintain a Register of Fines in the form XII of the CL (R&A)Rules 1971. The contractor shall display in a good condition and in a conspicuousplace of the work the approved list of acts and omission for which fines can beimposed.

6.74 The contractor shall maintain a Register of deduction for damage or loss in formXX of the CL (R&A) Rules 1971.

6.75 The contractor shall maintain a Register of Advances in form XXIII of the CL (R&A)Rules 1971.

6.76 The contractor shall maintain a Register of Overtime in form XXIII of the CL (R&A)Rules 1971.

ATTENDENCE CARD-CUM WAGE SLIP :

6.77 The contractor shall issue an Attendance card-cum wage slip to each workmanemployed by him.

6.78 The card shall be valid for each wage period.

6.79 The contractor shall mark the attendance of each workman on the card twice eachday, once at commencement of the day and again after the rest interval, before heactually starts work.

6.80 The card shall remain in possession of the worker during the wage period underreference

6.81 The contractor shall complete the wage slip portion on the reverse of the card at leasta day prior to the disbursement of wages in respect of the wage period underreference

6.82 The contractor shall obtain the signature or thumb impression of the worker on thewage slip at the time of disbursement of wages and retain the card with him

EMPLOYMENT CARD :

6.83 The contractor shall issue an Employment Card in the Form XIV of CL (R&A) CentralRules 1971 to each worker within three days of the employment of the worker.

SERVICE CERTIFICATE :

6.84 On termination of employment for any reason whatsoever the contractor shall issue tothe workman whose services have been terminated, a service certificate in the FormXV of the CL (R&A) Central Rules 1971.

PRESERVATION OF LABOUR RECORDS :

6.85 The Labour records and records of Fines and deductions shall be preserved in originalfor a period of three years from the date of last entries made in them and shall bemade available for inspection by the Engineer-in-charge or Labour Officer or any otherofficers authorised by the Ministry of Communication in this behalf.

POWER OF LABOUR OFFICER TO MAKE INVESTIGATIONS OR ENQUIRY :

6.86 The Labour officer or any person authorised by the BSNL on their behalf shall havepower to make enquiries with a view to ascertaining and enforcing due and properobservance of fair wage clauses and provisions of these regulations. He shallinvestigate into any complaint regarding the default made by the contractor in regardto such provision.

REPORT OF INVESTIGATING OFFICER AND ACTION THEREON :

6.87 The Labour officer or other person authorised as aforesaid shall submit a report ofresult of his investigation or enquiry to the Engineer in-charge indicating the extent, ifany, to which the default has been committed with a note that necessary deductionsfrom the contractor’s bill be made and the wages and other dues be paid to thelaborers concerned. The Engineer in-charge shall arrange payments to the labourconcerned within 45 days from the receipt of the report from the Labour Officer or theauthorised officer as the case may be.

INSPECTION OF BOOKS AND SLIPS :

6.88 The contractor shall allow inspection of all the prescribed labour records to any of hisworkers or to his agent at convenient time and place after due notice is received or tothe labour officer or any other person, authorised by the BSNL on his behalf.

SUBMISSION OF RETURNS :

6.89 The contractor shall submit periodical returns as may be specified from time to time.

AMENDMENTS :

6.90 The BSNL may from time to time add to or amend the regulations and on any questionas to the application /interpretation or effect of those regulations.

INSURANCE :

6.91 Without limiting any of his other obligations or liabilities, the contractor shall, at his ownexpense, take and keep comprehensive insurance including third party risk for theplant, machinery, men, materials etc. brought to the site and for all the work during theexecution. The contractor shall also take out workmen’s compensations insurance asrequired by law and under take to indemnify and keep indemnified the BSNL from andagainst all manner of claims and demands and losses and damages and cost(including between attorney and client) charges and expenses that may arise in regardthe same or that the BSNL may suffer or incur with respect to end / or incidental to thesame. The contractor shall have to furnish originals and / or attested copies asrequired by the Corporation of the policies of insurance taken within 15 (fifteen) daysof being called upon to do so together with all premium receipts and other papersrelated thereto which the Corporation may require.

6.92 The contractor shall have necessary insurance for payment of compensation in caseof any damages. The contractor is liable to pay damages to all third party damageswhether these damages are as a direct consequence to the work or indirectconsequence. The damages shall also be payable to BSNL in case of damages toBSNL property like cables, concrete ducts, pipes etc.,

COMPLIANCE WITH LAWS AND REGULATION :

6.93 During the performance of the works the contractor shall at his own cost and initiativefully comply with all applicable laws of the land and with any and all applicable by-lawsrules, regulations and orders and any other provisions having the force of law made orpromulgated or deemed to be made or promulgated by the Government,Governmental agency or Department, municipal board, Government of otherregulatory or Authorised body or persons and shall provide all certificates ofcompliance therewith as may be required by such applicable law. By-laws, Rules,Regulations, orders and /or provisions. The contractor shall assume full responsibilityfor the payment of all contributions and pay roll taxes, as to its employees, servants oragents engaged in the performance of the work specified in the contractor documents.If the contractor shall require any assignee or sub-contractor to sham any portion of

the work to be performed hereunder may be assigned, sub-leased or sub-contractedto comply with the provisions of the clause and in this connection the contractoragrees as to undertake to save and hold the BSNL harmless and indemnified fromand against any/all penalties, actions, suits, losses and damages, claims anddemands and costs (inclusive between attorney and client) charges and expenseswhatsoever arising out or occasioned, indirectly or directly, by failure of the contractoror any assignee or sub-contractor to make full and proper compliance with the said-bye-laws, Rules, Regulations, Laws and order and provisions as aforesaid.

TOOLS AND PLANTS :

6.94 The contractor shall provide at his own cost all tools, plants appliances, implements,measuring instruments etc., required for proper execution of works. The contractorshall also supply without charge the requisite number of persons with the means andmaterials necessary for the purpose of setting out works, counting, weighing andassisting the measurements for examination at any time and from time to time. Thecontractor shall be responsible to make all arrangements, at his own cost fordewatering of trenches/ducts and de-gasification of the ducts before carrying out thework. The contractor shall also be responsible to make arrangements, at his own cost,for water required for carrying of works at sites including curing of CC/RCC works.Failing his so doing the same may be provided by the Engineer-in-charge at theexpense of the contractor and the expenses shall be deducted from any money due tothe contractor under this contract or otherwise.

SECTION VII

SCOPE OF WORK AND JURISDICTION OF CONTRACT

SCOPE OF WORK

7.1 The scope of work shall include the following

(i) Obtain Right of way / way leave permission from Road/ Railway/ MunicipalCorporation/ Local bodies/ Police/ other authorities etc., in the most costeffective manner as detailed in Clause 6.30 and 6.31.

(ii) Excavation of trench to a nominal depth of 165 cm along National/StateHighways/other roads/ in city limits and pipe laying as per specifications.

(iii) Duct integrity test shall be done as per specifications for all pipes laid and noseparate charges are payable.

(iv) Sub-ducting shall be done in existing telecom ducts/ troughs, as per thespecification given for the work.

(v) Cable shall be blown/ pulled after pipe laying is completed, on the directions ofEngineer-in-charge, and the work shall be done as per the specifications. Cableblowing / pulling may be done immediately or at a later date after pipe laying, asper the discretion of Engineer –in - charge. It may be noted that cable blowing isthe preferred method, and if blowing is insisted by BSNL, the contractor shall doaccordingly. Cable has be laid end to end i.e., from the point where joint is to bedone, upto the desired location, and therefore, work may extend beyond theroute awarded to the contractor, and the contractor is bound to do it.

(vi) The cable shall be led in, into the exchange or desired site like BTS etc. Thismay involve laying in ducts or trenching in exchange compound/ desired site,extending to the desired room by laying GI pipes, PVC pipes etc., both vertically& horizontally along the wall , roof etc., Leading in will also involve laying PLBducts to the existing RCC Manhole chambers by making holes through concretewalls.

(vii) Any other associated works including the various items for which the rates areprefixed in Route XIV of Part III of the tender document, will be in the scope ofthe work and shall be done on the directions of the Engineer-in-charge.

7.2 The steps involved in trenching and pipe laying works are as under:

i) Excavation of trench up to a nominal depth of 165 cm according to constructionspecifications along National/State Highways/other roads and also in city limits asmentioned in the notice inviting tender.

ii) Laying of PLB pipes/coils coupled by PLB sockets in excavated trenches, onbridges and culverts.

iii) Providing of mechanical protection by R.C.C. Pipes/GI Pipes and /or concreting /

chambering according to construction specifications, wherever required.

iv) Fixing of GI pipes/troughs with clamps at culverts/bridges and/or chambering orconcreting of G.I. Pipes/troughs, wherever necessary.

v) Back filling and dressing of the excavated trenches according to constructionspecifications.

ALLIED ACTIVITIES :

7.3 Transportation of Materials: The materials required for executing the work entrustedto the contractors against a work order shall be made available at Store dump ofrespective Division or any place within the jurisdiction of the Division, and thecontractor shall collect the store as directed by the Engineer-in-charge. Thecontractor shall be responsible for transporting the materials, to be supplied by theCorporation or otherwise to execute the work under the contract, to site at his/theirown cost. The costs of transportation are subsumed in the standard Schedule Ratesand therefore no separate charges are payable on this account.

7.4 Supply of Materials: There are some materials required to be supplied by thecontractor for execution of works under this contract like Bricks, Cement, Wire Meshand Steel for protection, etc., besides using other consumables which do/do notbecome the part of the asset. The contractor shall ensure that the materials suppliedare of best quality and workmanship and shall be strictly in accordance with thespecifications.

7.5 COST OF WORK: The estimated cost of work is as mentioned in the Notice InvitingTenders which has been worked out based on standard scheduled rates mentioned inthis tender document. The actual value of work may vary based on the actualrequirement but generally being limited to +/- 25% of the indicated value.

ROUTE VIII

OPTICAL FIBRE CABLE CONSTRUCTION PRACTICES

The guidelines in the form of Engineering Instructions (E.Is.) on ConstructionPractices of Optical Fibre Cables are issued by T & D wing of theCorporation, from time to time, and the present practices are summarizedhereunder. The work has to be carried out as per the specifications givenbelow.

GENERAL

8.1 The Optical Fibre Cable is planned considering the following objectives of the scheme.

i) Minimum possible route length vis-à-vis route having maximum number of townswith potential telecom growth.

ii) Linking of small exchanges off main road by leading in O.F.C. vis-à-vis routing themain cable itself via. Such exchanges.

8.2 After deciding the above mentioned issues, a detailed measurement of lengths ofcable route along with details of rail/road crossings, culverts, causeways, etc. may berecorded in the detailed survey register. The probable locations of joints, terminationsand re-generators may also be decided and marked on the route map.

