COURSE INFORMATION

Course Description This course teaches knowledge, skills, and abilities essential to provide basic patient care to residents in long-term care facilities. Topics include resident rights, communication, safety, observation, reporting, basic comfort, and safety. Emphasis on effective interaction with members of health care team. Successful completion entitles one to test for registration as a certified Nursing Assistant for the state of Texas. Contact Hours: 112 Student must also complete NURA 1060 (clinical component) to be eligible for certification examination.

Mission Statement: This program's instructors believe in the dignity, worth, and rights of all people. As nurses, we further believe that it is the nursing role to promote communities and the

society they form by helping people throughout their lives. To efficiently fulfill their helping role, nurses need informed assistants to provide nursing-related activities. This program offers information necessary for nurse assistants to provide nursing- related activities in a compassionate, competent, caring manner. Nurse's assistants will learn information in a variety of classroom and clinical instructional settings. Once learned, these nursing-related activities will allow the nurse assistant to work with nurses in their role of helping people throughout their life span, during periods of health or illness. . The focus of the Kilgore College Nurse Assistant Program is Geriatrics in the Long-Term Care setting. Student Learning Outcomes Upon successful completion of this course, students will: 1. Be able to discuss basic care of residents in a long-term care facility and perform

tasks according to the Texas Curriculum of Nursing Assistants in Long Term Care.

2. Be able to communicate and interact effectively with residents and their families based on sensitivity to the psychosocial needs.

3. Be able to discuss the rights of the residents.

4. Be able to provide safety and preventive measures in the care of residents.

5. Be able to demonstrate skills in observing and reporting.

6. Be able to assist residents in attaining and maintaining maximum functional independence.

EVALUATION/GRADING PROCEDURES Grade Calculation

Chapter/Unit Exams

Final Exam The final exam is comprehensive and covers material from the entire course. A minimum score of 80% is required.

Skills Clinical skills will be demonstrated and checked off on a TDHS Skills Checklist and will be rated: Satisfactory (S) or Unsatisfactory (U). The TDHS requires that students satisfactorily complete all skills. Students who cannot do this cannot complete the program. A student’s class average has no bearing on clinical performance.

EVALUATION OF INSTRUCTOR Each semester students will be given an opportunity to evaluate the instructor and the course. Approved evaluation forms are provided by the Office of Institutional Research, which is also responsible for their analysis

Professional Conduct: 1. Conduct in classroom:

a. Food or uncapped drinks are not permitted in the classrooms. Exceptions would be hard candy, mints, gum.

b. Students should conduct themselves in a quiet, orderly manner in the hallways and on break in consideration of other students in class.

c. Raise your hand if you have a question. The instructor will acknowledge your hand up during an appropriate pause in the lecture/lab.

d. Please be courteous to your classmates and instructor. Do not interrupt or talk to each other during class/lecture.

e. Use the restroom during your breaks given in class.

f. Do not put your head down or fall asleep in the class

g. Do not do homework during class

h. Breaks are assigned at the discretion of the instructor

Professional Conduct: 1. Students are expected to treat patients with kindness, courtesy, and respect.

When contact with the patient is initiated, students will introduce themselves and try to initiate rapport. When providing care, the student should keep the door closed and make sure that patient privacy and modesty is properly respected.

2. Professional behavior is not limited to contact with patients. It is reflected in the student’s attitude and in communication with facility staff, family members, and other students.

3. Smoking, eating, drinking, or chewing gum is permitted only in designated areas as specified by the clinical facility. Many clinical affiliates enforce a smoke free campus.

4. Students will not leave assigned area at any time without permission.

5. Students will not remain at the clinical facility after scheduled clinical hours.

6. When not actively engaged in nurse aide work or other duties, students should remain in their assigned area and not congregate in offices, halls, or other rooms.

