This action provides the following:
Credit Earning and Parole Consideration
I. Introduction
Passage of The Public Safety and Rehabilitation Act of 2016 (the "Act") by the people of the State of California on
November 8, 2016 authorizes _the California Department of Corrections and Rehabilitation (CDCR or the
"Department") to develop regulations that { 1) create a process for non-violent offenders who have served the full
term for their primary criminal offense rn state prison to become eligible for parole consideration by the Board of
Parole. Hearings {the. "Board") and, (2) award credits earned for good conduct and approved educational or
rehabilitative achievements. The Act also amends the law to require judges, rather than prosecutors, to determine
whether. juveniles charged with certain crimes should be tried in juvenile or adult court.
The Act's primary purposes are to "Stop the revolving door of crime by emphasizing rehabilitation" and "Prevent
federal courts from indiscriminately releasing prisoners." To achieve these goals, the Department proposes to
establish a parole consideration process for non-violent offenders and to increase the credit earning opportunities
for inmates who successfully complete approved rehabilitative programs. In this_ way, the Department seeks to
create .incentives for inmates to take respansibitity for their own rehabilitation while incarcerated, enhance public
safety by encouraging inmates to pursue educational, vocational, and self~improvement programs, and reduce
recidivism by increasing the likelihood that inmates will better prepare themselves for their eventual return to
society.
It. Credit Earning
The Act amends the California Constitution to authorize the Department to award credits earned in state prison for
good behavior and approved rehabilitative or educational .achievements. Using this .authority, the Department
proposes to revise the complex system of credits that currently exists in the Penal Code and regulation {see. A Short
History of Credit Earning ̀ 101' Programs in California below). These proposed .regulations. revise .and simplify
several existing forms of credit and adopt new ways inmates may earn credit based on their participation in and
completion of specific rehabilitative or educational programs. Such credits may advance an inmate's release date if
sentenced to a determinate term or advance an inmate's initial parole consideration (searing if sentenced to an
indeterminate term. Condemned inmates and thaw serving a sentence of life without the possibility of parole will
remain ineligible to earn any credit. Inmates who violate the rules and regulations of the Department shall have
their credits forfeited. Some forfeited credits may be restored if the inmate remains free of disciplinary violations
for a specified timeframe, other forfeited credits cannot be restored.
Activation of the revised and new credit earning categories will be phased-in during the initial implementation of
these regulations because of the significant training, case recoeds and information technology infrastructure changes
and programming needed to support each credit earning change. Good Conduct Credit shall take effect on May 1,
2017, and the remaining credit provisions described below shall take effect an August 1, 2017. With the exception
of Educational Merit Credit, all new or revised credit provisions will be applied prospectively from the date of
implementation.
Inmates shall not be awarded credit or have credit restored which advances the date of his or her transition to parole
to a date less than 60 calendar days from the date the credit is applied. This will ensure that the Department has
adequate time to conduct pre-parole assessments and planning to provide inmates with the best possibly opporkunity
` to succeed upon their transition to the community, as well as provide, where applicable, advance notification to
crime victims, prosecutors, and law enforcement (as required. by Penal Code sections 3058.b a~ld 3058.9) of the
inmate's pending transition to parole supervision.
There are five categories of credit earning programs that are the subject of this rulemaking action.
A. Good Conduct Credit
Good Conduct Credit is an existi~lg type of credit awarded to eligible inmates who comply with the regulations and
rules of the Department and perform the duties assigned to him or her. These proposed regulations will simplify
the credit-earning categories for various offenders, incentivize more inmates to comply with prison regulations, and
create a durable solution to prison overcrowding by incorporating mandatory federal court-ordered credit increases.
Since Good Conduct Credit is awarded conditionally based on an expectation. that each inmate will comply with
prison rules and perform the duties as assigned, Good Conduct Credit is subject to forfeiture for disciplinary
reasons.
B. Milestone Completion Credit
Milestone Completion Credit is an existing type of credit awarded to eligible inmates for successful completion of
approved rehabilitative or educational programs. The awarding of Milestone Completion Credit requires the
mastery of certain performance measures that demonstrate an understanding of course curriculum (either academic
or vocational) through completion of assignments, instructor evaluations, and standardized testing. each milestone
credit is weighted based on the number of hours of classroom time and assignments. In keeping with the intent of
the Act, the maximum amount of Milestone Completion Credit an inmate may be awarded in a 12-month period
will increase from six (b) to twelve (12) weeks, and all inmates eligible far Gaod Conduct Credit shall be eligible to
earn Milestone Completion Credit. These proposed regulations will incentivize more inmates to seek out
educational or vocational training opportunities available to them and to strive to complete the longer and mare
complex programs. The revised Milestone Completion Credit Schedule (Rev 3/17) is incorporated by reference.
Milestone Completion Credit is subject to forfeiture far disciplinary reasons.
C. Rehabilitative Achr'even~ent Credzt
Rehabilitative Achievement Credit is.a new type of credit for eligible inmates who participate in approved group or
individual programs designed to further the educational, behavioral, or rehabilitative development of an inmate,
such as alcohol and substance abuse support groups and counseling, anger management, life skills, victim
awareness, restorative justice, and parenting classes. Inmate group programs must be organized to achieve
educational or rehabilitative goals, must be sponsored by Department staff ar volunteers, and must be approved by
the institutional warden. All inmates eligible for Good Conduct Credit shall be eligible to earn Rehabilitative
Achievement Credit. Inmates may earn up to a maximum of four weeks of credit per year. Rehabilitative
Achievement Credit is subject to forfeiture for disciplinary reasons.
D. Educational Merit Credit
Educational Merit Credit is a new type of credit for eligible inmates who successfully complete, while incarcerated,
a high school diploma or equivalent, an associate of arts or science degree, a bachelor's degree or graduate level
college degree, or an alcohol and drug counselor certification. This is a one-time credit awarded for each level of
educational achievement and must be earned during the inmate's current term of incarceration.. All inmates eligible
for Good Conduct Ceedit shall be eligible to earn Educational Merit Credit. Educational Merit Credit will not be
subject to forfeiture for disciplinary reasons.
E. Extraordinary Conduct Credit
Extraordinary Conduct Credit is an existing type of credit awarded pursuant to Penal Code section 2935, under