8.3 On the basis of surveys, general permission from road and rail authorities for layingthe Optical Fibre Cable along the decided routes and permission for rail / roadcrossings will have to be obtained. Generally, O.F.C. is laid straight as far as possiblealong the road near the boundaries, away from the burrow pits. The O.F.C. is laidalong the roads at a minimum distance of 15 meters from the centre line of the road orin accordance with the permission from the concerned road authorities in view of theirroad-widening plan. As the O.F.C. carries high capacity traffic and is planned for 40years of life, it is imperative that the cable is laid after obtaining due permission fromall the concerned authorities to avoid any damage/shifting at a later stage and alsodisruption of services / revenue loss.

8.4 In special cases, where it may be necessary to avoid burrow pits or low lying areas,the cable may be run underneath the shoulders at a distance of 0.6 meter from theouter edge of the road embankment provided the same is located at least 4.5 metersaway from centre line of road and 1.2 meter below the road surface.

8.5 The Optical Fibre Cable is laid through PLB Pipes buried at a nominal depth of 165cm. The steps involved in OF Cable construction are as under:

i) Excavation of trench up to a nominal depth of 165 cm, according toConstruction specifications along National/State Highways/other roads and also incity limits as mentioned in the notice inviting tender.

ii) Laying of PLB-HDPE pipes/coils coupled by PLB couplers in excavatedtrenches, on bridges and culverts as per construction Specifications and sealing of

PLB-HDPE pipe ends at every manhole by PLB end caps of suitable size.

iii) Providing of mechanical protection by R.C.C. Pipes/GI Pipes and/orconcreting/chambering according to construction specifications, whereverrequired.

iv) Fixing of G.I. Pipes/troughs with clamps at culverts/bridges and / orchambering or concreting of G.I. Pipes/troughs, wherever necessary.

v) Back filling and dressing of the excavated trenches according toconstruction specifications.

vi) The PLB Pipe length varies from 0.2 KM to 1.0 KM. The JACKMECHANISM for uncoiling of PLB Pipe must be procured by contractor ofrespective section. BSNL will not provide the uncoiling jack.

8.6 SPECIFICATIONS OF MATERIALS USED :

PLB-HDPE PIPE / COILS

The Optical Fibre Cable is pulled through 40 mm outer diameter PLB Pipes/ Coilshaving strength of 10 Kg/sq.cm. PLB-HDPE pipes/coils will normally be of 200 metersto 1000 meters length, but if desired by BSNL, smaller length or bit pipes may also beissued.

PLB Couplers and End caps:

For coupling PLB-HDPE Pipes/Coils, PLB Couplers as per required specificationsshould be used. The open ends of the PLB-HDPE pipes/coils are closed with PLB EndCaps/plugs, to prevent entry of mud, rainwater, insects, rodents etc.

Cable Sealing Plug

To prevent entry of rodents into PLB pipes, the ends of PLB pipes are sealed at everyjoint using cable-sealing plug supplied, after optical fibre cable is pulled. It should beable to prevent the entry of insects, rodents, mud, and rainwater into the PLB pipe. Iftest pits are taken in between for cable pulling, the same shall be made, as throughconduit by using smaller length of PLB pipe and additional couplers. No split PLBpipes shall be used at manholes. Sealing plug will be used only at joints.

MATERIALS FOR MECHANICAL PROTECTION

For lesser depths requiring mechanical protection as per specifications and in built upareas, in towns and cities falling within the municipal limits, road/ railway crossings,laying across bridges, culverts etc., suitable mechanical protection is provided to PLB-HDPE pipes/coils using GI pipes, RCC full round pre-cast pipes, Half round (semicircular) RCC pipes, DWC Full/Split pipe/ RCC Slabs, or concreting of size 20cm X20cms, reinforced with MS weld mesh where required or a combination of any ofthese as per the written instructions of the Engineer-in-charge.

Reinforced cement concrete pipes (spun type) coupled with RCC collars sealed withcement mortar are used to provide mechanical protection to PLB-HDPE pipes/coils.The RCC pipes/collars should be of NP-2 class for 100 mm. - 250 mm. (internaldiameter) full round, conforming to IS Standard 458-1988 revised upto date. Thepipes should have a nominal length of 2 meters.

The RCC Collars should be properly sealed using cement mortar 1:3 (1:53 gradecement of reputed brand, 3: fine sand without impurities). If the mechanical protectionis provided by RCC pipes, every third joint will be embedded in a concrete block ofsize 60 cm (L) x 40 cm (W) x 25 cm (H) of 1:2:4 cement concrete mix 1:2:4 (1: cement,2: coarse sand, 4: stone aggregate of 20 mm. Nominal size) so that the alignment ofRCC pipes remain firm and intact. Both ends of RCC / GI pipes will be sealed byproviding concrete block of size 40 cm. (L) x 40 cm (W) x 25 cm (H) of 1:2:4 cementconcrete mix to avoid entry of rodents.

ii) G.I. PIPES

G.I. Pipes should be of medium duty class having diameter of 50 – 150 mm. The G.I.Pipes should conform to IS 554/1985 (revised up to date) IS 1989 (Part-I), 1900Sockets (revised up to date) & IS 1239 (Part-II) 1992 revised up to date). Whereverprotection by G.I. Pipe is provided, it is preferable to use PLB coils.

iii) Half round (Semi circular) RCC pipe / Napah/ Cuddapah / RCC Slabs

In the city and town limits, PLB pipes should be protected with Half round (Semicircular) RCC pipe/RCC Slabs provided by BSNL, and the locations where theseprotection are to be provided will be as per the directions of the Engineer-in-charge.

iii) M.S. WELD MESH

The PLB-HDPE pipes/coils can also be protected by embedding it in concrete of sizeof 20 cm X 20 cm reinforced with MS weld mesh. The MS weld mesh used should beof 50mmX100 mm size, 12 SWG, 120 cm in width in rolls of 50 m each. One meter ofMS weld mesh caters to approx 3 meters of concreting.

The strength of RCC / CC is dependent on proper curing; therefore, it is imperativethat water content of RCC / CC mix does not drain out into the surrounding soil. Inorder to ensure this, the RCC / CC work should be carried out by covering all the sidesby yellow PVC sheets of weight of not less than 1 kg per sq.m to avoid seepage ofwater into the soil.

Route/ Joint IndicatorsThe route/ joint indicators are co-located with each manhole/joint chamber. In additionroute indicators are also to be placed where route changes direction like roadcrossings etc. The route / joint indicators made of pre-cast RCC will have the followingnominal dimensions 300 x 125 x 1250 mm.

RCC ring and slabsRCC ring and slabs of about 100 cm diameter, having base plate, ring (40 cm height),top cover will have to be used at joint locations.

EXCAVATION OF TRENCHES

TrenchingLocation and Alignment of the Trench:

8.7 In city areas, the trench will normally follow the foot-path of the road except where itmay have to come to the edge of the carriage way when cutting across road withspecific permissions from the concerned authorities maintaining the road (suchpermissions shall be obtained by the corporation). Outside the city limits, the trenchwill normally follow the boundary of the roadside land. However, where the road sideland is full of burrow pits or afforestation or when the cable has to crossculverts/bridges or streams, the trench may come closer to the road edge or in somecases, over the embankment or shoulder of the Road (Permissions for such deviationsfor cutting the embankment as well as shoulder of the road shall be obtained by thecontractor.

8.8 The alignment of the trench will be decided by a responsible departmental official, notbelow the rank of a Junior Telecom Officer. Once the alignment is marked, nodeviation from the alignment is permissible except with the approval of engineer-In-Charge. While marking the alignment only the centre line will be marked and theContractor shall set out all other work to ensure that, the excavated trench is asstraight as possible. The Contractor shall provide all necessary assistance andlabour, at his own cost for marking the alignment. Contractor shall remove all bushes,undergrowth, stumps, rocks and other obstacles to facilitate marking the centre linewithout any extra charges. It is to be ensured that minimum amount of bushes andshrubs shall be removed to clear the way and the contractor shall give allconsideration to the preservation of the trees.

8.9 The contractor shall ensure that trenching and pipe laying activities are continuous,without leaving patches or portions incomplete in between. In case intermediate patchesare left, measurement of the completed portions will be taken only after work in such leftover patches are also completed in all respects.

8.10 The line up of the trench must be such that PLB-HDPE Pipes/Coils shall be laid in astraight line, both laterally as well as vertically except at locations where it has tonecessarily take a bend because of change in the alignment or gradient of the trench,subject to the restrictions mentioned elsewhere.

Line-Up:

Method of Excavation:

8.12 In city limits as well as in built up areas, the contractor shall resort to use of manuallabour only. This is to ensure no damage is caused to any underground or surfaceinstallations belonging to other public utility services and/or private parties. At least

200 m of continuous length of pipe should be laid per day, without cutting of pipes. Notrenches should be kept open overnight (or during day time if work done during night).Trenches may have to be closed without laying of pipes, if it is not ready for pipelaying, on the same day/ night; and again reopened the next day/ night to completebalance trenching and pipe laying. Therefore sufficient labour has to be deployed tocomplete trenching and pipe laying on the same day/ night for at least 200 m length.Any other directions issued by local authorities shall be scrupulously followed.

8.13 However, along the Highways and cross country there shall be no objection to theContractor resorting to mechanical means of excavation, provided that nounderground installations existing in the path of excavation, if any, are damaged.

8.14 The contractor shall resort to horizontal boring to bore a hole of required size and topush through G.I. Pipe through horizontal bore wherever required as decided by theEngineer-in-charge (at road crossing of National Highways or Corporation/MunicipalRoads or rail crossing or small hillocks etc.).

8.15 All excavation operations shall include excavation and ‘getting out’. ‘Getting out’ shallinclude throwing the excavated materials at a distance of at least one meter or half thedepth of excavation, whichever is more, clear off the edge of excavation. In all othercases ‘getting out’ shall include depositing the excavated materials as specified.

8.16 In Rocky strata excavation shall be carried out by use of electro mechanical meanslike breakers or by blasting wherever permissible with express permission from thecompetent authority. If blasting operations are prohibited or not practicable, excavationin hard rock shall be done by chiseling.

8.17 Trenching shall as far as possible be kept ahead of the laying of pipes. Contractorsshall exercise due care that the soil from trenching intended to be loose for back fillingis not mixed with loose debris. While trenching, the Contractor should not causedamage to any underground installations belonging to other agencies and anydamage caused should be made good at his own cost and expense.

8.18 Necessary barricades, night lamps, warning boards and required watchman shall beprovided by the contractor to prevent any accident to pedestrians or vehicles. Whilecarrying out the blasting operations, the contractor shall ensure adequate safety bycautioning the vehicular and other traffic. The contractor shall employ sufficient manpower for this with caution boards, flags, sign writings etc.

8.19 The contractors should co-ordinate with all agencies like water, electricity, petroleum,telephone, Municipal Corporation, highways, police etc., and ensure no damages arecaused to their properties. Cost towards damages caused shall be recovered from theamounts payable to the contractor. Contractor may take necessary insurance coveragainst damages, theft, fire etc.,

8.20 The contractor should provide sufficient width at the trench at all such places, where itis likely to cave in due to soil conditions without any extra payment. A minimum freeclearance of 15 cm should be maintained above or below any existing undergroundinstallations. No extra payment will be made towards this.