7. Telephone calls and visitors: Kilgore College, Longview (903) 753-2642. Students are not to use the telephones in the offices at the Longview Center. Only EMERGENCY calls will be taken at the Longview Center or in clinical areas. No Personal Calls Allowed. Tell your family, day care personnel, etc. not to call except in an emergency (notify person taking the call that this is an .emergency or urgent.) In the event that someone must reach you in a clinical area, he or she must page the Nursing Assistant Instructor and she will relay the message to you. Students are not to use the facility or patient phones at any time

8. Cell phones and personal electronic devices of any kind are STRICTLY prohibited from use in patient care areas due to concern of the potential for breach of HIPAA regulations. CELL PHONES MAY NOT BE CARRIED BY STUDENTS IN THE CLINICAL SETTING.

9. Breaks: Clinical: Assigned by the Instructor. Fifteen (15) minute break begins when you leave the unit and ends at your return. Students may not leave assigned unit without permission from the instructor. Students may not return to their car during the 15-minute break.

10. Online activity in the clinical setting is strictly prohibited. Personal computers and/or tablets are not allowed in the clinical setting.

11. Employment- If the student is employed, he or she must remain in the class or assigned area until dismissed by the Instructor before going to work. The

uniform, apron, and name pin of Kilgore College shall be worn only while participating in student program.

12. Gifts- Students will not accept gifts or money from patients or family members. Students should not give gifts or money to patients or family members.

Routine Duties: 1. Students are assigned to clinical work areas and rotations by the Program

Director, Clinical Coordinator, or Clinical Instructor.

2. Students will be responsible for:

a. Providing baths to assigned patients, if it is the patient’s scheduled bath day.

b. Performing ADL (activities of daily living) care for assigned patients.

c. Assisting facility staff with passing of meals during clinical hours.

d. Keeping assigned areas neat and clean.

e. Providing for privacy for the patient during care.

f. Maintaining professional attitude.

3. Students ABSOLUTELY MUST NOT leave assigned areas for break, lunch, or at the end of the day until all work assigned to the student has been completed or the student is relieved. Immediately upon return from break or lunch the student will report to the licensed nurse or Clinical Instructor in charge of the assigned area.

Dress Code (Classroom and Clinical): White uniform and royal blue apron, college name badge, white shoes. Clean, neatly ironed white uniform is required. If a dress is utilized, the length of the uniform must be at least two (2) inches below the knee. Male students must wear white tunic (scrubs), white slacks, white socks, and white shoes. The designated royal blue apron for students must be worn over the uniform while on the units or giving patient care. Aprons are purchased at the bookstore or Scrubs Galore ‘N’ More 815 North 4th Street 903-757-3600. Clean, white shoes with non-slip soles (at least 75% of shoe must be white) and white shoelaces and white ankle socks. Shoes should be a standard duty shoe- no open toes or sandals. No crocs or similar shoes with holes. Back of shoe should cover back of heel. Hem of pants may not touch floor. Kilgore College name badges must be worn on the left upper apron.

Good grooming includes daily bath with the use of an antiperspirant or deodorant. Perspiration and odor increase with physical activity, nervousness, and excitement. Good oral hygiene includes regular tooth brushing and use of mouthwash. An

unclean mouth is offensive and serious diseases may originate with infections of the mouth and teeth. Many people have fragrance sensitivities, so cologne and aftershave is not allowed on clinical days.

Jewelry may consist of one small post earring in each ear and a plain wedding band. No facial jewelry may be worn.

Fingernails must be clean, trimmed to the end of your finger, and have rounded edges. Artificial nails and colored nail polish will not be permitted.

The hair (men and women) must be kept clean, neat, and off the collar and professional in appearance. No long, dangling, or loose ponytails, no hairpieces allowed. Hair that falls forward around the face must be secured behind ears with pins or barrettes or headband. Male students: facial hair shall be shaved clean daily. Bears and moustaches are allowed if kept neatly trimmed.

A watch with second hand and pen with black ink are required. No digital watches allowed. A small pocket sized notebook is helpful for recording assignments and clinical observations.

The student will be sent home if his or her appearance or hygiene is not acceptable. The student will be marked absent for the entire clinical day.