III. Non Violent Parole Consideration
In 2014, a federal Three Judge Court ordered the Department to implement a parole consideration process for non-
violent second-strike offenders who have served 50 percent of their sentence. This court-ordered process requires
prison officials to carefully review and screen out inmates based on public safety criteria. Inmates who satisfy
these rigorot,~s public-safety screens are then referred to the Board. Within .five days of any referral, the Board
notifies the prosecutor from the county of commitment and any registered victims. Interested parties are afforded 30
days to .provide written comment and input concerning the imnate's potential parole.
A hearing officer with the Board reviews all relevant information, including the inmate's criminal history, behavior
in prison, rehabilitative efforts, and written statements from interested parties, and approves or denies the inmate's
parole. The Board's decision to grant or deny parole follows established legal standards and is based on whether
the inmate poses an unreasonable risk of violence. to the .community. Ifparole is approved,.. the Department notifies
registered victims, local law-enforcement agencies and probation officers, and the Division of Adult Parole
Operations completes its normal pre-parole review process.
Under section 32(a}(1} of Article I of the California Constitution, adopted under Proposition 5'7, the Department is
directed to establish a process by which. any person convicted of a nonviolent felony offense and sentenced to state
prison shall be eligible for parole consideration after completing the full term for his ar her primary offense. The
full term for the primary offense means the longest term of imprisonment imposed by the court far any offense,
excluding the imposition of an enhancement, consecutive sentence, or alternative sentence. ___. _
These regulations establish anon-violent parole process that mirrors the existing court-ordered non-violent second
strike .parole process. Key terms such as "nonviolent," "full term," and "primary offense" are defined, and rules
established when and how a nonviolent offender may become eligible for parole consideration. To further the goal
of protecting public safety, the Department will maintain the same public safety screening criteria and notification
procedures for registered victims and prosecuting agencies, and the Board will review all relevant evidence and
apply the same legal standard for reviewing an inmate's suitability for parole—whether the inmate poses an
unreasonable risk of violence to the community. For nonviolent offenders granted parole, the Department proposes
to clarify the timing of release and the application of other laws to this parole process, such as laws governing
holds, writs, detainers, notification laws, and serving additional sentences for in-prison offenses.
A~JTHORITY AND REFERENCE CITATIONS (Gov. Code § 1134b.5 (a)(2))
In California, adopting, amending, or repealing a regulation requires an express grant of authority in law. As stated
in subdivision (b) of section 11349 of the Government Cade, "`Authority' means the provision of law which
permits ar obligates the agency to adopt, amend, or repeal a regulation."
Ordinarily, the authority to adopt, amend, or repeal regulations in Division 3 of Title 1.5 ("Adult Institutions,
Programs and Parole") is found in subdivision {a) of section 5058 of the Penal Code: "The [Secretary] may
prescribe and amend rules and regulations for the administration of the prisons ...." Authority to do the same in
Division 2 of Title l 5 ("Board of Parole Hearings") is found in section 3U52 of the Penal Code, which states, "The
Board of Parole Hearings shall have the power to establish and enforce rules and regulations under which inmatescommitted to state prisons may be allowed to go upon parole outside the prison buildings and enclosures wheneligible for parole." Furthermore, pursuant to section 5058.3 of the Penal Code, the Department is authorized topromulgate emergency regulations, as it proposes to do here, "to expedite the exercise of its power to implementregulations as its unique organizational circumstances require."
With the passage of The Public Safety and Rehabilitation Act 2016 (the "Act"), the California Constitution was
amended to specifically require the Department to promulgate regulations in furtherance of the Act's parole and
credit provisions. Specifically, Prapasition 57 states that, "notwithstanding anything in this article or any other
provision of law," CUCR "shall adopt regulations in furtherance of [the Act], and the Secretary of the Departmentof Corrections and Rehabilitation shall certify that these regulations protect and enhance public safety." {Cal.
Const., art. 1, § 32, subds. (a)-(b).) Accordingly, the Secretary has been granted broad rulemaking authority under
the California Constitution to adopt, amend, or repeal regulations in furtherance of the Act, notwithstanding other
provisions of law, and hereby invokes that constitutional grant of authority in support of this rulemaking action.
Other relevant authority: Penal Code section 5000 provides that commencing July 1, 2005, any reference to the
Department of Corrections in this or any code, refers to the CDCR, Division of Aduit Operations. Penal Code
section 5050 provides that commencing July 1, 2005, any reference to the Director of Corrections, in this ar anyother code, refers to the Secretary. of the CDCR. As of that date, the. office of the Director.. of Corrections_isabolished. Penal Code section 5054 provides that commencing July 1, 2005, the supervision, management, and
control of the state prisons, ,and the responsibility for the care, custody, treatment, training, discipline, and
employment of persons confined therein are vested in the Secretary of the CDCR. Penal Code section 5058
authorizes the Director to prescribe and amend regulations for the administration of prisons.