8.21 In order to prevent damage to PLB-HDPE pipes over a period of time, due to thegrowth of trees, roots, bushes etc., the contractor shall cut them when encountered inthe path of alignment of trench without any additional charges.

8.22 In large burrow pits, excavation may be required to be carried out for more than 165cm in depth to keep gradient of bed less than 15 degrees with horizontal. If notpossible as stated above, alignment of trench shall be changed to avoid burrow pitcompletely.

Depth and size of the Trench :

8.23 The depth of the trench from top of the surface shall not be less than 165 cm unlessotherwise relaxation is granted by competent authority under genuine circumstances.In rocky terrain, the depth of the trench may be restricted to a depth of 100 to 140 cm.However, Engineer-in-charge in exceptional cases due to adverse site conditionsencountered may allow laying PLB Pipes at a lesser depth with additional protection.In all cases, the slope of the trench shall not be less than 15 degrees with thehorizontal surface. The width of the trench shall normally be 45 cm at the top and 30cm at the bottom. In case, additional pipes (PLB-HDPE/GI/RCC Pipes) are to be laidin some stretches, the same shall be accommodated in this normal size trench.

8.24 When trenches are excavated in slopes, uneven ground, inclined portion, the loweredge shall be treated, as top surface of land and depth of trench will be measuredaccordingly. In certain locations, such as uneven ground, hilly areas and all otherplaces, due to any reason whatsoever, it can be ordered to excavate beyond standarddepth of 165 cm to keep the bed of the trench as smooth as possible. Near theculverts, both ends of the culverts shall be excavated more than 165 cm to keep thegradient less than 15 degree with horizontal. For additional depth in excess of 165cm, additional payment of pro rata basis shall be applicable.

8.25 If excavation is not possible to the minimum depth of 165 cm, as detailed above, fullfacts shall be brought to the notice of the Engineer In charge in writing giving details oflocation and reason for not being able to excavate that particular portion to theminimum depth. Approval shall be granted by the competent authority in writing undergenuine circumstances. The decision of the competent authority shall be final andbinding on the contractor.

Dewatering:

8.26 The Contractor shall be responsible for all necessary arrangements to remove orpump out water from trench. The Contractor should survey the soil conditionsencountered in the section and make his own assessment about dewateringarrangements that may be necessary. Wetting :

8.27 Wherever the soil is hard due to dry weather conditions, if watering is to be done forwetting the soil to make it loose, the same shall be done by the contractor. No extrapayment shall be admissible for this.

Blasting :

8.28 For excavation in hard rock, where blasting operations are considered necessary, thecontractor shall obtain approval of the engineer-In-Charge in writing for resorting toblasting operation.

8.29 The contractor shall obtain license from the competent authority for undertakingblasting work as well as for obtaining and storing the explosive as per the ExplosiveAct, 1884, as amended upto date and Explosive Rules, 1983. The contractor shallpurchase the explosives fuses, detonators, etc. only from a licensed dealer.Transportation and storage of explosives at site shall conform to the aforesaidExplosive Act and Explosive Rules. The contractor shall be responsible for the safecustody and proper accounting of the explosive materials. Fuses and detonators shallbe stored separately and away from the explosives. The engineer-in-charge or hisauthorized representative shall have the right to check the contractor’s store andaccount of explosives. The contractor shall provide necessary facilities for this.

8.30 The contractor shall be responsible for any damage arising out of accident toworkmen, public or property due to storage, transportation and use of explosive duringblasting operation.

8.31 Blasting operations shall be carried out under the supervision of a responsibleauthorised agent of the contractor (referred subsequently as agent only), duringspecified hours as approved in writing by the Engineer-In-charge. The agent shall beconversant with the rules of blasting.

8.32 All procedures and safety precautions for the use of explosives drilling and loading ofexplosives before and after shot firing and disposal of explosives shall be taken by thecontractor as detailed in IS:4081 safety code for blasting and related drilling operation.

Trenching Near Culverts / Bridges :

8.33 The PLB-HDPE Pipes shall be laid in the bed of culvert at the depth not less than 165cm protected by G.I. Pipes and concreting as decided by Engineer-In-Charge. Bothends of culverts shall be excavated more than 165 cm In depth to keep the gradient ofnot less than 15 degree with horizontal. The bed of trench should be as smooth aspossible.

8.34 While carrying out the work on bridges and culverts, adequate arrangement forcautioning the traffic by way of caution boards during day time and danger lights atnight shall be provided.

8.35 In case of small bridges and culverts, where there is a likelihood of their subsequentexpansion and remodeling, the cable should be laid with some curve on both sides ofthe culvert or the bridge to make some extra length available for readjustment of thecable at the time of reconstruction of culvert or the bridge.

8.36 Preparatory to laying the PLB pipe the contractor may pressurize the pipe to thespecified limit and ensure that there is no leak. Unsuitable lengths shall be removed.This will help, to avoid subsequent failure of Duct Integrity Test, after pipe laying. Thepipes shall be brought near the work spot so that they are available for pulling/ layingimmediately after the trenches are ready. The pressure-checked pipes should be de-coiled to make it straight, smooth, un-deformed using uncoiling tool. It should be freefrom cracks, holes, defective ends, and crushed or any other defects. Contractor shallprovide collapsible drums for mounting, unrolling of PLB ducts for laying in thetrenches. Contractor is expected to handle and use PLB Coils carefully.

8.37 After the trench is excavated to the specified depth, the bottom of the trench has to becleared of all stones or pieces of rock and leveled up properly. A layer of soft soil / orsand (in case the excavated material contains sharp pieces of rock / stones) of notless than 5 cm is required for leveling the trench to ensure that the cable when laid willfollow a straight alignment. Adequate care shall be exercised while laying so that theOF cables are not put to undue tension / pressure after being laid as this mayadversely affect the optical characteristics of cables with passage of time.

8.38 Each length of the PLB/HDPE pipe shall be thoroughly cleaned to remove all sand,dust or any other debris that may clog, disturb or damage the optical fibre cable whenit is pulled/blown at a later stage. Ensure no mud, water or debris goes inside thepipe. Any obstructions found in the pipeline after its completion, shall be removed atthe expense of the Contractor. It should be ensured that no damage is caused to thePLB pipes during the laying operation. The pipes will be handled carefully to avoiddamage to them due to rubbing or crushing.

8.39 After the trench is cleaned the PLB-HDPE Pipes / coils shall be laid in the cleanedtrench. Where multiple PLB pipes are to be laid, the pipes are to be bundled and tiedwith nylon rope at every two metre and laid in the trench. In case of laying throughexisting ducts the bundled pipes shall be pulled, applying continuous lubrication.

8.40 At the end of each day’s work, the open ends of the pipes sections shall be cappedsecurely and closed with end caps/ plugs, which will be supplied by BSNL, to preventthe entry of dirt / mud, water or any foreign matter into the pipe, until the work isresumed.

8.41 Optical Fibre cable is blown through the pre-laid PLB pipes, using Air jet blowingmachines. The PLB pipe shall be joined using air tight couplers which will be suppliedby BSNL. The pipes laid, should be airtight, and therefore minimum couplers have tobe used. The contractor shall ensure pipe issued are laid to the maximum lengths,without cutting. If couplers used are more than 5 per Km, the cost of additionalcouplers will be recovered from the contractor. The ends of each pipe and inside ofeach HDPE Socket shall be thoroughly cleaned of any dirt or other foreign materialsso as to avoid defects in the joints. The overlapping ends of the pipes shall be cutperpendicular with minimum gap required for the stopper inside the coupler. In case ofpushfit couplers, the pipe ends shall be pushed into the coupler, without opening thecoupler mechanism. To ensure required length of pipe goes into the coupler, markingshall be done on the pipe with marker before pushing into the coupler. If required,Nylon or Polypropylene rope shall be drawn through PLB pipes properly at the time oflaying pipes or before cable pulling, as directed by the Site Engineer. Coupling shouldbe done by skilled person, and special attention is required for coupling, as it could be

reason for failure of Duct Integrity Test, Cable blowing due to air leak. The location ofcoupler points shall also be indicated in the offset diagram. The joints shall be capableof withstanding subsequent pneumatic testing / air blowing.

8.42 Duct shall generally enter jointing/ manhole chambers at right angles or nearly rightangles to the walls. All duct pipes in jointing chambers and the duct ends in cablevaults will be sealed by end plugs. Extra duct pipe entries in the trenches shall besealed with a plastic duct cap at open ends.

8.43 Though normally the pipes supplied shall be of 200 m to 1000 m coils, BSNL maydesire to use shorter lengths of about 5m or more, and in such case the contractor isbound to lay the same. When bit lengths of PLB pipes are used, the contractor shallsegregate pipes of similar colours and use it in one stretch/ route i.e., mixed coloursshall not be used in a route unless warranted and permitted by engineer-in-charge.The bit PLB pipes shall be coupled using PVC pipes or couplers of suitable diameterand here again the coupling shall be done after applying (coating, dipping) withbonding compound. In case longer length PLB pipes are used, suitable couplers shallbe issued and they shall be installed by skilled workmen.

8.44 In City, Town, Urban area falling within Municipal / corporation limits, the PLB-HDPEPipes shall be laid with protection using RCC/G.I. pipes/Concreting reinforced withweld mesh. Moreover, in cross-country routes, if depth is less than 1.2 meters,protection by using RCC/G.I. Pipe/Concreting reinforced with weld mesh shall beprovided. Engineer-In-Charge shall decide about such stretches and type ofprotection to be provided in view of the site requirements. Normally 100 mm RCCPipes shall be used for protecting PLB-HDPE Pipes but if more than one PLB-HDPEPipes is to be laid and protected, RCC Pipe of suitable size to accommodate therequired number of PLB-HDPE Pipes shall be used.

8.45 The PLB-HDPE Pipes shall be laid in RCC Full Round spun Pipes/GI Pipes asrequired at road crossings. The RCC pipes / GI pipes shall extend at least 3meters on either side of the road at road crossings. At road crossings, extra GI / PLB-HDPE Pipes may be laid as per the direction of the Engineer-In-Charge. On Railbridges and crossings, the PLB/HDPE Pipes shall be encased in suitable cast iron asprescribed by the Railway Authorities.

8.46 Wherever RCC pipes are used for protection, the gaps between the RCC Collars andthe RCC pipes shall be sealed using cement mortar 1:3 (1:53 grade cement of reputedbrand, 3: fine sand without impurities) to bar entry of rodents. Every third collar ofRCC pipes (normally 2 meters length) and also both ends of RCC Pipes will beembedded in a concrete block of size 40 cm (L) x 40 cm (W) x 25 cm (H) of 1:2:4cement concrete mix (1:53 grade cement of reputed brand, 2: coarse sand, 3: stoneaggregate of nominal size of 20 mm.) so that the alignment of RCC pipes remain firmand intact and to avoid entry of rodents.