Attendance Kilgore College expects punctuality and regular class attendance. An absence is defined as a student's not being in class for any reason. Students who are absent may miss important instruction, discussion, assignments and deadlines. Students are expected to communicate with instructors regarding their absences. Some workforce programs may have specific attendance requirements due to applicable external requirements and/or competencies; therefore, students in workforce programs should check with their instructor regarding the specific number of absences allowed. Students may be dropped for non attendance per Federal Financial Aid requirements.

Program/Course Specific Attendance Policy For this course, in order to meet state and federal guidelines, Students must be on time for all class and clinical assignments. Being absent or late for class will result in dismissal from the program.

Policy on Make Up and Late Work: For missed work or exams due to an absence because of a Kilgore College event, arrangements with the instructor need to be made beforehand, before the assignment due date or exam date, and need to be accompanied by an official Kilgore College communication designating the student’s required participation in the activity.

Communication Policy Per Kilgore College Policy, your instructor will email you only through your official college email. Students are also encouraged to use this email for college business, and it should be regularly checked. Emails will be answered within 24 hours during the week and will be checked once on the weekend. Grades and feedback will be available in a timely fashion: no more than 7 days for regular assignments and 14 days for larger work.

Statement on Civility in the Classroom Students are expected to assist in maintaining an environment that is conducive to learning. Inappropriate or distractive behavior is prohibited in order to assure that everyone has an opportunity to gain from time spent in the course. Should a disruptive incident occur, the faculty member in charge may remove the student. Students have the right to appeal through the student complaint process, described below.

Additional Criteria for Dismissal: The Director may dismiss a student who has shown evidence of any of the following behavior while in the classroom or clinical areas:

• Major incidents of unsafe performance in clinical area as determined by the instructor, nursing staff, and written clinical evaluations. For example, leaving a resident unattended in the shower or bath, refusing to follow instructor direction, transferring a patient without proper assistance.

• Breach of confidentiality, unethical discussion of patient diagnosis and care, defamation of physicians, nurses, or staff, (including the use of abusive, profane language).

• Chemical impairment rendering nurse aide unable to perform activities as directed.

• Stealing money, food, or any other item from a classmate, resident, or other .person.

• Academic dishonesty

• Possession of a weapon.

• Uncontrolled, violent behavior requiring intervention.

• Insolence or insubordination toward school policies or staffing affiliating agencies.

• Intentional damage to school, clinical, or private property.

• Failure or inability to safely perform nursing related activities according to commonly accepted education and nursing standards

• Abuse, threatening to abuse others, profanity, or persistent disruptive behavior in class.

• Sexual Harassment

o Sexual Harassment is an exploitative abuse of power which violates college policy; sanctions will be taken against persons found guilty of engaging in such behavior, which is specifically prohibited by both federal law (Title VII, Civil Rights Act of 1964), State Law (Texas Commission on Human Rights Act and Title IX of the Educational Amendment of 1972) and the Texas Penal Code (Section 39.02).

• Failure to practice ethical care. Examples, leaving clinical area without instructor knowledge from instructor, failure to report an incident or resident injury to appropriate nursing personnel and instructor; misuse of resident personal property.

READMISSION • A student who is dismissed for absenteeism or inadequate grades will be eligible

for re-entrance to another scheduled program. • The TDHS requires that a student be present for the complete program in order

to meet their requirements. Therefore a student needs to be present all scheduled days. If not, student will be dropped from the program.

• Any student dismissed for any reasons listed under the section "Additional Criteria for Dismissal" is not eligible for re-entrance

Student Grievance/Student Complaints Kilgore College is committed to resolving student concerns or complaints in the most expeditious and informal manner possible. Academic Honesty Statement Academic dishonesty is a violation of the Kilgore College Student Rights, Responsibilities and Code of Conduct Policy (available at https://www.kilgore.edu/about/human-resources/policy-and-procedures#stu-rights-policy2). Sanctions for violating the Code of Conduct are outlined in the policy.

