NOTICE INVITING TENDERS
FOR OPERATION AND DAY TO DAY ELECTRICAL MAINTENANCE CONTRACT
(OMC) FOR 11KV SUB STATION AND DG SETS AT STATE BANK ACADEMY, PLOT
NO 77, SEC 18, GURGAON.
State Bank of India, having its Office named State Bank Academy at Plot No. 77, Sector
18, Gurgaon invites sealed tenders for Operation and day to day electrical maintenance
of 11KV Substation and DG Sets in SINGLE STAGE TWO BID SYSTEM – PART ‘A’
(Technical bid) & PART ‘B’ (Priced bid). PART ‘A’ containing the qualification proposal
and EMD and PART ‘B’ containing the price bid, if not sealed in separate covers, the
tender shall be rejected. The Tender duly filled along with EMD of Rs.25,000/- should be
submitted to Chief Manager(Administration) State Bank Academy, Plot No 77, Sec 18,
Gurgaon on or before 27.06.2017 by 3:00PM and will be opened on same day at
3:30PM.
The contractors should read the details term & condition properly and quote their rates
strictly in accordance to the T & C only.
The tenders without the requisite EMD will be rejected. Bank reserves the right to cancel
any/all Tender(s) without assigning any reason.
The envelopes should be subscribed clearly at the top as Tender for Operation and Day
to Day Electrical maintenance of 11KVA Substation and DG Sets

TERMS & CONDITIONS
TENDER FOR OPERATION AND DAY TO DAY ELECTRICAL MAINTENANCE
CONTRACT FOR 11KV SUB STATION AND DG SETS
1. THE SITE OF WORK: State Bank Academy, Plot No. 77, Sector-18, Gurgaon.
2. Sealed Tender documents duly completed in all respects shall be submitted to Chief
Manager (Admn.), State Bank Academy, Plot No 77, Sector 18, Gurgaon, Haryana, 122-
015, either in person or by post so as to reach the Academy/Bank on or before 3.00
P.M. on 15.05.2017. The Bank will not be responsible for any postal delay/loss/non-
receipt thereof. No consideration will be given to a Tenders received after the time/date
specified above and such Tenders are deemed to be rejected. The Tender Documents
are not transferable. Incomplete Tenders and not conforming to the requirements of the
invitation for tenders are liable to be rejected. Tenders submitted by a firm shall be
signed separately by proprietor, each partner thereof and in the absence of any partner,
shall be signed by the Power of Attorney holder. Tender by a company shall be
executed by person(s) duly authorized under the resolution of the Board of Directors of
the Company.
3. The offers are to be submitted in two bid system:- The qualification/technical proposal
and the price proposal in two separate sealed covers, distinctly marked accordingly and
both the proposals then put in a third envelope and sealed duly superscribed as “Tender
for Operation & Day to Day Electrical Maintenance Contract for 11KV Substation,
DG Sets for State Bank Academy at 77, Sector 18, Gurgaon”. Technical bid & price
bid, if not enclosed in separate sealed covers, the tender shall be rejected.
4. Earnest money deposited (EMD) will be refunded to all except the successful bidder.
EMD amount shall not carry any interest.

5. Qualification proposals will be opened at 3.30 P.M. on 15.05.2017 at the office of the
DGM & Sr. Faculty, State Bank Academy, Plot No.77, Sector 18, Gurgaon, in the
presence of bidders or the bidders duly authorized representatives.
6. The price proposals of those qualified bidders based on qualification proposals will be
opened in the presence of bidders or the bidder’s duly authorized representatives who
desire to remain present, at the time and date and the venue to be advised by the
Academy/Bank after approval of the evaluation of the qualification proposal. The
authorized representatives should bring necessary authority letters under an official
letterhead of the bidders conferring full and comprehensive authority to deal with all
matters relating to the tenders.
7. The tenderer should also submit the following documents along with their offers in
support of:-
a) List of technical/skilled personnel.
b) List of machinery, equipments and tools, etc. available on hand (own) for the work
and proposed to be inducted.
c) List of works on hand, indicating description of work, contract value, date of award,
number of personnel and equipments deployed, supportive documents from the
organization to be enclosed.
d) Earnest Money Deposit of Rs.25,000/- by way of Banker’s Demand Draft or Banker’s
Cheque in favour of State Bank Academy drawn on a Nationalized/Scheduled Bank
payable at Gurgaon.
e) List of proposed items to be provided.
f) Valid ‘A’ Class Approved Electrical License, Valid registration certificate/licence
with Labour Department under the Contract Labour (Regulation & Abolition) Act,
1970, if applicable.
8. The contract for services would be for a period of Two Years from the date of
acceptance, subject to renewal for a further period of one year on the same terms and
conditions and upon renewal of License by the Contractor on or before expiry of the
License granted by the Appropriate Authority under the Contract Labour
(Regulation & Abolition) Act, 1970, if applicable. However, the contract will not be
renewed beyond total 3 years.