8.47 Wherever GI Pipes are used, special care should be taken to ensure that G.I. Pipesare coupled properly with the sockets so as to avoid damage to PLB/HDPE Pipe andeventually the OF Cable in the event of pressure coming on the joint and G.I. Pipejoint giving its way. Rubber bushes shall be used at either end of the GI pipes toprotect PLB-HDPE Pipe. Both the ends of G.I. Pipe will be embedded in a concreteblock of size 40 cm (L) x 40 cm (W) x 25 cm (H) of 1:2:4 cement concrete mix (1:53

grade cement of reputed brand, 2: coarse sand, 3: stone aggregate of nominal size of20 mm) so that the alignment of G.I. Pipes remain firm and intact and to avoid entry ofrodents.

8.48 In case of protection by concreting at site, the nominal dimension of concreting shallbe 200 mm. X 200 mm. Section. Cement Concrete Mixture used shall be of 1:2:4composition i.e., 1:53 grade Cement of a reputed company, 2: Coarse Sand, 4:Graded Coarse Stone aggregate of 20 mm. nominal size, reinforced with MS weldmesh. As the RCC is cast at site, it is imperative to ensure that special care is takento see that proper curing arrangements are made with adequate supply of water. Thecontractor shall invariably use mechanical mixer at site for providing RCC protection,to ensure consistency of the mix.

8.49 For carrying out concreting work in trenches, yellow PVC Sheets of width not less than1.0 M and of weight not less than 1 Kg. Per 8 sq. meters shall be spread and nailed onsides of the trench to form trapezoidal section for concreting in the cleaned trench, toavoid seepage of water into the soil. A bed of cement concrete mixture of appropriatewidth and 75 mm. thickness shall be laid on the PVC Sheet, before laying PLB-HDPEPipes. The PLB-HDPE Pipes shall then be laid above this bed of concrete. Afterlaying the PLB-HDPE Pipes, MS weld mesh is wrapped around and tied and concretemix is poured to form the cross sectional dimensions as instructed by the engineer-In-Charge. The strength of RCC is dependent on proper curing; therefore, it isimperative that water content of RCC mix does not drain out into the surrounding soil.Portions where cement concreting has been carried out shall be cured with sufficientamount of water for reasonable time to harden the surface. After curing, refilling of thebalance depth of the trench has to be carried out with excavated soil.

8.50 The PLB-HDPE Pipes/RCC/GI Pipes shall be laid only in trenches accepted byEngineer-In-Charge or his representative. The Contractor shall exercise due care toensure that the PLB/HDPE Pipes are not subjected to any damage or strain.

8.51 Water present in the trench at the time of laying the PLB-HDPE Pipes shall bepumped out by the contractor before laying the pipes in the trench to ensure that nomud or water gets into the pipes, thus choking it.

8.52 In case of nallahs, which are dry for nine months in a year, the PLB-HDPE Pipes shallbe laid inside the RCC Pipes / or GI Pipes and concrete laid at a minimum depth of165 cm, as instructed by the Engineer-In-Charge. The mechanical protection shallextend at least 5 Meters beyond the bed of nallah on either side.

8.53 Notwithstanding anything contained in clauses referred above, the engineer-In-Chargemay order, based on special site requirements, that the PLB-HDPE Pipes may beencased in reinforced cement concreted, as detailed, in bid.

Laying Protection Pipes On Bridges and Culverts :

8.54 In case trenching and pipe laying is not possible in the beds of the culverts, the pipesshall be laid over the culverts / bridges after getting due permission from thecompetent authority. Of late, the bridge construction authorities are providing ductsbelow the footpaths on the bridges for various services. The telecom Officers need tomaintain good liaison with the concerned authority to get one side of the duct allotted

for Telecom Cables. In such ducts, G.I. Pipes can be coupled and laid for pulling thecables. It would be pertinent to mention here that close liaison with bridge constructionauthorities would be of immense advantage in ensuring provision of ducts on one orboth the sides of the bridges as per future requirements. However, for laying cableson existing bridges, where duct arrangements does not exist, one of the followingmethods may be adopted.

8.55 Normally, in the Bridges/Culverts, where there are no ducts and where the cushion onthe top of the Arch is 50 cm. to 100 cm. or more, G.I. Pipe (carrying PLB-HDPEPipes/coils and cable) may be buried on the top of the Arch adjourning the parapetwall, by digging close to the wheel guards. Every precaution shall be taken to see thatno damage occurs to the arch of the culvert. After burying the GI Pipe, the excavatedsurface on the arch shall be restored.

8.56 Where the thickness of the Arch is less than 50 cm, the pipe must be buried under thewheel guard masonry and the wheel guard rebuilt.

8.57 If neither of the two methods is possible, the G.I. Pipes / GI Troughs must be clampedoutside the parapet wall with the clamps supplied by the Corporation. If necessary,the pipes may be taken through the parapet wall at the ends where the wall divergesaway from the road.

8.58 In case where the methods explained in clauses referred above are not possible, theG.I. Pipes/GI Troughs can be fixed on the top of the road kerb close to the inside faceof the parapet wall by means of clamps supplied, using raw plugs and wood screws orsmall diameter bolts, without damaging the concrete and limiting the external diameterof the bolts to 7.5 mm. The permission for carrying out this work will be obtained fromthe road Authorities by the Corporation.

8.59 Methods cited in above clauses should be carried out under close supervision of Roadauthorities.

8.60 The surface to be concreted should be thoroughly cleaned and leveled beforeconcreting. At both ends of the Bridges/Culverts, where the GI Pipes/GI Troughsslope down and get buried, the concreting should be extended to ensure that noportion of the GI Pipes/GI Troughs is exposed as ordered by the Engineer-In-Chargeto protect the Pipe / trough from any possible damage externally caused.

8.61 Where white wash / colour wash is existing on the Bridges / culverts, the same shouldalso be carried out on the concreted portion to ensure uniformity.

Back filling and Dressing of the Trench:

8.62 The earth used for filling shall be free from all roots, grass, shrubs, vegetation, trees,saplings and rubbish. Provided that the PLB-HDPE Pipes have been properly laid inthe trench at the specified depth, the back filling operation shall follow as closely aspracticable. The back filling operation shall be performed in such a manner so as toprovide firm support under and above the pipes and to avoid bend or deformation ofthe PLB-HDPE Pipes when the PLB-HDPE Pipes get loaded with the back filled earth.

8.63 At locations where the back filled materials contains stones / sharp objects which maycause injury to the PLB-HDPE Pipes and where the excavated or rock fragments are

intended to refill the trench in whole or in part, the trench should be initially filled, witha layer of ordinary soil or de-rocked loose earth of not less than 10 cm above thepipes.

8.64 Back filling on public, private roads, railway crossings, footpaths in city areas shall beperformed immediately after laying the PLB/HDPE pipes. Back filling at such locationsshall be thoroughly rammed, so as to ensure original condition and made safe fortraffic. All excess soil / material left out on road / footpath/railway crossing shall beremoved by contractor. However, along the high ways and cross-country, the dug upmaterial left out should be kept as heap above the trench while refilling.

8.65 In city limits, no part of the trench should be kept open for more than 50 metre lengthat any time and in all places where excavation has been done, no part of the trenchshould be kept open over night to prevent any mishap or accident in darkness. In citylimits, the back filled trench should be flooded with water to ensure settlement andconsolidation of the soil. The cave-in portions are to be refilled properly after flooding.The back filling operation shall be performed in such a manner so as to provide firmsupport under and above the pipes and to avoid bend or deformation of the PLB pipeswhen PLB pipes get loaded with the back filled each. The Contractor is responsible forrefilling and leveling of trench at his own cost, if found sunk / Cave-in at Later date. Thetime period for this is taken as 6 months from the completion of work. After back fillingthe trench, all excess soil/material left out on road/footpath/railway crossing shall beremoved by contractor and shall be dumped at the designated dumping yards asfinalized by Local Authorities. The vehicle thus utilized for this purpose should have validcurrent registration and should meet emission norms set by Local authorities.

ROAD RESTORATION WORK

8.66 Road restoration work is required to be performed in private roads, in VVIP roads, andin premises of corporate customers where OFC trenching is carried out. Therequirement for the road restoration shall be decided by the Engineer-in-charge. Thework is to be completed within 5 days of pit closure by back filling. The restoration is tobe carried out as per the specifications of the local agencies. The quality of the workshould be high and should not cause any hindrance to the traffic. The restoration workis to be carried out within the time allotted, for execution. Necessary material/ labourlogistics are to be planned by the contractor for proper completion of work in stipulatedtime. The restoration work consists of two components :

Cement concreting

8.67 The Sand settled in the pit is to be engraved for a depth of 300mm from the surface.The bed is to rammed for firm settlement.

8.68 The bed is to be filled with cement concrete of thickness 225mm.The cement concreteshould be done with 1:4:8 mixes(1: Cement,4:coarse sand,8: graded stone) using25mm down crushed stone to aggregate thickness of 225mm. the concrete has torammed well for firm settlement. Proper water curing is to be carried out.

8.69 The sand to be covered for smooth vehicular movement.

8.70 Any sand spilled over is to be cleaned and the area is to be swiped to clear any

8.71 Daily water curing of the pit is to be carried for a period of 3 days.

Black Topping

8.72 4 days from the concreting, the black topping of the pit is to be carried out. Roadrestoration with bitumen macadam for semi grouting 50 mm thick and premix carpetsurfacing of 25 mm thick over the grouted surface total up to 75 mm thick includingsupply of Asphalt, etc., evenly to match the road surface including consolidation androlling as per standard specifications of CPWD.

8.73 After completion of black topping any excess earth or sand available in the area is tobe cleared and the area is to be cleanly swiped.

8.74 Storm water drain inlets available in the vicinity to be cleared.

8.75 The contractor is responsible for refilling and redoing the work at his own cost if thesurface found sunk/cave-in at later date. The time period for this is taken as 6 monthsfrom the completion of work

SPECIFICATIONS FOR SUB – DUCTING

8.76 The work involves laying of PLB / HDPE/ PVC pipes through existing telecom ducts/troughs. Normally 3 nos. of 40 mm PLB pipes can be sub ducted in a 100 mm ducts.The rates are prefixed as given in the tender schedule.

8.77 The following are approximate amount of work involved in sub-ducting for 1 Km:

a) Arranging barricades, protection and caution boards etc.,b) Opening manholes (average 7 per Km), dewatering, exhaust of trapped airc) Cleaning of PVC ducts, removal of blocks in the duct indicated by site –engineerd) Inserting of 12 / 16mm Nylon rope in duct for pulling the PLB pipes.e) Transportation of PLB pipe from store godown, and arranging pipes as perspec, bundling 1 or up to 3 nos. and pulling in one PVC duct of 100 mm size.No. of pipes to be pulled depends on size of PVC duct and may vary.Spools should be de-coiled using jack mechanism and bends removed byproper forming so that the pipes are straight.f) Clamping in manholesg) Duct integrity test and preparation of route diagrams.