Withdrawal Policy Student-Initiated Drop is an official action whereby a student informs the Office of Admission and Registrar that the student will cease attending a class in which he or she is enrolled while remaining in at least one other course. After the Financial Aid

Attendance Verification Deadline, a student must follow the course withdrawal process and complete the official Course Withdrawal Request Form. Withdrawing from the college is an official action whereby a student informs the Counseling Center and the Office of Admissions and Registrar that the student will cease attending all classes in which he or she enrolled. Kilgore College Campus Carry Policy (effective August 1, 2017) We respect the right and privacy of those who are duly licensed to carry concealed weapons in this class. Alternative Operations During Campus Closure/Emergency In the event of an emergency and/or campus closure due to a natural disaster or health crisis, Kilgore College may alter its regular operations. To minimize the disruption of teaching and learning, the College may continue to deliver instruction via one or more of the following modes: online learning, remote learning with video conferencing using its Learning Management System Blackboard, email messaging, and/or other means of communication with students. The College may also implement an adjusted class schedule. Students are responsible for monitoring the Kilgore College website (www.kilgore.edu), their Kilgore College email account, and Blackboard for information related to each of their courses and to Kilgore College.

An adjusted delivery mode or class schedule does not entitle students to either a full or partial refund of their tuition and fees for the semester. In the event that students are not able to complete all of the requirements of a course by the end of the term/semester, Kilgore College will make reasonable provisions for students to complete the course requirements within a designated amount of time.

DUTY TO REPORT DISQUALIFYING HISTORY Nurse Assistant Program

As part of the admission requirements for the Nurse Assistant Program, students consent to an initial criminal history screening as required by the Kilgore College Health Science Programs Criminal Background Check Policy. As is further stipulated by the same policy, students are bound by the duty to report to the Nurse Assistant Program Director any disqualifying history that occurs subsequent to admission to the program. Upon reporting a disqualifying history subsequent to the initial criminal history screening, students will not be allowed to continue in the Nurse Assistant Program and will be required to withdraw from all NURA courses. If it is discovered that a student has failed to comply with the duty to report a disqualifying history after admission to the program, he/she will not be allowed to continue in the program and will be required to withdraw from all NURA courses.

KILGORE COLLEGE HEALTH SCIENCE PROGRAMS DRUG SCREEN POLICY

Applicability This Policy applies to all accepted applicants and currently enrolled students in an educational program in any Kilgore College Health Science Program. These students will be required to undergo and pass drug screen testing. Rationale Safety and Well Being of Patients. Health care providers are entrusted with the health, safety and welfare of patients; have access to drugs or controlled substances; and operate in settings that require the exercise of good judgment and ethical behavior. Accreditation Standards. Competency extends beyond technical skills to an individual’s substance abuse history. Clinical facilities are increasingly interpreting standards by accreditation agencies, such as Joint Commission of Accreditation of Healthcare Organizations (JCAHO) to require drug screening for security purposes on individuals who provide services within the facility and especially those who supervise care and render treatment including controlled substances. To facilitate this requirement, educational institutions have agreed to conduct drug screening for students who participate in programs of facilities having such requirements. Contractual Obligations. The Health Science Departments and Kilgore College are obligated to meet the contractual requirements contained in affiliation agreements between Kilgore College and various healthcare facilities. Licensure Issues. Many healthcare licensing agencies require individuals to pass a drug screening panel as a condition of licensure, certification or employment. Therefore, it is to the benefit of all to identify and resolve these issues, prior to a commitment of resources by the College or the student. Liability Issues. Both institutions of higher education and healthcare facilities are mindful of those factors that may adversely affect the security or safety of the clinical environment and thus increase their liability exposure. As a result, schools and healthcare facilities have appropriately sought to enhance their scrutiny of professional and non-professional students involved in patient care activities. Testing Requirements All accepted applicants to any Kilgore College Health Science Program must consent to, allow to be conducted and have results from an initial drug test submitted to the Kilgore College Health Science Program prior to enrollment. In addition, enrolled students may be required by an affiliated healthcare facility to submit to a drug screen before participating in a clinical program at the institution. Further, a drug screen may be required if the student is cited for “unsafe clinical practice” as defined by Kilgore College policy. A citation for “unsafe clinical practice” can be issued at any time during a student’s participation.