9. The contractor should inspect the premises and assess the scope of work before
quoting the rates. The tender quoted rate or quoted amount will be valid for a period of
03 months from date of opening of price bid. If the tenderer withdraws his/her offer
during validity period or makes modification in his/her offer which are not acceptable to
the Bank without prejudice to any other right or remedy, the Bank shall be at liberty to
forfeit EMD.
10. Within the validity period of the tender the Bank shall issue a letter of acceptance to
the successful bidder at the address of the bidder as given in the tender to enter into a
contract for the execution of the work as per terms of the tender. The letter of
acceptance shall constitute a binding contract between State Bank Academy (SBA) and
the bidder/contractor.
11. On receipt of the intimation of the acceptance of the tender from SBA the successful
tenderer shall be bound to implement the contract and within 15 days thereof, he shall
sign an agreement in a non judicial stamp paper of appropriate value.
12. The Courts in Gurgaon city alone shall have the jurisdiction in respect of any or all
matters relating to or connected with the Tender.
13. The Bank does not bind itself to accept the lowest tender and reserves to itself the
right to reject at any stage any or all the tenders received without assigning any reason.
14. Final award of the contract for Operation and day to day electrical maintenance
contract (OMC) services will be subject to the approval of the Competent Authority in the
Bank.
15. The specifications, duration of the work and the Terms and Conditions under which
the contract is required to be performed and also the rights and obligations of the
person(s)/ firm /company whose tender is accepted shall be under an Agreement to be
executed within 15 days after awarding the work.

SPECIAL TERMS AND CONDITIONS
1.0 SECURITY DEPOSIT:
The contractor shall deposit a sum of Rs. 1,20,000/- (Rupees one lakh and twenty
thousand only) as SECURITY DEPOSIT (inclusive of EMD) with the Bank for due
fulfillment and performance of the Contract. The Security Deposit shall be held in Term
Deposit with the State Bank of India in the joint names of State Bank Academy and the
Contractor and the deposit receipt will be kept in the custody of the Bank. Periodical
Interest accrued on the deposit may be claimed by the contractor, under intimation to the
Bank. The Security Deposit will be returned to the contractor after three months from the
date of expiry of the contract provided that there are no defects or loss or damage
caused to the Bank and/or materials/motors/equipments, etc provided to him are duly
accounted for and returned to the Bank in good working order and condition by the
contractor to the satisfaction of the Bank and all his dues to the Bank and all other
liabilities under any law or otherwise arising out of or in connection with or in respect of
the services are fully settled.
2.0 CONTRACT AGREEMENT:
The contractor shall bear all the costs and expenses and stamp duty in respect of all
Agreements that may be entered into with the Bank (SBA) to give effect to this
arrangement.
3.0 LIQUIDATED DAMAGE:
3.1 In case the contractor fails to fulfill his obligations for any day or any number of days
to the satisfaction of the Bank, for any reason whatsoever, he shall pay by way of
liquidated damages a sum of Rs.1000/- per day for the entire number of such days and
the bank shall without prejudice to their rights and remedies including the termination of
the contract, be entitled to deduct such damages from the security deposit and monthly
bill, if any, payable to the contractor. Such work will be carried out through any agency
by the Bank at the cost of the Tenderer.
4.0 MATERIALS, TOOLS & TACKLES & EMPLOYEES:
4.1 The contractor shall arrange for required spares, consumables, tools & tackles and
such other materials required for keeping the plant in excellent condition.
4.2 The contractor shall arrange for their purchases on his own with the approval of the
Bank and shall bear all expenses in connection with such purchases including their