SPECIFIC BENEFITS ANTICIPATED BY THE PRCYPOSED REGULATIONS
(Gov. Code § 11346.5(a)(3)(C))
The proposed regulations regarding credit eaniing will benefit our criminal justice system and our communities by
creating incentives and opportunities for inmates to take responsibility for their own conduct and. rehabilitation
while incarcerated. These regulations enhance public safety by encouraging inmates to pursue educational and
vocational achievement, engage in self-improvement programs and make personal preparation for the transition to
state parole supervision or Post Release Community Supervision. Providing incentives to inmates to engage in
rehabilitative programming also reduces inmate disciplinary misconduct and violence in the prisons, yielding safer
conditions for inmates and a safer workplace for staff.
Successful implementation of these regulations will help reduce overcrowding in state prisons and aid the
Department in keeping its inmate prison population below the 137.5 percent of design capacity threshold ordered
by the federal Three Judge Court. Furthermore, by maintaining the inmate population below the federal court cap,
the Department and the State avoid the possibility of indiscriminate court-ordered early releases of prisoners.
Establishing a durable remedy to prison overcrowding can eventually lead to the end of federal court intervention
and substantial. savings from reduced litigation costs.
The establishment of the nonviolent offender parole consideration process will also. make our prisons andcommunities. safer by encouraging and motivating inmates to participate in rehabilitative. programs and serviceopportunities that create skills, employability and hope. The proposed regulations establish rigorous screeningcriteria and notification procedures for registered victims and prosecuting agencies. Establishing screening criteriabenefits public safety because it excludes inmates who are more likely to pose a risk to the public and providesnonviolent offenders with substantial motivation to .avoid prison .misconduct and focus on their .rehabilitation:Establishing notification processes benefits public. safety by ensuring .that registered victims and prosecutingagencies, as well as other interested parties, have the opportunity to submit additional information regarding thenonviolent offender for the Board's consideration. Under .the proposed regulations, the Board will review allrelevant. evidence, including an inmate's .full criminal history, institutional behavior, rehabilitative .efforts, andwritten statements from interested parties and determine whether the inmate poses an unreasonable risk of violenceto the community. This process will enhance. public safety by motivating eligible inmates to take responsibility fortheir own rehabilitation and work to prepare themselves to be productive members of the community upon theirrelease.
EVALUATION OF CONSISTENCY AND CONIl'ATIBILITY WITH EXISTING STATE REGULATIONS(Gov. Code § 11346.5(a)(3)(D))
The Department must evaluate whether the proposed regulations are inconsistent or incompatible with existingState regulations. Pursuant to this evaluation, the Department and the Board performed a search of Title 15Divisions 2 and 3 and has determined these proposed regulations are not inconsistent or incompatible with-existingregulations within CCR, Title 15, Division 2 and Division 3.

Article 3.5 Credits.
Section 3043..Credit Earning.
(a) Generat. Inmates are expected to work or parCicipate in rehabilitative programs and activities to
prepare for their eventual return to society.' :Inmates who comply with the rebulations ~~xd rules of the
departme~lt and ~erforn~ the duties assigned to him or her shall be eligible to earn Gaod Conduct
Credit as set forth in section 30432 below. In addition, inmates who. participate in approved
rehabilitative programs and activities shall be eligible to earn Milestone Co~ripletit~n Credit,
Rehabilitative Achievement Credit, a~~d Cc~ucational Merit ~redit'as set forth in sections 3043.3,
3Q43.4 and 343.5 C3elUw. The award of these credits, as well as Extraordinary Conduct Credit as .set
forth in section 3()43.6 below, shall advance an inmate`s release date if sentenced to a deteriniilate
term or advance ~~n inmate's initial parnle`hearing date pursuant to st3bdivisiUn (a)(2) of section 3Q41
of t11e Penal Cade if sentenced to an indeterrninat~ term with .the possibility of parole. Inmates why

(b) inmate Panic iF~atic~a~ in Credit Earning Programs and Activities. All eligible inmates shall have a
reasonable c~p~ort~ulity to participate in credit earning progra►ns and activities in a manner consistent
with the availability cif staff, spa~~, and` resources,' as well as tl~e unique safety and security

Section 3043.2. Good Conduct Credit.
(a) Tlie award of Gaod Conduct Ct-edit regtures that an inmate comply with the rules ai d regulatio~~s
of a prison and perform the duties assigned an a regular and satisfactory basis.
(b} Notwithstanding any other az~thority to award or limit credit, effective; May 1, 20 (7, tl~e award of
Good Conduct Credit shall advance an inmate's release date if sentenced to a determinate term oi-
advance a~i inmate's initial parole hearing date pursuant to subdivision (a}(2} c~'s~ctic~n 30~ 1 of the
Penal Code if sentenced to an indeterminate term with the passibility of parole pursuant to the
following schedule:(1} Na credit shall be awarded to an inmate sentenced to death ar a term of life witl~aut the possibility
of parole;..(2) One day ofi ca~edct for every four days of incarceration (20%) shall be awarded to an inmate

