INTRODUCTION:

e-Tender through e-procurement solutions are invited from authorized distributors/Publishers for

supply of Medical Books to the ESIC Medical College, PGIMSR & Model Hospital,

Rajajinagar, Bangalore under two bid system. The ESIC MC, PGIMSR & Model Hospital, Rajajinagar, Bengaluru

is a 500 bedded hospital run by the Employees State Insurance Corporation which is a statutory organization under

the Ministry of Labour and Employment, Govt. of India.

CHAPTER-1: INSTRUCTIONS FOR ONLINE BID SUBMISSION

re-Tenders are invited from reputed and eligible authorized distributors/Publishers for supply of

Medical Books to the ESIC Medical College, PGIMSR & Model Hospital, Rajajinagar,

Bangalore.

1. Bids for the tender will be accepted only online through (https://etenders.gov.in/eprocure/app) and no

manual tender applications will be accepted. Any manual application received will be summarily rejected.

2. Bid Security/Earnest Money Deposit (EMD)

i) The last date for receipt of EMD at ESIC Model Hospital Rajajinagar is 12.05.2020 (The EMD of Rs.50,000/- in the form of Demand Draft(of any Scheduled/National Bank) drawn in favour of “ESI Fund A/c No.1” payable at Bengaluru should be dropped in the drop box placed at General Branch, ESIC Model Hospital, Rajajinagar or sent to “The Assistant Director, General Branch, ESIC MC, PGIMSR and Model Hospital-, Rajajinagar, Bengaluru-560 010” in a closed cover super scribed as “EMD- Tender for supply of Medical Books at ESIC MC, PGIMSR and Model Hospital Rajajinagar”. along with the details of firm which is issued after publishing date of Tender.

ii) EMD (the said Demand Draft) should remain valid for at least 90 days from the date of publication of

Tender.

iii) A bid received without Bid security (EMD) may be rejected at the bid opening stage.

iv) The earnest money deposit (EMD) will be refunded to the unsuccessful Tenderers after finalization of

the Tender process.

v) It will be refunded to the successful Tenderer on receipt of Security deposit or shall be allowed to be

adjusted towards Security Deposit.

vi) No interest is payable on the EMD.

vii) The EMD/Bid security may be forfeited:

(a) If a bidder withdraws his bid during the specified period of bid validity specified in the bid

document.

(b) In the case of successful bidder, if the bidder fails to:

- Accept the offer of contract

- Submit the written Agreement on Non Judicial Stamp Paper after awarding of the contract.

- Furnish the performance security within the time specified in the document. (Amount of stamp paper will be intimated to qualified firm at the time of award of contract).

3. e-Tender Procedures and helpdesk:

The bidders are required to submit soft copies of their bids electronically on the e-bidding Portal i.e.,

https://etenders.gov.in/eprocure/app, using valid Digital Signature Certificates. The instructions given below are

meant to assist the bidders in registering on the e-bidding Portal, prepare their bids in accordance with the

requirements and submitting their bids online on the e-bidding Portal.

More information useful for submitting online bids on the Central Public Procurement Portal may be

obtained at e-bidding Portal

REGISTRATION:

1) Bidders are required to enrol on the e-Procurement module of the Central Public Procurement (CPP) Portal by

clicking on the link “Online bidder Enrolment” on the CPP Portal which is free of charge.

2) As part of the enrolment process, the bidders will be required to choose a unique username and assign a

password for their accounts.

3) Bidders are advised to register their valid email address and mobile numbers as part of the registration process.

These would be used for any communication from the CPP Portal.

4) Upon enrolment, the bidders will be required to register their valid Digital Signature Certificate (DSC) (Class-

IIIB Digital Signature Certificate (DSC) with Both DSC Components i.e., Signing & encryption to participate in the

Re-e-Tenders) issued by any Certifying Authority recognized by CCA India (e.g. Sify /nCode / eMudhra etc.), with

their profile.

5) Only one valid DSC should be registered by a bidder. Please note that the bidders are responsible to ensure that

they do not lend their DSC’s to others which may lead to misuse.

6) Bidder then logs in to the site through the secured log-in by entering their user ID / password and the password

of the DSC / e-Token.

SEARCHING FOR BID DOCUMENTS:

1) There are various search options built in the CPP Portal, to facilitate bidders to search active bids by several

parameters. These parameters could include Bid ID, Organization Name, Location, Date, Value, etc. There is also

an option of advanced search for bids, wherein the bidders may combine a number of search parameters such as

Organization Name, Form of Contract, Location, Date, Other keywords etc. to search for a bid published on the

CPP Portal.

2) Once the bidders have selected the bids they are interested in, they may download the required documents /

bid schedules. These bids can be moved to the respective ‘My Bids’ folder. This would enable the CPP Portal to

intimate the bidders through SMS / e-mail in case there is any corrigendum issued to the bid document.