transportation. Day to Day Maintenance of DG Sets, electrical panels, motor control
panel, replacement of electrical cables/wires etc. is in the scope of OMC and all
expenses/charges towards repairs, taxes and transportation will be borne by the
contractor.
4.3 All the equipments and machineries provided by the Bank are for exclusive use in
the Bank’s (SBA) premises for the purpose. The contractor shall take due care of all the
equipments provided by the Bank, as a bailee, in terms of the provisions under the
Indian Contract Act and duly return them in good working order and condition to the
Bank on and at the expiry of the currency of the contract or on its sooner determination
in terms of these presents. The day to day electrical maintenace of the DG sets and
11KV sub station shall be the sole responsibility of the contractor.
4.4 The Contractor shall provide adequate number of efficient, clean, healthy, honest,
well-behaved staff as his agents or nominees for operating and maintaining the DG sets
and 11KV sub station and allied equipments, who will personally operate and keep the
surroundings around the DG room neat and clean.
4.5 The contractor shall be responsible for the good conduct and performance on the
part of his personnel and the contractor shall and be deemed, for all legal and
contractual purposes, the employer of the said personnel engaged by him and such
persons shall not have any claim for employment in the Bank in whatsoever and
howsoever manner or in any connection therewith against the Bank now or at a future
date. He will, at the request of the authorized officer of the Bank/establishment remove
from the work any person engaged by him for the services, who may be unsuitable or
incompetent or whose conduct is not trustworthy or who misbehaves and/or is not
courteous, polite with the employees of the Bank or it’s customers or third parties.
5.0 PERMITS, LAWS AND REGULATIONS:
5.1 The Contractor shall strictly comply with all Labour and such other statutory Laws in
relation to the services to be provided and the personnel engaged by the Contractor and
he shall be solely responsible for all acts of the said personnel so enrolled and there
shall and will not be any privity of contract for any purpose and to any intent between the
Bank and said personnel so engaged by the Contractor. The Bank shall neither be liable
nor answerable in respect of any claims or demands in respect of any matter or on any
account which may be raised by the said personnel so engaged by the Contractor and it
shall be the sole responsibility and liability of the Contractor to answer all such claims or
demands of the said personnel so engaged, under any law for the time being in force.

5.2 The contractor shall be responsible for the training, 24 hours of operation & day to
day maintenance of the DG Sets and Substation, etc. The contractor shall alone have
the right to exercise control, give directions and manage the personnel engaged for the
purposes.
5.3 The contractor should possess, for the entire duration of the contract, all licences
and registrations as may be required under any law and shall be responsible to register
himself and obtain a valid license under Contract Labour (Regulation and Abolition) Act,
1950 and rules there under. The Contractor shall comply with all rules and regulations in
force under the said Act and rules. The Contractor shall comply with all applicable laws,
rules and regulations relating to Provident Fund, Payment of Bonus, Minimum Wages or
any other Statutory/Regulatory requirements( Presently of Central Government applicable
in Gurgaon city). Any dispute regarding such dues shall and be dealt with and settled by
the contractor.
5.4 The Contractor shall in terms of the provisions of Section 16, 17 and 18 of the
Contract Labour (Regulation & Abolition) Act, 1970 and the rules framed under the said
Act provide the prescribed amenities to its personnel. In case of failure of the Contractor
in complying with the said provisions, the bank may provide the same when called upon
to do so by the Competent Authorities and deduct the expenses incurred thereof from
the bills of the Contractor without prejudice to its other rights and remedies under the
contract. The Contractor shall be responsible for proper maintenance of all Registers,
Records and Accounts so far these relate to the compliance of any and all statutory
provisions/obligations for inspection of Bank /Statutory bodies.
5.5 In terms of the provisions of the aforesaid Contract Labour (Regulation & Abolition)
Act, 1970 and Rules 72 and 73 of the Rules framed there under, in case the same are
applicable to the Contractor, the Contractor shall disburse the minimum wages payable
to its personnel only in the presence of the Authorised Representative of the bank and
shall obtain due certification to that effect from the said Authorised Representative of the
Bank. Any violation of the aforesaid provisions of the Law will entail forthwith termination
of this Contract in addition to such penal consequences as may be attended with under
these presents.
6.0 TAXES:
6.1. The contractor shall alone bear all taxes, rates, charges, levies or claims
whatsoever as may be imposed or levied by the State/Central Government(s) or any
local body or authority for and in connection with the rendering services except service
tax as applicable.

