The Pyidaungsu Hluttaw hereby enacts this

Law.

1. This Law shall be called the Nuclear

Safety Law.

2. For the purposes of this Law:

in this Law shall have the meanings given

hereunder:

(a) Activities mean the production,

use, import and export of radiation

sources for industrial, research and

medical purposes; the transport of

radioactive material; the siting,

construction, commissioning,

operation and decommissioning of

facilities; radioactive waste

(b) Practice means any human activity

that introduces additional sources

of exposure or exposure pathways

or extends exposure to additional

people or modifies the network of

(d) Site means that area delimited by

the State in the relevant design

information for a facility, including

a closed-down facility, and in the

relevant information on a location

outside facilities where nuclear

material is customarily used,

including a closed-down location

carried out). It also includes all

installations, collocated with the

facility or location, for the

provision or use of essential

services, including: hot cells for

processing irradiated materials not

containing nuclear material;

installations for the treatment,

irradiation installations, some

mining and raw material

processing facilities such as

uranium mines; radioactive waste

management facilities; and any

other places where radioactive

material is produced, processed,

used, handled, stored or disposed

of, on such a scale that

consideration of protection and

safety is required.

where activities or practices

utilizing nuclear material are

conducted, including a nuclear

power plant, research reactor, fuel

fabrication plant, spent fuel storage

facility, enrichment plant,

reprocessing facility or any other

facility determined by The

Department of Nuclear Safety.

(h) Clearance means the removal of

radioactive material or radioactive

objects within authorized practices

from any further control by The

leading to the release of a facility,

(j) Discharges means planned and

controlled releases into the

environment, as a legitimate

practice, within limits authorized

(k) Exemption means the

determination by The Department

of Nuclear Safety that a source or

practice need not be subject to

some or all aspects of regulatory

control on the basis that the

exposure (including potential

exposure) due to the source or

practice is too small to warrant the

application of those aspects or that

this is the optimum option for

protection irrespective of the actual

level of the doses or risks.

(ဌ) တငပြခငး ဆသညမာ ပငရငးများအပါအဝင

(l) Export means the physical transfer,

originating from the Republic of

the Union of Myanmar, into an

importing State, of nuclear or other

radioactive material, including

sources and specified equipment

and non-nuclear material listed in

Annex II of the Additional

Protocol.

(ဍ) တငသငးြခငး ဆသညမာ ပငရငးအပါအဝင

နျကလးယား သမဟတ

(m) Import means the physical transfer,

into the Republic of the Union of

Myanmar or to a recipient in the

Republic of the Union of

Myanmar, originating from an

exporting State, of nuclear or other

radioactive material, including

sources and specified equipment

and non-nuclear material listed in

Annex II of the Additional

Protocol.

(n) Ionizing radiation, for the purposes

of radiation protection, means

radiation capable of producing ion

issued by The Department of

Nuclear Safety granting

authorization to perform specified

activities related to a facility or

activity.

(p) Licensee means the holder of a

current licence granted for an

activity or practice who has

recognized rights and duties for the

activity or practice, particularly in

relation to safety, security and

uranium-233, or uranium enriched

in the isotopes uranium-233 or

uranium-235, or any other material

The Department of Nuclear Safety

nuclear material.

(r) Nuclear material, for purposes of

the application of International

Atomic Energy Agency safeguards,

means any special fissionable

self-sustaining chain process of

nuclear fission outside a nuclear

(t) Nuclear or radiological emergency

means an emergency in which

there is, or is perceived to be, a

hazard due to: (a) the energy

resulting from a nuclear chain

reaction or from the decay of the

products of a chain reaction; or (b)

radiation exposure.

(u) Operator means any organization

or person applying for an

authorization, or that is authorized

or responsible for nuclear,

radiation, radioactive waste or

transport safety when undertaking

activities or in relation to any

nuclear facility or source. This

includes private individuals,

governmental bodies, consignors or

(w) Radioactive source means

radioactive material that is

permanently sealed in a capsule or

closely bonded in a solid form and

that is not exempt from regulatory

control; it also includes any

radioactive material released if the

radioactive source is leaking or

broken, but does not mean material

encapsulated for disposal, or

nuclear material within the nuclear

(x) Radiation source means a radiation

generator, or a radioactive source

or other radioactive material

outside the nuclear fuel cycles of

research and power reactors.

material designated in the law of

the Republic of the Union of

Myanmar or by The Department of

Nuclear Safety as being subject to

regulatory control.

occurrence or series of occurrences

having the same origin which

causes nuclear damage or, but only

with respect to preventive

measures, creates a grave and

imminent threat of causing such

damage.