8.78 The manholes available between 100 – 200 m approx have to be opened, using keys,and should be dewatered by using pumps, and subsequently left open for some timefor the air to exhaust, before persons enter inside the manhole.

8.79 The Contractor should himself provide the necessary digging tools, camping materialsfor his workers, caution boards, red lamps during night, etc. at his own cost and heshould also observe all prescribed precautions during this work for safety ofpedestrians, vehicular traffic, etc. Before opening the manholes, barricades and

warning boards should be provided at sufficient distance from the manholes, to protectthe pedestrians/ workers/ traffic.

8.80 16/12 mm dia. nylon rope should be inserted into the duct by blowing/ rodding etc., orby using 4 mm rope if available in the duct. With the help of this 16 / 12 mm dia ropePLB pipe should be pulled. The PLB pipes should be placed in position, uncoiledusing de-coiling tools. The 16/12 mm rope will be tied to the PLB pipe and pulled.Lubricant should be provided by the contractor and it should be put in the ductsbefore pulling the pipes. If more number of pipes are to be pulled, the pipes will bepulled in a bunched form as per the decision of Engineer-in-charge. The number ofpipes to be laid and the structure to be followed could change as per the requirementof BSNL and this is within the scope of the contract.

8.81 After pulling the PLB pipes, the exposed pipes in the manhole are to be protected bysuitable protection as instructed by site engineer and suitably clamped. PLB pipes atmanholes should be lead along the walls & suitable MS clamps should be provided (4on each side). Additional protection if required shall be provided at manholes.

8.82 If needed, rodding has to be done in the allotted duct pipe, for which the pipes have tobe hired by the contractor. In certain cases if there are no free slots, existing unutilizedcable may have to be pulled out to make the slot free. In the entire work only 40 mmPLB pipes (or HDPE , PVC pipe of about 50 mm size) will be supplied by BSNL.

8.83 Supply and fixing of Galavanised MS clamps for suspending PLB pipes in manholeshas to be done by the contractor. After fixing the clams the PLB pipes should besecurely fixed.

8.84 Making openings in concrete manholes, by drilling etc., for the desired dimensions forleading out PLB pipes.

8.85 Duct integrity Test : Testing of the pipe before and after laying for holding of pressure,detection of air leak etc.,

8.86 Offering the completed work for acceptance testing for, quality, air leakage & allaspects of the constructions.

8.87 Preparation of 3 – dimensional offset diagram in computer showing duct, offset fromCenter line, edge of road, road boundary with cross- sectional views, details of allimportant buildings, landmarks etc., shall be incorporated.

SPECIFICATION FOR LEADING IN:

8.88 The cable shall be led in into the specified room of the exchange or desired site likeBTS etc. This may involve laying in ducts or trenching in exchange compound /desired site, and extending to the desired room by laying GI pipes, PVC pipes etc.,both vertically & horizontally along the wall , roof etc., as per the site conditions. Therate payable is as per prefixed rates.

8.89 In case of trenching in compound, the rates for trenching will be applicable.

8.90 In case of laying in existing ducts, the rates for sub – ducting will be applicable.

8.91 Leading in using existing support: In sites, where existing support structure isavailable, GI pipes along with Rigid PVC pipes / PVC hose, shall be clamped on thesupport structure. This particular work shall be taken up with utmost care not todamage the telecom/ power cables. The work involves supplying and fixing PVC pipes(32 mm dia and 4 mm thickness) or PVC hose, inside GI pipe, with clamps at every 1metre, cable ties to the supporters and drawing cable through them. The work may berequired to be carried out in multistoried buildings also with appropriate clamps fixingIn case Engineer-in-charge decides GI pipe is not required, direct PVC pipe/ hose willbe clamped. In certain buildings, where more number of cable are not expected, onlyone or two pipes may be clamped directly on the wall of the building using GI clampsby embedding in the structure of the building. The pipe shall be led in into the desiredroom as directed by the site engineer. It will also involve making holes in the walls,foundations; slabs etc., by drilling etc., All items are to be supplied by the contractor,except GI pipe which will be supplied by the Corporation.

8.92 Leading in where existing support is not available: Wherever support is notavailable new support and runways have to be fixed by the contractor. This particularwork shall be taken up with utmost care not to damage the telecom/ power cables.The work involves supplying and fixing runways with angle support at every 1 metre,by embedding in the structure of the building, laying PVC pipes, cable ties to thesupporters and drawing cable through them, and the work may be required to becarried out in multistoried buildings also. The pipe shall be led in into the desiredroom as directed by the site engineer. It will also involve making holes in the walls,foundations; slabs etc., by drilling etc., All items are to be supplied by the contractor,except GI pipe which will be supplied by the Corporation.

8.93 After leading in pipes upto the inside of the desired room at the desired location, asdecided by the site in charge, OF cable shall be led in. In the leading in portions bothvertical and horizontal, the cable shall be clipped to GI wire, and the GI wire shall befixed at intermediate locations, so that the cable is not put to strain.

DUCT INTERGRITY TEST:

8.94 Laying of PLB pipes shall be done with utmost care, and only skilled personnel shallfix the couplers. The PLB pipes should be checked for pressure leak after laying andany defect shall be rectified by the contractor at his cost. Duct integrity test should beconducted as described below, and no extra cost is payable.

8.95 The test involves cleaning of the PLB pipe, blowing of a wooden bullet and conductingthe pressure leak test. The tests shall be conducted for single stretches having aminimum length of 4 Km, having coupled PLB pipes.

8.96 The remote end of the buried PLB pipe is left open. Two litre of lubricating oil ispoured in the PLB pipe at the blowing end. A rectangular sponge piece of dimension60mm x 50 mm shall be inserted in the PLB pipe. Air shall be blown at 10 Kg/cm2

pressure into the pipe. The sponge shall come out at the remote end after cleaning thepipe.

8.97 A wooden bullet having 80% of the inner diameter of the PLB pipe shall be inserted at

the blowing end. The bullet shall be received at the end of the pipe, if there is no blockin the pipe. Any block in the pipe should be removed or rectified by the contractor.

8.98 After the bullet is received at the remote end, the remote end should be closed withthe end plug.

8.99 Air leakage test : The PLB pipe from end to end for a minimum length of 4 Km shall bepressurised to 10 Kg/cm2 using suitable adapters at both ends, with pressure meters.The pressured pipes shall be left for 1 day and the leakage shall be measured. Theleakage shall be less than 0.2%. If any leakage the same shall be identified andrectified.

CABLE BLOWING / PULLING

8.100 Cable blowing is the preferred way of laying cable. Cable pulling shall be resorted to,only in very small sections, as per the decision of the Engineer-in-charge. The rate forCable blowing and pulling is prefixed. The Contractor has to bring the blowingmachine, air compressor, manpower and other resources required, to complete thework. Only Optical Fibre cable and RCC joint rings shall be provided by BSNL. Thecable shall be led-in into desired room in the exchange/ site as per directions of theSite – Engineer. Preparation of cable diagram in computer showing cable make, drumno, duct, coils offset of manholes etc., from Center line, edge of road, road boundarywith cross- sectional views, etc., shall be incorporated. In case where offset diagramsare available, the details of cable shall be incorporated into the diagrams, in computer.The work of cable pulling/ blowing includes the work of cable pulling up to exchangetermination point and has to be carried out as per the directions of Engineer-in-charge.

General Precautions --- Handling of Cable Drums

8.101 The Optical Fiber Cable drums should be handled with utmost care. The drums shouldnot be subjected to shocks by dropping etc. They should not be rolled along theground for long distances and when rolled, should be in the direction indicated by thearrow. The battens should be removed only at the time of actual laying. OF cabledrum loading at the store and unloading at the site are to be done with extreme care.A portable metallic ramp suitable for the truck-in-use may be got prepared which canbe conveniently used for this purpose.

8.102 Precautions – Handling of cable drums :

a) Do not drop cable drums from height. Use fork lift or similar arrangement.b) Do not keep drums flat.c) Do not roll the drums for transportation except for short movements.d) Do not remove battens until cable laying work is to actually start.

8.103 Precautions to be observed to avoid fibre breaks / high losses.

a) Maintain proper direction as marked on the drum, for rolling/unwinding the drum/ cable

b) Never pull cable without pulling eyec) Do not pull cable suddenly or by Jerks

d) Use anti-twist device to avoid twisting of optical fibre cablee) Before pulling the cable ensure that ducts are clean.f) Never exceed pulling force beyond recommended limits (e.g. 169 for LT cable)g) Never bend the cable beyond recommended limits. Bending radius should

always be more than 30 x D. (Where D = outer dia., of the optical fibre cable)h) Maintain proper communication / coordination among the pulling crew, during

cable pulling.i) Fibre break cases reported after cable pulling/ blowing will have to be attended

by the contractor and also will entail recovery of costs.j) Store lengths of cable properly looped in the manholes / pits.k) Avoid longer pulls. Deploy manpower at intermediate points.

CABLE BLOWING

8.104 The tenderer should blow/deblow the cable in the PLB duct by airjet blowing as perSpecification. Within 7 days of notice, the contractor shall commenceblowing/deblowing and complete the work at an average speed of 4 KM per day.There shall not be any damage to the OF cable blown/deblown. . Cable blowing shallbe done using blowing machine which can be kept inside the manhole, as it will avoidformation of loop outside. Compressor of suitable capacity shall be used.

8.105 Blowing has to be done for the route length, end to end. This implies work may haveto be done beyond the route awarded to the contractor, and he is bound to do it. Theworks involved in blowing are listed below.

Transportation of all materials issued by BSNL from stores includingcable drums, joint rings and handling of the same (including loading, unloading,handling and local distribution). Digging of manhole and reinstatement after blowing of cable. The opening of End plug, de-roping of rope in PLB pipes. Duct integrity test as per specifications. If any coupler is not connected properly, they should be connected atthe coupling points. If required the coupling points are to be dug open for thispurpose and the existing duct cut, aligned and coupled properly. Extra piece ofpipe if required has to be coupled. Blowing of cable and fixing cable seal plug. Keeping 30mtr coil in every joint chamber. Digging of joint chambers, placing RCC chambers supplied by BSNL,and filling with river sand Closing the manhole/joint cover and ensuring that the cover sitsproperly.

8.106 If there is time gap after laying of pipes and blowing, the contractor should carry outDuct Integrity test of the pipe to the specified pressure and ensure that there is noblock or leak, as per specifications. If there are blocks the same shall be rectified. Acheck-list may be submitted to the Site Engineer of the section after every pipe istested, indicating the blocks etc., and action taken to rectify the ducts. No separaterates are payable for DIT or rectification of ducts.

Cable should be blown for the entire section in the pre-assigned pipe &colour. No

crossing should take place in manholes between different coloured pipes, if multiplepipes are available. Ensure no mud, water or debris goes inside the pipe during thework. Any obstructions found in the pipeline after cable blowing, shall be removed atthe expense of the Contractor.