6.2 All the taxes which the Bank may be liable to deduct or called upon to so deduct,
during the currency of the arrangement which are liable to be payable by the contractor
under the law but not so paid, shall be set-off against the bills raised by the contractor
and paid to the respective government departments or authorities as may be required
under law and the contractor shall have no claim against the Bank in respect of any or all
such payments.
7.0 INSURANCE:
7.1 The contractor shall arrange and pay for policy under the Public Liability Insurance
Act, 1991 and insure and keep insured all materials which are or have been declared to
be hazardous under the notifications issued or that may be issued from time to time
under the above said Act or any Rule framed there under and which are used by the
Contractor during the course of the OMC services under these presents.
7.2 The contractor shall obtain adequate Insurance Policy in respect of his workmen
engaged for the service, towards meeting the Liability of Compensation arising out of
death, injury/disablement at work, etc. and shall regularly and punctually pay each and
every premium as and when the same shall become due during the currency of these
presents.
8.0 DAMAGE TO PERSONS & PROPERTY:
8.1 The Contractor undertakes, accepts and admits absolute and complete responsibility
for the service conditions, claims, damages and other compensations of the personnel
enrolled by him and will be liable for and unequivocally assume responsibility for due
compliance with all the requirements of all statutory obligations, duties and liabilities
(including insurance) and to pay all such claims, costs, damages, expenses, fines
penalties and compensation which may arise out of any claim, suit or prosecution for
contravention thereof. The contractor shall indemnify and keep the Bank indemnified
from and against all such claims, demands, costs, charges, fines, or penalties and
compensations, etc. if any, as aforesaid.
8.2 The Contractor shall be responsible for any loss due to theft/pilferage and/or damage
to the Bank’s property, when such damage is, in the opinion of the Bank, caused due to
negligence, carelessness or any fault on the part of the Contractor or his
workmen/employees engaged for the services. The Contractor shall ensure that the
character and antecedents of the personnel engaged by him are duly verified before
such engagement.
9
9.0 ASSIGNMENT AND SUBLETTING:
9.1 The Contractor shall not assign or sublet the benefits of this contract to any person
or entity and in the event of any violation or breach thereof, the Bank may at its
discretion, but without prejudice to its other rights and remedies terminate this contract.
10.0 PAYMENTS:
10.1 The Contractor will submit the bills for the OMC services rendered, only at the end
of each month to the authorized officer who will scrutinse the bills. The payments as far
as possible will be made within one week from the date of certification, subject to the
condition that the contractor has cleared/paid all his dues, viz. Labour Payments, taxes,
levies, etc. as required to be paid/payable by him under any law for the time being in
force.
10.2 The Bank further reserves right to delete or reduce any item or sanction of the bills
before effecting payment, in case any complaints regarding quality of services, inefficient
service, non-adherence to agreed quality of materials or services have been received or
noticed by the Bank without assigning any reason whatsoever and no claim will be
entertained in this regard.
10.3 The tender quoted amount or total contract value is fixed and no claim will be
entertained during contract period and extension(s) to the present contract.
11.0 PERFORMANCE:
11.1 The contractor shall ensure excellent standard of operation and maintenance of DG
Sets and Substation and also ensure that the entire surrounding area of DG Room is
kept hygienic and clean. Regular preventive maintenance/services of plant, DG sets,
Electric Panels, equipment, motors and machineries will also have to be done by the
Contractor.
11.2 The contractor shall ensure proper upkeep of all plants, equipments, motors, and
machineries at DG Room and in case of any breakage, pilferage of any kind, or any
other material etc., the responsibility shall be of the contractor and the contractor shall
be liable to make good the loss(es).
11.3 The contractor shall deploy suitable trained operators round the clock, who will be
responsible for smooth and proper operation of DG sets and Sub Station. The records
maintained by the Contractor will be Bank’s property.
11.4 The contractor will be responsible to attend all complaints/requirements within the
purview of the contract.