Forfeited credit under this section shall be restored if the disciplinary aeti~n is reversed pursuant to

article 5.5 of Subchapter 4 at Chapter 1 of Division 3 of Title l5 of the California Code of

(a) The award o1' Milestone Completion Credit requires t11e achievement of a distinct objective of
approved rehabilitative. probrams, including academic programs, substance ̀ abuse treatment
programs, social life skills programs, Career Technical Education programs, Co nnive Behavioral
Treatment p~•ogran~s, .Enhanced Outpatient Program group module treatment .programs, or other
approved programs with sirr~iiar demonstrated rehabilitative qualities.
(b) Milestone Completion Credit for General Education Development (GED), Tesi of Adult Basic
Ed~rcatian (TAE3E), and Comprehensive Ad~~lt Student Assessment System (CASAS) achievements
shall nog he awarded to ilir~nates already possessing a GI L?, high school diploma, high scilo~l
equivalency, or college de~re~.
(c}Notwithstanding ~iiy other authority to award ar limit credit, effective August 1, 2017, all inmates

increments upan a finding of guilt of a serio~is rule violation in accordance with section 3323, only
after all Goad Conduct Credit is exhausted. Forfeited credit under tihis sec~ian sl~~ll be restored i~f the

Section 3043.4. Rehabilitative Achievement Credit.
{a) 7'he award of Rehabilitative Achievement Credit requires verified aftendanc~: and satisfactory
participation in approved group or individual activities which promote the educational, behavioral, ~r
rehabilitative development of an inmate. To qualify for credit under this section, the purpose,
expected benefit, program materials; and nl~mberslvp criteria of each pr~pased activity, as well as
any affiliations with organizations or individuais outsideof the depat~tment, must be pre-approved by
the institution. The meeting freque~lcy and location of each activity shall only he approved ender safe
and secure conditions. Inmate ~~C~IC1~Jclttdil in such activities shall be cc~ilsistc~nt with his ar her•
custodial classification, work group assignir~ent, privilege group, and ether safet}j and security
considerations.(b) Notwithstanding any other authority to award or limit credit, effective t~;tl~;c~sl 1; ~O17 all inmates
eligible for Gt~od Conduct Credit pursuanC to section 3043.2 sl~tall be eligible f~c~r Rehabilita~iv~
Achievement Credit pursuant to this section. The award of Rehabilitative Achieveanent Credit shall
advance an inmate's release date if sentenced to a determinate term or aciva~lce an inmate's initial
parole hearing date pursuant to subdivision (a}(2) of sectiai~ 3041 of the Penal Cade if' sentenced to
an indeterminate term with the possibility of parole. Rehabilitative Achievenl~nt Credit shall b~
awarded in the following increments: one week of credit for evat-y 52 hours o~I` participation in
approved rehabilitative activities up to a maximum of four weeks of credit for 208 hours o~
participation in a twelve-month period. Rehabilitative Achievement Credit' earned in excess of this
limit during a single year (which "shalt commence after the inmate cc~mplet~s his or her first 52 hours
of such activities and each year thereafter} shall ' be deemed void. Upon release from prison, any
excess credit under this section shall also be deemed void: One week is equivalent to 7 calex~clar days.
(c) Udder the direction oflhe Secretary and in coiljuncti~n with the Director vt`the l~ivisic~n of Adult
Institutions, every Warden shall periodically (but no' less than once per calendar year} issue a
separate loco[ rule i~~ compliance with subdivision (c) of section SQ58 o~t the Penal Cade f'or each
particular prison ar other corr~ctiona) facility identifying the Rehabilitative achievement Credit
activities which comply with subsection (a}'and are approved at that location.
(d) Within ten (10) business days o~f c~ornpleting 52 hours o~ a~prc~ved activity under this section,
staf'F designated by the Warden at each inst7tuCinn shalt verify tl~~ inrx~ate's catnpletion cif tl~e hour
necessary for this credit, confirm the inmate's eligibility to receive this`credit; and ensure the credit is

educational Merit Credit, during the inmate's current term of incarceration, department staff shall
verify completion of the diploma, certificate, ar degree in the department's information technology
system.

Section 3043.7. Special Assignments.
(a) Special assignments include:
(1 } Inmate advisory council. The positiUns of chairperson ~~~d s~cretaty of an institution's inmate
advisory council may be full-time p~sitians in Work Group A-1 .(2) Prerelease pragrain. Assignment to an ~p~aroved full tine pre-release pr~~;ram shall qualify as full
time assignment in Wnrk Group A-l.(3) Any Reentry Nul~ program assignment shall qualify as a fill time assignment ire Wcirk Group
A- l .(b) Medical/psychiatric inpatient hospitalization (29 calendar clays or less). Inmates cietermineci bymedical/psychiatric staff t~ need shirt-term inpatient care s11a11 retain their existing credit earning
category. inmates requiring . longer periods of 111pc~~1011Y care sha(1 be referred by the atitending
physician/psychiatrist to a classification committee. The classification committee shall confiri~~ the