Prior Permission, Registration and

8. Any person who intends to engage in

an activity or practice enacted in this law

12.Before conducting activities and

practices prescribe in this law, the licensee

shall be followed the inspection

conducted by the department, for the safety

of people and environment and for the

purposes of security of nuclear materials,

radioactive materials , radiation apparatus

and /or source and, also to follows/ abides

the international instruments : conventions,

treaty, agreement concerning the nuclear

matter.

15. The licensee shall apply to the

Department to renew the licence in

accordance with identification of licencing

procedures 30 days prior to the expiry of the

term of licence.

16. The Department may allow or refuse to

issue renew licence for submitting

according with the stipulations under

section 15, after verifying compliance with

21. Where an authorized (licensed) person

or entity is found to be in non-compliance

with (violation of) this Law, applicable

regulations or the terms and conditions of

the authorization (licence), The Department

of Nuclear Safety shall take the necessary

enforcement actions commensurate with the

seriousness of the non-compliance

(violation).

22. For cases involving non-compliance (a

violation) that is of minor safety or security

significance, the Department of Nuclear

Safety may issue a warning in writing and

determine the period of time during which

remedial action must be taken.

23. For cases representing an immediate

safety or security hazard to people or the

environment, the Department of Nuclear

Safety may require the person or entity

subject to enforcement action to suspend its

activities until the situation has been

corrected. In such cases, the Department of

24. In cases of persistent or extremely

serious non-compliance with (violation of)

the terms and conditions of an authorization

(a licence) or in cases of significant release

of radioactive waste into the environment,

the Department of Nuclear Safety may

revoke the authorization (licence) and

require the authorized person (licensee) to

remedy any unsafe condition.

ensuring safety rests with the person(s) or

entities authorized (licensed) to engage in

activities involving ionizing radiation or

nuclear energy.

the Department of Nuclear Safety and shall

ensure that radiation doses to workers and

the public, including doses from releases

into the environment, are as low as

reasonably achievable, taking into account

social and economic factors.

55. A national emergency plan for

responding to emergencies shall be

coordinated with all relevant emergency

intervention or response organizations.

Emergency plans shall be periodically

reviewed, updated and tested. In the event

of a nuclear or radiological emergency, the

authorized person (licensee) shall

implement the emergency plan as approved

by the Department of Nuclear Safety.

Department and approved at the committee.

68. To ensure the safe and secure

management of radioactive waste (and spent

fuel) in Myanmar, the Department shall

establish administrative regulations.

70. The authorized person (licensee) of a

nuclear waste disposal facility shall prepare

a plan for the closure of that facility that

includes both active and passive

institutional controls. The Department shall

approve this plan prior to authorizing the

operation of that facility.

71. Subject to the provisions of this law,

only the operator of a nuclear installation

shall be liable for nuclear damage wherever

suffered, upon proof that such damage has

been caused by a nuclear incident at the

operator’s nuclear installation.

73. In the case of transport of nuclear

material, the sending operator shall be liable

for nuclear damage until the receiving

operator has taken charge of the material

involved, unless the sending and receiving

operators have entered into a written

agreement to shift liability at another stage

of transport or to shift liability to the carrier

of the material at its request. In the latter

74. In the case where the nuclear material

has been sent to a person within the territory

of a State that is not Party to the nuclear

liability conventions, the sending operator

shall be liable before the nuclear material

has been unloaded from the means of

transport by which it has arrived in the

territory of that non-contracting State.

75. The minimum amount of liability of

the operator of a nuclear installation is [300

million SDRs under the 1997 Vienna

Convention and the 1997 CSC, 700 million

EUR under the 2004 Paris Convention] for

nuclear damage caused by any one nuclear

incident.

77. Rights of compensation for nuclear

damage under this law shall be extinguished

if an action is not brought with respect to

loss of life or personal injury, within 30

years from the date of the nuclear incident

and with respect to any other nuclear

damage, within 10 years from the date of

the nuclear incident.