11.5 The contractor shall discharge his obligations under the contract most diligently,
efficiently and honestly.
11.6 The contractor will be obligated to meet the Officer-in-charge once in a month for
assessing and monitoring the quality of OMC services rendered. The Contractor shall
comply with such observations made and furnished by the Bank for improvement of the
services by him/her. However, the continuance of the contract shall be subject to review
of the performance from time to time and in case the performance is not found to be
satisfactory by the Bank for any period under such review, the Bank at its discretion,
reserves its right to terminate the contract under due notice to the Contractor without
incurring any further liability thereof.
12.0 OWNERS RIGHT TO TERMINATE THE CONTRACT:
12.1 The Agreement shall come into force and be effective from ………….. for a period
of 1 (ONE) year and expires on ……………….. subject to the review of satisfactory
performance as mentioned hereinabove. This agreement shall be terminated by efflux of
time or earlier by one month’s notice at the option of the Bank in the event of
unsatisfactory performance or on breach of any of the stipulated conditions or qualitative
dimensions of the various services agreed upon by the Contractor under these presents.
The contractor may, after giving three months’ notice to the Bank to terminate the
contract, if he so desires at any time during the course of the currency of this agreement.
The contract may be renewed for a further period of 12 + !2 months under the same
terms and conditions stated in this Agreement.
12.2 If during the currency of the Contract, any Statute, rules/Govt. notification prohibits
employment of Contract Labour for the services envisaged under this Agreement or
otherwise, the contract shall come to an end forthwith and no compensation shall be
payable to the Contractor or his workmen/ employees.
13.0 SETTLEMENT OF DISPUTES AND ARBITRATION:
13.1 All questions relating to the performance of the obligations under this agreement
and to the quality of materials used in respect of the OMC services and all the disputes
and differences which shall arise either during or after the agreement period or other
matters arising out of or relating to this agreement or payment to be made in pursuance
thereof, shall be referred to The Principal, State Bank Academy, Gurgaon, Haryana, in
the Bank, whose decision shall be final, conclusive and binding on the contractor.
13.2 Nothing contained in the contract is intended nor shall be construed to be a grant,
demise or assignment in law of the premises or the plant/equipments or any part thereof
by the Bank to the Contractor and/or its personnel and they shall vacate and handover

the same in good working condition and order upon termination of these presents either
by efflux of time or otherwise.
14.0 Any indulgence, forbearance or waiver, granted or shown or made on the part of
the bank will not prejudice its rights under the contract.
15.0 The Courts in Gurgaon City (Haryana State) alone shall have jurisdiction in respect
of any matter touching these presents.

SCOPE OF WORK
1.0 Operation and day to day electrical maintenance of following installations:-
a) 11KV substation (including HT/LT Transformer, HT VCB, HT cable,
L.T. Panels, Motor control panel etc.
b) Capacitor Bank’s panels
c) D.G. sets (320KVA *3 Nos) along with AMF panel, cooling Tower,
Pumps, and Diesel storage Tank / pumps.
d) Batteries and Battery charger for tripping & Alarm circuits, Kent
makes oil meters etc.
e) Liaison with DHBVNL for shutdown / restoration of H.T. supply for
breakdown / preventive maintenance work for which no extra
charges are payable.
2.0 The CONTRACTOR shall carry out preventive maintenance and day to
day operation of electrical installation / equipment (As mentioned above).
An appropriate Logbook / record book should be maintain for operation as
well as maintenance of all equipments / installations, nothing extra will be
paid for such work.
I. To maintain DG set clean & in good running condition along with all its
accessories like cooling tower, day tank, pumps, storage tank & AMF
Panel.
II. To carry out / coordination with outsource vendor for scheduled
maintenance (Monthly / Half yearly / Yearly) of individual equipments and
periodic check of DG sets as per recommendation of suppliers.
III. To carry out day to day operation & maintenance of DG set
IV. Cleaning of the cooling tower once in a week.
V. Operation and day to day maintenance of cooling tower pumps & its
electrical starters.
VI. Examine for cracks and deposits on bushings every three months and
clean to the Transformer.
VII. To check oil level in conservator, Bucloz`s operation, tap changer
positioning etc for Transformer.