Depending upon the length of the cable and the addl. length required at manholes,chain measurement should be taken from the starting end of the section, and thedrums should be properly located.

The drums are of approx. 2 Km to 4 Km, and may sometimes be smaller. It may bepreferable to blow the OF cable by placing the drum at the manhole point nearest tomidpoint of the coil size, and blow in both directions.

The standard practice is to keep the clock-wise end of the cable to A side of the routeand the anticlockwise end to 'B' side. Also it is the convention to have the clock-wiseend on top and anticlockwise at the bottom of the drum. With that in view, the OFcable is mounted on the jack and wheel and positioned at the manhole point. It isimportant to keep the drum shaft (axle) in horizontal position by adjusting the jacks.After it is set in position, the cable should be inserted into the blowing machine.

Proper communication is to be established between the lead-in and take outmanholes. This can be done by suitable Trans Receivers (Walkie Talkies) or Magnetotelephones with drop wire. This has to be arranged by the contractor andcommunication with each point should be kept throughout the blowing.

OF cable at RCC chambers should be lead along the walls & suitable MS clampsshould be provided (4 on each side). Additional protection of cable if required shall beprovided at manholes.

CABLE PULLING

8.107 Cable pulling shall be done normally for very small sections, as per directions of theEngineer-in-charge.

8.108 Manholes shall be marked along the route where PLB pipe is laid, of approx. size of3m length x 1.0m width x 1.65m depth shall be excavated for pulling the cables. Theremay be situations where additional manholes are required to be excavated, for somereasons, to facilitate smooth pulling of cable. Excavation of additional manholes will becarried out, without any extra cost. De-watering of the manholes, if required, will becarried out without any extra costs. De-watering/De-gasification of the ducts, ifrequired, will be carried out without any extra costs.

8.109 In case, rope is not available in the prelaid pipes, then 4 mm PP rope shall be blowninside the PLB pipe after Duct Integrity Test. At Manholes the PLB pipes shall be cut,and before cable pulling a through pipe will be inserted with two sockets. This willfacilitate to get a through conduit even after cable pulling. Before cable pulling thePLB/ HDPE pipes are to be cleaned for pulling the cable without exerting unduetension on the OF cable. While cleaning, excessive pressure should not be put whichmay result in breaking of P.P. rope and thus require opening of additional manholes.However, in case the cleaning rope gets stuck up during pulling, the location of

clogging of PLB/HDPE Pipe should be measured and located accurately. The trenchat that location should be opened and the PLB/HDPE Pipe should be cleaned properlyor if not possible it should be changed by a clean new PLB/HDPE Pipe to facilitateeasy cable pulling at a later stage without any breakage. If clogging of PLB/HDPEPipe is in the location where the pipes are protected either by RCC Pipe or byconcreting and the protection is broken for cleaning/changing the PLB/HDPE Pipe, theprotection thus removed should be brought back to normal by the contractor withoutany extra cost. However, PLB/HDPE Pipes, RCC Pipes required for this purpose willbe supplied by BSNL.

8.110 The Optical fibre cables are available in drums in lengths of approx. 2 Km - 4kms.Thecables shall be manually pulled through already laid PLB Pipes by using 8mm PP ropewhich is pulled initially by 4 mm rope. This work is to be carried out under the strictsupervision of site-in-charge. At a time, maximum three persons at every manholeshould be deployed to pull the cable as more tension to cable may lead to breaking offibres. Cost of such damages will be recovered from the contractor.

a) As the drums are standardized for 2 or 4 Km. for highways, it is preferable to laythe cable by placing the cable drum at the manhole point nearest to 1 or 2 Km,from the joint locations.

After it is set in position, the cable covering battens areremoved and the top end with the cable eye is taken out and kept ready forconnecting to the rope.

c) The 8/12mm rope end could be permanently fixed to one end of swivel (Anti-twistdevice) or by means of a shackle and the other end of the swivel is tied to thepulling eye. If cable-pulling eye is not available due to any reason, then a cablegrip is to be used.

d) As the cable length is 2/4 Km, during cable laying work proper communication is tobe established between the lead-in and take out manholes. This can be done bysuitable Trans Receivers (Walkie Talkies) or Magneto telephones with drop wire.This has to be arranged by the contractor and communication with each pointshould be kept throughout the pulling.

e) To reduce the friction between the cable and the PLB pipe a suitable lubricant maybe continuously applied with a sponge to the cable surface during pulling at everyintermediate man- hole. The use of a suitable lubricant reduces the frictionbetween the cable and the conduit. The use of lubricants considerably reduces thecoefficient of friction between the cable and the pipe thus making the pullingeasier. This is especially true while pulling the cable thro' the last 2 manholes (i.e.last 400 m) in a 1 km pull. The use of the lubricant will be able to reduce thecoefficient of friction from 0.5 to 0.18.

f) Rollers of hard rubber should be used near the drum-end as the cable enters thepit. With the communication established by magneto or walkie-talkies, continuousmonitoring of the pulling is to be done with care and alertness. Special attentionshould be paid to the cables at the manholes to avoid any scratching of the sheathat the edge of the pipe. Arrival of the cable at the man-hole (joint location) shouldbe immediately communicated to the drum- controlling end so that another extralength of 30 mtr or such length as instructed by Engineer –in-charge could bepulled out for coiling purposes.

Laying the remaining half

a) Uncoil the cable and make the formation of 8. This should be done manually withsufficient care and keeping the minimum bending radius in mind.

b) Take out the end of the cable with eye and repeat the process of connecting tothe 12mm rope with Anti twist swivel.

c) Repeat the process of pulling as done earlier with special attention to lubricant,supervision and coiling the end and placing it in the pit.

d) After each drum is laid, the coil in the pit is protected by RCC ring. The mouth ofthe PLB pipes at every manhole should be closed by cable sealing plug. This ismainly required for prevention of rodent entry.

8.111 Closing of intermediate manholes : A correct length of PLB pipe with sockets at bothends are to be inserted before cable pulling at all intermediate manholes. After cablepulling, the pipe should be coupled to the main pipe to make the conduit through.Thereafter reinstatement of the manholes is to be done.

8.112 After pulling of the drum is completed, the PLB/HDPE Pipes in each manhole shouldbe made through to avoid entry of rodents/mud into PLB/HDPE Pipes.

8.113 After fixing of PLB Pipes at manholes, necessary back filling/reinstatement anddressing of manholes should be carried out as referred under trenching. The locationof the pulling manhole should be recorded for preparation of documentation.

8.114 The Contractor should be in a position to pull at least Two drums i.e., 4 Kms perday. The contractor should employ a minimum of 25 skilled labourers and at least 5supervisors.

JOINT CHAMBER:

8.115 Construction of Jointing Chamber:

The joint chambers are provided at every joint to keep the O.F.C. joint well protectedand also to keep extra length of cable, which may be, required to attend the faults at alater date. Jointing chambers are to be prepared normally at a distance of every 2 Km.Actual location of jointing chamber depends on length of cable drum andappropriateness of location for carrying out jointing work. The location is finalized byEngineer-in-charge. The jointing chambers are constructed either of brick masonrywork at site & pre cast RCC slabs for covers or by way of fixing pre-cast RCC

chambers and covers as per the instructions from Engineer-In-Charge.

8.116 Pre cast RCC chamber.

For fixing pre cast RCC chamber, first a pit of size 2m x 2m x 1.8 m depth is requiredto be dug. Pre cast RCC chamber consists of three parts (i) round base plate in twohalf of 140 cm dia. and 5 cm thickness (ii) full round RCC joint chamber with dia. of120 cm and height of 100 cm and thickness of 5 cm (iii) round top cover will be in twohalves with dia. of 140 cm and thickness of 5 cm having one handle for each half incenter and word ‘OFC’ engraved on it. The full round RCC chamber may be ofdifferent height or in two halves, as per the requirement of local conditions. Pre castRCC chamber (which is coming in part) should be placed in the pit and parts shouldbe fixed by applying cement mortar. The pre cast RCC chamber will be supplied bythe corporation. After, fixing the pre cast RCC joint chamber, the joint chamber is filledwith clean sand before closing. Lastly, back filling of joint chamber pit with excavatedsoil should be carried out up to normal ground level and compacted.

Fixing Of Route Indicators/Joint Indicators:

8.117 Pits shall be dug 1m towards jungle side at every manhole and jointing chamber forfixing of Route/Joint Indicator. In addition, Route Indicators are also required to beplaced where O.F. Cable changes directions like road crossing etc. The route/jointindicators made of pre-cast RCC shall be supplied by BSNL and have the followingdimensions approx : Base - 250 mm x 150 mm; Top - 200 mm x 75 mm;Height- 1250 mm

8.118 The pits for fixing the indicator shall be dug for a size of 60 cm x 60 cm and 75 cm(depth). The indicator shall be secured in upright position by ramming with stone andmurrum up to a depth of 60 cm and concreting in the ratio of 1:2:4 (1: cement, 2:coarse sand, 4 stone aggregate 20 mm nominal size) for the remaining portion of 15cm Necessary curing shall be carried out for the concreted structure with sufficientamount of water for reasonable time to harden the structure.

8.119 The route and joint indicator shall be painted with primer before painting with oil paint.The material used should bear ISI mark. The word ‘BSNL OFC’ should be engravedon the route/joint indicators, along with the route name. The size of each written lettershould be at least 3.5 cm The colours of painting and sign writing is as under:

(1) For Joint Indicator Yellow(2) For Route Indicator Orange(3) For Letters White

8.120 The numbering scheme for route indicators will be Joint No./Route Indicators No. forthat joint. For example 2/6 indicator means 6th route indicator after 2nd joint.Additional joints on account of faults at a later date should be given number ofpreceding joint with suffix A, B, C and D. For example sign writing 2A on a jointindicator means, additional joint between joint No.2and 3. The numbering existingroute/joint indicator should not be disturbed on account of additional joints. Enamelpaints of reputed brand should be used for painting and sign writing of route as welljoint indicators. It is at the discretion of BSNL to change the colours and no additional

payment shall be made. The contractor shall confirm the colour to be painted from theEngineer-in-charge before commencement of the work.

Providing OF Cable Storage Boxes

8.121 The optical cable should be coiled by providing 760 mm x 760 mm x 200 mm size boxmade of iron sheet of 20 SWG thick with 2 doors and locking arrangements as perdirections of Site engineer. Proper sign writing shall be done on the OF storage box.The work involves the cost of providing and fixing OF cable storage box, coiling OFCand sign writing

DOCUMENTATION:

8.122 The documentation, consisting of the following shall be prepared exchange toexchange for intra SSA OFC links and for each section in case of inter SSA/NationalLong distance routes.

i) Route Index Diagrams – General: This diagram shall consist of Cable RouteDetails on Geographical Map drawn to scale with prominent land marks andalignment of cable with reference to road. This shall be prepared on A-3 sheets of80 GSM.

ii) Route Index Diagrams – Profile: These diagrams will contain:

Make and size of the cable. Two point Offset of cable i.e., one from centre of the road andone from the nearest compound wall / fixed structure, each taken atevery 10 meters; Depth profile of cable at every 10 meter; Details of protection with type of protection depicted on it; Location of culvert and bridges with their lengths and scheme oflaying of PLB Pipe thereon. Location of Crossings with Three Point Offset i.e., from nearestpermanent structures taken in different directions. Important landmarks, Name of the Roads to be facilitated forlocating the cable in future. Locations of jointing and pulling manholes with Three PointOffset i.e., from nearest permanent structures taken in differentdirections.

