Shopping Centers and Other Areas of Assembly (Local Law Amendment)November 4, 2019Supervisor Shaw WHEREAS, a public hearing was held on October 21, 2019, for discussion and publiccomment concerning adoption of proposed local law #13, 2019, and WHEREAS, proposed local law #13, 2019, calls for the amendment to Chapter 210 ofthe Town Code of the Town of Hamburg entitled “Shopping Centers and Other Areas ofAssembly” by adding thereto one new location as follows:

Lighting at Town Park Tot LotWHEREAS, a request from Building and Grounds Department was made for a floodlight toshine on the new Tot Lot at the Town Park, the Town Engineer has recommended that afloodlight is warranted at this location, THEREFORE BE IT RESOLVED, that the Town Board authorizes National Grid toinstall one, 400 Watt Flood Light on National Grid Pole No. 9-2-A, inaccordance with the terms and conditions of the current National Grid street light tariff. BE IT FURTHER RESOLVED, that the Town Clerk is requested to provide two certifiedcopies of this resolution to the Engineering Department, for transmittal to National Grid. MOVED: Farrell

16. Business from the Floor

Reports from Department Heads Ted Casey, Highway Superintendent - stated his crews were at Hoover Beach to assist after thestorm and did a great job. Sean Crotty, Sr. Public Safety Coordinator - commended the members of the town HighwayDepartment as well as the members of the police, fire, power company, NYSDOT, and all those whohelped throughout the town the night of the storm and the following day. Mr. Crotty also stated thathe had a conversation earlier in the day with representatives from the state about possible assistance. He also asked that both public assistance assessments and individual assessments be done. Furthermore, he stated that they are pursuing federal funds and any other means of funding possible. Martin Denecke, Director of Youth, Recreation and Senior Services - Golf Course is closed forthe season. Gregory Wickett, Chief of Police - Winter parking rules are now in effect (no street parking from 1am to 6 am). Resident Comments, Questions, Concerns Steve Miska, Hoover Beach Resident - Lake Levels have been high all summer. High winds of 60-65mph Thursday evening through Friday morning creating 20 foot high waves. Those on the water inthe Hoover Beach Community are devastated. The sea walls experienced significant damage leavingthe rest of the are in peril. We need help. Some people have home owners insurance and others do

not. Dennis Chapman - Invited everyone to the Veteran's Day observance on November 11 at AmericanLegion Post 527. LeAnn Powers, Hoover Beach Resident - Was invited to Shoreline Revitalization Committee Meetinga few weeks ago and the topic of conversation was focused on bike trails and recreation. Nopreparation or discussion took place regarding erosion, storm prep, sandbags, etc. Would like thecommittee reformed and renamed for stabilization. She expressed her dissatisfaction stating that shefelt concerns were dismissed and took exception to being called a "worry-wart" by a member of thecommittee. Also, concerned about assessment values. Mirror emergency measures taken on Lake Ontario. Supervisor Shaw replied that he will leverage the influence the town has to contact upper levels ofgovernment to get a short term solution in place for the coming months as well as a long term fix inplace. Bedrock Eatery owner is unable to physically or financially able to remove the debris and trees fromthe property possibly leaving the roadway in jeopardy if another storm hits. When do you expect to hear from FEMA? Mr. Crotty responded that FEMA currently had workerson the ground in the Mohawk Valley and he has pushed to have Hamburg moved up as a priority. Hopefully by the end of the week they will have a firm answer and get boots on the ground next week. Supervisor Shaw recognized Joseph Kilian, 2649 Ferndale Avenue, he stated he is a member of theLocal Waterfront Revitalization Board and the committee has brought up the issue of erosion eachmeeting, but it hasn't gone too far. Mr. Crotty stated that the town includes Hoover Beach in it's mitigation proposal to Erie County, butevery year it gets cut. He continued that he has spoken with Commissioner Neaverth and said he hasspoken with the state and FEMA to press for help. Residents inquired about whether or not the Supervisor or town has spoken with any of thecommunities on Lake Ontario receiving assistance. Supervisor Shaw said that he had not, but that hewill do so.