over those with a low risk assessment. Inmates sflall be ~ner~~d i~n~o the receiving institution's waiting
list based an their CSRA and in accordance with subsection (3} above.
(b) Transfers to Department of Mental Health (DMH).
(1) Penal Code (PC) sections 2684 and 2690 transfers. An inmate tra~isferred to the DMf-1 pursuant to
PC sections 2684 and 2690 is not capable of performing a work ar training assignment. Such an
itvnate shall be classified by the sending facility before the transfer and placed ill Wat•k. Group A-1.
(2) Penal Code section 1364 transfers. An inmate transferred to DMI-I to participate in the v~(untary
experimental treatment program pursuant'. Ca Penal Code section 1364 shall participate in a full-time
credit qualifying work/training assignment in order tc~ earn ~Ful~l workti~~ne credit.
(c} t~dverse transfers.(1) Adverse transfers are defined as a transfer resulting; fresin any in-custody ci~cumet~ted inisbehavic~r
or disciplinary that may ~r may nat have resulted in an inmate`s removal from current program.
(2) If an inmate is removed from a program for adverse reasons and is subsec~uent(y ea~nerated oI°t[1e
charges, the credit earning status shall be designated as though the innate had noC been re~r►ovedfrom the assibnment.(3) Effective on the date of transfer an imnate in Work Group A-1 ~r I~ who ~•eceives an adverse
transfer shall be reclassified to Work Group A-2 by the s~;ndizlg institution. "I'11e inmate shall remain
ia1 Work Group A-2 untit reclassified. by the receiving i~7stitution.
(4) An inmate in Work Group A-2, C ~r D at the time of transfer shall be retained in that group status
until reclassified at the receiving institution.
(d) Reception center or layover status.
(1) Inmates being processed in reception centers, who are ineligible to earn day-f~~i--day credits per
Penal Code section 2933, can be assinned to half-trine assi~;nmentis. Inmates can layt~ver (en r~~utej
status in any institution shall a~1ly be assigned to half=time assignments. Exception to this policy
requires approval t'rom the director, division of adult institutions.
(2) Ate inmate's participatic~~1 ii1 a full or half=tine assig~lment while unde~•going reception center
processing shall be recorded on timekeeping logs. 1'11e inmate's timekeepi~l~ (off shall be cainpleted
by the work supervisor on a daily basis. A copy shall be issued to the inmate upo~i written request.
(e) Special housing unit transfers.(1) Inmates found guilty of'a credit loss offense which could result in a security housing unit (SHU)
determinate terns shall be evaluated for SITU assigmnent by a classi~(ication c~~nmitte~.
{2) Inmates placed in a SHU, PSU, ar in ASU for reasotls specified in sectio~i 3043.4 shall be placed
in workgroup D-2. All other inmates in SHU, I'SU, or ASU shall be placEcl in Work Uroup D-1.
E31VIU inmates shall be placed in the appropriate work~;rQup, as designated by committee. 'The
effective date of both waf~k.groups shall be the ~~irst day of placement into ~1-ItJ, PSU, E3MU or ASU.

Section 3044. Inmate Work Groups.
(a) Full-time and I~al~ dine defined.
(1) Full-time work/training assignme~~ts normally mean eigl3t (8} hours per day on a five day per
week basis, exclusive of meals.
(2) Half-time work/training assignments normally mean four (4) hours per day on a eve day per
week basis. exclusive ofineals.
{b} Consistent with the; provisions cif section 3375, all assignments oi~ reassignments of an ia~mate to a

(1) Work Gaup A-1 (Full-Tin1~. Assignment). ~n inmate willing and able to perform an assignment

{A) Any inmate who twice refuses to accept assigned housinb, or who ~•eFuses to accept car perform in
an assignmenti, or who is deemed a program failure as defined in section 30 0, shalC ~be placed in
Work Group C far a period not to exceed the number of disciplinary credits forfeited due to the
serious disciplinary infraction(s).
(B) An inmate in this work group shall not be awarded Good Conduct. Credit, ~s described in section
3Q43.2, for a period not tc~ exceed the number of disciplinary credits forfeited, and shall revert to 11is
or her previous workgraup upon completion of the credit fc~rteiture. Inmates sha11 be returned to a
classification committee for placement an an appropriate waiting list.
(5) Work Group d-1 (Lockup Status). An inmate assigned to a segregated housil~g pr~~ram shall be
placed in Work Group D-1. Segregated housing shall include, but not b~: limited to, the following:
(A) Administrative Segregation Unit (ASU);
(Bj Security I-lausing Unit (S~-IU);
(C) Psychiatric Services Unit (PSU),
(D) Non-T?isciplinary Segt~e~ation (NDS).
(6) We~rk Group D-2 {Lockup Status; Zero Credit). An inmate placed in S}-~U, PSU~, or ASU far
disciplinary related offenses, as described in Penal Code section 293 ~.6, or upon validation as a
STG-1 member or associate shall be placed in Work Group U-2 and. shall not be awarded Good
Conduct Credit, as described in section 3043.2, during their plac~.ment i~~ S~-IU, PSU, or ASU.
Inmates placed in S~-IU, PSU, ar ASU following t11e commission of any ether serious disc pli~lary
infraction shall not be awarded Good Conduct C~•edit for a. period nc~t to exceed the number of
disciplinary credits forf'c;ited.
(A) An inmate assigned to a determinate SHU term which included a forfeitlue of credits sha11 nc~t
receive Goad Conduct Credit during the period of credit forfeiture oc l ~0 days, ~~~1lichever is less,
starting from the date of change in c~~stoclial classification. An inmate confined in a secure housing
unit for a division ~1-7 offense, as designated in section 3323(c) cif' th~;se regulations, and which
included: great bodily injury on anon-prisoner s(iall not receive Good Cc~nd~ict Credit for up to 360
days. Upon co~n~let~ion of the period of credit for~Ceiture, the inmate slia(( be re-evaluated by a
classification committee.(B} An inmate's status in Work Group D-2 may be extended, in up to sip-~nonil~ inereanents, by a
classificati~il committee in unusual cases. where no other assignment can be I~nade without causing; a
substantial risk aFphysical harm to stafl'cir others. At t11~ end af'the designated period (six months or
less), the. determinatiof~ shalt be reviewed by a~n instituCion classific~ti~n committee.
(C) An inmate in ASU, SI-Ill, or F'SU, serving an administrative or determinate Sf-1U t~rzn, who is
deemed a program failure as defined in section 3000, may be assigned Work Group D-2 by a
classification committee. An inmate assigned to Work Group C at t11e time of placement in AStJ,
SHU, or PSU, or who refuses to accept or perform work assignments, shall be assigned Work G~•oup
D-2. An inmate released ti~om ASU, SHU, or PSU may he placed back into Work Group C by a
classification cammit~ee not to exceed: the remaining number of disciplinaryr credits ~t~~rfeited due to
the serious disciplinary int'raction(sj.
(D) if the administrative finding ot: i~aisconduct is avei~urned or iE the inmate is criminally prosecuted