These diagrams shall be prepared on A-4 sheets of 80 GSM. On one sheet profile ofmaximum 200 meters shall be given to ensure clarity.

iii) Joint location Diagram: This diagram will show:

Geographical location of all the joints. Location of joints manholes with Three Point Offset i.e., fromnearest permanent structures taken in different directions. Depth of Joint Chamber covers from ground level.

8.123 All the diagrams (i), (ii) & (iii) shall bear the signatures of the contractor, the Engineer-in-charge as a proof of accuracy of the details. The diagrams shall be bound in A-4size book with cover. The cover sheets shall be of 110 GSM and laminated.

8.124 The front cover shall have the following details.1. Name of the SSA/NTR Organisation.2. Name of the OFC link.3. Name of the Contractor4. Date of commencement of work.5. Date of completion of work

For each route/section 5 sets of above mentioned document along with 1 set ofSoftcopy in CD format (Microsoft / AutoCAD compatible) shall be submitted.

SAFETY PRECAUTIONS:

8.125 Safety Precautions when excavating or working in excavations close to electriccables :

The Engineer-in-charge of the work should get full information from Electricityundertaking regarding any electric cables, which are known or suspected to exist nearthe proposed excavation and unless this is done, excavation should not be carried outin the section concerned. The electricity undertaking should be asked to send arepresentative and work should be proceeded in close consultation with them.

Only wooden handled hand tools should be used until the electric cables have beencompletely exposed. Power cables, not laid in conduits, are usually protected fromabove by a cover slab of concrete, brick or stone. They may or may not be protectedon the sides. It is safer, therefore, always to drive the point of the pickaxe downwardsthen uncovering a cable, so that there is less chance of missing such warning slabs.No workman should be permitted to work alone where there are electric cablesinvolved. At least one more man should be working near by so that help can be givenquickly in case of an accident. If disconnection of power could be arranged in thatsection it will be better. No electric cables shall be moved or altered without theconsent of the Electric Authority and they should be contacted to do the needful. If anelectric cable is damaged even slightly, it should be reported to the electric Authorityand any warning bricks disturbed during excavation should be replaced while backfilling the trench. Before driving a spike into the ground, the presence of otherunderground properties should be checked. Information on plans regarding thelocation of power cables need not to be assumed as wholly accurate. Full precautionsshould be taken in the vicinity until the power cable is uncovered. All electric cablesshould be regarded as being live and consequently dangerous. Any power isgenerally dangerous, even low voltage proving fatal in several cases.

8.126 Electric shock-Action and Treatment :

Free the victim from the contact as quickly as possible. He should be jerked awayfrom the live conductors by dry timber, dry rope or dry clothing. Care should be takennot to touch with bare hands as his body may be energized while in contact. Artificialrespiration should begin immediately to restore breathing even if life appears to beextinct. Every movement of delay is serious, so, in the meanwhile, a doctor should becalled for.

8.127 Safety precautions while working in public street and along railway lines

Where a road or footpath is to be opened up in the course of work, special care shouldbe taken to see that proper protection is provided to prevent any accidents fromoccurring. Excavation work should be done in such a manner that it would not undulycause inconvenience to pedestrians or occupants of buildings or obstruct road traffic.Suitable bridges over open trenches should be so planned that these are required forthe minimum possible time. Where bridges are constructed to accommodatevehicular traffic and is done near or on railway property, it should be with the fullconsent and knowledge of the competent railway authorities.

8.128 Danger from falling material:

Care should be taken to see that apparatus, tools or other excavating implements orexcavated materials are not left in a dangerous or insecure position so as to fall or beknocked into the trench thereby injuring any workman who may be working inside thetrench.

8.129 Care when working in Excavations :

Jumping into a trench is dangerous. If it is deep, workmen should be encouraged tolower themselves. Workers should work at safe distance so as to avoid striking eachother accidentally with tools. If the walls of the trench contain glass bits, corroded wireor sharp objects they should be removed carefully. If an obstruction is encountered, itshould be carefully uncovered and protected if necessary. Care must be taken to seethat excavated material is not left in such a position that it is likely to cause anyaccident or obstruction to a roadway or waterway. If possible the excavated materialshould be put between the workmen and the traffic without encroaching too much onthe road.

8.130 Danger of Cave in:

When working in deep trenches in loose soil, timbering up / shoring the sides willprevent soil subsidence. The excavated material should be kept at sufficient distancefrom the edge of the trench or pit. Vehicles or heavy equipment must not be permittedto approach too close to the excavation. When making tunneled opening, it should beensured that the soil is compact enough to prevent cave in even under adverseconditions of traffic. Extra care should be taken while excavating near the foundationsof buildings or retaining walls. In such cases, excavation should be done graduallyand as far as possible in the presence of the owners of the property.

8.131 Protection of Excavations :

Excavations in populated areas, which are not likely to be filled up on the same dayshould be protected by barriers or other effective means of preventing accidents andthe location of all such openings must in any event be indicated by red flags or othersuitable warning signs. During the hours from dusk to dawn, adequate number of redwarning lamps should be displayed. Supervisory Officers should ensure that allexcavations are adequately protected in this manner as serious risk and responsibilityis involved. Notwithstanding adoption of the above mentioned precautions, worksinvolving excavations should be so arranged as to keep the extent of opened groundand the time to open it to a minimum.

8.132 Precautions while working on roads :

The period between half an hour after sun-set and half an hour before sunrise, andany period of fog or abnormal darkness may also be considered as night for thepurpose of these instructions, for the purpose of providing the warning signs.Excavation liable to cause danger to vehicles or the public must at all times beprotected with fencing of rope tied to strong uprights or bamboo poles at a suitableheight or by some other effective means. Any such temporary erection which is likelyto cause obstructions and which is not readily visible should be marked by postscarrying red flags or boards with a red background by day and by continuously lightedlamps at night.

The flags and the lamps should be placed in conspicuous positions so as to indicatethe pedestrians and drivers of vehicles the full expanse i.e. both width and length ofthe obstruction. The distance between lamps or between floors should not generallyexceed 1.25m. along the width and 6 m along length of the obstruction in non-congested areas, but 4 meters along the length in congested areas. If the excavationis extensive, sufficient notice to give adequate warning of the danger, should bedisplayed conspicuously not less than 1.25m above the ground and close to theexcavation. Where any excavation is not clearly visible for a distance of 25m to trafficapproaching from any direction or any part of the carriage way of the road in which theexcavation exists ,a warning notice should be placed on the kerb or edge all suchroads from which the excavation or as near the distance as is practicable but not lessthan 10M from the junction of an entering or intersecting road in which the excavationexists. All warnings, in these should have a red background and should be clearlyvisible and legible. All warning lamps should exhibit a red light, but white lights maybe used in addition to facilitate working at night. Wherever required a passage forpedestrians with footbridge should be provided. At excavations, cable drums, toolsand all materials likely to offer obstructions should be properly folded round andprotected. This applies to jointer’s tents as well. Leads, hoses etc. stretched andacross the carriageway should be guarded adequately for their own protection andalso that of the public.

8.133 Traffic Control :

The police authorities are normally responsible for the control of traffic and mayrequire the setting up of traffic controls to reduce the inconvenience occasioned byestablishment of a single line of traffic due to restriction in road width or any other form

of obstruction caused by the work. As far as possible, such arrangements should besettled in advance. If there are any specific regulations imposed by the localauthorities, these should be followed.

8.134 Work along Railway Lines :

Normally all works at Railway crossing is to be done under supervision of the railwayauthorities concerned, but it is to be borne in mind that use of white, red or green flagsby the Departmental staff is positively forbidden to be used when working along arailway line as this practice may cause an accident through engine drivers mistakingthem for railway signals. When working along a double line of railway, the men shouldbe warned to keep a sharp look on both the “UP” and “DOWN” lines to avoid thepossibility of any accident when trains pass or happen to cross one another near thework spot.

8.135 Procedure and Safety precautions for use of explosives during blasting fortrenching :

In areas where the cable trench cannot be done manually on account of boulders androcks, it is necessary to blast the rocks by using suitable explosives. The quality ofexplosive to be used depends on the nature of the rocks and the kind of boulders. Afew types of explosive fuses and detonators normally used for making trenches forcable works are detailed below:

i) Gun powderii) Nitrate Mixtureiii) Gelatiniv) Safety fusev) Electric Detonatorvi) Ordinary Detonator

8.136 Procedure:

A detailed survey of the route is to be done to assess the length of the section wheretrenching is to be done with the help of blasting. A route diagram of the rocky sectionmay be prepared indicating the length of the route where the explosives are to beused. For the purpose of obtaining license, a longer length of route should be given inthe application as in many cases, after digging, rocks appear were blasting was notinitially anticipated.

Next a license will have to be obtained for use and storing of explosive in that section.If the area falls under a police commissioner, the authority for granting such license isthe police commissioner of the concerned area. When the route does not fall in thejurisdiction of a police commissioner, the authority for issuing license is the DistrictMagistrate.

The concerned authority should be applied in prescribed form with a route map. Theconcerned authority will make an enquiry and issue a license for using / storingexplosives for cable trenching work. Such license will be valid for 15 days only. Thelicense should be got renewed if the blasting operation need to be extended. Once thelicense is granted, it is the responsibility of the holders of the license for the proper useof explosives, its transportation and storing.

8.137 Method of using :

The safest explosive is the Gelatin and electric detonator. Gelatin is in the form of astick. Electric detonator is a type of fuse used for firing the explosive electrically.Holes are made at suitable intervals on rocky terrain or boulders either by aircompressor or by manual chipping. The depth of the holes should be 2 to 3 ft. Fill upthe holes with small quantity of sand for about 6”. First the electric detonator is to beinserted into the Gelatin and the Gelatin is to be inserted into the holes keeping the+ve and –ve wiring of electric detonators outside the holes. Again refill the holes withsand. These +ve and –ve insulated wires of detonator are then extended and finallyconnected to an EXPLODER kept at a distance of not less than 100m.

Now the explosive is ready for blasting. But, before connecting wires to exploder forblasting, all necessary precautions for stopping the traffic, use of red flags, exchangeof caution signals, etc., should be completed and only then Exploder should beconnected and operated.