3) The bidder should make a note of the unique Bid ID assigned to each bid, in case they want to obtain any

clarification / help from the Helpdesk.

PREPARATION OF BIDS:

1) Bidder should take into notice of any corrigendum/addendum published on the bid document before submitting

their bids.

2) Please go through the bid advertisement and the bid document carefully to understand the documents required

to be submitted as part of the bid.

3) Bidder, in advance, should get ready the bid documents to be uploaded as indicated in the bid document /

schedule and generally, they can be in PDF / XLS / RAR / DWF/JPG formats. Bid documents may be scanned with

100 dpi with black and white option which helps in reducing size of the scanned document.

4) To avoid the time and effort required in uploading the same set of standard documents which are required to

be uploaded as a part of every bid, a provision of uploading such standard documents (e.g. PAN card copy, annual

reports, auditor certificates etc.) has been provided to the bidders. Bidders can use “My Space” or ‘’Other

Important Documents’’ area available to them to upload such documents. These documents may be directly

submitted from the “My Space” area while submitting a bid and need not be uploaded again and again. This will

lead to a reduction in the time required for bid submission process.

CHAPTER-2: GENERAL TERMS AND CONDITIONS:

1. ESIC Model Hospital, Medical College, PGIMSR Rajajinagar, Bangalore -10 invites e-quotations from the reputed

authorized distributors/Publishers for supply of Medical Books.

2. The tender documents s ha l l be dow n lo a d e d f rom t h e we b s i t e www.eprocure.gov.in/eprocure/app or www.esic.nic.in from 08.04.2020 to 30.04.2020.

3. 1. MINIMUM ELIGIBILIBILITY:

(i) Should have minimum of 3 years experience in supplying Medical Journals / Medical

Books to Medical College libraries / Govt. libraries

(ii) Should not have been blacklisted by the Govt. / PSUs Should not have been blacklisted by

the Govt/PSUs.

2. Earnest Money Deposit (EMD).

(i) The EMD as specified in Chapter-1 in this tender document in the form of Demand Draft/ from any

Schedule bank drawn in favor of ESIC FUND A/C NO.1 payable at Bengaluru shall be dropped in the

drop Box along with the details of the firm with address on the cover overleaf.

(ii) The Demand Draft (EMD) should be valid at least 90 days, from the date of Publish of tender.

(iii) A bid received without Bid security (EMD) shall be rejected at the bid opening stage.

(iv) The earnest money deposit (EMD) shall be refunded to the unsuccessful tenderers after finalization of

the contract.

(v) No interest is payable on the EMD

(vi) The bid security may be forfeited:

• If a bidder withdraws his bid during the specified period of bid validity specified in the bid

document.

• In the case of successful bidder, if the bidder fails to:

- * Submit the written Agreement on Non Judicial Stamp Paper of appropriate value after awarding of

the contract.

*Fails to fulfill contract

*Furnish the Performance security within the time specified in the document.

3. Security Deposit:

The successful tenderer will have to furnish security deposit, 10% of contract awarded value, in the form of

Demand Draft/Pay Order from a nationalized bank drawn in favor of ESIC FUND A/C NO.1 payable at

Bangalore or Bank Guarantee in the Name of the Dean, ESIC MC, PGIMSR and Model Hospital, Rajajiangar,

Bangalore 10, towards Security Deposit within 15 days from the date award of contract. On request of the

bidder, the EMD submitted may be adjusted against Security Deposit.

4. The near relatives of employees of ESIC Model Hospital, Rajajinagar are prohibited from participation in this

tender. The near relatives for this purpose are defined as: -

(i) Members of a Hindu Undivided Family.

(ii) Their husband and wife.

(iii) The one is related to the other in the manner as father, mother, son(s), son’s wife (daughter-in- law),

daughter(s) & daughter’s husband(son-in-law), brother(s) & brother’s wife, sister(s) and sister’s

husband (brother-in-law).

4. Submission of Bids: All bidders are to upload their bids online at (https://etenders.gov.in/eprocure/app)

The documents to be uploaded and instructions in this regard are as below:

(a) Annexure I, II, III and IV, Duly filled and signed by authorized signatory with seal of the firm

and serially numbered as per the Serial numbers in the Bid form.

(b) Self-Attested Photocopy of PAN card issued by Income Tax Department

(c) Self-Attested Photocopy of Income Tax returns for the last 03 years.

(d) Balance sheet for the last 03 years.

(e) Self-Attested Photocopy of GST Registration

(f) Self-Attested Photocopy of Registration certificate of firm/Establishment.

(g) Declaration regarding availability of books in ready stock.

(h) Self-Attested Photocopy of Proof of experience in the field.