Article 1. Parole Consideration for Determinately—Sentenced Nonviolent Offenders
Section 3490. Definitions.
I'or the purposes of this article, the following definitions sI1a11 apply:
(a) A "Nonviolent Offender" is an inmate who is not any of'tihe following:
(1} Condemned, incarcerated 'for a tei°m of life wifhoiit t11e possibility of par~~le, ~r incarcerated for a
term of life with the possibility of parole;
(2) Serving a tei-~~n of incarceration fora "violent Felony;" or
(3) Convicted of a sexual offense that requires registratiotl as a sex offender under Penal Cede
section 290.
{bj A "Nonviolent Oftend~r" includes the ~following:~
(l) An ir~anate who has completed a detern~inaCe tetm of irlcarceratio» 'for a violent f~l~~ny end is
currently serving a concurrent term 'for a ilanviolent felony offense;

Section 3491. Initial Eligibility Determination.
(a) By June 1, 2017, the de~partmenl shall begin the iniCial eligibility d~tcrmi~lati<>n for nc~m~iolent
offenders as defined in section 3494.
(b) Qnce thy; department completes the initial eligibility determitlati~» ~t«r inmates already under tl~►ecustody of the department, it shall complete the initial-eligibility detez•mination upon ali inmate's
adinissian to the depat-tment.
(c) Regardless oi' a prior initial eligibil'►ty determination, the department shall conduct a new
eligibility determination whenever a sentencing court issues a new ox amend~:d abstract of judgment
that changes the inmate's convietion(s) or terms) ~~f imprisonment.
(dj The department shall conduct an initial eligibility det~rminatian review by completing all of the
following steps:(1} The department shall determine i~ the i~~ma~e meets the definition of a nonviolent offender in

Classification C<~minittee has not ~ssessecl the innate a Security ~~ousing Unit term .for any Security
'Threat Group or disciplinary reason within the past five years;
{?) Tile inmate has n~~i beets found ~~iilty of a serious Rules Violation R~pnrt far a Division A-1 or
Division A-2 ofFense 1s specified in section 3323, subdivisians {b) and (c) within the past five years;
{3) T11e i►lmate 1~as rr~t been placed in Work Group C as sp~ei~ed in section 3044, subdivision (b),para;raph {4), in the fast year;
(4) The inmate has not been fund guilty of two or more serious Rules Violation Reports in the past

Passible Release L7zte and the inmate will not reach his crr her Earliest Possible Release Date for at
least 180 days; and(8} "I'he inmate has nit subsequently been deemed no longer eligible for the nonviolent offender
parole process cinder sections 349Q or 3491.
(c) Inmates who ire eligible For referral under subdivision (b) shall be referred to the Board of Parole
I~~earings tar parole consideration under the California Code of Regulations, title 15, division 2,
chapter 3, articte ! ~.(~d) Ifthe inmate is nc~t eli~r~il~ i~or referral, t11e inmate shall be screened main one year from the date

Section 3493. Processing for Release.
If an inmate is approved for nonviolent offender parole and the decision is i~at vacated by the Board
of ~'arale Hearings, the Division of Adult Institutions and Division of Adulf Parole Operations sha11
release the inmate 6Q days from the date of the Board of F'arc~le 1-~earings' decision i~~ accordance with
Penal Code section 4755 and section 3075.2, of this title, and any other ~arocedures i~egl~ired by law,
including required notifications to victims and law eiliorcement agencies. Inmates who have an
additional term to set•ve pursuant to E'enal Code section 1 170.1, subdivision (c) shall begi7l to serve
that term 60 days from the date they are approved for nonviolent ofilender parole, if the Board of
Parole f-leanings' decision is not vacated.

