(b) ptocurementofLNG; (c) ttansntission and distribution of natural gas to an LNG facility;

(d) t)mduction of LNG frmn naturalgas at an LNG facility;

(e) storage of LNG; (f) provision or sale of LNG, including LNG dispensing service; (g) use of LNG fuemng stations a'nd fuelling equipment;

(h) transportation ofLNG, including LNG transportation service; (i) use of cryogenic receptacles, .including; but not limited to~ tatlkers~

containers and vessels; {{LNG ·b:ansportatimt setvice,· .means the transportation service referred to in

section 6 ofthe LNG rate schedule;

CNG services and LNG services

3 In setting rates under the Act for a utility, the cormnission must do aU of the foliQwing: ,

(a) ireatCNG senike and LNG service~ and all costs and reven\tes (~!~ted to those ser\ilcest as pad of the utility's natural gas class of service;

(b) nUocnte aU costs and revenues related to CNG service and LNG service to all applicable customers;

(c) allow recovery ofcosts of purchasjng LNG tmder the agreement referred to insf!ctlon 5 (l) (b) of this direction.

Expansion facmues 4 - (1) The conm1ission must not exercise its power under section 45 (5) of the Act in

respect of the expatlsion facilities.

(2) In setting rates under the Act fot· FortisBC Energy Inc.,. the commissiqn must do both of the follo\ving: ·

(a) indude in the utility)s natural gas Class ofservice rate base the lesser of

(i) Hm capital costs of constructing the expansionfacHitiesf and

(H) $400 million; {b) include the utility's feasibility and development costs on or after

Janun1·y 1$ 2013} related to the expansion facilities, plus a return onthose

'LNG rate schedule and LNG purchase agreement

5 (1) \Vithin 20 days of the date this direction comes into force, the commission mnst do an of the following: (a) issue an order setting the LNG mte schedule as a rt1te for ForHsBC E11ergy ,

Inc. effective on the date the order is issued; (b) acceptfpt filing under section 71 of the Act the Gas Liquefaction, Storage

and Dispet1sh1g Service Agreement between FortisBC Energy (Valtcmwer Island) Inc. and FortisBG Energy Inc. as s(tt out in Appendix 2 attached to this. direction;

(c) issue an order setting the agreement referred to in JJaragra}>h {b) as a rate for FottisBC Energy,(Vunconver Island) Inc .

. (2) The comnussion must not do anything to amend) can. eel or suspend the LNG n1te schedul~l except on application hythe utility.

(3) IfPortisBC Et1ergy Inc, applies to the commission to amend a clmrge. in. the LNG ra~e schedule} the commission must not set the charge by reference to chatges imposed by other providers providing shn.ilar services.

(4) tfbe commission must not exercise ti power under the Act in a \Vay that would directly or indirectly prev¢nt FortisBC Energy Inc. from providing LNG dispe11sing service under the LNG rate schedule.