Drug Screening Kilgore College will select a company that follows the guidelines established by the Substance Abuse and Mental Health Services Administration (SAMHSA) to collect and test the specimens. Kilgore College will not accept drug screening results from any company other than the one designated by the College. The student will pay the cost of the drug screening at the time of testing. The accepted applicant will be responsible for contacting the designated vendor within the designated time frame, paying for expenses of the drug screen, and for insuring that results of the drug screen will be forwarded directly to the College from the vendor. Drug screening results should be sent to the applicable Program Director. For enrolled students required by a healthcare facility to submit to a drug screening test prior to a clinical experience, the College will inform the student in advance if the clinical experience will require a drug screen test. The student will be responsible for contacting the designated vendor, paying for expenses of the drug screen if required, and for insuring that results of the drug screen is forwarded directly to the healthcare facility. Failure to either request a drug screen or have the results sent in a timely manner may result in the student’s not being allowed to start a specific clinical experience or program. Students who refuse to submit to the required drug screen or who do not pass the drug screen may be dismissed from the program. Failure to cooperate or refusal to take part in any drug test stemming from a citation for “unsafe clinical practice” will result in the student losing the opportunity to remain in the applicable program. Falsification of application materials, including tampering with drug specimens or test results, is grounds for denial to or suspension from the Kilgore College Health Science Program or clinical experience. Test Results If the test is positive for an eligible substance, the student has the right to review the information reported by the designated vendor for accuracy and completeness and to request that the designated vendor verify that the results of the drug screen provided are correct. If a student produces such verification, and in the opinion of the testing facility, a medication legally prescribed to the student accounts for the positive test result, no retest shall be required, and the student shall be treated as if he or she had provided a negative test sample. If the medications do not account for the positive result, in the sole and conclusive opinion of the testing facility, the student shall be denied admittance to or subject to suspension from the Kilgore College Health Science Program or clinical experience. The student will be required to withdraw passing from all courses. Appeal Process A student testing positive will have an opportunity to request, in writing, a second test, using the second specimen bottle originally obtained, within seventy-two hours from notification of the initial test results. If the results of the retest are negative, the student

will remain eligible to participate in the Kilgore College Health Science Program or clinical experience, subject to any contractual limitations or requirements.

KILGORE COLLEGE HEALTH SCIENCE PROGRAMS CRIMINAL BACKGROUND CHECK

1. Applicability

A. All applicants accepted to any Kilgore College Health Science Program (“the Program”) will be required to submit to and satisfactorily complete a criminal background check (“CBC”) from an approved vendor at their own expense as a condition to matriculate into the Program. Students who refuse to submit to a CBC may be denied admission or dismissed from the Program. Currently enrolled students in the Program may be required to submit to and satisfactorily complete an additional CBC at their own expense prior to participating in clinical or practical experiences.

B. Students enrolled in the Program shall self-disclose to the Director of the appropriate Program criminal history record information NO later than five (5) business days following the charge of any crime. Failure to disclose information that is subsequently found on a background check may result in dismissal from the Program. Criminal activity, including an arrest, that occurs while a student is enrolled in the Program may result in disciplinary action, including dismissal, and will be addressed according the academic policies of Kilgore College.

C. Background check reports will be kept in a confidential file located in the office

of the applicable Program Director, not in the student’s academic file. Access to these reports is not bound by the Family Educational Rights and Privacy Act (FERPA) requirements. The information contained in this file is NOT subject to release to other College officials and affiliated clinical agencies and may only be accessed by the Directors.

D. A student who has a break in his/her enrollment is required to complete a new

background check. A break in enrollment is defined as non-enrollment of at least one semester. An officially approved leave of absence is also considered a break in enrollment.

2. Rationale

A. Health care providers are entrusted with the health, safety and welfare of patients; have access to drugs or controlled substances; operate in settings that require the exercise of god judgment and ethical behavior.