VIII. To ensure all safeties & protection of 11KV substation to be incorporated
in the system.
IX. To check Earthing for all HT/LT switchgears of substation, Lightening
Arrestor system and building.
X. Clean H.T. switchgears, bus trucking and bus bars by air blower once in
three months.
XI. Minor repairs of battery charger wiring, pump starters, H.T. & L.T. panels
and relays control wiring etc.
3.0. Proper preventive maintenance of electric installations including following
items of work shall be carried out as per period stated against them.
a) Clean the contact points of L.T. switchgears including ACB’s
starters, contractors and relays of AMF panels etc. with the help of
CTC liquid every three months.
b) Earth testing - once in a year.
c) Insulation of test – once in six month.
d) Cleaning of Electrical panels – once in every three months.
e) Periodic operation of valves, switchgears, starters and pumps etc.
f) Check and replace indicating lamps if required (lamp supplied by
Bank).
4.0 The contractor is required to render service through his skilled staff, tools /
safety measures etc. to operate and efficiently maintain the installations /
equipments.
5.0 All the materials required for carrying out operations and day to day
maintenance services (like cotton waste, duster, insulation tape, soaps,
CTC liquid, discharge resistance rod for capacitors, etc) will be supplied
by the contractor.
6.0 The contractor shall takeover the electrical and mechanical installations
before commencement of the work and make over the same at the time of
‘completion’ of contract in original condition. However, normal wear and
tear will not be the responsibility of the contractor.
7.0 The contractor will assess the requirement of materials for preventive
maintenance and breakdowns and intimate to the Bank in advance for
procurement of materials by the Bank.
8.0 All the dismantled materials shall be returned to the Bank by the
contractor or his representatives.

9.0 The operation and day to day maintenance service will be for 24 hours a
day including holidays.
10.0 The CONTRACTOR shall arrange adequate relief staff for weekly rest
days and holidays.
11.0 The CONTRACTOR shall provide required number of qualified and
experienced electricians and operators (along with attested
certificates & license) as mentioned in Price Bid for maintenance of
11KV Substation and operation of entire electrical installations.
12.0 The CONTRACTOR shall furnish details of staff engaged in the work to
the Chief Manager (Admin) who will have the authority to ask the
contractor to remove / replace any his staff member in the event of any
misconduct of the latter.
13.0 Complaint register, demand register, log books for DG sets, Transformers,
HSEB supply, battery unit, periodical inspection books( log books /
registers shall be provided by the Bank). The insulation and earth test
register on CPWD format and workman’s diaries shall be provided by the
contractor.
14.0 The CONTRACTOR shall carry out preventive maintenance service /
check as per program given by the Bank’s engineer or as per CPWD
specifications of respective trade practice and maintenance instructions.
15.0 Normally information of breakdown faults, defects etc, noticed by the
contractors shall be recorded by them and action be initiated immediately.
It should also be brought to the notice of the Bank.
16.0 The CONTRACTOR shall have required number of caution boards such
as “Man on line” & “Don’t switch on” for displaying on the controlling
switchgears, while undergoing repair work.
17.0 The CONTRACTOR will follow all electricity safety rules as per tender
documents and also required safety precautions while doing work on the
equipments.
18.0 Local security rules shall be observed by the CONTRACTOR and his staff.
19.0 It will be responsibility of contractor to keep the electrical installation,
substation, Transformer yard, Cooling Tower area, switch gear and meter
rooms and generator room neat and clean.
20.0 The CONTRACTOR shall maintain properly the trip battery supply unit as
per the recommendation of battery manufacturers. The surfaces of