8.138 Operation of exploder (IDL Schaffler type 350 type exploder):

The type 350 blasting machine consists of a bearing block with blasting machinesystem and the explosion proof light – alloy injection moulded housing. The exploderis held with the left hand. The twist handle is applied to the drive pin, clapped with theright hand turned in the clock wise direction in continuous measurements at thehighest speed from the initial position until it reached to a stop. At this stage anindication lamp will glow. When the indication lamp glows, "press button switch"should be pressed. This will extend the electric current to detonator and Gelatin willbe detonated. The rock will be blasted out of the trench. Number of holes can beblasted in a single stroke by connecting all such detonators in series connection andfinally to the exploder. After blasting, again mazdoors are engaged on the work toclear the debris. If the result of the first blasting is not satisfactory, it should berepeated again on the same place.

8.139 Warning :

There may be two reasons for unsatisfactory results of the blasting :a) Misfire of Gelatin due to leakage of current from detonator;

b) Over-loading because of overburdens.

Never pull the broken wire pieces from the holes in such cases. Attempt should notbe made to re-blast the misfired Gelatin. The safest way is to make a fresh hole by itsside and put fresh Gelatin in that hole and blast it.

8.140 Precautions :

The abstract of Explosives Rules, 1983 which are relevant to our work is given below:

Restriction of delivery and dispatch of explosives :No person shall deliver or dispatch any explosives to any one other than a person who

a) Is the holder of a license to possess the explosives or the agent of aholder of such a license duly authorized by him in writing on his behalf.

O Rb) Is entitled under these rules to possess the explosives without alicense.

The explosives so delivered or dispatched shall in no case exceed the quantity, whichthe person to whom they are delivered or dispatched is authorised to possess with orwithout a license under these rules.

No person shall receive explosives from any person other than the holder of a licensegranted under these rules. No person shall receive from or transfer explosives to anyperson for a temporary storage or safe custody in a licensed premise unless priorapproval is obtained from the Chief Controller.

A person holding license for possession of explosives granted under these rules shallstore the explosives only in premises specified in the license.

Protection from Lightening During Storing :

Every magazine shall have attached there to one or more efficient lighteningconductors designed and erected in accordance with the specification laid down inIndian Standard Specifications No.2309 as amended from time to time. Theconnections to various parts of earth resistance of the lightening conductor terminal onthe building to the earth shall be tested at least once in every year by a qualifiedelectrical engineer or any other competent person holding a certificate of competencyin this behalf from the State Electricity Department. A certificate showing the results ofsuch tests and the date of the last test shall be hung up in conspicuous place in thebuilding.

Precautions during thunder-storm :

When a thunder-storm appears to be imminent in the vicinity of a magazine or storehouse, every person engaged in or around such magazine and store house shall bewithdrawn to a safe distance from such magazine or store house and the magazineand store house shall be kept closed and locked until the thunder storm has ceased orthe threat of it has passed.

Maintenance of Records:

Every person holding a license granted under these rules for possession, sale or useof explosives shall maintain records in the prescribed forms and shall produce suchrecord on demand to an Inspecting Officer.

Explosives not to be kept in damaged boxes :

The licensee of every magazine or store house shall ensure that, the explosives arealways kept in their original outer package. In case, the outer package gets damaged

so that the explosive contained therein cannot be stored or transported, suchexplosives shall be repacked only after the same are examined by controller ofexplosives.

Storage of Explosives in excess of the licensed quantity:

The quantity of any kind of explosives kept in any licensed magazine or store houseshall not exceed the quantity entered in the license against such kind of explosives.No explosives in excess of the licensed quantity shall be stored in the magazine orstore house unless a permit in this behalf is obtained from the licensing authority by aletter or telegram.

8.141 Precautions to be observed at site:

The electric power at the blasting site shall be discontinued as far as practicablebefore charging the explosives. No work other than that associated with the chargingoperations shall be carried out within 10 meters of the holes unless otherwisespecified to the contrary by the licensing authority.

When charging is completed, any surplus explosive detonators and fuses shall beremoved from the vicinity of the hole and stored at a distance which should preventaccidental detonation in the event of a charge detonating prematurely in any hole.The holes which have been charged with explosives shall not be left unattended till theblasting is completed. Care shall be taken to ensure that fuse or wires connected tothe detonation are not damaged during the placing of stemming materials andtamping.

Suitable Warning Procedure to be maintained :

The licensee or a person appointed by the licensee to be in charge of the use ofexplosives at the site shall lay down a clear warning procedure consisting of warningsigns and suitable signals and all persons employed in the area shall be made fullyconversant with such signs and signals.

Precautions to be observed while firing:

The end of the safety fuse (if used in place of a detonator should be freshly cut beforebeing lighted. The exploders shall be regularly tested and maintained in a fit conditionfor use in firing. An exploder shall not be used for firing a circuit above its ratedcapacity. The electric circuits shall be tested for continuity before firing. All personsother than the shot-firer and his assistant, if any, shall be withdrawn from the sitebefore testing the continuity.

For the purpose of jointing, the ends of all wires and cables should have the insulationremoved for a maximum length of 5 cm, and should, then be made clear and bright fora minimum length of 2.5 cm, and the ends to be joined should be twisted together soas to have a positive metal contact. Then these should be taped with insulation toavoid leakage when in contact with earth.

In case of blasting with dynamite or any other high explosive, the position of all the

bore holes to be drilled shall be marked in circles with white paint. These shall beinspected by the Contractor’s agent. Bore holes shall be of a size that the cartridgecan easily pass down. After the drilling operation, the agent shall inspect the holes toensure that drilling has been done only at the marked locations and no extra hole hasbeen drilled. The agent shall then prepare the necessary charge separately for eachbore hole. The bore holes shall be thoroughly cleaned before a cartridge is inserted.Only cylindrical wooden tamping rods shall be used for tamping. Metal rods or rodshaving pointed ends shall never be used for tamping. One cartridge shall be placed inthe bore hole and gently pressed but not rammed down. Other cartridges shall thenbe added as may be required to make up the necessary charge for the bore hole. Thetopmost cartridge shall be connected to the detonator which shall in turn be connectedto the safety fuses of required length. All fuses shall be cut to the length requiredbefore being inserted into the holes. Joints in fuses shall be avoided. Where joints areunavoidable, a semi-circular niche shall be cut in one piece inserted into the niche.The two pieces shall then be wrapped together with string. All joints exposed todampness shall be wrapped with rubber tape.

The maximum of eight boreholes shall be loaded and fired at one occasion. Thecharges shall be fired successively and not simultaneously. Immediately before firing,warning shall be given and the agent shall see that all persons have retired to a placeof safety. The safety fuses of the charged holes shall be ignited in the presence of theagent, who shall see that all the fuses are properly ignited.

Careful count shall be kept by the agent and others of each blast as it explodes. Incase all the charged bore holes have exploded, the agent shall inspect the site soonafter the blast but in case of misfire the agent shall inspect the site after half an hourand mark red crosses (x) over the holes which have not exploded. During this intervalof half an hour, nobody shall approach the misfired holes. No driller shall work nearsuch bore until either of the following operations have been done by the agent for themisfired boreholes.

a) The contractor’s agent shall very carefully (when the tamping is a damp clay)extract the tamping with a wooden scraper and withdraw the primer and detonator.

b) The holes shall be cleaned for 30 cm. of tamping and its direction ascertained byplacing a stick in the hole. Another hole shall then be drilled 15 cm away andparallel to it. This hole shall be charged and fired. The misfired holes shall alsoexplode along with the new one.

Before leaving the site of work, the agent of one shift shall inform the another agentrelieving him for the next shift, of any case of misfire and each such location shall bejointly inspected and the action to be taken in the matter shall be explained to therelieving agent.

The Engineer-in-charge shall also be informed by the agent of all cases of misfire,their causes and steps taken in that connection.

8.142 General Precautions:

For the safety of persons red flags shall be prominently displayed around the area

where blasting operations are to be carried out. All the workers at site, except thosewho actually ignite the fuse, shall withdraw to a safe distance of at least 200 meterfrom the blasting site. Audio warning by blowing whistle shall be given before ignitingthe fuse.

Blasting work shall be done under careful supervision and trained personnel shall beemployed. Blasting shall not be done within 200 meters of an existing structure,unless specifically permitted by the Engineer-In-Charge in writing.

8.143 Precautions against misfire:

The safety fuse shall be cut in an oblique direction with a knife. All saw dust shall becleared from inside of the detonator. This can be done by blowing down the detonatorand tapping the open end. No tools shall be inserted into the detonator for thispurpose.

If there is water present or if the borehole is damp, the junction of the fuse anddetonator shall be made water tight by means of tough grease or any other suitablematerial. The detonator shall be inserted into the cartridge so that about one-third ofthe copper tube is left exposed outside the explosive. The safety fuse just above thedetonator shall be securely tied in position in the cartridge. Waterproof fuse only shallbe used in the damp borehole or when water is present in the borehole.

If a misfire has been found to be due to defective fuse, detonator or dynamite theentire consignment from which the fuse, detonator or dynamite was taken shall be gotinspected by the Engineer-In-charge or his authorized representative before resumingthe blasting or returning the consignment.

8.144 Precaution against stray currents:

Where electrically operated equipments is used in locations having conductive groundor continuous metal objects, tests shall be made for stray current to ensure thatelectrical firing can proceed safely.

2) The NIT (notice inviting tender), Bid documents (Qualifying and Financial), letter ofintent, approved rates, annexed hereto and such other additional particularsinstructions, drawings, work orders as may be found requisite to be given duringexecution of the work shall be deemed and taken to be an integral part of the contract

4) The contractor hereby declares that nobody connected with or in the employment ofthe Corporation of Telecommunications/DTs/BSNL is not/shall not ever be admitted aspartner in the contract.

5) The contractor shall abide by the terms and conditions, rules, guidelines, constructionpractices, safety precautions etc. stipulated in the tender document including anycorrespondence between the contractor and the BSNL having bearing on execution ofwork and payments of work to be done under the contract.

Remarks:1. (i) It will be responsibility of the contractor to obtain ROW/Permission as the trenching rates have

been suitably raised. For this, the contractor shall have to coordinate with various authorities onbehalf of BSNL.(ii) The payment of ROW/Permission charges for reinstatement to Government agenciesconcerned will, however, be made by BSNL.(iii) The contractor shall make over the ROW/Permission letter(s) of the concerned authorities tothe DE OFC Concerned.

2. BSNL will supply PLB/GI/RCC/DWC pipe, weld mesh, OF Cable, PLB couplers and EndCap.

3. All the stores to be supplied by BSNL are to be transported by the contractor from Divisional Storeof concerned DE OFC in charge of the work.

4. Rs. 400/- shall be recovered from the contractor’s bill for each empty drum.5. The contractor will have to lay either DWC split or RCC split or stone slabs or all as protection

pipe depending upon availability of material in the store and as per site conditions. Rates for layingwill be paid as per schedule above.

Note: All materials shall be collected by the contractor from the Divisional Store Godown or any otherlocation in the jurisdiction of the Division. No separate charges for loading, unloading,transportation etc. shall be paid by BSNL, NTR.