5. The rates for the items as per Annexure IV is to be entered directly in the space provided for uploading of

the Financial Bids (BOQ) and should not be uploaded along with Technical bid. The Financial bid (BOQ) is

programmed to calculate the lowest firm on its own.

6. Last Date for submission of bids:

(a) The last date for submission of EMD and online submission of tender is 12.06.2020 (1200 Hours).

(b) The DEAN, ESIC MC, PGIMSR & Model Hospital, Rajajinagar, Bengaluru - 10, may, at his / her

discretion, extend the deadline for submission of bids or call for re-e -Tender in case sufficient bids

are not received. In such case, EMD received in the form of DD/Bankers Cheque will be considered

for the re-e-Tender.

7. Bid Opening and Evaluation

(a) The bid shall be opened online by the Officers authorized by the DEAN at 14:30 Hrs on 13.06.2020

at ESIC MC, PGIMSR & Model Hospital, Rajajinagar, Bengaluru, in the presence of the bidders or

their representatives duly authorized by the bidder who wish to be present.

(b) All the bids will be scrutinized, relevant documents will be checked for their eligibility.

(c) The tenderers whose technical bids and financial bids are accepted will be informed about awarding

the contract through Post/ e-mail.

8. Contacting Officials:

(a) No bidder shall try to influence the office administration on any matter relating to its bid, from the

time of the bid opening till the time contract is awarded.

(b) Any effort by the bidder to influence the office administration in the bid evaluation, bid

comparison or contract award decision shall result in the rejection of the bid.

9. No Tenderer will be allowed to withdraw after submission of the tenders within the bid validity period

otherwise the EMD submitted by the tendering firm would stand forfeited.

10. Tenders received and found deficient on account of registrations, documents or any required

information are liable to be summarily rejected.

11. The Tenders from Individual/Firm/Organization including its Partners/ Shareholders/ Directors who

have been blacklisted/prosecuted by any departments/statutory bodies in any State or by any Court of

Law, the Tender would be cancelled and furnishing of false information/ fabricated document would lead to

rejection of re-e-Tender at any stage, beside liabilities towards prosecution under appropriate law .

12. Each bidder shall submit only one tender either by himself or as a partner in joint venture or as a

member of consortium. If a bidder or if any of the partners in a joint venture or any one of the members

of the consortium participate in more than one bid, their bids are liable to be rejected.

13. The bidder shall submit full details of his Agency / firm or, if the bidder is proprietor / partnership or a

Private Limited Company, full details of ownership and name of the Directors. If the bidder is a

Registered Company / partnership of two or more persons, all such persons shall be jointly and

severally liable to the Hospital for the fulfillment of the terms of the contract. Such persons shall

designate one of them to act as authorized signatory with authority to sign. The Company

/ Partnership shall not be altered without the approval of the Hospital authority.

14. The bidder is expected to examine all instructions, Forms, Terms and conditions in the tender document.

Failure to furnish all information required by the tender document or submission of a tender not

substantially responsive to the tender document in every respect will be at the bidder’s risk and may

result in rejection of his bid.

15. All the information as required in the tender document should be filled up in the relevant part and no

column should be left unfilled. An incomplete tender document or tender document submitted /

uploaded will not be considered even if the EMD is submitted.

16. Tenderer signing the tender must clearly specify whether he is signing as sole proprietor, partner, under

power of attorney or as Director/Manager/Secretary etc., as the case may be.

17. Non transferability: This tender is nontransferable.

18. Any conditional acceptance is liable for rejection of tender.

19. The DEAN, ESIC MC PGIMSR and Model Hospital, Rajajinagar, Bengaluru – 10 reserves the right to accept

or reject any bid including the lowest and to annul the bidding process and reject all bids, at any time

prior to award of contract, without thereby incurring any liability to the affected bidder or bidders or

any obligation to inform the affected bidder or bidders of the grounds for the said action.

20. The DEAN, ESIC MC PGIMSR and Model Hospital, Rajajinagar will award the contract to the successful

evaluated bidder whose bid found to be responsive and who is eligible and qualified to perform the

contract satisfactorily as per the terms and conditions incorporated in the bidding document.

21. The bidder who has quoted the least (item wise) in the Financial bid shall be considered as the lowest

tenderer. The rates quoted shall be firm and fixed and are inclusive of cost of GST, Transport, duties

and levies, insurance etc. No escalation of whatsoever nature shall be payable thereafter.

22. In case more than one bidder quoting the same rates are received, the award of the contract will be

decided on the basis of evaluation by committee constituted by the DEAN, ESIC MC PGIMSR and Model

Hospital, Rajajinagar, Bengaluru – 560 010.