batteries shall be maintained clean and dry. The contractor shall make
required entries in the logbook for recording specific gravity of electrolyte
in each cell, DC voltage per cell and final output DC voltage of battery
bank.
21.0 The CONTRACTOR shall arrange to render efficient service as outlined in
these specifications. In case he fails to maintain the satisfactory service &
if the Bank and the department have to incur any expenditure to maintain
the installation by alternate arrangement, the expenditure thus will be
recovered from the contractor.
22.0 The CONTRACTOR shall be responsible for any damage due to
negligence of his staff and shall have to make good such damages to its
original shape and description as when breakage etc is noticed or taken.
23.0 The bank has reserved its right to discontinue the contract at any time
without assigning any reason.
24.0 The payment will be made monthly on written request after the receipt of
satisfactory service rendering certificate from the concerned officials.
25.0 The following works will be looked after by the contractor:-
a) To maintain complaint register, log books, demand register, earth
testing and insulation record register etc.
b) To replace material such as fluorescent tubes, lamps, chokes,
starters, holders, HRC fuse links, MCB’s, isolators, switches,
sockets etc.
c) To attend all complaints / works given by the concerned officers of
Administrative department and hostel reception.
d) To maintain DC supply including batteries for H.T. panels.
e) To give proper account of materials issued by the Bank.
f) To switch on / off the compound and street light, floors light and
ceiling (space frame) lights as per time schedule give by the
Department.
g) All minor repairs, adjustment of relays, timer etc.
h) Testing of transformer oil is to be done by the contractor once in a
year.
26.0 The CONTRACTOR staff should rush for rescuing the persons from the
lift if it is required to do so.
27.0 No advance payment of any kind shall be made.

28.0 The CONTRACTOR shall employ qualified/trained persons for operation
Maintenance of equipment and shall be fully responsible to obtain such
licences for taking up the above work as are prescribed by the state /
local bodies / CPWD both for execution and operation staff. They shall
also be responsible for any periodic statutory inspections (statutory fee
will be borne by the Bank) to be carried out on the equipments,
rectification of defects pointed out during such inspection etc. A failure of
contractor to comply with all penalties imposed by the state / local bodies
and the inspection and subsequent rectification will be carried out by the
Bank at his risk and cost.
29.0 This contract can be terminated by the Chief Manager (Admin.) without
assigning any reasons by giving a notice period of 30 days at any time
during the period of contract. No claim for any compensation will however
be entertained due to such termination prior to the expiry of stipulated
period of contract.
30.0 In case of any accident during the operation and maintenance of the
equipment, leading to injuries/damages to human beings / equipment, the
contractor will settle all claims and indemnify the department against any
claims arising out of such accident consequent damages to other system
will however be not recoverable from the contractor.
30.0 The fair wages will be paid by the contractor to the staff as per the
prevailing Govt. labour laws in force and as may be amended from time
to time during this contract.
31.0 The rates quoted should be inclusive of all statuary obligations such
as minimum wages ( Presently of Central Government applicable in
Gurgaon city), ESI, PF contribution, Service charges etc., all kind of
taxes (except service tax). The offer of those prospective bidders which
do not meet the statuary requirements are liable to be rejected
32.0 The CONTRACTOR will provide technical advice for proper maintenance
of the system and their safety and when it is sought by the department.
33.0 In case of absence of staff, suitable alternate arrangement shall be made
by the contractor. In case of absence of such arrangement pro-data
deduction shall be made from the contract amount and heavy penalty
may be imposed i.e Rs.1000/- per electrician per day.