Sectian 2449.1. Definitions,
For the purposes nf~this article, the fallowing detinitions shall apply:
(a)1~ ̀`Nonviolent Offcnc~cr" is an inmate wl~o is nat any of fine following:
(1} Coi~de~nned, incarcErated for a term of life without the possibility'of parole, or incarcerated for a
term of life with tllc pc~ss'rbility of parole;
{2} Serving a term ~~i' incarccratian fora ̀`violent felony;" or
(3) Convicted cif a scxta~l c~t~'ense that requires re~istl•atibn as a .sex offender under Penal Code

(b) A "Nonviolent Otfend~r'" includes the fiollowii~g:

(2) A~~ inrrlate who his cc~znpleted a determinate or i►ideterminate term of iiacarceration a»d iscurrently serving a determinate teran far a nonviolent in-prison offense.
(c) ̀̀ Violent ~'elot~y'" is a crime or enhancelinent as detineci in Penal Cede section Gfi'7.5, subdivision
~~)~(d) ̀`Primary Offense'' ►Weans the single crime far which any sentencing court imposed the longestterm cif imprisonment, cxr.lud n~; all enhancements, alternative sentences, and consecutive sente~lces.
(e) '`Full Ter~~n"' means the actL~al z~urr~ber of years irnpased by the sentencing court for the inmaCe`s
primary offense, not including; any sentencing credits.
{~ A "Nonviolent Parole eligible Date ' is the date on which an inmate who qualifies as a nonviatent
offender has served the fill .term of his or her primary offense, less pre-sentence credits applied by

Section 2449,2. Notification Process.
{a}(l) Within five. business days of referral from the department, the board shall notify registered
victims and the prosecuting agency or agencies of the inmate's pending nonviolent offender parole
co►~sideration and pi•c~vide an opportunit}~ tc~ submit a written statement.(2}.Responses to the beard must be in wrifi ng and pastrna~ked or electronically stamped no later than
30 days after the board issued the notification.
(b) A registered victim is any person who is registered as a victim with the Office of Victim and
Survivor Rights and S~rvic~.s at the time ofthe referral to the board,

Section 2449.3. Jurisdictional Review.(a) Once the 30-day notification response period under sectio~~ 2449.2 has expired, a hearing officer
shall review the' inmate's case to determine whether the board has jurisdiction to review the inmate
for nonviolent offender parole consideration.(b) Jurisdiction Defiined. For t}~e purposes of this article, the board leas jurisdietioa~ to consider ~n
innate for nonviolent offender parole when:(l) Thy inmate"s Earliest Possibly; Release Date is greater than or equal tics the departl~nent's refr;rral

Section 2449.4. Review on the NTerits.(a) Upon determination that the board leas jurisdiction, a hear ~lg officer shall complete a nonviolent
offender parole cansideratian review on the merits..(b} inf'c~rmation'co~~sidered. ̀ The hearing of~ieer shall review and ci~i~sicf~r all relevant. and reliable
iniorrnation about the inmate including, b~~t not limited to:(1) InFormatian contained in the inmate's central file and documented criminal histt~ry, including
current KAP sheets and any return to prison with a new conviction alter being i-el~ased as a res~~it o~f'
this section; and(2} Written statements s~~bmitted by the inmate, any victims registered ~t ~f1c tine ~f the refierral, aild
the prosecuting agency ar agencies that received notice under section 2~F49.2.
{c) Standard of Review. After reviewing the relevant and reliable in~[~orination, the hearing of'f~icer
sh3il determine whether the inlx~ate poses an unreasonable risk of violence to the community. In
reaching this determination, the hearing officer shall consider the totality of the circumstances,
including the fallowing fUur factors:(1 }The circumstances surrounding the current co~iviction;
(2) The inmate's print criminal record;(3) The inmate's institutional 6ehaviar ine,Iuding bath rehabilitative programming and "rnstitutianal
misconduct; and

{4) Any input lrom the inmate, any victims registered at the time of the referral, and the prosecuting
agency or agencies that received notice udder section 2449.2.
(d) Nonviolent QCfendert• ~'arole Determinations.
{1) If the hearing o9ficer finds the inmate poses an unreasonable risk of violence, the hearing officer
shall deny parole.
(2) If'the hearing officer finds the inmate does not pose an unreasonable risk of violence, the hearing
officer shall. approve parole.
(3)1"he hearing officer shall document his or her decision in writing with a statement of reasons. The
inmate., a~1y victims registered at the time of the referral, and the prosecuting agency that received
notice under section 2449.2 shall be notified.
(4) Jf the decision dill result in the inmate. ~bei~~g released two or more years prior to his or her
Earliest Possible Release Date, the deaisit~n sliail require a second signature from an Associate Chief
Depuuty C~mmissic~ner or the beard's Chief Nearing Offieer.
(.e) Nonviolent of'P~nde~r parole determinations under• this section are nc~t subject to the Inmate Appea(

the decision under section 2449.5 of this article.