23. The successful bidder will be informed by Registered post/e-Mail that his bid has been accepted.

24. The successful bidder will be required to execute an agreement within a period of 15 days from the date

of issue of Letter of Award of Contract unless extended by the DEAN, ESIC MC PGIMSR and Model

Hospital, Rajajinagar Bengaluru up to a maximum of another two weeks in a non-judicial stamp paper,

and all the expenditure in this regard should be borne by the bidder. (Amount of non0judicial stamp paper

will be intimated to the successful bidder at the time of award of contract).

25. The successful bidder shall be required to furnish a Performance Security within 15 days of receipt of

“Letter of Award of contract” for an equivalent amount of 10% of contract value (calculated near 100)

in the form of Demand Draft from a Scheduled / commercial bank drawn in favour of “ESIC Fund

A/c No -1”, payable at Bengaluru.

26. This Security deposit will not bear any interest whatsoever.

27. Tender containing false, misleading information will be rejected outright and may also be Liable for

consequences for submitting false information.

28. The DEAN, ESIC MC PGIMSR and Model Hospital, Rajajinagar, Bengaluru does not bind himself to accept

the lowest or any tender and reserves the right to accept or reject any or all the tenders, either in whole

or in part, without assigning any reasons for doing so.

29. The DEAN, ESIC MC PGIMSR and Model Hospital, Rajajinagar may at his discretion, amend/modify the

tender and/or extends the deadline for submission of tenders at any time prior to the last date for

submission of Tenders. The DEAN, ESIC MC PGIMSR and Model Hospital, Rajajinagar may for any reason

at his own initiative modify the Tender documents by amendment and information thereof will be

uploaded on Corporation’s website & CPP Portal and shall be binding on all concerned.

30. The Financial bid will be scrutinized for lowest bid made on the basis of the figure arrived at Column “E”.

31. The competent authority reserves the right to withdraw/relax any of the terms and conditions

mentioned above.

32. The DEAN, ESIC MC PGIMSR and Model Hospital, Rajajinagar, Bengaluru -10 is the Competent Authority

to renew the contract or to terminate the contract.

33. All disputes relating to this tender can be legally resolved through the sole arbitrator appointed by The

DEAN whose decision shall be final and binding on both the parties.

34. The Books, shall be supplied F.O.R. destination as per the supply order.

35. The successful tenderer will have to supply the Books available in India within 30 days and in

case of imported from Foreign publishers, it should be supplied within 45 days from the date of

issue of supply order on the rates quoted by them and approved by the competent authority of

this Hospital.

36. Delivery of the Medical books is the responsibility of the bidder and no postage, insurance or any

other extra charges shall be paid.

37. The latest edition of Medical books alone will be accepted.

38. The Medical Books shall be accepted only after the inspection by the Dean or any other officer

nominated by him.

39. Mode of Payment details :

39.1. The payment for the books shall be made after the completion of full supply to the

satisfaction of the Dean.

39.2. The payment shall be made through e-payment only. Hence the Bank details along with

MICR Code are to be submitted along with the bills.

39.3. The bill should bear the Certificate from the supplier that only Medical Books (Indian /

Foreign) of latest edition have been supplied and that the prices have been charged correctly

and in accordance with the latest publishers Catalogue / Invoice or Importer / Distributors

invoice.

39.4. If new editions of Medical Books is released in the market to that quoted by the firm. The

publisher shall supply the latest edition of the Medical books at the same discount rate

quoted for the earlier edition. Any difference of amount arising for the newer edition may

be claimed separately.

40. In case of delay / failure in supply, the indented items shall be purchased from the market at the

risk and cost of the Supplier. The extra expenditure involved in procuring supplies from elsewhere

will be recoverable from the Supplier in full at discretion of the Medical Superintendent.

41. The recovery thus due shall be deducted from any sum then due to the Supplier from the ESIC

Model Hospital from this or any other contract placed with said Supplier by the ESIC Model

Hospital.

42. The Security Deposit/ Bank guarantee will be forfeited if the bidder violate any of the conditions of

this contract.

43. The Medical Superintendent also reserves the right to terminate the contract in whole or in part by

give it in written notice if the bidder fails to satisfy the conditions of this contract.

44. The Medical Superintendent reserves the right to increase or decrease the requirement

45. For any dispute regarding quality / service and rates the decision of the Medical Superintendent

shall be final and binding to the Contractor.

46. All disputes relating to this tender can be legally resolved through courts in Bangalore only.

EXCLUSIVE RIGHT OF THE DEAN :

The Dean, ESIC Medical College, Model Hospital & PGIMSR, Rajajinagar, Bangalore-10 has the full and exclusive right to enhance or reduce the quantity or to decide not to purchase any tendered items, to accept any tender in full or in part, to place order on one or more firms, to reject any or all the tenders without assigning any reasons thereof. No enquiries, verbal or written shall be entertained in respect of acceptance/rejection of the tender.