34.0 As per terms of the contract, extra manpower will have to be procured by
the contractor as and when required and nothing extra shall be paid by us
for the same. No overtime shall be paid.
35.0 The CONTRACTOR shall obtain adequate insurance policy in respect of
his workmen to be engaged for the work, towards meeting the liability of
compensation arising out of death / injury / disablement at work etc.
36.0 The CONTRACTOR shall provide two sets of uniform including
shoes for summer and in winter one set of woolen sweater to his
employees at its own cost as per approved colour and specification
of the Bank and ensure their cleanliness and use.
37.0 The CONTRACTOR / contractor’s engineer shall visit the site / office
once in a week and also as and when required, failing which recovery will
be made @ Rs.500/- per visit.
38.0 Please note that no residential accommodation shall be provided by the
Bank.
39.0 The CONTRACTOR will have to agree for the lowest / approved rates for
miscellaneous electrical jobs to be executed at the site.
40.0 The company agrees to keep rates firm throughout the contract period
and shall not change at any event during the contract period. Any
statutory increase in the minimum labor wages, taxes / duties shall be
borne by the Bank.
41.0 In the event of any difference or dispute in connection with this
agreement over the right of obligations of the parties have to the matter
shall be settled by arbitration in accordance with the Indian Arbitration Act
of 1996 in the Jurisdiction of the Gurgaon Court.
42.0 The following measuring instruments/ equipments and tools in good
working condition must be available at site/ with the Electricians and
other equipments shall be brought by the CONTRACTOR as and when
required at their cost (If any)
43.0 Contractor staff may be utilized for other electrical maintenance work in
the premises as per the requirement, for which no extra cost will be paid.
44.0 Contractor staff may be deputed to SBA Campus 2, if required.

5. In case it is observed that the material used is of inferior quality or insufficient quantity
is used, the Bank will reserve the right to purchase the same itself and deduct the cost
thereof out of the monthly bill payable to the contractor.
6.The contractor shall pay the wages of his employees in presence of the authorized
representative of the Bank as required under Contract Labour (Regulation & Abolition)
Act, 1970 and Rules 72 and 73 of the Rules framed there under, in case the same are
applicable to the Contractor, for which the contractor shall intimate the Bank.

ANNEXURE – A
SAFETY CODE: The Safety Code has to be observed by the Contractor as under:- 1. These shall be maintained in a readily accessible place - first aid appliances including
adequate supply of sterilizers, dressings and cotton wool.
2. The injured person shall be taken to a public hospital without loss of time in case
where the injury necessitates hospitalization.
3. Suitable and strong scaffold should be provided for workmen for all works that cannot
safely be done from ground.
4. No portable single ladder shall be over 8 metres in length. The width between the side
falls shall not be less than 30cms (clear) and the distance between two adjacent rungs
shall not be more than 30 cms. when a ladder is used, an extra Mazdoor shall be
engaged for holding the ladder.
5. Every opening in the floor of a building or in a working platform shall be provided with
suitable means to prevent the fall of persons or materials by providing suitable fences or
railing minimum height of which shall be one meter.
6. No floor, roof or other parts of the structure shall be loaded with rubbish or materials
as to render it unsafe.
7. Suitable facemasks should be supplied for use by the workers, when the paint is
applied in the form of spray or surface having lead paint dry rubbed and scrapped.
8. Ropes used in hoisting or lowering material or as a means of suspension should be of
durable quality adequate enough and free from defects.
9. The contractor will ensure that all types of safety measures as advised by
Government are taken care of during the performance of work.

PENALTY 1) The bank is at liberty to impose suitable penalty and deduct the same either from the
bills submitted by the contractor or at its discretion from the Security deposit for any
damage caused to bank’s property by the contractor or for unsatisfactory work.
2) The contractor shall while maintaining or repairing the electrical items,
equipments/substation equipments and other development works at the aforesaid
complex only for the aforesaid maintenance and repair purposes, use the aforesaid and
not to any other purpose and any violation or breach of this condition shall make the
contractor liable for all the losses and of damages suffered or may be suffered by the
bank in addition to pecuniary liability for
all the consequences, besides forfeiture of the security deposit.
3) The contractor shall keep switches, switchgears, electrical apparatus, Dbs, wirings,
switch boards etc of all the floors of the various buildings in the aforesaid complex
whatsoever nature in good, substantial and proper working order and condition while
carrying out the maintenance and repairs operations of the aforesaid work and shall not
come cause any damage or destruction to the aforesaid fixtures and fittings and material
and contactor expressly undertake to indemnity and keep the bank indemnified from all
monitory losses. Legal actions proceedings suffer the bank and pay all the costs charges
of expenses and whatsoever nature immediately on demand by the bank.
4) The contractor specifically agree for the safe custody and storage of the various
materials supplied to him by the bank and shall indemnify the bank for all the losses in
the event of any theft, robbery, dacoity, fire or civic circumstances and will not allow any
free access to any person who is not acceptable to the bank.