The regulation text is being submitted as currently adopted,along with the Form 40Q, Part B.
The.. department has made. and continues. to make substantial.. progress and . is proceeding tocomplete this rule making action. Proposition 57, the law change on which these regulations arebased, was passed by the voters in November 2016. By mid-March 2017, the depart►nentsubmitted .regulations to .the Office of Administrative Law for consideration for emergencyadoption under Penal .Code section .50583. The Office of Administrative Law approved theemergency regulations on Aprir 13, 2017, at which time the regulations went into effect with anexpiration date, of .September. 21, 2017.. The Notice of .Proposed. Emergency: Regulations, whichincluded the ..Initial. Statement of Reasons and proposed text, was..published and mailed onJuly 14, 201.7. The public comment period began on that date and closed on September 1, 2017,when a public hearing was held. During the public comment period the department receivedcomments from .approximately 12,404.. individuals totaling approximately 41,000 specificcomments. At the public hearing over 100 speakers provided additional verbal comments. All ofthese comments require responses from the department.
Un August 31, 2017, the department .submitted a request .for. a 90-day re-adoption of theemergency regulations to the Office of Administrative Law under Penal Code. section 5058.3,which wasapproved on September 19,.2017, with an expiration date of December 21, 2017. Thedepartment plans to issue a re-notice and accept and respond to those comments before filing the 'final rulemaking package with the Office of Administrative. Law. An extension is necessary inorder to finalize the revisions. to the regulations, issue the re-notice, and respond to publiccomment.:Per Gavet~runent Code .section l 1346.1, subdivision. SPECIFIC FACTS DEMONSTRATING. THE EXISTENCE. OF AN EMERGENCY
AND THE NEED FOR IMMEDIATE ACTION
Background
The California Department of Corrections and Rehabilitation (department) finds that an
emergency continues to exist to justify re-adoption of the. department's emergency regulations
concerning inmate credit earning and parole consideration. These. emergency regulations, found
at California Code of Regulations, Title 15, Divisions 2 and 3, were .adopted pursuant to
Proposition 57, The Public Safety and. Rehabilitation Act of 2Q16 {the "Act"), which was
approved by the California voters on November 8, 2016, and approved. by the Office of
Administrative Law on April l 3, 201'7. The department further finds .that :the emergency
regulations. continue to be .necessary to .avoid serious. harm to public safety and the inmate
population.
"I'o re-adopt these regulations, Government Cade section 11.346.1, subdivision..{a)(2), requires
that,. "[a]t least five working days before submitting an emergency regulation to the [(7ffice of
Administrative Law], the adoptinb agency shall ... send a notice of the proposed emergency
action to every person who has filed a request for notice of regulatory action with the agency." In
addition, .Government Code. section 11349.6, subdivision (b), provides that after submission of
the proposed emergency ~ctio~z to the Office of Administrative Law, the Office of Administrative
Law. "sha11 allow .interested ..persons Fve calendar days to submit comments an the proposed
emergency regulations ...."
Necessity for Re-Adoption of Emergency Regulations
With the passage of Proposition 57, The Public Safety and Rehabilitation Act of 2016, the
California Constitution was amended to reform inmate credit earning and establish a new .parole
consideration. process. The Act requires the department .promulgate. regulations in furtherance of
the. credit earning provision and the parole consideration provision and provides .that the
"purpose and intent of the people of the State of California: to 1) Protect and enhance public
safety[;] 2) .Save money by reducing wasteful spending on prisons[;] 3) Prevent federal courts
from. indiscriminately releasing prisoners[;] [and] 4) Stop the revolving door of crime by
emphasizing rehabilitation, especially for. juveniles ...."
The immediate .adoption of these emergency regulations was necessary to implement the will of
the people of California. to achieve the four goals listed above. The. department acted quickly to
implement the Act, and within less than six months of the Act's. passage, on April 13, 2017, the
Office of Administrative Law approved these emergency regulations. Furthermore, the
department took great strides to enhance its information technology. systems so it could
recalculate credits for tens of thousands of inmates and assessed hundreds of inmateprogramming opportunities.
On May 1, 2017, inmates began ..earning Good Conduct Credit as outlined in the .emergency
regulations. On July 1, 201.7, the Board of Parole. Hearings began reviewing .eligible inmates
under the Nonviolent Parole Process as outlined in the emergency regulations. And on August 1,
2017, inmates began earning Milestone Completion Credit, Rehabilitative Achievement. Credit,
and Educational Merit Credit. as outlined in the emergency .regulations. As a result, thousands of
inmates have already received the benefit of one or more. of these provisions of the emergency
regulations.
Thus, failure to re-adopt the regulations would adversely impact thousands of inmates .who have
relied on these regulations to earn credit or participate. in the Nonviolent Parole Process..
Therefore, the emergency amendments to California Cade of Regulations, Title 15, .Division. 3,
sections 3042, 3043, 3043.1, 3043..2, 3043..3,. 3043.4,. 3043.5, .3.043.6, .3043.7,. 3043.8 and 3044;.
the adoption of new sections 3490, 3491, 3492 and 3493 of thatdivision; and the adoption of
new sections 2449.1, 2449.2, .2449.3., 2449.4, and 2449.5. of Title 15, Division 2, must be
re-adopted,

The . department immediately .began. developing regulations after. the .passage of .the Act. By
mid-March 2017, the department submitted. regulations to the Office of Administrative Law forconsideration for. emergency :adoption under Penal. Code section 5058.3. The Office. of
Administrative Law approved the emergency regulations on April 13, 2017, at which time the
regulations went into effect with an expiration date of September 21, 2017. The Notice of
Proposed.Emergency Regulations, which includedthe Initial Statement of Reasons andproposed
text, was published and mailed on July 14, 2017. The public comment period began on that date
and extended until September 1, 2017, when a .public hearing was .held. During the public
comment period the department received comments from approximately 12,000 individuals.
totaling approximately 41,000 .specific comments. At the public hearing over 100 speakers
provided additional verbal comments. All of these comments require responses from the
department.
On August 31, ~ 2017, the department submitted a request for. a 90-day re-adoption of the

which was approved on September 19, 2017, with an expiration date of December 21,.20.17. The.

rulemaking action. The department .plans to issue a re-notice and accept and respond to those
comments before filing the final rulemaking package with the Office of Administrative Law. An
extension is necessary. in order to finalize the revisions to the regulations, issue the re-notice, and
respond to public comment.