B. Competency extends beyond technical skills to an individual’s substance abuse history. Clinical facilities are increasingly interpreting standards by accreditation agencies, such as Joint Commission of Accreditation of Healthcare Organizations (JCAHO) to require CBC for security purposes on individuals who

provide services within the facility and especially those who supervise care and render treatment including controlled substances. To facilitate this requirement, educational institutions have agreed to conduct a CBC for students who participate in programs of facilities having such requirements.

C. The Health Science Departments and Kilgore College are obligated to meet the

contractual requirements contained in affiliation agreements between Kilgore College and various healthcare facilities.

D. Many healthcare licensing agencies require individuals to pass a CBC as a

condition of licensure, certification or employment. Therefore, it is to the benefit of all to identify and resolve these issues, prior to a commitment of resources by the College or the student.

3. CBC

A. The CBC will cover at least the seven (7) years preceding the date of the respective student’s application. Further, the CBC will cover cities and counties in Texas and Louisiana, as well as any state where the applicant has resided in the seven (7) years preceding the date of application. The student must consent to the initial criminal history screening in writing and must agree in writing to be bound by the duty to self-report disqualifying history that occurs subsequent to admission to the program.

B. Kilgore College will designate a company to conduct the CBC. Results from any company other than the one designated by the College will not be accepted. The applicant will be responsible for timely contacting the designated company and comply with its instructions for obtaining a background check. Additionally, each student or applicant must complete the required release so that the College will receive a copy of results of the CBC directly from the approved company. Students and accepted applicants are responsible for paying any and all fees charged by the designated company for the CBC service and for providing a copy of the results directly to the College. For the College, results should be sent to the appropriate Program Director.

C. For enrolled students required by a healthcare facility to submit to a CBC prior

to a clinical experience, the College will inform the student in advance if the clinical experience will require a CBC. If an additional CBC is required by the affiliated facility, the student will be responsible for contacting the designated vendor, paying for expenses of the CBC if required, and for insuring that the

results of the CBC are forwarded directly to the College. D. Falsification of application materials, including tampering with criminal history

screening results, is grounds for denial to admittance to the Kilgore College Health Science Program.

4. Test Results

A. If the CBC screen contains a disqualifying history, the prospective student will be immediately notified. The applicant or student will have five (5) business day from the date notification is provided, to contact the vendor to verify that that the background information provided is correct. The applicant or student will have seven (7) business days from the date of notification to request review by the Director and submit additional information (such as court documents and police records) at the student’s expense or to present other evidence that the adverse finding of a disqualifying history is in error. Any evidence that the student wishes to be considered must be included. In cases other than obvious error in the CBC, the applicable Director shall not make a determination whether the student should be excluded from admission or dismissal from enrollment as a student in the Program, pending review as provided in Subparagraph (C), below.

B. In the event of a report of an adverse finding, the College will inform the student or applicant of his/her rights and how to contact the designated vendor to challenge the accuracy of the report.

C. Any report of a positive criminal history, other than a minor traffic offense, will

be referred to the licensing or certifying body governing the applicable discipline. If the board or certifying body approves, in writing, the student for either licensure or certification OR approves continuation of a course of study leading to licensure or certification, the student will be eligible for admission or re-admission in the Program.

D. An “adverse finding” or “positive criminal history” means a finding of a

conviction, guilty plea, and plea of nolo contendre or a probated sentence for any felony or misdemeanor, other than a minor traffic offense.

Texas State Competency Testing for Certification The Nursing Home Reform Act, adopted by Congress as part of the Omnibus Budget Reconciliation Act of 1987 (OBRA ’87), was designed to improve the quality of care in long-term health care facilities and to define training and evaluation standards for nurse aides who work in such facilities. Each state is responsible for following the terms of this federal law. The Texas Health and Human Services Commission (HHSC) has contracted with Prometric, a nationally recognized leading provider of assessment services to regulatory agencies and national associations. Prometric will develop, score and report the results of the Nurse Aide Examination required for certification and placement on the Texas Nurse Aide Registry. The nurse aide certification examination is an evaluation of nurse aide-related knowledge, skills, and abilities. Policy for Electronic Devices and Social Networking Sites (i.e. Facebook, Twitter, Instagram)