80. Where claims exceed, or are likely to

exceed, the maximum amount made

available pursuant to Article 143 [Amount

of Liability], compensation for nuclear

damage caused by a nuclear incident shall

be provided first for compensation for any

loss of life or personal injury. After all these

claims have been satisfied, claims for other

81. The civil court shall be the only court

having jurisdiction to examine claims for

compensation for nuclear damage pursuant

to this law caused by a nuclear incident

occurring within the territory or within the

exclusive economic zone of the Republic of

the Union of Myanmar and which are

brought before that court according to the

provisions of this law.

82. Any person who has a right of

compensation for nuclear damage pursuant

to this law may bring an action for

compensation against the liable operator, or

directly against the insurer or against any

other person providing financial security.

proved to be directly caused by an act of

armed conflict, hostilities, civil war or

insurrection.

84. If the operator of a nuclear installation

proves that the nuclear damage resulted

wholly or partly either from the gross

negligence of the person suffering the

damage or from an act or omission of such

person done with intent to cause damage,

the operator may be relieved, wholly or

partly, from his obligation to pay

compensation in respect of the damage

suffered by such person.

liability of any individual for nuclear

damage for which the operator, by virtue of

Articles 156 and 157 of this Article, is not

liable and which that individual caused by

an act or omission done with intent to cause

damage.

authorized (licensed) persons and entities

shall cooperate fully with the IAEA in the

application of safeguards measures.

96. Where there has been a theft, threat of

theft or loss of nuclear (or other radioactive)

material, the licensee shall: notify the

Department of Nuclear Safety without delay

of the incident and circumstances thereof;

provide a written report, including

particulars, to the Department of Nuclear

Safety as soon as practicable after providing

notice and provide the Department of

Nuclear Safety with any additional

information requested.

someone else knowing that the

communication could prejudice the physical

security of nuclear material, or an

associated item, to which Section [cite

relevant section] applies shall be punished

၁၀၃။ ဦးစးဌာန၏ 103. Any applicant, authorized person or

other person substantially impacted by a

decision of the Department shall have the

right to file an appeal against this decision

consistent with existing laws and

regulations of the Republic of the Union of

အခါအား လျာစာ ထတြပနသည စကကရယာများ၊

ပငရငးများက လကဝယထားရြခငး မြပရ။

105. No person shall, if application has not

been made for a registration certificate in

accordance with this Law or if the

application for a registration certificate has

been refused by the Department, keep in

possession nuclear material, radioactive

material or irradiation apparatus.

၁၀၆။ မညသမ လငစငမရဘ နျကလးယားြဒပပစစညး၊

106. No person shall, without a licence,

utilize, produce, store, distribute or sell

nuclear material, radioactive material or

irradiation apparatus.

၁၀၇။ မညသမ ဦးစးဌာန၏ ကတငခငြပချကမရဘ 107. No person shall without prior

108. No person shall keep in possession,

utilize, produce, store, distribute or sell

nuclear material, radioactive material or

irradiation apparatus determined by the

Department as being not suitable for further

utilization or retention.

109. No person shall carry out an activity or

practice unless specifically authorized

(licensed) by the Department of Nuclear

Safety, or unless the practice has been

exempted from regulatory control.

၁၁၁။ လငစငရရထားသမညသမ လငစငပါ

လပငနးနငလပ ဆာငမ များက တးချ မမးမရန

ရညရယချကရပါက ထတးချ မမးမမအတက လငစင

မရမချငး ဆာငရက ြခငးမြပရ။

111. That the authorized person (licensee)

will not modify its conduct of any

authorized activity or practice in a manner

that could affect the protection of workers,

the public or the environment without

seeking the approval of the Department of

Nuclear Safety;

၁၁၂။ သတမတထား သာ အ ြခခအချကအလကများနင

မကကည ပါ က မညသမ ရဒယ

112. No person or entity shall engage in the

transport of radioactive material without

complying with the requirements

established pursuant to the provisions under

Regulation of the Transport of Radioactive

Material.

113. No person or entity shall operate a

radioactive waste (or spent fuel)

management facility without an

authorization (licence) issued by the

Department.

အချပအြခာအာဏာပငနယနမတြပငပရ ရဒယသတတ က

114. Radioactive waste or spent fuel

generated outside the territory of the

စနပစပစစညးများ သမဟတ အသးြပ ပး လာငစာများက

မညသညရညရယချကနငမ နငင တာ အတငးသ

တငသငးြခငးမြပရ။

Republic of the Union of Myanmar shall not

be imported into the Republic of the Union

of Myanmar for any purpose.