Students in the Nurse Assistant Class at Kilgore College are expected to maintain professional standards expected of a member of the nursing care team. This includes not only preserving patient confidentiality {HIPPA) from the clinical sites, but also confidentiality for the nurse assistant class, faculty, staff, and classmates. . The following guidelines are to be followed. Failure to do so may result in disciplinary action, reporting student to the police and/or dismissal from the program:

• Do not "friend" your instructors-they have been advised against this • Do not post photos from clinical sites, especially not of patients • Do not post pictures of yourself in the Kilgore College clinical uniform or at any

clinical site • Do not post any written references to your clinical rotation, facility, patient, or

their room numbers • Do not post photos of other students, faculty or staff without their permission • Do not post threats or derogatory remarks about anyone associated with the

nurse assistant class which includes classmates, faculty, staff or administration • Do not use cell phones in the classroom/ lab or en route to or from classroom/lab

unless on break -if discovered they will be taken up for the remain der of the class

OBRA nurse aide training regulations include:

1. The facility must assure that nurse aides complete an approved Nurse Aide Training and Competency Evaluation Program (NATCEP) and be placed on the Nurse Aide Registry within 4 months of their date of hire by the facility.

a. The first 16 hours of training must be completed prior to any direct contact with a resident.

b. After the first 16 hours, nurse aides can perform only those skills for which they have been trained and found to be proficient by the instructor.

2. An approved Nurse Aide Training Program must be at least 100 clock hours in

length (including 60 classroom and 40 clinical training hours). The nurse aide must pass the training program to be eligible to take the state test.

3. The state test (CEP) includes: a. A written or oral exam. b. A skills test consisting of 5 randomly selected skills.

4. The nurse aide must pass the skills and written test before being placed on the

registry. The nurse aide has 3 opportunities to pass each test and must meet competency within two years of his or her training completion date.

Texas State CNA Registry Requirements

• Each individual listed on the registry must keep the department informed of his or

her current address and telephone number.

• Nurse aide certification expires 24 months after being entered into the registry. Nurse aides must submit verification of paid employment prior to the expiration date to continue certification.

• Nurse aides renewing certification after September 1, 2013 must complete 24 hours of in-service education every two years.

• HHSC does not recertify nurse aides that are listed on the Employee Misconduct Registry (EMR) or have been convicted of a criminal offense listed in Texas Health and Safety Code, §250.006.

• A finding of abuse, neglect or misappropriation of resident property may be entered into the registry. If a finding is entered, the nurse aide will not be employable as a nurse aide in LTC facilities.

Safe Medical Devices Act of 1990 (SMDA) Texas Nurse Aide Curriculum calls it Safe Medical Devices Act of 1991- it requires that the Food and Drug Administration (FDA) be notified of any death or serious injury caused by any type of medical device The Safe Medical Devices Act of 1990 requires user facilities (e.g. hospitals, nursing homes) to report suspected medical device-related deaths to both the FDA and the manufacturers. Medical device-related serious injuries must be reported to the manufacturer. However, if the medical device manufacturer is unknown, the serious injury is reported by the facility to the FDA. Laboratory personnel should familiarize themselves with their institution's procedures for reporting adverse events to the FDA. Medical devices that are included in this reporting requirement (if they may have caused serious injury to a patient or patient death) are laboratory instruments, reagents, or devices used during phlebotomy procedures. If it appears that a device has caused injury, it is important that the device and packaging be saved and any serial or lot numbers noted. An incident report should be completed within 24 hours. The incident report must then be handled by the institution's Risk Management Department, who will file the necessary reports.

(c) The sign required under Subsections (a) and (b) must give notice in both English and Spanish that it is unlawful for a person licensed under this subchapter to carry a handgun on the premises. The sign must appear in contrasting colors with block letters at least one inch in height and must include on its face the number “51” printed in solid red at least five inches in height. The sign shall be displayed in a conspicuous manner clearly visible to the public.