၁၁၅။ မညသမ ဦးစးဌာန၏ ကတငလငစင

ရယထားြခငးမရဘ ကနသတကနပစစညးများက

နငင တာသ တငသငးြခငး သမဟတ နငင တာက

115. The export from or import into the

Republic of the Union of Myanmar of a

controlled goods/items without prior

authorization (licence) by the Department.

116. No person shall disclose confidential

information, including any such information

that is acquired pursuant to the provisions of

the Convention on the Physical Protection

of Nuclear Material and its Amendment.

117. Nuclear weapons and other explosive

devices, the direct or indirect control over

such weapons or devices, the manufacture

or other acquisition of such weapons or

devices, and the seeking or receiving of any

assistance in the manufacture of nuclear

weapons or other explosive devices is

prohibited in the Republic of the Union of

Myanmar.

၁၁၈။ မညသမ အာက ဖာြပပါ ဆာငရကချကတစခခက

(က) ရဒယသတတ ကပစစညး သမဟတ

118. Whoever commits:

(a) a theft or robbery of

များကအလသးစားြပြခငး သမဟတ

နျကလးယားြဒပ ပစစညးများက ဥပ ဒနငအည

ခငြပချကမရရဘ ြပညတငး သ ြဖစ စ

ြပညပသြဖစ စ သယယြခငး၊ ပ ဆာငြခငး

သမဟတ ရ ြပာငးြခငး။

radioactive/nuclear material;

(b) an embezzlement or fraudulent

obtainment of radioactive/nuclear

material;

(c) an act which constitutes the

carrying, sending, or moving of

radioactive material into or out of a

State without lawful authority shall

be punished with penalties which

take into account the grave nature

of those offences.

119. Whoever threatens to commit an

offence set forth in Article 198(a) of this

Article in order to compel a natural or legal

person, international organization or State

to do or to refrain from doing any act shall

be punished with penalties which take into

account the grave nature of those offences.

နျကလးယားပစစညးတစခခ သမဟတ နျကလးယား

ဥပ ဒနငမညသည တာငးဆမများ မြပရ။

120. Whoever demands radioactive/nuclear

material or a device or a nuclear facility by

threat, or by use of force, or by any other

form of intimidation, under circumstances

which indicate the credibility of the threat

shall be punished with penalties which take

into account the grave nature of those

offences.

ရညရယချကြဖင ဆာငရကမများ မြပရ။

121. Whoever, without lawful authority,

receives, possesses, transfers,alters, or

disposes of radioactive/ nuclear material or

possesses a device with the intent to cause

death or serious bodily injury or substantial

damage to property or to the environment or

which causes or is likely to cause death or

serious injury to any person or substantial

damage to property or to the environment

shall be punished with penalties which take

into account the grave nature of those

offences.

၁၂၂။ မညသမ ရဒယသတတ ကြဒပပစစညး သမဟတ

122. Whoever, without lawful authority,

uses or disperses in any way

တစခခက ြပမ ဆာငရကြခငး မြပရ-

(က) တမငရညရယ၍ လပဂဂလ၏

အသကဆးရး စသည

အနတရာယကျ ရာက စြခငး သမဟတ

ြပငးထနစာ ထခကဒဏရာရ စြခငး၊

ပငဆငမများ သမဟတ ပတဝနးကျငက

radioactive/nuclear material or uses or

makes a device or uses or damages a

nuclear facility, [interferes with its

operation, or commits any other act directed

against a nuclear facility] in a manner which

releases or risks the release of radioactive

material:

(a) with the intent to cause:

(i) death or serious bodily injury; or

(ii) substantial damage to property

or to the environment; or

(b) to compel a natural or legal

person, an international

organization, or a State to do or

124. Whoever commits the prohibition set

forth in Article 103 of this Article shall be

punished with imprisonment for a term not

exceeding a year or with fine at least from

one hundred thousand to not exceeding one

million kyats, or with both.

provisioins of this law:

၁၃၁။ ဤဥပ ဒြဖင 131. The Atomic Energy Law (No.8/98) is

အဏြမစမးအငဥပ ဒကရပသမးလကသည။

hereby repealed by this law.

Upon entry into force of Nuclear Safety

Law, the provision of the Atomic Energy

Law is hereby repealed.

132. The procedures, order and directives

issued under the Atomic Energy Law may

continue to be applicable in so far as they

are not inconsistent with this law.
